7 PUBLIC FORUM Graeme Flett addressed council to outline his concerns about the risks and hazards associated with car rallying through the various forests in our district. Scott Martin, Responsible Camping Ranger, presented a powerpoint summarising his observations of freedom campers and campsites in the Catlins area and showing demographics of visitors are spread across both New Zealand and internationally. He advocated a blanket ban on freedom camping in the Catlins except for a small number of designated spots which he considered would give clarity to tourists and campers and enable better enforcement. However, Mr Campbell advised this approach would need to be aligned with the Freedom Camping Act and Council s Bylaw, which largely mirrors the Act. He also advised the Act does not have any provision relating to self-contained camping. 1 CONFIRMATION OF COUNCIL MINUTES The minutes of the meeting of the Clutha District Council held on 22 February 2018 were submitted for confirmation. Additional information to this report the Draft Statement of Proposal for Proposed Rating Policies 2018 was circulated outside the published agenda and was tabled. Moved Councillors Cowie/Blackmore and Resolved: (i) That Council receives the Your Community Your Council Your Future report. (ii) That Council adopts the Statement of Proposals for the following: a. Proposed Rating Policies including the Revenue and Financing Policy 2018/28, Policy on Remission of Rates & Policy on Remission and Postponement of Rates on Maori Freehold Land. b. 12 13 OUR PLACE BALCLUTHA, MILTON & WAIHOLA COMMUNITY PLANS The Strategic Planning Manager and Communications Coordinator submitted a report asking Council to adopt the Our Place Balclutha and Milton Community Plans, and approve the Our Place Waihola material for release for consultation. Councillors identified and discussed several required corrections to the document s formatting, including item numbering, photo captions, re-situating topics where they are related to others in the document and typographical errors. The Strategic Planning Manager undertook to action these amendments. Moved Councillors Jenkinson/Herbert and Resolved: That Council receives the Our Place Balclutha, Milton & Waihola Community Plan report. Moved Councillors Finch/Sutherland and Resolved: That Council adopts the Our Place Balclutha Community Plan. Moved Councillors Finch/Blackmore and Resolved: That Council adopts the Our Place Milton Community Plan, as amended. Moved Councillors Finch/Vollweiler and Resolved: That Council approves the Our Place Waihola consultation document for feedback from 11 April to 11 May Moved Councillors Vollweiler/Ludemann and Resolved: That Council confirms the extended closing date for the Draft Waihola Reserves Management Plan as 11 May BYLAW UPDATES The Strategic Planning Manager submitted a report for Council to consider a range of updates to Council s Regulatory Bylaw, Water and Sanitary Bylaw Part 1 Water Supply, and Roading Bylaw to reflect community and legislative changes that have occurred in recent years. Additional information to this report was circulated outside the published agenda and was tabled: Clutha District Council Draft Water and Sanitary Services Bylaw, Clutha District Council Regulatory Bylaw 2018, Clutha District Council Draft Roading Bylaw Councillors identified and discussed several required corrections to the documents formatting, particularly clause numbering and including consolidation or separation of clauses where the numbering was out of sequence. 13 13 Moved Councillors Blackmore/Jenkinson and Resolved: (i) That the Council receives the Bylaw Updates report. (ii) That Council adopts the amended Regulatory Bylaw 2018, Water and Sanitary Services Bylaw - Part 1 Water Supply 2018, and Roading Bylaw 2018, and makes public notification. (iii) That Council delegates approval of corrections and formatting for these documents to the Chief Executive. (iv) The Council proceeds with work in 2018/19 to consider amendments to bylaws relating to Regulatory, Stock Crossing, Speed Limits, Freedom Camping and Hostels in 2018/ OTAGO MUSEUM HEADS OF AGREEMENT 2018/28 The Chief Executive submitted a report with a proposal regarding the Otago Museum Heads of Agreement 2018/28. The Mayor and a number of Councillors expressed their support for the museum but there was also concern expressed about the historical inequities regarding Council s funding contribution compared to other Otago Councils. Although Dunedin City contributes the majority of local government funding to the museum, Clutha s contribution is significantly higher than that of the other Otago Councils. Several Councillors were reluctant to sign the Heads of Agreement (HOA) for this reason. However, it was noted that Clutha s financial contribution in the proposed HOA is consistent with the funding amount outlined in the governing legislation, the Otago Museum Trust Board Act. Councillor Finch, Council s representative on the Museum Board, outlined its recent initiatives including increased outreach around Otago communities and more support to the various other museums in the region. Moved Councillors Vollweiler/Blackmore: That the Otago Museum contributing Local Authority s Heads of Agreement be signed. Discussion Councillor Cochrane: concern that the Queenstown Lakes contribution is voluntary, reviewable in three years at its sole discretion. In response, Mr Hill clarified the legislation does not provide for representation by Queenstown Lakes District Council, which is why it is a voluntary party. Councillor Cochrane supported adhering to the Act and noted the HOA does not need to be signed to do this. Councillor Cowie: sought clarification regarding future funding. Mr Hill advised the funding formula under the Act, which is based on a dollar amount plus inflation, is not connected in any way to the museum budget. However the Act also allows Clutha District Council 5 April 2018 Minutes

