1 Lake Joy Campground 2012 Seasonal Campsite Contract This seasonal campsite contract is herein agreed to by Lake Joy Campground, LLC., hereafter referred to as "owners" or campground owners and the party(ies) signing this contract, hereafter referred to as "seasonal camper(s)". By signing this contract, the seasonal camper(s) agrees to all of the terms and conditions of this contract as follows and further agree to be bound by all rules of Lake Joy Campground and assumes responsibility for adherence to these rules by family members and guests. Seasonal campers are not allowed to sublet their contract agreement" to any other individual(s). Seasonal Camping In return for a designated annual fee, a seasonal camper receives: A set number of camping days one gravel pad for placement of a camping unit one fire pit non-metered electricity to each camping trailer (30 amp service) non-metered water professional lawn mowing services holding tank pump service (extra charge) boat dock space on an existing dock or a location to build a new dock (space permitting) boat and boat trailer storage winter camping unit storage access to all campground non-charged activities Seasonal Camping Units Seasonal campers are allowed to place one trailer on their site not exceeding 40 feet in length (including hitch if attached) and 8 feet in width which requires no more than 30 Amp service. Trailers of prospective new seasonal campers must be 10 years of age or newer (2002). Seasonal Camping Definition Lake Joy Campground defines seasonal camping as follows: The seasonal campers are provided a set number of days of camping for a designated fee. A seasonal camping day is defined as any 24 hour period or portion thereof in which the seasonal camper is present on the campground. The set number of seasonal camping days provided for the 2012 camping season is 70 days. This provides 25 two day weekends or week days of camping with an additional 20 discretionary days to be used for extended weekends, vacations or periodic week day usage. If seasonal campers wish to increase their set number of camping days, they can do so for an additional daily fee. Seasonal Camping Family Lake Joy Campground defines a seasonal camping family as an individual or married couple and their dependent children up to 20 years of age. Any exceptions to the seasonal camping family definition must be approved on an individual basis by the campground owners. All persons not defined as a part of the seasonal camping family on the seasonal campsite contract are considered guests and are subject to Lake Joy Campground s guest policies. Adult children (21 years of age and older) of any seasonal camping family are considered as guests and must adhere to all guest policies. It is further agreed that dependent children 20 years of age and younger are not allowed to occupy the seasonal campsite without a parent present. 1

2 Campground Contract Term The seasonal campsite contract term for 2012 shall run from April 20, 2012 to April 18, For 2012, we will open on April 20 th at 9:00am and close October 7 th at 3:00pm (weather permitting). During the period of time that the campground is closed, no seasonal campers are allowed on the campground without the campground owners permission. Also, no business will be conducted between the campground owners and seasonal campers and/or prospective buyers of a seasonal camper s trailer and/or seasonal campsite improvements except in relation to payment of seasonal camping fees or arrangements for removal of a seasonal camper s trailer from a seasonal site. The campground owners reserve the right to temporarily restrict access to any portion (or the whole) of Lake Joy Campground for extenuating circumstances due to weather, health and safety concerns or other problems which might arise and are out of the owners control. Seasonal campers agree that no refund will be given for temporarily restricted access to Lake Joy Campground or any portion thereof. Contracts for the upcoming season are mailed to seasonal campers in early March of each year. Seasonal Contract Fee The basic seasonal campsite contract fee for the 2012 camping season is $1, In addition, there is another $ for the required state and local sales taxes, for a total of $1, The seasonal campsite contract fee is to be paid as follows: Seasonal campers can choose to pay the seasonal campsite contract fee in full on or before April 13, Or, if a two installment plan is elected, one half ($999.50) of the seasonal campsite contract fee shall be paid on or before April 13, 2012, and a final payment of $ shall be made on or before July 13, Please make note of seasonal campsite contract fee due dates as we do not send out reminders for the July payment. Payment of the seasonal campsite contract fee is to be received by Lake Joy Campground no later than the dates stated in the preceding paragraph. Payments received anytime after the above dates will be assessed a $25.00 per week late charge. Payments for the seasonal