Tucson is a good habitat for attracting urban-adapted lizards. Five of the most popular are the Ornate Tree Lizard, the Regal Horned Lizard, The Tiger Whiptail, The Mediterranean House Gecko, and the Desert Spiny Lizard. Creating an exceptional environment for these creatures is easy. A few key elements will provide for their basic needs: Plants use a variety of trees, shrubs, cacti and flowering plants helps to provide a place to forage, bask, hibernate and breed. Tree and Desert Spiny Lizards use trees for basking and foraging. Since the bulk of a lizard s diet is insects, gardeners can use flowering plants to attract pollinators and butterflies, providing food for the insects and thus the lizards. Cover Spiny plants are great as they provide a safe haven. The lizard s tough skin protects them from thorns, but predators like cats and dogs won t venture into a clump of vegetation such as prickly pear cactus. Sex Offender Living in the Zip Code Another great cover is a pile of rocks or logs. Homeowners can enhance rock piles by placing PVC pipe in between the rocks for the lizards to hide and hibernate. 2 PAGE 2 Erik Hite Memorial Dedicated On June 2, hundreds of family members, friends, and officers gathered to remember Officer Erik Hite. Officer Hite was gunned down one year ago. The gathering took place at La Mariposo off Houghton Road. A memorial was unveiled which includes, several subtle references to the Officer's life. The memorial is open to the public. The one year anniversary of Hite's death, brings back memories for Tucson Police Chief, Roberto Villaseñor. "As I drove in and saw all of you out there with the American flag, it brought me back to almost a year ago when we drove through the streets of Tucson and took Eric to his final resting place." As you may know, on June 1, 2008, Officer Hite was shot while in pursuit of an individual who had fired on innocent citizens in our community and who had wounded Pima County Sheriff's Deputies. Erik died from his wounds the following day, June 2, The memorial is a design that is modest and simple, while embodying a variety of layered meaningful elements as a representation of Erik's life, service and sacrifice. This design permits the visitor to meditate on a life of service and compassion. The site also pays tribute to the wounded Sheriff's STILL We ^ Need Your Help! Department Deputies, and to Erik's service to his nation in the United States Air Force. One of our local boy scouts took it upon himself to champion this project as part of his effort in earning his Eagle Scout rank. The owners of La Mariposa generously provided a memorial location, and companies throughout Tucson donated material and labor for the construction. Your neighbors need a Social & Welcome Committee Chair in the HOA. The volunteer duties include: Greet new neighbors on behalf of the Board. Organize the community events such as the Halloween and Holiday home decorating contests. Launch new activities such as a monthly seminar program. 5 PAGE 5 Each year, Southern Arizonans experience a variety of weather related dangers, especially from late spring into early autumn. The time period from June 15th through September 30th has been defined as "The Monsoon." A period of extreme heat is typically ongoing at its onset, which in the coming days or weeks is followed by an influx of moisture lending to daily rounds of thunderstorms. The heat is deadly in its own right, causing dozens of deaths in Arizona each year. In addition, thunderstorms present an array of hazards which often strike suddenly and with violent force. The goal of Monsoon Safety Awareness Week is to reduce the number of injures, deaths and property damage caused by thunderstorms by educating Arizonans about weather related dangers that occur during the monsoon and the precautions they can take to protect themselves and minimize property damage. Armed with Doppler radars, powerful supercomputers, advanced weather satellites, automated weather and stream gages, and an advanced lightning detection network, forecasters at the National Weather Service are able to provide highly accurate severe weather warnings. Advanced National Weather Service computer systems now allow warnings to be generated in seconds for highly detailed areas. Those warnings are then transmitted to the public, the media and emergency management offices via NOAA Weather Radio, the Emergency Alert System, and the Internet. Television meteorologists pay critical roles in the warning process. They relay National Weather Service warnings to the public and provide additional details about the storms, what they are doing and where they are going. The best way to avoid lightning, flash floods, and other dangerous conditions is by not being in danger in the first place. Many ways are available to gain weather information including: Watching current weather forecasts on TV or the Internet Listening to weather reports on the radio or a NOAA weather radio Subscribing to lightning and severe weather notification services Scanning the skies 360 degrees around and overhead before leaving a safe location Disaster Supply Kit Contents Three gallons of water in clean, closed containers for each person and pet First ad kit A stock of food that requires no cooking or refrigeration A portable, battery-operated radio and flashlights in working order and extra batteries. Candles and oil lamps are fire hazards. Necessary medications Back-up power source for life support or other medical equipment that requires electricity to function. Pet food Flash Flood Safety for Homeowners If you live in a flood prone area have an evacuation plan. Store materials like sandbags, plywood, plastic sheeting and umber for protection from floodwaters and to make quick repairs after a severe storm. Store materials above flood levels. Secure objects to prevent them from floating away. Learn where to find high ground, which is safe from flooding. In a flash flood seek high ground quickly. Contact an Insurance agent to discuss flood insurance coverage. Flood losses are not covered under normal homeowners' insurance polices. Flood insurance is available through the National Flood Insurance Program. Get coverage early there s a waiting period before it takes effect.

