1 Gavin Newsom, Mayor Recreation and Park Commission Minutes September 21, 2006 President Gloria Bonilla called the regular meeting of the Recreation and Park Commission to order on Thursday, September 21, 2006 at 2:15 p.m. ROLL CALL Present Gloria Bonilla Tom Harrison Jim Lazarus Meagan Levitan Larry Martin John Murray Absent David Lee PRESIDENT S REPORT On behalf of the Commission, Commissioner Bonilla presented a Certificate of Retirement to She-Yuen Won. GENERAL MANAGER S REPORT The General Manager accepted the following gifts on behalf of the Department in accordance with the gift policy: A donation of toys and equipment to the Richmond Recreation Center by the Planning Association for the Richmond (approximate value: $1,600) Mr. Agunbiade introduced Margot Shaub, the Department s new Director of Partnerships and Resource Development. She is an experienced public relations strategist and fundraiser and has worked as a political relations adviser to a number of Bay Area elected officials, also serving as West Coast Finance Director for the 2000 Bill Bradley for President Campaign. She has extensive experience in project management and development including work with the Federal Emergency Management Agency, the Department of Housing and Urban Development and, most recently worked as the Director of Public Affairs and Development for a San Francisco public charter school. She was the Director of California Special Projects for Senator Dianne Feinstein in San Francisco and served as senior staff for the Senator in Washington DC for more than four years. Palou Phelps Encroachments Several months ago, staff observed several structures on Palou Phelps open Space without the knowledge or permission of the Department. The structures were associated with the activities of a nearby residence. Staff observed two sheds, carport, and parked cars on the flat, southeasterly portion of the open space. Staff pursued the matter with the Department of Building Inspection, and all of the structures have now been removed from Recreation and Park property. Report by: Daniel LaForte, RPD Planner

2 Howard Langton Mini Park In July 2006 the Commission approved a recommendation to the Planning Commission that the shading from the Trinity Plaza Project on Howard-Langton Mini Park and Civic Center would not be significant or adverse. As a condition of its resolution the Commission required Trinity Properties, Inc. ( Sponsor ) to reach an agreement regarding improvement measures to the Mini Park that is satisfactory to the General Manager of the Recreation and Park Department. In August 2006 the Sponsor and the GM entered in to an agreement on specific improvement measures, including a $20,000 allowance for ongoing support (see attached). Howard-Langton Community Garden members provided many of the ideas for the improvement measures. Bill Wilson gave a brief report on the Park, Recreation and Open Space Advisory Committee. CONSENT CALENDAR Commissioner Lazarus requested that items 4 B and C be moved to the general calendar. On motion by Commissioner Lazarus and duly seconded, the following resolutions were adopted: RES. NO RESOLVED, That this Commission does approve the minutes of the August 2006 meeting. RES. NO RESOLVED, That this Commission does approve a request by Black Rock Arts Foundation for the temporary installation of Stan, Submerging Man in Victoria Manalo Draves Park for six months. RES. NO RESOLVED, That this Commission does approve an improvement agreement to allow Jamestown Avenue Associates, LLC to construct and maintain a retaining wall and drainage improvements on the east slope of Bayview Park in association with a residential development project on Jamestown Avenue. RES. NO RESOLVED, That this Commission does approve the conceptual plan for construction of a new trail and overlook at the northeast end of Lake Merced s East Lake. RES. NO RESOLVED, That this Commission does decommission the community garden plots in Juri Commons Mini Park.