contract fee can be paid by check, money order, debit card or credit card. For accounting purposes, no cash payments will be accepted. If a seasonal camper wishes to place their trailer and/or seasonal campsite improvements for sale, the yearly seasonal campsite contract fee and any overdue Belmont Township personal property taxes must be paid in full at the time of listing. By signing the 2012 seasonal campsite contract, the seasonal camper agrees to pay in full the 2012 contract fee of $1, Failure to make payment after 30 days of any payment due plus any assessed late charge fees will result in Lake Joy Campground s right to pursue recovery of any owed contract fee and late charges. Personal Property Tax Belmont Township assesses personal property tax on all seasonal campsite improvements that are made at Lake Joy Campground. The campground owners do not have involvement in the assessment process, which is conducted by the Belmont Township Assessor. Belmont Township has, however, required Lake Joy Campground, LLC. to sign an agreement stating that seasonal campers who have not paid their assessed personal property taxes will not be allowed to camp until all overdue taxes have been paid. These taxes become due in January and July. Notification is sent out by Belmont Township. As per Lake Joy Campground s agreement with Belmont Township, no seasonal campers are to prepare their camper for the 2012 season, occupy their campsite or list their trailer and/or seasonal campsite improvements for sale until all overdue taxes are paid. 2

3 Contract Termination by Seasonal Camper Seasonal campers have the right to terminate this contract at any time by written notice to the campground owners. If such a termination should occur, the seasonal camper agrees to remove all personal property, including the seasonal camping trailer within seven (7) days. Termination of this contract by seasonal campers prior to the end of the current season specified in this contract does not release the seasonal camper from their financial obligation to fulfill the terms of this contract as well as payment of any overdue Belmont Township personal property taxes. There will be no proration, assignment or refund of seasonal fees for early contract termination by a seasonal camper. In the event a seasonal camper vacates their site and has sold their trailer and/or personal onsite improvements to another approved seasonal camper, there is no assignability of prepaid seasonal fees or any other interests afforded under this contract. Sign-In of Seasonal Camping Family An adult seasonal camper must sign-in at the office for the number of camping days or any portion thereof that will be stayed upon entering the campground. Dependent children of a seasonal camping family are not allowed to sign in for their family. If the seasonal camper arrives after office hours, they must sign-in when the office opens the next day. (A seasonal camper s sign-in date must correspond to the date in which the camper arrived on the campground). Current seasonal stickers must be displayed on the outside back window, driver's side of the vehicle. Seasonal stickers will be limited to (2) per family. These stickers are to be used for your primary vehicles. If you have additional vehicles or your dependent children have their own vehicles, you and/or they are required to check-in at the office and obtain a visitor pass for the car. Visitor Policies It is the responsibility of the seasonal camper to make sure that all delivery people, insurance inspectors, subcontracted workers and guests register at the office upon entering the campground and obtain a visitor pass for their vehicle. Each seasonal family signed in on the campground is allowed three (3) guests (adults or children) daily at no charge to the guests. All additional guests (adults or children) shall be charged a reduced day pass fee of $2.50 per guest (13 and older) and $1.00 per guest (5 12 years of age) per day. This policy includes any friends of your dependent children. Guests will be allowed to place tents, pop-ups and trailers on seasonal camping sites with prior approval of the owners. If such arrangements do not require electricity and/or water hook-ups, guests will be charged a reduced overnight camping rate of $20 per family per night. If such arrangements require electricity and/or water hook-ups, guests will be charged current overnight camping rates. Seasonal campers who allow guests to stay in their trailer in their absence must notify the campground owners in advance with the names and dates of the guests who will be staying. Guests who use the Lake Joy Campground facilities in the absence of the seasonal camper will be charged $20.00 per family per night. Friends of any such guests will be charged the campground s normal day pass rates. It is the responsibility of the seasonal camper to inform guests of this policy in advance of their stay. On the following dates, May 25 May 27, July 3 July 5 and Aug. 31 Sept. 2, all guests of seasonal campers are required to pay the reduced day pass fee in place for guests of seasonal campers in order to cover the cost of additional holiday campground expenses. If a seasonal camper wishes to prepay for their guests rather than having the daily or overnight fees collected from their guests, this may be done by prior arrangement at the office. 3