14 other arrangements such as the Heads of Agreement, providing the contributing authorities agree. Councillor Ludemann supported promoted a change to the Act and did not support signing the HOA. Councillor Graham noted the agreement reflects the Act and supported signing it. The Chief Executive clarified that Clutha is the only authority contributing according to the Act. He noted if Central Otago and Waitaki District Councils also paid according strictly to the Act, then Dunedin City s contribution would be significantly more than its current cost. Councillor Finch supported the museum and a fair funding formula for it. She noted that refurbishment of many of the galleries is required and has been long delayed. Upgrades are not possible with the current funding level. She advised the museum has made applications for funding elsewhere, with some success. Councillor Vollweiler, in closing the debate, noted the museum is a regional attraction, that Council is obliged to pay no matter what, the HOA doesn t change what we re legally obliged to pay and it s a matter of good faith to sign it, particularly as Queenstown Lakes has come on board voluntarily. The motion was put. For 4 Against 11 The motion was lost. 16 PART ROAD STOPPING REID STREET AND THURSO STREET, LAWRENCE The Senior Infrastructure Engineer submitted a report informing Council of the unformed section of Reid Street and Thurso Street, Lawrence and the request to stop part of this unformed road area, as requested by Mr Jim Robertson. The Manager Service Delivery advised that some further planning and investigative work is required, including engagement with the Lawrence/Tuapeka Community Board. The request shall be forwarded to the Board to seek its feedback. Council agreed that the agenda item Part Road Stopping Reid Street and Thurso Street, Lawrence may lie on the table pending this work. 14 The meeting adjourned at 3.58 pm. The meeting reconvened at 4.18 pm. 17 MAYORAL REPORT The Mayor submitted a written report on meetings and functions he had attended since the previous meeting of Council. 15 The Group Manager Planning and Regulatory noted that the Mayor s reported meeting on 28 March was held at Calder Stewart with various landowners regarding the Regional Development Fund Application, rather than with Calder Stewart about Plan Change 41 as noted in the Mayoral report. Councillors reported on meetings and events they had attended since the previous meeting of Council. Moved Councillors Cowie/McNab and Resolved: That the Mayoral Report and Councillors attendances be received. 18 CHIEF EXECUTIVE REPORT The Chief Executive submitted a written report on meetings and functions he had attended since the previous meeting at Council. Moved Councillors Kennedy/Ludemann and Resolved: That the Chief Executive s report be received. 19 DOCUMENTS FOR CONSENT AND SEAL A report was submitted advising use of the Clutha District Council Common Seal since the previous Council Meeting. Moved Councillors Ludemann/Blackmore and Resolved: That Council approves the fixing of its seal, under the hands of the Chief Executive to the documents as listed: 19.1 Lease Agreements Hut Site 14 situated on Sections 10 and 11 Block 1 Waipori Survey District between MB Smail and CM Smail. INVESTMENT PORTFOLIO UPDATE REPORT The Group Manager Corporate Services presented a report showing the movement in our Investment portfolio for the months of July 2017 to March 2018, including the following attachments: A - Nikko s March 2018 Quarterly report on the Forestry portfolio; B - Nikko s March 2018 Quarterly report on the Normal Portfolio and C - MJW s Investment Survey for March (Compares various fund performance in the market including Nikko). APPLICATION FOR 100% RATES REMISSION The Rates/Property Officer submitted a report asking the Corporate Services Committee to approve a rates remission in accordance with the Policy for Remission of Rates for Land Subject to Special Preservation Conditions. Under the policy, applications for 100% Rates Remission for Land Subject to Special Preservation Conditions have to come to the Corporate Services Committee. Moved Councillors Cowie / Blackmore and Resolved: 1. That the Corporate Services Committee receives the Application for 100% Rates Remission report. And 2. That the Corporate Services Committee grants 100% rates remission under the Policy for Remission of Rates for Land Subject to Special Preservation Conditions, to Tracy Pearson for the Ken Stephens Open Space Covenant. 