HEARING/PUBLIC HEARING: (a) Opening Statement For Hearing By Chairman Development Variance Permit for a property legally described as Lot A, Sec 35, Twp 8, ODYD, Plan 35556, Except Plan KAP73308, located at 180 Greenhow Road and owned by BC Ltd. c/o Robert Tupper (Vandekerkhove) 1-20 (i) (ii) (iii) (iv) Introduction of Development Variance Permit Presentations by Public beginning with the Applicant Closing Statement by Mayor Resolution Development Variance Permit THAT upon consideration of input from adjacent land owners, the Township of Spallumcheen Council not authorize the issuance of a Development Variance Permit for the property legally described as Lot A, Sec 35, Twp 8, ODYD, Plan 35556, Except Plan KAP73308 and located at 180 Greenhow Road to permit a variance to Section and Table 4.1 of the Township of Spallumcheen Subdivision Servicing Bylaw No. 1404, 1996 by waiving the requirement to connect the lots shown on the attached proposed subdivision plan (dated May 30, 2014) to a community water system. 4. ADOPTION OF THE MINUTES: (a) Regular Council Meeting Minutes of Monday, June 16 th, That the Township of Spallumcheen Regular Council minutes for a meeting held Monday, June 16 th, 2014 be adopted as presented. 1
2 4 Adoption of the Minutes Cont d (b) City of Armstrong/Township of Spallumcheen Joint Council Committee Meeting Minutes of Thursday, June 19 th, *2 Resolutions to Consider for Ratification (1) Purchase/Sale of Internment Licenses That the Township of Spallumcheen Cemetery Operations and Maintenance Bylaw be amended by adding a new sub-section to Section 5 Internment Right Contract stating the following: The Armstrong Spallumcheen Cemetery, at the direction of the City of Armstrong and Township of Spallumcheen Councils, reserves the right to refuse a Right of Interment of more than two (2) plots to any one individual ; AND FURTHER THAT the aforementioned bylaw amendment be adopted prior to the conclusion of the 2014 calendar year. (2) BCEHS Resource Allocation Plan Emergency Health Services BC Ambulance Service That the Township of Spallumcheen direct staff to write a collaborative letter of support from the City of Armstrong/Township of Spallumcheen Mayors to the City of Pitt Meadows in regards to their letter dated May 26 th, 2014 regarding the British Columbia Emergency Health Services Resource Allocation Plan, noting the BC Ambulance Service be properly funded and resourced as a critical public safety agency and not rely on first responders such as volunteer fire departments to provide first responder services; AND THAT the local Member of the Legislative Assembly, Greg Kyllo be carbon-copied in the letter, as well as the Union of British Columbia Municipalities. Minutes to Receive: That the minutes of the City of Armstrong/Township of Spallumcheen Joint Council Committee Meeting held on Thursday, June 19 th, 2014 be received. (c) Committee of the Whole Meeting Minutes of Monday, June 23 rd, Recommendation Minutes to Receive: That the minutes of the Township of Spallumcheen Committee of the Whole Meeting held on Monday, June 23 rd, 2014 be received. 2

Minutes to Receive: That the minutes of the Township of Spallumcheen Committee of the Whole Meeting held on Monday, July 7 th, 2014 be received. 5. 4 7(b) Staff Reports Cont d (ii) Report from Anthony Kittel, Regional Growth Strategy Coordinator, Regional District of North Okanagan dated June 27 th, 2014 Re: Official Community Plan Amendment Bylaw 1872 (Regional Context Statement) That the Township of Spallumcheen Official Community Plan Amendment Bylaw 1872 which proposes to amend the Township of Spallumcheen Official Community Plan Bylaw 1794, 2011 to include a Regional Context Statement be given First Reading; AND THAT Official Community Plan Amendment Bylaw 1872 be referred to various agencies and First Nations in accordance with Section 879, 881 and 882 of the local Government Act. (iii) Report from Deputy Planning Manager, Regional District of North Okanagan dated July 3 