4 Special Event Policy Prior to sending out or extending an invitation, any seasonal camper who is planning to have a "special event" e.g. birthday party, anniversary, employee appreciation party, group picnic etc. must notify the Lake Joy Campground owners of the dates of the event and the anticipated number of people who will attend the event. The Seasonal campers agree to be responsible for adherence to all campground rules for themselves and their guests. This includes maintaining appropriate noise levels and respecting the campground quiet hours of 11:00pm to 8:00am. Seasonal campers who host such events will be responsible for making arrangements with the owners to cover the costs of additional guests (greater than 3) or will take responsibility to inform the additional guests that they will be required to pay a reduced day pass fee at the office. Seasonal campers hosting a special event must clarify with the campground owners how the fees for additional guests will be handled. It is also the responsibility of the seasonal camper hosting the event to leave the event site neat and clean. Acts of God Lake Joy Campground, LLC. assumes no responsibility for damage to any property owned by seasonal campers which results from electrical malfunctions, severe weather, fires, floods or any other acts of God during the term of this contract. Physical Damage Insurance Seasonal campers will obtain at their own expense an appropriate physical damage insurance policy to cover the seasonal camper for loss of any kind to their trailer, building structures, boats, boat trailers, docks, ATV s and golf carts as well as any other personal property of any description owned by the seasonal camper. The campground owners shall not be responsible for any loss or damage to any seasonal camper s property on the campground that is not directly attributable to the owners, employees or subcontractors of Lake Joy Campground, LLC. Liability Insurance Seasonal campers will obtain an appropriate liability insurance policy with adequate limits to cover liability claims resulting from the seasonal camper s family or their guest s negligence pertaining to: Use of any of the Lake Joy Campground, LLC. premises. Use of any trailer, building structures, boats, boat trailers, docks, ATV s and golf carts as well as any other personal property of any description for which the seasonal camper is the owner. Seasonal campers must provide proof of insurance as a part of the annual registration process. Seasonal Campsite Improvements or Repairs Seasonal campers contemplating repairs or improvements to their campsite must first schedule an appointment to meet with the campground owners to discuss the desired repairs or improvements. Seasonal campers must obtain approval on any contemplated repairs or improvements before work on the improvements or repairs begin. Any seasonal campsite improvements or repairs made without prior approval of the campground owners will be removed by the seasonal camper at their expense. Electrical Safety All seasonal campsites are supplied with one 30 Amp plug-in (essential) for a seasonal camper s trailer and one 20 Amp GFI outlet (non-essential) for use with attached rooms, enclosed porches, outdoor electrical equipment etc. All electrical work on seasonal campsites needs to be approved by the campground owners prior to any work being started. All electrical work must be done by a licensed electrician and approved by the campground s electrician, unless otherwise approved in writing by the campground owners, no exceptions. Any electrical improvements found by Lake Joy Campground, LLC. which were not approved and/or were not done, (if required) by a licensed electrician will be considered a complete violation of the seasonal campsite contract.. 4

5 Additionally, seasonal campers recognize that in the interest of electrical safety, they agree to the following: Electrical boxes are soley the property of Lake Joy Campground, LLC. Seasonal campers are not allowed to hardwire electrical cable from their electrical boxes (bypassing breakers) to supply electricity to any part of their seasonal site. No outlets in the electrical boxes are to be altered by anyone other than Lake Joy Campground, LLC. employees or an individual subcontracted by the campground. No extension cords are to be run to boat docks to charge trolling motor batteries. Electrical Usage Lake Joy Campground, LLC. seasonal sites are not metered for electrical usage. Electricity is the campground s single largest expense. Therefore, please make every effort to conserve energy including: Turn off all air conditioners and heaters when