File: /27022 May 25,2007 Ministry ofenvironment 102 Industrial Place PentictonBC V2A7C8 ^Qoeived MAY Attention: Solveij Patschke Dear Ms Patschke: Re: Bald Range Creek - on May 20,2007 I have been retained by the Lakeview Irrigation District (LID) to assess the impacts to Bald Range Creek, a tributary to Lambly Creek that is the Community Watershed for LID resulting from a motorcycle event held on May 20,2007. I was advised by telephone on Friday, May 18, 2007 that the Okanagan Trail Riders (OTR) had scheduled a cross-countrymotorcycle event in the Lambly Creek watershed (Bear RMZ) for May 20, James Moller, Manager, LID contacted Ken Umbarger, President of the OTR on Friday regarding the event and Ken confirmed that it was scheduled and that the riders wouldbe crossing Bald Range Creek but that the OTR had installedtemporaiy bridges. On Tuesday, May 22"^ a contractor for LID inspected the area (Figure 1). He noted that there were two marked racecourses, A and B. He followed the various routes along Bald Range Creek for ~2 km upstream from Bear Main. The first crossing he encountered was for coursea that crossedbald Range Creek < 100 m upstream from Bear Main (Figure 2). A new foot bridge had been built to cross the creek (site 1)and a newfrail had been builtthroughthe riparian zone from the old road on the west side to the bridge that continued downstream for -60 m along the east bank of the creek before the trail turned and proceeded up the steep slope to the east (site 1). The frail along the creek had been significantly disturbed by the motorcycles and was located <1 m from the creek for most of the 60 m. Based on the recently cut green vegetation along this sectionof trail from the old road on the west side of the creekand alongthe sectionon the east side of the creek, this is a new trail. Referto photographs in Appendix A. The second area that he noted was a new trail onto the old road from the west -80 m upstream from the bridge. This was a new trail used for the event (course A) that traversed directly down the slope from the upper staging area on slopes ranging from 40-55% (site 2). The soils on these slopes is very fme grained and with the loss of the vegetative cover are subject to severe erosion during intense rainstorms with the sediment flowing directly into Bald Range Creek. The third site he noted was where course B intersected the old road a further 80 m upsfream. This was also a new trail created for the event to the north ofcourse A on similar slopes in the range of40-45% (site 3).As withtheprevious course thistrail will erode andthe sediment willflow into the creek. 2 w w Damage bymotorcycles The fourth site was where course B crossed Bald Range Creek where the motorcycles were ridden through the creek (site 4). Photographsillustrating the impacts from the motorcyclesare provided in Appendix A. Lakeview Irrigation District requests that you as the Source Water Protection Officer as well as someone from the Environmental Stewardship Division (Fisheries) inspect the areas noted in this report as soon as possible. It is our opinionthat the damage causedby motorcycles in and aroundbald Range Creek during the event organized by the Okanagan Trail Riders contravenes the federal Fisheries Act and the Water Act. Bald Range Creek is a fish stream from the confluence with Lambly Creek upstream well beyond the areas noted in this report and is also part of the source of supply for the Lakeview Irrigation District. The district's intake is located approximately 3.5 km downstream (Figure 1). We can make someone available to accompany you to the area to show you the areas ofconcem. The Lakeview Irrigation District takes this issue very seriously. The investigation should be conducted as soon as possible with remedial workplannedand implemented before it rains.