rd, 2014 Re: Township of Spallumcheen Zoning Text Amendment Bylaw 1855, 2013 (Medical Marihuana)(File # SPL-TA) (a) Information Bulletin, Ministry of Community, Sport & Cultural Development dated June 24 th, 2014 Re: BC Preserves Local Governments Tax Revenues from Medical Marijuana Growers (b) Regular Council Minute Excerpt from Monday, June 2 nd, (c) Committee of the Whole Minute Excerpt from Monday, May 26 th, (d) Regular Council Minute Excerpt from Monday, April 7 th, (e) Public Hearing Package from Monday, April 7 th, That the Township of Spallumcheen Zoning Text Amendment Bylaw 1855, 2013 be amended at second reading to permit and regulate medical marihuana production facilities within the Agricultural Industrial (I.4) and Agricultural (A.2) zones of the Township of Spallumcheen Zoning Bylaw 1700, 2008; AND THAT the Township of Spallumcheen Zoning Text Amendment Bylaw 1855 be forwarded to a Public Hearing prior to consideration of a new Public Hearing. 4
5 7(b) Staff Reports Cont d (iv) Report from Ed Forslund, Public Works Manager dated July 7 th, 2014 Re: McCallan Bridge Repairs That the Township of Spallumcheen Council receive the Report from the Public Works Manager dated July 7 th, 2014 regarding McCallan Bridge Repairs; AND THAT the Township of Spallumcheen Council direct staff to proceed with a Request for Proposal to complete the required repairs to the McCallan bridge as recommended by CWMM Consulting Engineers and to proceed with the repairs not to exceed $33,000.00, and that funding be divided from the 2014 Capital Road Program to the Public Works Operating Budget for this purpose. (v) Report from Ed Forslund, Public Works Manager dated July 7 th, 2014 Re: Stepney Bridge Replacement That the Report from the Public Works Manager, dated July 7 th, 2014 regarding Stepney Bridge Replacement be received, AND THAT the Township of Spallumcheen Council approve the proposed project as recommended by staff, AND FURTHER THAT the project be tendered in January of 2015 with construction to take place during the environmental window, from July 15 th to August 31 st 2015 with the understanding that if the tender price comes in as estimated the budget shortfall can be budgeted for in the 2015 budget process. (vi) Report from Ed Forslund, Public Works Manager dated July 8 th 2014 Re: CN Rail Crossing Larkin Cross Road That the Report to Council from the Public Works Manager dated July 8 th, 2014 regarding the Township of Spallumcheen Railway Crossing Replacement Larkin Cross Road be received; AND THAT the Township of Spallumcheen Council direct staff to proceed with the installation of a new concrete rail crossing on Larkin Cross Road and that subject to there being insufficient funds in the Public Works budget at the end of the 2014 fiscal year, Council authorize a draw from the Contingency account to a maximum amount of $20, to fund the railway crossing improvement on Larkin Cross Road. 5

(viii) Chief Administrative Officer s Report (c) Council Reports: (d) Mayor s Report: 8. CORRESPONDENCE: (a) Requests (i) from Eric Williamson per Hilda Williamson dated March 21 st, 2014 Re: Williamson Subdivision Application Date Extension Chief Administrative Officers Comments: The Preliminary Layout Review Extension Request letter should have been forwarded by the Deputy Chief Administrative Officer for Council s consideration when it was received. Not forwarding it has not negatively impacted the approval of the subdivision. It is recommended that Council grant another six month extension beginning July 14 th, This would be the sixth extension. That the dated March 21 st, 2014 from Eric Williamson and attached letter dated March 20 th, 2014 from Hilda K. Williamson regarding Williamson Subdivision Application Date Extension be received, AND THAT the Township of Spallumcheen Council grant a six (6) month subdivision application extension beginning July 14 th, 2014 and that development services be directed to provide a letter advising of the extension. 6