3. 23 The Group Manager Service Delivery advised that while no date had been confirmed for the prosecution sentencing, he had met with the ORC to discuss a range of issues of which some will hopefully be resolved before this occurs. Councillors are concerned that even with a fully consented and functioning system we are still being prosecuted by the ORC. The Group Manager stated that this forms part of the conversation CDC are currently having with the ORC in regard to the prosecution. 2. OPERATIONS UPDATE The Group Manager Service Delivery submitted a report advising on operational matters within the Department. Moved Councillors Cowie/Blackmore and Resolved: That the Service Delivery Committee receives the Operations Update report dated 3 May There was discussion about the discoloured water affecting some Milton residents. The Group Manager Service Delivery advised that contractors and council staff are working to correct this situation by implementing a variety of measures. A press release was to be issued this afternoon advising of CDC s latest response. Bottled water will be made available and can be collected from the Milton Service Centre. In addition a water tanker will be situated at the White Horse Inn for anyone requiring more water. The state of the rural roading network was also discussed. Councillors are concerned about logging trucks damaging the roads and who is then responsible to rectify the damage. Metalling of the roads was also of concern as it is felt that some roads are being missed. A lack of crushed gravel seems to be an issue and councillors felt that there should be a stockpile left available for use when there is a change of contractor. It was also emphasised that it is important to use the service request system to record any issues that arise. 3. ITEM 8 IN AGENDA RUNNING ORDER: CHRISTIE STREET PLAYGROUND TREES this item was taken out of the agenda running order when the Ross s arrived. The Community Facilities Supervisor submitted a report advising of issues regarding the trees in the Christie Street Playground. Lisa Ross spoke regarding this item. Discussion was held about removing one or both of the trees as it was felt that these trees were inappropriate for this location and should be replaced with plantings that will not grow too large and are in keeping with the structure of other plantings in the reserve. Signs will be fitted to frames before hanging. Councillor Herbert commented that this project will be completed by the end of the financial year Christmas Tree This is a work in progress. Councillor Kennedy will contact Blue Mountain Nurseries as the tree should be planted before winter Cell phone Tower Booster National MP Hamish Walker is to meet with the Community Board and a representative from Crown Fibre Holdings on 11 July 2018 before the Community Board meeting. The Community Board are to provide information on the blackspots of most concern for discussion prior to this meeting. 2.3 Irresponsible Campers Work in progress and will be part of Freedom Camping Bylaw review. 2.4 Waikoikoi Monument A revised quote has been received from Southern Monuments Ltd, and a quote from Hammond & Ryder Funeral Services & Monumental Masons was tabled at the meeting. Veteran Affairs will give up to $5K but this is conditional on the rest of the money in excess of this figure being covered by other groups or individuals. WOCB have already agreed to contribute $10K but would like the committee to consider other options for this monument. Another community meeting will be held to discuss further fundraising and to confirm the final size of the monument. The West Otago Community Board will be represented at this meeting. 2.5 Tapanui Carpark The carpark has been sprayed but the Community Board would still like this metalled. Council staff are to look at options for tidying up and remetalling km signs at Tapanui Still no response from NZTA. 34 2.7 Flooding Event 2017 The book style signage has been ordered. Councillor Herbert has reviewed the draft flooding plan and suggested that a simplified version for the local response group be provided for consideration. The draft plan will be tidied up before distribution to the local response group prior to finalising. 2.8 Crossing at Koi Cross Roads A service request was lodged directly with NZTA on 10 April 2018 requesting they assess this corner and provide feedback to council staff and the community board for consideration. 