6 PAGE 6 Meet Your Neighbor - Sheila Peress & John Velez Sheila came to Tucson from New York City in 1973 to teach on Colorado River Indian Tribe reservation. While earning her masters at the U of A by 1975, she said, I fell in love with Tucson. While she is officially retired now, she is frequently called back to work with kids in enrichment programs or to discover why a child is not learning. She moved to The Lakes in 1997 when the development was new. John arrived in Arizona, also from NYC, in 1999 to live near his mother and sister. He moved into The Lakes in 2004 when his son entered Emily Gray J.H.S. John is a fee-based financial planner. John will soon celebrate the opening of his second office located near Speedway and Wilmot with Grand Opening events at the Mountain Oyster Club scheduled for August and September. Sheila is going professional with her work. She is opening PeressXpress, a News in the Neighborhood learning (education) consultancy for parents and teachers. Also included will be advocacy work on behalf of students. Every student has a learning style and we re so into cookie cutter education now, says Sheila. Sheila and John met at a board meeting and shared a salad. In two weeks they were committed, says John. They share their home with John s son, Ian, and Sheila s adult daughter, Abra, and a cat named Blue. John and Sheila are very active in Toastmasters. Both of them are on the Roadrunners Toastmasters Board. This club is the oldest and largest of the thirty local Tucson chapters. In July, John will be the President and Sheila will be the VP of Education. Toastmasters is known worldwide for public speaking, but there is also a leadership component. John now participates in statewide Toastmasters competitions. John is a runner and is frequently seen around the neighborhood. His best time for a marathon is a very respectable 2 hours 40 minutes, which is well inside the qualifying time for the prestigious Boston Marathon. He has also qualified for the Senior Olympics. Back in Staten Island, NY, he would run the entire perimeter over 40 miles. Sherlockiana is also a hobby of John s. It encompasses memorabilia, ephemera and collectibles associated with the fictional character Sherlock Holmes and, by extension, the fictional Dr. Watson and the very real Sir Arthur Conan Doyle. John has a big collections of the books and old (1940 s) radio show tapes. Sheila and John are also dancers. Their favorite is swing. It used to be clubs, but no longer. We used to go to Westward Look every week for live music and dancing, but it is no longer available. We re looking for a new spot, says John. The winner of the sign up contest was Gerald and Sandra Ross of 2344 N. Catalina Vista Loop. Their name was randomly selected from all those who have signed up for this newsletter. The Ross had their May homeowners dues paid by the Association. It s summertime and the pools are busy. You must watch your children at all times. A neighbor writes: When I arrived at the pool four boys ages approx 7-11 were in the pool rough housing. The boys would go back and forth between the pool and the hot tub. A short time later a woman arrived with 4 or 5 boys. These boys were running, jumping, and pushing each other in the water. This is not the first incident this year. A few weeks ago there were 4 boys ages approx in the pool alone. Last year I pulled an unsupervised 3 year old out of the center of the hot tub. She had slipped off the edge and fallen into the middle. Her parent or guardian was swimming in the pool. Let s not have a tragedy here at the Lakes. You are accountable for the close supervision of any children you bring to the pools. Their safety and decorum is your responsibility and violators will lose pool privileges. HOMEOWNER INPUT Homeowner complained about holes in the fence by the Rec Center pool and says they must be fixed before any accident happens. Mr. Silverman will look at the fence. Homeowner offered to work on removal of the cattails in the lakes. He says it is now nesting season and does not want to see the nesting disturbed. Board will take his offer under advisement. Homeowner complained about late fees she has been receiving when paying her homeowner dues. She has even moved the payment date to earlier in the month the last couple months but is still receiving a late fee. Management Representative explained that there have been some problems with US Bank not posting payments in a timely manner. He also advised homeowner that she can send payment directly to Cadden s office to avoid any future late fees. Homeowner praised the landscaper for the excellent job the company is doing. Homeowner informed Board that there is a yard with a see-through fence at the model homes that needs to have the weeds in the back yard removed. Another homeowner informed Board