you are not on the campground. All outside lights on trailers, attached rooms and porches need to be turned off at 11pm. Decorating seasonal sites with lights is permitted, but please be conservative. Turn off all electrical appliances and air conditioning in your attached rooms and enclosed porches when they are not used. During times of critical electrical issues such as electrical hazard concerns, brownouts or blackouts, Lake Joy Campground, LLC. reserves the right to alter electrical service to seasonal campsites or adopt procedures which will benefit the overall electrical needs of the campground. Such procedures might include but are not limited to turning off electricity to non-essential seasonal campsite improvements such as attached rooms and enclosed porches. When such actions are undertaken by Lake Joy Campground personnel, seasonal campers are not permitted to resupply electrical power to their seasonal campsite until instructed to do so. Any violation of this procedure shall be deemed a breach of this contract agreement. By signing this contract, seasonal campers accept the fact that seasonal campsites will only be provided 30 Amp electrical service to their camping units. Seasonal Campsite Maintenance It is the philosophy of the campground owners to provide all campers with a peaceful, relaxing and natural environment. To meet this goal, the following is our seasonal campsite maintenance policy: Grass cutting and grass maintenance is the sole responsibility of Lake Joy Campground, LLC. The campground contracts with a professional lawn service to provide mowing on a designated day each week. (weather or need permitting) Seasonal campers are not to remow the grass surrounding their seasonal site. (Grass height is varied based on lawn and weather conditions) Seasonal campsite trimming is to be maintained by the seasonal campers using a string trimmer and must be performed at least every other week. Seasonal campers agree not to apply pesticides, vegetation killer, weed killer or fertilizer on or around their sites at Lake Joy Campground, LLC. Seasonal campsites must be well maintained. This includes the seasonal camper s trailer, porches, decks, room additions, fire rings, lawn furniture and any personal items stored onsite. Firewood is to be neatly stacked (not piled) in an amount not to exceed one cord (4 feet wide by 4 feet high by 8 feet long). Any non-used building materials must be concealed and stored out of sight under the trailer or in a storage shed. Non-operational golf carts must be removed from the campground. 5

6 Concerns relative to a poorly maintained seasonal campsite will be discussed with the seasonal camper. Disregard of seasonal campsite maintenance will result in employees of Lake Joy Campground performing any work deemed necessary by the campground owners to make the seasonal site acceptable. Seasonal campers will be billed for any work conducted by Lake Joy Campground employees. Sale of Trailer and/or Seasonal Campsite Improvements If a seasonal camper wishes to place their trailer and/or seasonal campsite improvements for sale, the yearly seasonal campsite contract fees and any oustanding Belmont Township personal property taxes must be paid in full at the time of listing. Prior to advertising, seasonal campers must notify the campground owners in writing of their intent to sell their trailer and/or seasonal campsite improvements. Seasonal campers may sell their trailer on site, with the new buyer keeping the same site, provided the trailer and any site improvements are in good condition and the age of the trailer does not exceed 15 years of age (1997) during the contract term of this agreement. However, site improvements older than 15 years of age in good condition may be sold separately. The sale of a trailer and/or seasonal campsite improvements does not include a dock which will remain under the control of Lake Joy Campground. No "For Sale" signs are to be posted at the seasonal campsite or in or on the said camper and/or site improvements which are for sale. For a one time per season fee of $50.00, an ad may be placed in the Lake Joy Campground Trailers for Sale Binder at the office and online at While all arrangements to show the trailer are the responsibility of the seller, campground employees will assist in giving directions to the trailer and answer general questions regarding seasonal camping. No showings are to be conducted during the months that the campground is closed, between Mid-October and Mid-April of each calendar year. If after a showing, the prospective buyer expresses interest in purchasing a trailer or seasonal campsite improvement that is for sale, they need to meet with the owners of Lake Joy Campground, LLC. The intent of this initial meeting will be to determine whether the prospective buyer meets the campground s criteria for becoming a seasonal camper. This meeting must preceed any further negotiations concerning the sale of the trailer or seasonal campite improvement. The