2.9 Trees in Tapanui Township The cherry trees have all been pruned. A list of the berm trees requiring attention was forwarded to council staff by the Chairperson. This has been passed on to the contractor to action Station Road/Dorset Street Intersection An was sent to the NZTA on 22 March 2018 requesting them to liaise directly with the Chairperson regarding the safety concerns. There has been no response so far Seismic Hall Reports Written reports are to be given to the Chairperson within the next fortnight for forwarding to Beca Gorse around Sewerage Pond This item is to stay on the Work in Progress update as the issue is ongoing. The Group Manager Service Delivery advised that there is a strong possibility the lease will not be renewed when it comes up for renewal as it clearly states that the gorse is the responsibility of the lessee to control Kelso Dairy Factory Area Concerns were raised about damage done to the road after the recent flooding. Ongoing work will be done subject to funding. Concern was also raised about the actual Kelso Dairy Factory as this building is in disrepair and is used for photographic opportunities. This is a potential health and safety issue and the ownership is to be confirmed. Good feedback was received from the Community Board regarding Whitestone Roading contractors who are currently working on Station Road/Dorset Road. Mayor Cadogan arrived at 11.10am. No Spray Register In response to a complaint about people on the No Spray register not maintaining their roadside verges, the Group Manager Service Delivery advised that if you are not prepared to maintain these then council s contractor will spray regardless of whether you are organic or not. This information is clearly stated on the No Spray form which is signed by the customer at the time of applying. PUBLIC FORUM Craig Morrison Hospital Creek stormwater issues on Back Road Spoke about the July 2017 flooding issues and asked what was being done about this. Mr Morrison thanked Jules Witt for meeting with him on site prior to the meeting to discuss what preventative measures would be done in the short term and long term. Mr Witt advised that a submission would be put into the LTP for addressing this issue and having a budget provided for this work. Exploratory work needs to be done to quantify the amount of work that needs to be done to correct this issue. ORC have maintained the lower end of Hospital Creek in the past by spraying and this needs to be cleaned out to prevent flooding but need to look at cleaning the entire creek. Drains will be included in ongoing maintenance going forward which would involve an annual inspection. Policy agreement needs to be reached between CDC/ORC to ensure that issues don t fall through the cracks in the future. 1. The fence and the signage are the most important things to get done in order to open the track to the public. Councillor Blackmore will follow this up. The NZTA safety team are currently assessing the request from the Community Board to replace the chevrons with low plantings and will advise of their decision in due course. 2.5 Peace Gardens The next newsletter is to be written for autumn so that the community is informed before the trees are removed. No trees are to be removed prior to this. 2.6 Proposed Toilet Redevelopment Community Board members have inspected the toilets and agreed that the stainless steel urinal needs to be replaced with individual pans, 4 new toilets (flat to the wall for ease of cleaning) and stain the woodwork around the roof. A meeting with Clutha Development recently pointed out that there is a lack of parking around these toilets so there is a chance for a submission to the LTP for another block of toilets somewhere else in the town perhaps at the end of the rail trail. 2.7 Parking Signs in Lawrence An option for signage is to place one at either end of Lawrence pointing out the distance to both the Information Centre and Toilets. The Community Board would prefer to have two 120 litre bins and get them emptied on a daily basis. They would like these bins installed outside the Night n Day shop. After discussion it was agreed by the Community Board that both trees identified in the arborists report should be removed as they detract from the heritage look of Lawrence. The policy states Council must return market rentals but where there are low value rentals this new process avoids having to spend money on formal valuations. HEALTH & SAFETY UPDATE REPORT The Risk Management Support Officer submitted a summary of the activities in Health and Safety to meet the requirements of the Health and Safety at Work Act, The Committee heard that good progress has been made on ensuring small contractors were meeting Council expectations. INVESTMENT PORTFOLIO UPDATE REPORT The Group Manager Corporate Services presented the Investment Portfolio for the months of July 2017 to March 2018 for information. The report included: A - Nikko s March 2018 Quarterly report on the Forestry portfolio; B - Nikko s March 2018 Quarterly report on the Normal Portfolio and C - MJW s Investment Survey for March The Committee noted that there had been two months of losses and that the annual return remained good. It was also noted the Nikko funds were amongst the best performing in the MJW survey results. A discussion followed about benchmarking. It was felt that development of a consistent approach to benchmarking which recognises the long-term investment objectives of Council s funds was appropriate. MAJOR PROJECTS UPDATE REPORT The Group Manager Corporate Services provided an update on projects identified for risk reporting. The report is in a new format which focuses on the stage projects are tracking which reflects elements of risk. Classifying projects with a table of track indicators with descriptions. Table summarising the number and classification of projects. Chart summarising the number and classification of projects. A detailed list of projects with classifications and indicators. The ERP Implementation Risk Register. The M-Files Implementation Risk Register. Feedback was sought from the Committee as to the usefulness of this report and whether the Committee is happy to substitute this format on projects identified for risk reporting and to provide an update on the projects identified by Council. 