that there is a water leak by the 3-way stop and she has seen water in the ravine. Homeowner informed Board that there always seems to be a car waiting for someone to come through in order to get in at the East Gate. He feels that more security is needed. Board explained that there is an item on the Board agenda for further discussion on security at the gate. CALL TO ORDER Meeting was called to order at 7:10 p.m. LANDSCAPE COMMITTEE Chris Kaselemis informed Board and homeowners that he had driven the property with the landscape manager to determine if any plants need to be replaced. Mr. Cords informed landscaper that he had requested the company to come to his house to remove mistletoe but nobody had ever come. Landscape representative reassured Mr. Cords that he will follow up on that. Benches that Mr. Silverman found at Lowe s have been purchased and placed around the lakes. APPROVAL OF MINUTES Motion (Kaselemis/Baker) to approve minutes from March 2009 as amended. MOTION PASSED. FINANCIAL REPORT Ms. Blumenthal said that the finances for the Association are in good shape. They are under budget or right on budget for Minutes Continues on Page 8...

She explained that since last month, a question was raised as to how the CD s are invested, that the Association has been maintaining a 4.86% rate of return and that maturity dates are staggered in case the Association needs money. Mr. Kaselemis requested that Ms. Blumenthal send the details of a $4,200 bill from the landscaper to him for review. Mr. Baker also requested that Ms. Blumenthal send copies of the bills for the Lakes to him for review. MANAGER S REPORT Written report submitted to the Board. Board requested that Management Representative make sure the pools are clean when he does his site tours and also to please walk through the restrooms to make sure they are cleaned. COMMITTEE REPORTS DRC The committee approved an addition to Lot 255 but the Board feels they need more information before they can approve. The homeowner needs to talk to their neighbors and the Board needs a bigger set of plans that shows the elevation. Management Representative will call homeowner and have her contact Mr. Silverman with the information. Landscape Previously discussed. Lakes Mr. Baker requested that maintenance bills for the Lakes be sent to him. Security/Gates Discussion ensued regarding installation of a swinging arm, similar to those used at the airport, which goes up when a car enters but immediately goes down preventing another car from following into the neighborhood. Board feels they need more information and topic was tabled for the next Board meeting. Roads/Walkways Mr. Silverman informed Board that it had cost $9,300 to have the streets crack-sealed. Mr. Kaselemis said he had received complaints about cracks on Castle Rock that have not been sealed. Management Representative will contact the company for further information. Recreational Facilities After brief discussion, Board requested that Management Representative obtain another opinion from Andy s about the lock at the Fitness Center. Board also does not believe that the pool is being heated properly. There have been several complaints and Board requested that Management Representative contact the pool company. There have also been complaints about the television at the fitness center not receiving a strong enough signal. After brief discussion, including having cable installed at the fitness center, Board requested that Mr. Kaselemis bring information about the television to the next meeting. Board also requested that Management Representative have Roberto remove the broken table in the dumpster and also remove broken chairs from the recreational areas. Board also briefly discussed information from the Audubon Society about funding from the Army Corp of Engineers. The only way that the Audubon Society can obtain this funding is for the Association to give away their rights to the property so it can be designated as a conservation area. Board does not believe that they can or should give away rights to the property since the area technically belongs to each and every homeowner in the neighborhood. Social/Welcome No report at this time. Reserve Study No new information. Communications Mr. Schuldenfrei was out of town so no information was provided. SECURITY FOR THE GATES The current bid from Antech for traffic control bars is $7, After reviewing the bid, and determining that the bid is for only one arm, the Board tabled the topic for the next Board meeting so more information can be obtained. BID TO IMPROVE SECURITY AT FITNESS CENTER After brief discussion, Board requested that Management Representative obtain another opinion from Andy s about the lock at the Fitness Center. NEW MAINTENANCE CONTRACT FOR ARIZONA HEALTH Contract was signed. RESERVING THE RECREATION CENTER