sale of a trailer and/or seasonal campsite improvements does not transfer the seasonal campsite contract to prospective buyers. This must be enacted as a separate order of business by the owners of Lake Joy Campground. Prior to finalization of the sale and any exchange of money for a trailer and/or seasonal campsite improvements, prospective buyers who meet the criteria to become a seasonal camper and the campground owners must meet a second time to review and sign the Lake Joy Campground contract. It is the responsibility of the seller to inform the prospective buyer of this requirement. The Lake Joy Campground owners will not enter into a contract agreement with prospective buyers if this policy is not followed. Meetings with the campground owners to discuss and sign the Lake Joy Campground contract will not be conducted on weekends. Such meetings will be scheduled at a time conducive to the owners operation of the campground. Seasonal Trailer Replacement or Movement Replacement or movement of a trailer on a seasonal campsite must be discussed with the owners of Lake Joy Campground prior to purchasing or moving the unit. Replacement trailers must be 10 years of age or newer (2002). Replacement trailers must not exceed 40 feet in length (including hitch if attached) and 8 feet in width and require no more than 30 Amp service. If a seasonal camper wants to move their current trailer to a different available site, their trailer must be 15 years of age or newer (1997). Seasonal campers are responsible for any costs associated with site preparation or damages to the campground property as a result of the move. Additionaly, any individual who will be assisting in the movement of the seasonal s trailer and/or improvements must provide the campground owners with proof of insurance and sign a release form for liability which might occur as a result of the move. 6

7 Boats and Boat Docks Boat docks cannot be sold, promised to or traded to any prospective buyers or current seasonal campers. Docks are not guaranteed to every seasonal camper and any arrangements for dock space are to be handled separately with the campground owners. Because dock space is limited, you may be required to share your dock with another seasonal camper. If you no longer use your dock, please inform us and we will reassign it. Otherwise, it will continue to be assigned to you from year to year. No new docks or dock modifications may be started without the written approval of the campground owners. Dock maintenance is the sole responsibility of the seasonal camper. Failure to properly maintain a dock will result in the loss of dock privileges and the removal of said dock. Each dock must be identified by the seasonal campsite number or the name of the seasonal camper. If a dock is not properly identified with the seasonal campsite number of the seasonal camper, it will become the property of Lake Joy Campground, LLC. At the cancellation of a seasonal camper s contract or the sale of a seasonal camper s trailer and/or seasonal campsite improvements to another individual(s), the seasonal camper has the right to remove their boat dock from the lake. Any boat dock used by the seasonal camper which is not removed will become the property of Lake Joy Campground, LLC. During the camping season, all boats including pedal boats, rowboats, sailboats, canoes, kayaks, pontoon boats etc. must be in the water at their designated dock, stored on a seasonal campsite or kept in the boat storage area. Boats beached along the lakefront or on racks along the lakefront are not allowed. All boats must be removed from the lake, identified as to the owner and stored in the boat storage area by October 7, Golf Cart & Multi-Use/Work Vehicle Policies For the sake of safety, the following rules apply when operating golf carts & multi-use/work vehicles: All golf carts and multi-use/work vehicles used on the Lake Joy Campground property must be identified by a seasonal campsite number. Golf carts and multi-use/work vehicles may be driven only by a licensed driver (temporary permits are not considered a driver s license). An updated list of licensed drivers between the ages of 16 to 21 that will be driving golf carts or multi-use/work vehicles must be submitted at the beginning of each camping season to the campground owners. It is the responsibility of the seasonal camper to notify the office of guests between the ages of 16 to 21 who will be driving their golf cart or multi-use/work vehicle and provide proof of license for these drivers. No driver should have a minor child sit on their lap to help steer the golf cart or multi-use/work vehicle. Golf carts and multi-use/work vehicles should be used for transportation purposes only. Golf carts and multi-use/work vehicles are not to be used for recreational activities such as races, hide and seek, water balloon fights etc. The number of passengers on a golf cart or multi-use/work vehicle shall not exceed the number of seats on the vehicle, and passengers