2 Update Hans Peterson & Söhne GmbH & Co. KG MLC 2006, ON BOARD COMPLAINT PROCEDURE (Form MLC-OR-01 Flag State ) The on board complaint procedure allows seafarers to enforce their right under the Convention. Hans Peterson & Soehne GmbH & Co. KG as MLC Shipowner of the fleet implemented an on board complaint procedure to ensure for fair, effective and expeditious handling of seafarers complaints alleging breaches of Convention requirements. The on board procedure is designated to resolve complaints at the lowest level possible. However, in all cases, the seafarer has a right to complain directly to the Master and where considered necessary, to appropriate external authorities. The on board complaint procedure includes the right of a seafarer to be accompanied or represented during the complaints procedure, as well as safeguards against the possibility of victimization for filing complaints. Victimization covers any adverse action taken by any person with respect to a seafarer for lodging a complaint which is not manifestly vexatious or maliciously made. Each seafarer will receive a copy of the actual on board complaint procedure prior to joining a vessel. The on board complaint procedure includes contact information of the competent flag state authority and in the seafarers country of residence. Extract from Liberian DMLC Part II 1. Adequate procedures are established on board for the fair, effective and expeditious handling of seafarer complaints alleging breaches of the requirements of MLC Convention (including seafarers rights), including the seafarers right to be accompanied or represented during the complaint procedure, while ensuring that seafarers are not victimized for lodging complaints. 2. Seafarers are provided with a copy of the on-board complaint procedure and name and contact details of the appropriate Flag State competent authority on joining the vessel. 3. Seafarers complaints are first sought to be resolved at the lowest level and may be raised to the level of departmental head. For any complaint not resolved by the departmental head, the seafarer is free to complain directly to the Master and to the shipowner or appropriate Flag State authority. 4. The Master provides seafarers with impartial advice on their complaint and assists them in following the complaint procedures. By a selection of all crew members two seafarers to be designated to provide impartial advice if the complaint is against the master. The Rank and Name to be placarded on board the vessel by Master. In case one of the designated seafarer signs off a new seafarer to be nominated. 5. All complaints of seafarers are recorded along with the decisions taken and a copy of the complaint provided to the seafarer. Any victimization of a seafarer for filing a complaint is prohibited and subject to penalties. These matters are without prejudice to a seafarer s right to seek redress through whatever legal means may be appropriate. 2

Saturnino Palma Mr. Palma was promoted to 2nd Engineer on board Niledutch Springbok in July Mr. Palma joined our company in August 2001 as 4th Engineer. Since July 2005 he served as 3rd Engineer and after he successfully passed license he was promoted on board Niledutch Springbok. Chief Engineer Aidas Cesonis Mr. Cesonis was promoted to Chief Engineer on board M.V. WESTERAL in October Mr. Cesonis joined our company in July 2008 as 2 nd Engineer on M.V. WESTERMOOR and completed several contracts on various ships. Due to always excellent performance reports he has been promoted to Chief Engineer. Chief Engineer Mr. George Lebosada Mr. Lebosasa was promoted to Chief Engineer on board M.V. WESTERBURG in November Since November 2008 Mr. Lebosada was employed as 2nd Engineer. Due to always excellent performance reports he has been promoted to Chief Engineer. Mr. Lebosada joined our company in May 2006 as oiler on MV WESTERHEVER. Chief Mate Mezentsev Mr. Mezentsev was promoted to Chief Mate on board WESTERHAMM in November 2013 after recommendation for promotion due to good performance. He is employed as 2 nd Mate since He has been promoted on board WESTERHAMM. We wish Mr. Palma, Mr. Cesonis, Mr. Lebosada and Mr. Mezentsev all the best and success in their new position and looking forward to continuing our good cooperation. TWENTY YEARS SEA SERVICE Chief Engineer Matthias Adler Mr. Adler joined the company in 1993 as 2 nd Engineer on board former WESTERLAND. Since 1998 he is employed as Chief Engineer on various ships. Chief Engineer Michael Hutwalker Mr. Hutwalker joined the company November 1993 as Chief Engineer M.V. CCNI Valparaiso. FIFTEEN YEARS SEA SERVICE 2 nd Engineer Klaus Dieter Spindler Mr. Spindler joined the company November 1993 as 2 nd Engineer. Farewell on Shore. Martje-Christine LeComte Unfortunately the continuing poor market situation forced us to let Mrs. Le Comte go at the end of November. Mrs. Le Comte started in our company as shipping apprentice back in 2006 and after her successful graduation in January 2009 she has been working in our crewing department. We highly appreciate the cooperation and engagement of Mrs. Le Comte in her years with our company and regret the recent development. We wish Mrs. Le Comte all the best for her private and professional future. 3
4 Share of good practice This time the topic for our well established column was not initiated within our own fleet but is driven from a report from the German Federal Bureau of Maritime Casualty Investigation (BSU). The BSU recently reported about a fatal accident on board a German container vessel due to inappropriate storage of steel plates. After review of the report in our monthly Office ISM Meeting it was distributed within our fleet and we asked the vessels to send some pictures of their individual storage situation on board to the office. Obviously already this information request about areas, which normally do not attract too much attention, initiated a new risk assessment of the storage condition on some vessels. On another vessel the crew decided a renewal of the rack after the original situation was already reported. By intend we do not indicate the name of the vessels to the pictures. You may identify some by own experience on different vessels At least one vessel did not send the actual situation but admitted that the area needs considerable improvement which was started immediately. We suppose that all pictures received did show actual routine on board and not something which received special make up for the picture session. 4