52 The Committee agreed that the report should be limited to the major projects and an analysis of the overall progress on completing the capital program. The full report should go quarterly to Council (with the quarterly report). The Chief Executive will call a Project Control Group (PCG) meeting to discuss the Rosebank Industrial Estate once work starts and to complete the Planation Heights subdivision project. The Committee asked the Capital Delivery Manager for the reason projects are cancelled. He advised this happens when there is no further reason for the project, or the project has been rescheduled to a future Annual Plan. Some projects will be carried forward and some are already in the next Annual Plan. The Committee requested that at multiyear view be supplied in preference to a yearly view to get complete picture of percentage of projects to be undertaken. After good progress on the initial implementation the ERP reporting should be refocussed toward the final stages of the project e.g. there is still a risk around setting up corporate reporting The date on the M-Files Implementation Risk Register in the report is incorrect (4 June). The Committee noted that due to the ERP project financial reporting had been minimal for most of the financial year. 56 56 2. YOUTH COUNCIL MEMBERS UPDATE The Corporate Services Administrator presented a report asking that all Youth Councillors give a brief verbal report to the meeting. Youth Councillors, Councillors, the Mayor and the Community Support and Development Advisor gave verbal updates. Councillors Jenkinson and Payne spoke on the Long Term Plan and commented on the number of submissions being received. Mayor Cadogan spoke of his concerns around the closure of Roxburgh Children s Camp and the accommodation shortage in Balclutha. Youth Councillor Blackbourn has met with Hamish Walker (Clutha Southland MP), who is keen to hear about youth issues in the region. 3. CLUTHA DISTRICT YOUTH DEVELOPMENT PROGRAMME The Clutha District Youth Worker submitted a report on the Clutha District Youth Development Programme. The Be Motivated Be You event was very successful and she thanked Youth Councillors for help with running this event. LONG TERM PLAN The Community Support and Development Advisor submitted a report asking which topics the Youth Council would like to submit to the Long Term Plan (LTP) Youth Councillors held a workshop prior to the meeting and indicated an interest in submitting to the LTP on the following topics: Lobbying for a crackdown on of methamphetamine in the Clutha District. Skatepark in Tapanui. Better district wide no distraction and other road safety signage. What a Load of Rubbish (services at Mt Cooee landfill). Milton s Makeover. Getting it Right for Roading 4.1 High Crash Zone South of Waihola It was suggested that more improved signage should be erected in high crash area south of Waihola to warn motorists of hazards. 57 Sunstrike Sign at Cannibal Bay There is a hand painted sunstrike warning sign near Owaka which perhaps should be replaced with a formal sign. The Chief Executive advised that in this type of situation it is better to lodge a service request with Council, giving specific details of the location and the type of service required. 4.3 Youth Drop-In Centres It was suggested that more youth drop-in centres should be created in towns/areas lacking in youth facilities. As there are several successful youth groups running throughout the district, Youth Councillors felt that it was better to support existing youth groups rather than reinventing the wheel. Youth Council could identify where there are gaps and offer to support organisations to establish new groups. This could be part of the Youth Council s Future Activities programme. Mayor Cadogan left the meeting 6.48pm Youth Councillor Blackbourn (Chairperson) left the meeting at 6.48pm and Youth Councillor Johnston (Deputy Chair) assumed the chair. 4.4 Substance Use Campaign Ideas on how to tackle substance abuse in the district were discussed. It was agreed that Youth Council would like raise the youth voice and speak out against substance use across the district and that a campaign driven by youth to address substance use, would have better impact in promoting positive messages and raising awareness of the issues. It was agreed the campaign would cover all types of substance use, not just methamphetamine. Youth Councillor Blackbourn returned to the meeting at 6.51pm and assumed the Chair. It was noted that some schools already provide education on the use of substances. It was agreed that the Youth Councillors, supported by the Community Support and Development Advisor and the Clutha District Youth Worker, should research antisubstance abuse programmes or activities already in place throughout New Zealand, in particular, those driven by young people. The Youth Council agreed to submit to Council s LTP for financial support