1 DECISION AND ORDER 2015 NSUARB 228 M07085 NOVA SCOTIA UTILITY AND REVIEW BOARD IN THE MATTER OF THE MOTOR CARRIER ACT -and- IN THE MATTER OF THE APPLICATION of PICTURE PERFECT TOURS LIMITED to amend Motor Carrier License No. P03067 BEFORE: ~id J. Almon, LL.B., Member DECISION AND ORDER WHEREAS Picture Perfect Tours Ltd. ("Picture Perfect") of Halifax, Nova Scotia, made an Application to the Nova Scotia Utility and Review Board ("Board") requesting to amend its Motor Carrier License No. P03067 ("License"), by expanding its existing Charter services and amending its rates, including the addition of deadhead charges, as set out in the attached Appendices "A," "B," and "C," and as summarized below: 1. Expand Charter Service to remove the restriction of originating and terminating within the Halifax Regional Municipality ("HRM") to the proposed authority to read as follows: The transportation of individuals or organized groups on sightseeing travel tours organized and promoted by Picture Perfect Tours Ltd. All tours originate in the Halifax Regional Municipality to points across the Province of Nova Scotia, one way or return. 2. Increase the stated rates for Full Day Tours (5-8 hours) category from $110/$140 to read "$11 0/$145"; and

Amend Charter rates by adding "Deadhead Kilometre" charges of $1.25/$1.75 AND WHEREAS after the Application was received by the Clerk of the Board on September 18, 2015, under the Board's direction, the Notice of Amendment Application was published in the Royal Gazette on September 23, 2015, posted on the Board's website, and forwarded to licensed carriers by , fax or letter; AND WHEREAS no objections to the granting of the Amendment Application were received by the Board by the stated date of September 30, 2015; AND WHEREAS Picture Perfect stated the reasons for the amendment are: "Photo tour groups originating in Halifax are requesting travel points outside the municipality; e.g. the recently opened Black Loyalist Heritage Centre located at 119 Old Birchtown Road, Shelburne, NS." AND WHEREAS the Board considered the Amendment Application and filed information without a public hearing on October 1, 2015; IT IS ORDERED THAT: 1. The Amendment Application is approved effective immediately. 2. Schedule B(1) shall be deleted and replaced with Appendix "A"; 3. Schedule 0(1) shall be deleted and replaced with Appendix "B"; and 4. Schedule F(1) shall be deleted and replaced with Appendix "C". DATED at Halifax, Nova Scotia this 1st day of October, 2015.

4 -4- Appendix "B" RATES 0(1) RATES RATES, TOLLS, AND CHARGES Packaged Tours Half Day Tour (3-5 hours) $75/$105 Full Day Tour (5-8 hours) $110/$145 Professional Portrait Tour (3-5 hours) $300/$800 Kayak or Cycling Tour including rental (4-8 hours) $120/$180 Surfing & Portrait Tour including rental and lesson (4-8 hours) $200/$400 Custom Tours Base daily rate $325 Per km travelled (live) $1.25/$1.75 Per km travelled (dead) $1.25/$1.75 Note: deadhead kilometres are calculated from the equipment point located on North Park Street, Halifax Additional Driver/Guide $115/$150 per night Driver/Guide Meals $40 per day per driver/guide Charges are the greater of the kilo metric charges or the applicable daily rates. Additional Charges and Discounts: All ferry, bridge tolls, parking and toll highway fees, applicable taxes and activities/entrance fees (e.g. sea kayaking, surfing, museums, National Historic Sites, sailing, cycling) provided these are not otherwise paid for by the customer. Charges for organizing the tour and tour preparation, such as booking activities. Airport pickup or drop off $65/$95 (extra flat fee per trip)

5 - 5-0(1) continued Cancellation Charges Children 12 & under receive 50% discount on "Packaged Half Day and Full Day Tours" only. Destination Halifax convention delegates with the "Show Your Badge" program receive 10% discount on "Packaged Half Day Tours" only. At the discretion of Picture Perfect Tours Ltd., a person(s) chartering a tour to familiarize travel agents, travel writers, tour operators and/or tourism department and agency employees with Nova Scotia and/or the Atlantic Provinces may pay reduced tariff charges, as defined by the company. If any group or person cancels a tour within 48 hours of the scheduled departure date, they shall pay 50% of the tour price and the applicable taxes. Cancellation before 48 hours in advance will result in full refund minus 1 0% booking fee & the applicable taxes. "Additional Charges & Discounts" and "Cancellation Charges" apply to Packaged and Custom Tours Effective this 1ST day of October, 2015.