5 Target of putting this topic into the is not to blame anyone nor to create a ranking of solutions but to raise attention to the matter and to follow our principle of continuous improvement of the safety conditions in our fleet. As much as possible we want to manage by awareness and prevention rather learning the lessons the hard way. Thank you for your support. /D. Jebsen Fortunately we did not receive any picture showing a totally unacceptable unsafe condition although some vessels received comments and proposals. Chief Eng. Werner Kampf - 25 YEARS SEA SERVICE Although the real 25th anniversary of C/E Werner Kampf with the company actually happened already on April 15th, 2012 it took a while to schedule the company celebration. On October 31st, the company invited C/E Kampf together with his wife Heidi to spend a nice evening with the management and some longtime colleagues from the office in the famous restaurant ConventGarten in Rendsburg. However, since everything can be improved at any time we appreciate the thorough review and safety upgrades which were initiated or will be carried out after review of this article. If you want to replicate any solution of another vessel please feel free to contact your colleagues directly or Capt. 7 - From the archives - Westermarsch & Westertal In 1983 two of the largest dry-cargo freighters, each 14,400 dwt vessels, to be built by the Nobiskrug Shipyards GmbH, Rendsburg, equipped with Krupp MaK 8 M 601 engines, were completed. They were the sisterships WESTERMARSCH and WESTERTAL, building numbers 714 and 715, built for Gebrüder Peterson Schiffahrtsgesellschaft Westerland (or Westertal) mbh & Co. KG, of Hörsten, Rendsburg. The construction of the WESTERMARSCH and the WESTERTAL was an important event for the shipping company as well as for the Yard: for the shipping company they were the largest the company had ever had built and for the Yard they were the largest dry cargo vessels the yard had ever built. There is a curious point about the two vessels, and fairly unique in West German shipping, since the WESTERMARSCH and the WESTERTAL did not go into service with their names at all but with charter names ZIM Melbourne and ZIM Sydney. They have been chartered for the service Mediterranean-Far Australia. The sisterships are scantling vessels with double hulls and built with bow and stern bulges. The main specifications of WESTERMARSCH and WESTERTAL are: Length over all metres Moulded breath: metres Height to first deck: metres Draught: 8.35 metres Both vessels have been classified Class GL A 4 E Containership + MC E AUT. The vessels have a box capacity of 932 TEUs with connections for 75 reefer containers. The ships can carry 362 TEUs in three holds and 570 TEUs on deck. Neither vessel has its own loading gear but has a removable cell system for 40-foot containers. The jack-knife hatch covers are hydraulically controlled combined with rolling pontoon hatch covers. Hold space is 17,000 cbm. There were compliments all round for builder and engine builder when the first of the two ships was handed over. The contract called for vessels of 13,850 dwt, but in effect they were 14,436 dwt, and the speed at knots was an increase over the speed requirement per contract, knots. The MaK engines for both vessels were of the type 8 M 601 with a rating of 8,000 kw (10,900 hp) at 425 rpm. The engine operates over reduction gearing to a Lips variable pitch propeller at 135 rpm. Working at full capacity the engine can achieve knots. This article has been published in the former MaK Company magazine Toplaterne no. 53 edition May MV WESTERTAL was sold in 1996 to Pakistanian owners - Today still in service in China. MV WESTERMARSCH was sold in 1992 to owners in Chile. After several further changes of ownership the vessel finally ended up in Turkish hands and has been scrapped this August in India after a lifetime of 30 years. 7
8 Seafaring cooks / cooking seafarers! This delicious recipe comes from Captain Markov and Chief Engineer Mr. Sitzler of MV WESTEREMS Home-made farmer sausage from Schwarzwald (Black Forest) Recipe: Peel one complete garlic bulb and press it with salt and put into a cup with ¼ ltr of water, and remain overnight. Mince all meat, add all spices, garlic water (only liquid, NOT pulp) and eggs, and mix well by hands. Fill up the intestines with mixed mass, and divide the sausage by small rope (Bindfaden) for length as you prefer. Hang up the prepared sausage for drying overnight in a cool place (vegetable room). Ingredients: 1. Pork meat. 2 kg; 2. Pork belly. 2 kg; 3. Beef meat. 1 kg; 4. Garlic water.. 0,25 ltr; 5. Fresh eggs.2 pcs; 6. Black pepper.7 tea/sp; 7. Nutmeg (Muskat). 2 tea/sp; 8. Coriander. 4 tea/sp; 9. Paprika powder (edelsüess).2 tea/sp; 10. Majoran 4 tea/sp; 11. Salt 4 table/sp; 12. Smoke (hard wood, juniper berries). Smoke the sausage about 1.5 hrs with max temperature 70 C. After cooling down inside of smoke chimney, repeat the smoke procedure once again, and enjoy the perfect taste of Schwarzwälder Bauernbratwurst. 8
9 Last voyage for former MV WESTERMÜHLEN We have been informed from the current managers that after 20 years of reliable service MV CHARLOTTA ex. WESTERMÜHLEN started her last voyage to the shipwreck beaches in India after redelivery from charter in August. MV WESTERMÜHLEN sailed from 1993 until her sale to new owners end of 2006 under the Peterson flag and has been managed by the Peterson team for further 5,5 years until mid of Funny Tales Nautical Theory Joke What would you do if a sudden storm sprang up on the starboard?