to cover the provision of staff support, speaker support and any other resources required to develop and deliver the project, and that Youth Councillor Blackbourn will work with the Clutha District Youth Worker and Community Support and Development Advisor to compile the submission. REPORT 1 Background The Council s performance management framework is an important part of the way that Council seeks to explain what it is doing, and why in its Long Term Plan. The framework describes how each of Council s activities contributes to Council outcomes, what levels of service will be provided, how performance will be measured using key performance indicators (KPIs) and what the Council s targets are. It also helps the community, elected members and staff to assess whether the Council s policies and services are actually making a difference for our communities. For the 2018 Long Term Plan, Council has considered the levels of service for various activities throughout their series of LTP workshops during the past year. Decisions, directions and changes to levels of service have been integrated into the updated framework presented here. Improvements have been made to reduce the number of measures as the sector looks to have less, more meaningful measures. Mandatory measures as per the Local Government Non-Financial Measures rules also feature highly. There are now 66 measures proposed compared with 102 in the 2015 Long Term Plan. 62 these will still be reported to Council on an annual basis to help inform and assist in decision-making at Council level. RECOMMENDATIONS 1. That Council receives the Give Way and Stop Sign Register 2018 update report. 2. That Council adopts the Give Way and Stop Sign Register REPORT 1 Background As a road controlling authority, Council is required to authorise traffic control devices, which include give way and stop signs. In the past, a list of changes to give way and stop signs, along with a complete list of such signs, has been presented to Council for adoption. This list has been referred to as a Register. The last time this was done was in 2014, after an extensive review had resulted in many new signs being installed. As nearly four years have passed since the list of changes and the register was adopted, it is timely to review any subsequent changes that may need to be adopted. A review of signage data in RAMM (Road Assessment and Maintenance Management software) was undertaken. That Council approves the delegation of the authority to install, operate or remove traffic control devices to the level of Infrastructure Manager, or above. 3. That Council approves the delegation of the authority to impose weight and speed restrictions on roads and bridges to the level of Infrastructure Manager, or above. 4. That Council approves the changes to the Delegations Manual to reflect the decisions at 2 and 3 above. REPORT 1 Background As a road controlling authority, Council is permitted to authorise traffic control devices (stop and give way signs), and to fix weight and speed limits on any of its bridges. In the past, the authority in both these matters has been exercised by a full meeting of Council. This report proposes that the ability to authorise these two operational activities is delegated to staff. Changes to weight and speed restrictions do have an impact on users of the roading network and if a change of delegation is considered, there would be ongoing reporting through the Service Delivery Committee to ensure Councillors has access to up to date information. 95 1.1 Current delegations The document by which Council manages its delegations is the Delegations Manual. Paragraphs of the manual describe Council s adopted philosophy of delegation. Specifically, Council wishes to delegate to the lowest level of competence to allow the Council to delegate its powers and functions to the most efficient and effective levels. The delegations contained in the manual are intended to reflect this philosophy. This proposal addresses two activities which are operational in nature. This means that requiring Council to make decisions on these matters is probably not in keeping with Council s expressed desire to make the best use of the abilities of Councillors [and] develop effective managers. The decision to delegate these activities would be entirely in keeping with other operational matters already delegated. To date the Council has not delegated the ability to impose weight and speed restrictions. The responsibility for managing traffic control devices has not previously been listed as an area for delegation. However, the framework under which Council previously managed a register of traffic control devices is no longer current, and there is no reason why Council should not delegate this operational responsibility. Details of the current relevant legislation are given under section 6 below. 1.2 Other Councils current general practice A survey of the delegations documents of other Councils in the same general class as Clutha District Council has found that these two activities are generally delegated below the level of Council. Central Otago has delegated these matters to Community Board level, while Ashburton, Hurunui, Tasman and Waimate have delegated them to staff at the level of Roading Manager, Transportation Manager or similar. The principle that delegations should be made at the lowest possible competence level is fairly universally adopted. 