Board reviewed the contract and came up with several options. One is to reduce the notice to 7 days instead of 2 weeks. The Board will request the Reservation Chair to attend the next Board meeting to get her opinion on the matter. As far as reserving the recreation center during holidays, Board definitely agrees that no one homeowner can reserve the center for Memorial Day, the 4 th of July, or for Labor Day, due to the fact that many homeowners have those days off and want to use the pool and facility and it is not fair for one homeowner to monopolize the area. As far as reserving the center for Thanksgiving or Christmas, no firm decision was made. SAFETY AT THE POOL Mr. Silverman will look at holes in the fence to determine if they are a safety hazard. NEW BUSINESS Board requested that Management Representative contact Roberto to advise that he must clean up any and all debris after working on a project. NEXT MEETING Next meeting is scheduled for May 18, 2009, at 6:30 at the Recreation Center. Social / Welcome Committee - Plans community events, such as the annual yard sale, and coordinates activities for welcoming new homeowners to the community. Reserve Study Committee - Determines long-term budget needs for the community in regards to capital items. Many of these committees have only one or even no representatives. HOMEOWNER INPUT No open forum no residents present CALL TO ORDER Meeting was called to order at 6:35 p.m. LANDSCAPE COMMITTEE Chris explained that Complete Landscaping (our contractor) switched to a 4 day / 10 hour work week for the on-site crew and that he was upset that the Board was never notified on this change. Chris found out about this inadvertently at the last Board meeting and followed up with an to Larry explaining his concern and asking Larry to address the Board on this subject at the May meeting. Larry apologized to the Board. He explained that this change was made to save the firm on gas expenses. He said that the crew works Monday through Thursday from 6:00 am to 3:45 p.m. The crew is not here on Fridays, but the supervisors and the irrigation technicians are available on Fridays if we have a problem. Larry also explained that the crews hours were cut by 15 minutes a day in order to pay for more pre-emergence chemicals. The cost of this application is more than anticipated, so the firm had reduced the crew s hours in order to pay for this unexpected expense. The Board expressed disappointment that this also was not discussed with the Board when the change was made. Larry also stated that travel time is now eaten by the firm and not charged to our time. Other landscape issues discussed: Doggy bag holder moved by the crew at the request of Tony to get it out of the grass. The original poles were concreted in, but when moved, they were not re-concreted. Mel will ask Roberto to concrete them back in. Larry expressed a concern that the crew is noticing more dog waste than normal (especially around the Rec. center). Mel will explore placing a new holder, possibly attaching it to the pool fence. Chris had asked Larry to replace plants that were previously installed that had died. Larry stated that they are in the process of doing so. Chris also mentioned that he approved four (landscaping) proposals. Larry is working on those, which includes installing 2 new trees by the 3 way stop sign. At the last Board meeting, a resident, Brian Nicholas, has offered to cut down some of the reeds at Lake 14 for no fee so that chemicals would not have to be used. Chris researched this issue by checking with the attorney. McEvoy explained that there should not be an issue with this, as Board members and their volunteers are usually covered by the HOA insurance. Chris checked with Tony, who checked with our insurance company, and they said that Brian would be covered. Board passed a unanimous motion (Chris/Jim) to allow Brian to do this volunteer work. Chris will inform him. Larry explained that the on-site crew leader, John, is getting frequent calls from Tony to respond to issues raised by residents and that John has to drop his work to attend to the issue, and this can be disruptive for issues that are sometimes minor. 