must remain seated at all times. Golf cart and multi-use/work vehicle operators must obey all traffic signs and posted speed limits. All golf carts and multi-use/work vehicles driven after dark must have operating headlights. Horn use should be for safety and warning purposes only. There is a 9:00pm curfew which prohibits any seasonal campers golf carts or multi-use/work vehicles being driven through the wooded tent area. Drivers should remain on the main roads as much as possible and avoid driving through other campsites. Electric golf carts are not permitted at Lake Joy Campground. It is the responsibility of a seasonal camper to inform their dependent children and their guests of the golf cart policy. Failure to adhere to the golf cart policy as well as any observed or reported reckless behavior will result in the loss of golf cart or multi-use/work vehicle driving privileges at Lake Joy Campground. 7

8 ATV Policies Any seasonal camper who operates an ATV on Lake Joy Campground s property must have their ATV identified by a seasonal campsite number and adhere to Lake Joy Campground s ATV rules. A copy of these rules can be obtained at the office. Any unlicensed driver less than 16 years of age must be accompnied by an adult while driving an ATV on the campground. Additionally, ATVs may only be driven from seasonal campsites to and from the multi-use ATV trails south of the campground. ATVs are not to be substituted for golf carts and driven around the campground to the beaches, office, fishing spots etc. It is the responsibility of a seasonal camper to inform their dependent children and their guests of the ATV policy. Failure to adhere to the ATV policy as well as any observed or reported reckless behavior will result in the loss of ATV driving privileges at Lake Joy Campground. Solicitation No camper(s) may sell products or perform services for which they charge without the prior permission of the Campground Owners. Trash Removal Dumpsters are to be used strictly for everyday household refuse that has been placed in plastic bags. No other items including appliances, building materials, carpets, furniture, batteries etc. are to be deposited in or around the dumpster. Such items are the responsibility of the seasonal camper and must be removed from the campground. Since the campground owners cannot be present at all times to monitor the dumpsters, seasonal campers are expected to demonstrate responsibility in adhering to this policy. Plant Matter Disposal Leaves, grass clippings and plant matter must to be taken to the burn pile by seasonal campers to be properly disposed of by campground employees. Besides the deposit of leaves, grass clippings and plant matter, nothing else can be placed on the campground s burn site without prior permission of the campground owners. Due to smoke that may pose a health hazard to other campers, leaf burning is no longer allowed anywhere on a seasonal site or in the seasonal camper s designated fire pit. Pumping of Trailers Every seasonal site must have a State of Wisconsin certified holding tank hooked up to their trailer for collection of grey and black water discharge. Sign-up for pump-outs needs to be completed prior to 10:00am each Monday. We may not be able to honor late requests for pump-outs. Barring unforeseen circumstances, all weekly pumping will be completed by Thursday evening of the week it is requested. The charge is $12.00 for holding tanks up to 120 gallons and $24.00 for holding tanks over 120 gallons. The charge for emergency pumping of holding tanks is $30.00 and will only be performed schedule permitting. Seasonal Campsite Contract Interpretation and Violations Owners may make additional rules or changes to present policies governing Lake Joy Campground as campground owners deem necessary in order to protect the interests and safety of other seasonal and overnight campers as well as those of Lake Joy Campground, LLC. Seasonal campers agree to observe and comply with all additional rules and changes to present policies. In addition, by signing the seasonal campsite contract, the seasonal camper agrees to abide by the explanation of the seasonal campsite contract by the campground owners or their legal representative, not the seasonal camper s personal interpretation of said document. Any violation of the campground rules shall be deemed a breach of this contract agreement. Campground owners shall have the right to cancel a seasonal camper s contract agreement for violations of said contract. The campground owners also reserve the right to cancel a contract agreement with any seasonal camper who does not properly maintain their site, is habitually late in paying their seasonal contract fees or annual Belmont Township personal property taxes, engages in vulgar language, inappropriate conduct or has violated other rules contained within this contract which are deemed by the campground owners to be significant enough to warrant cancellation of their seasonal campsite contract. 8