1.3 Changes to the Delegations Manual The decision to delegate either or both of the two activities listed in the recommendations will result in changes to the Council s Delegations Manual. The issues under consideration are covered by two legal documents: 6.1 Heavy Motor Vehicle Regulations s(3) 11(3) For the purposes of this regulation, a controlling authority may with respect to any bridge under its control fix mass limits or a speed limit or both mass limits and a speed limit for heavy motor vehicles, and combinations of vehicles including a heavy motor vehicle, using that bridge. 6.2 LTNZ: Land Transport Rule: Traffic Control Devices 2004 (Rule 54002), Section 2 Role of road controlling authorities 2.1(1) A road controlling authority must: (a) authorise and, as appropriate, install or operate traffic control devices: (i) if required by or under this rule or other enactment; or (ii) to instruct road users of a prohibition or requirement that it has made concerning traffic on a road under its control; or (iii) to warn road users of a hazard; and (b) remove a traffic control device if required by or under this rule or other enactment. 2.1(2) A road controlling authority may authorise and, as appropriate, install, operate or remove traffic control devices: (a) if desirable for the guidance of traffic or to draw attention to a requirement that controls traffic; or (b) to provide information to road users. 7 Financial Impact NIL 97 Clutha District Council 17 May 2018 Delegation of Roading Matters

This request was the subject of a separate report to the Lawrence Tuapeka Community Board at their meeting of 18 April 2018, with the Board in favour of proceeding to the consultation process for the proposed part stopping of Reid Street and Thurso Street. 2 Strategic Goals and Outcomes Roading infrastructure that sustainably supports the community and economy. 3 Consultation As most of the adjoining land owners have provided written consent to the proposed road stopping (refer Attachment 8.1), it is considered that no further consultation on this matter is required other than that required by the Local Government Act Schedule 10 procedures, which would afford all other affected/interested parties to raise their support or objection to the proposal. 4 Assessment of Options The request from Mr Robertson for the part stopping of Reid Street and Thurso Street is for the purpose of building a residential dwelling and formalising existing occupations and use. On reviewing the request, it has been confirmed that this section of legal road reserve is superfluous to requirements from both a Council Roading and Council Utilities perspective, as easements for the sewer and water pipelines are to be created. As such, two options have been identified as follows: Option 1 Do Nothing This will result in the continuation of legal road reserve for this area, which will preclude the construction of any permanent building on it and the subsequent loss of a potential rateable property. Calculations have been provided to determine the actual amount of returns for offsetting against rates or for Long Term Plan deliberations. These are all based on the 31 March end of period returns published by Nikko and previously reported to Council and the Audit & Risk Committee. RECOMMENDATIONS 1. That Council receives the Nikko Investment Distribution Report. 2. When the Reserve Account is above 20% of the fund value, distributions may be higher but only up to twice the long-term distribution rate (i.e. up to 6.0%). When the Reserve Account is negative, but no less than -5% of the fund value, distributions shall fall to half the long-term distribution rate (i.e. 1.5%). When the Reserve Account is less than -5% of the fund value, distributions shall cease until the Reserve Account recovers to less than -5%. c. That Nikko Asset Management is appointed as the Investment Fund Manager for the Forestry Asset proceeds. d. That the Capital and Reserve Account model be adopted for the Reserving and Distribution policy for the Forestry Proceeds. Comments about the calculations: The balances tie back to the 31 March 2018 Nikko reports reflected in both the Audit & Risk Committee and Corporates Services Committee Agendas. We have used Berl data reflecting 1.8% inflation for the year April 2017 to March This ensures we preserve value by only distributing over and above the impact of inflation. The split between Capital at 95% and Reserve at 5% follows the agreed upon rules. The Net Return represents the increase in value in the fund over the past year which needs to be split up. The Distribution Rate follows a number of conditions. 2. B Normal Investment Distribution 106 When workshopping the Long Term Plan investment distribution rules Council proposed a distribution as per Table C. This included a return to rates, a return back to the relevant fund, and a return back to a balance (equivalent to the Reserve rules for the Forestry to cover for interest volatility). The distribution increased the rates return to 4% of an expected 5% return for the first few years reverting back to 3% later. Any return over and above the expected 5% would be available for Council distribution in any manner Council decides. This is the only year that returns over and above the budgeted $235,000 for rates have not been budgeted for. From years 1of the Long Term Plan onwards Council has budgeted on the 5% expected return. 