11 PAGE 11 Continuation of Minutes from Page Board informed Larry that John should check out the issue, and if it is not an urgent matter, to inform Tony that it will be handled at a more appropriate time. APPROVAL OF MINUTES A motion to approve the April 27, 2009 minutes. One change requested by Chris on page 2, under Landscape Committee, last word should be plural ( lake to lakes ). Motion to approve (Mel/Denise) passed unanimously. FINANCIAL REPORT Denise the gas bill high because of winter heating should come down now that it is warm. Pool maintenance contract not paid this month so next month will show double billing. Mel Mel has been approached by a consultant, Dave Sandy ( ) who explained that we are eligible to get a TEP rebate on our pump motors that were recently installed. He will handle this for us for a 15% cut. He estimates that we could get as much as $5,000 back from TEP. Board agreed to let Dave pursue this. MANAGER S REPORT No comments. COMMITTEE REPORTS DRC Langan addition. Jim explained that he had the large set of plans at his house for Board review. After hearing positive comments, he gave the approval to the Langans to proceed. Jim told the Langans that they needed to contact their immediate neighbors to inform them and work with them on the crew work hours. Motion to approve Langan s addition (Jim/Doug) passed unanimously. Lakes Doug stated that he has not received any invoices. Complaint from resident that the level of Lake 14 is low. Board (and Krista Lange, Lake Committee member who arrived during this discussion) stated that the lake level is not low in fact it is too high. Doug raised the issue of whether the lake technician has moved into summer mode yet to treat the algae. Doug will call him. Security/Gates Motion (Jim/Baker) passed unanimously to not pursue the additional gate arm because we do not seem to have a big enough issue right now to justify the change and expense. Doug suggested getting real estimates for how much it would cost to man the gates 24/7 and to take this to the residents to see if there is interest in paying extra for this service. This way, it would take it out of the Board s hands in terms of making this determination. Roads/Walkways Tanque Verde road widening approved by Board of Supervisors a few weeks ago. Pima County has now asked us to sign a temporary easement agreement. Board instructed Mel to sign the agreement. Chris reports large (1/2 to 1 ) gaps in road along Castle Rock between Diamond Lake and the Rec. Center on the south side of the road. Mel will check into this and get the paving company to address this. They just completed crack sealing and this seemed to be overlooked. A sidewalk on Creek Vista is buckling up. Mel will check into and get Roberto to address. Recreational Facilities A light at the tennis court is still out. Reviewed proposals to beef up the locks at the fitness center. The proposals were not clear to the Board and it was decided to table until next meeting so that Tony can better explain their approaches. This reason this was brought up initially was that Chris noticed that the doors must be manually dead-bolted with a key by residents after they leave the facility, and many times the residents do not take the time to do so, creating a security issue. Board was looking for an automatic mechanism that would provide more security without requiring residents to lock with a key. Board also asked Chris to talk to Terry Kellman, who has a glass company, to see what ideas he has, since the doors are glass panel doors. TV at Fitness Center agreement to table to next month because John Valdata and Tony installed an antenna and we will wait to see if it is effective. Question to be addressed at next meeting: will this antenna work after the industry switch to digital. Tony to bring back an answer. Reserving the Rec. Center- Discussion centered around two issues: 1) should the lead time to reserve the room be shorted from 2 weeks to 1 week, and 2) should residents be allowed to use the center on holidays, which is currently not allowed. There was much discussion, and Dena Orr s s were reviewed. There was consensus to shorten the lead time, and allow holidays. Dena commented that she could work with the shortened lead time. Regarding holidays, the Board felt that there were no compelling reasons why holidays should be excluded. Motion unanimously passed (Chris/Denise) to: 1) shorten lead time to 1 week, and 2) allow use on all holidays. This change will be effective June 1, Also, Doug proposed checking into the use of credit cards for the deposit. Denise will call USB to inquire regarding fees for doing so and report back at the next meeting. Minutes Continues on Page 12...

NEW BUSINESS hiring a pool boy / girl. It was decided by consensus to hire a pool boy / girl for five days a week for $50 per week to take care of both pools. The duties include: 1) gathering and putting in place all of the tables and chairs, 2) picking up and disposing of any trash, and 3) hosing down all of the furniture and the decking. This work must be completed prior to 9:00 am each day. We will only consider hiring someone who is at least 15 years old. Chris will work on a flyer to post on the gatehouses. Interested parties will be instructed to contact Tony. Mel and Chris were asked to help select the individual. Denise instructed the Board that money has been put in the budget and that it would more than cover the expense at $50 per week for the summer.