107 Table B identifies a total amount to be distributed of $1,315,113 from a 7.3% return. Applying the distribution rules (Table C) identifies $362,657 as to be applied to rates, of which the budget this year was only $235,000. This means an additional $127,657 is available to offset rates in Council s Long Term Plan decision-making. (Note this is additional to the Forestry rates offset available). Council also has the excess return over and above 5% to determine for distribution. This is $441,719, representing 2.3% of the 7.3% return. 107 This leaves $336,058 to add to the relevant fund value (as per Table C) and $174,679 to create a Reserve balance. RECOMMENDATIONS 1. That the Council receives the Biodiversity Funding Application report. 2. That Council grants $3,980 (including GST) from the 2017/18 biodiversity fund to the Yellow Eyed Penguin Trust for a perimeter fence around the proposed field base at Long Point. REPORT 1. Background As part of the District Plan review process, Council has put more effort into supporting active protection for biodiversity. In the current financial year, $11,563 is allocated for funding to support voluntary protection and enhancement measures, of which all is still available this financial year. Attached is an application from the Yellow Eyed Penguin Trust (YEPT) for funding for a perimeter fence around a proposed field base at Long Point. It is noted that the application also includes a request for funding towards the building consent fees, however this is covered by Council s reimbursement scheme, which allows for up to $2,000 to be reimbursed for such fees. 2. Strategic Goals and Outcomes The application supports the community outcomes of A sustainable environment that promotes a clean and green image. 112 3. Assessment of Options Council can either approve the funding request in whole, in part or decline it. The request can be assessed against the criteria set out in the Biodiversity Funding Policy (see section 5 below for these) as follows: the funding sought is 2% of the total cost with the other 98% being funded by other sources of funding; the project is an eligible activity for the fund; the Long Point coast has significant biodiversity values. Yellow-eyed penguins are classified as nationally vulnerable and the site also supports at least 15 other indigenous bird species, plus high quality coastal vegetation; the site is recognised as an Area of Significant Habitat of Indigenous Fauna in the Clutha District Plan; the site is protected under the Clutha District Plan and also through its ownership by the YEPT and DOC. Some consideration should also be given to the fact that the fund was set up in particular to support biodiversity on those small and privately owned habitats that are difficult to deal with through regulatory control, and this application does not fall into that category. Notwithstanding, the land has only been in the YEPT ownership for a few years and is of high ecological importance. 4. Consultation The application does not require further consultation. 5. Policy Considerations 112 The Council s Biodiversity Funding Policy sets criteria by which Council can assess applications, being: Funding is available on a cost share basis, with the fund providing up to 50% of the total project costs (excluding gst, and recognising reasonable in kind or labour costs invested by the applicant); Funding can be provided for any activities that will protect or enhance biodiversity, including but not limited to fencing, planting, pest control and weed control; Preference will be given to projects which protect or enhance: biodiversity values that are covered by the Government s National Priorities for Protecting Rare and Threatened Native Biodiversity on Private Land 2007 ; sites which are contained in the Clutha District Plan s Table 13.5 Significant Wetlands or Table 13.8 Areas of Significant Habitat of Indigenous Fauna (or successors to those Tables following District Plan review); sites which were Recommended Areas for Protection by the Department of Conservation but do not yet have protection through land ownership, a covenant or the District Plan; Funding will only be provided where the biodiversity values involved will be protected by either a protective covenant registered on the land title, or by a rule in the Clutha District Plan; Funding will be allocated by the Regulatory Services Committee or by Council; Funding will generally not be provided for activities that are required to be undertaken. 113 6. Legal Considerations Nil Financial Impact The funding sought falls within the existing budget so there is no financial impact. Given there is less than two months of the financial year remaining, there is unlikely to be any other funding requests and if there is, then there will still be over $7,500 remaining in the fund. 8.