3 RES. NO RESOLVED, That this Commission does increase the contract amount for Sean Smith Engineering by up to 15 percent from $248,290 to $285,534 for change orders in the renovation of the park. RES. NO RESOLVED, That this Commission does confirm the authority of Pacific Gas and Electric (PG&E) to install, operate and maintain its facilities within Golden Gate Park to provide permanent power to the Music Concourse Underground Parking Facility (Garage), and to provide permanent power to the California Academy of Sciences (Academy) in the alignment previously approved for temporary construction power in October GENERAL CALENDAR STOW LAKE Bruce McClellan stated that the Stow Lake Corporation had previously requested a one-year extension and that he was there to request that extension again. He believed the RPF was flawed and stated that it was not responsive to the operations of Stow Lake. On motion by Commissioner Lazarus and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve the issuance of a revised Request for Proposal for the lease and operation of the Stow Lake Boating concession. ST. FRANCIS YACHT CLUB LEASE Emeric Kalman requested that the Commission postpone this item for further study. He stated that there was not enough time to review the lease. He stated that missing from the documentation was a financial audit and asked why the revenues from operating the restaurant are not shown in the lease. On motion by Commissioner Murray and duly seconded the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve a new 40-year lease with the Saint Francis Yacht Club. FERRY PARK TO BE NAMES SUE BIERMAN PARK Sue Bierman passed away on August 7, 2006 after a fatal car accident in Cole Valley. She was 82 years of age. Ms. Bierman was a tireless activist and friend to many. She was the quintessential San Franciscan. She stood up for what she believed, was fiercely loyal and sought to make a difference in the City and in her community. As a resident in the Haight Ashbury Neighborhood in the 1950 s and 960 s, Ms. Bierman fought against freeway expansion through Golden Gate Park s Panhandle. In September 2001, after Ms. Bierman s time on the Board of Supervisors termed out, the San Francisco Recreation and Park Commission at the request of then Mayor Willie L. Brown, Jr., dedicated a small grove of trees, grass, benches and a plaque which reads: Dedicated September 5, 2001 to Honorable Susan J. Bierman, This beautiful grove of trees and greenery honors a true champion, who brought the neighborhoods together in an eight-year struggle to preserve the panhandle. Victory and what the nation called San Francisco s Freeway Revolt came in 1966 when, by one vote, the Board of Supervisors rejected plans to pave a freeway through this wooded Panhandle to Golden Gate Park. With the same courage, fervor, and concern for the City she loves, she served as a member of the San Francisco Planning Commission from1976 until 1992, and as a Supervisor from 1993 until She also worked tirelessly with others to get Block 202 of the City s Master Plan, the site of the former freeway ramps off Embarcadero between Clay and Washington to become a park, one of the only green open spaces in the financial district. Today, that park is known as Ferry Park. Ms. Bierman also served 16 years on the City s Planning Commission, championing causes such as affordable housing, child care and parks in a pro-development atmosphere. She paid attention to what the

4 regular person cared about and fought to be a voice of the people. By all accounts, running for supervisor in her sixties was unique. At a time when most people are departing from stressful jobs, she was taking on one. Even after she termed out in 2000, she still continued to fight for quality if life issues, appear at Board and Commission hearings and stay active with her family and friends. Supervisor Tom Ammiano introduced an ordinance at the Board of Supervisors to rename the area now known as Ferry Park to Sue Bierman Park as fitting tribute to honor Ms. Bierman. The action before the Commission today is to support that Board Ordinance. Eula Walters spoke against this item. She stated that she saved Ferry Park. She then discussed the renovation of Ferry Park. William Wilson was angered that there was even a question in anyone s mind that this park should be named after Sue Bierman. She would be the first one to not make personal attacks. He asked that the Commission support the Board s Ordinance. Patricia Vaughey stated that Sue Bierman did fight for the park and it deserves to be named after her. On motion by Commissioner Levitan and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does support the Board of Supervisor s Ordinance introduced by Supervisor Ammiano to rename the area now known as Ferry Park to Sue Bierman Park with the following amendment: on page two line 7 delete the words at the eastern terminus of Market Street and add between the Embarcadero, Clay, Davis and Washington Streets. ROLPH PLAYGROUND AND POTRERO DEL SOL PROJECT The Department of Public Works advertised the James Rolph Clubhouse and Playground renovation and Potrero del Sol Park improvements on June 28, Although the bid date was extended from July 26, 2006 to August 16, 20026, no bids were received. Upon the receipt of no bids, the San Francisco Administration Code allows staff to negotiate a construction contract with qualified bidders as long as the final negotiated price does note exceed the project construction budget. Staff has negotiated a bid with Angotti and Reilly in the amount of $3,408,663 for the base bid contract. Angotti and Reilly s bid meets the HRC subcontracting goal of 14% DBE participation. No alternates will be awarded. Jeanne Darrah asked the Commission to move this forward and to seriously look at the alternates for this project as they are much needed. On motion by Commissioner Martin and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does award a construction contract in the amount of $3,408,663 to Angotti and Reilly for improvement to Rolph Playground and Clubhouse and Potrero del Sol Park. MCLAREN PARK JERRY GARCIA AMPHITHEATER This is a request from NextArts to produce five, free evening concerts at McLaren Park on September 22 and 29, 2007 and October 6, 13, and 20, This is also a request to modify the amplified sound policy and permit amplified sound between the hours of 6:00 to 9:30 p.m. and a request to sell wine. The expected number of attendees is 300 people per concert. Possible food sales include hot dogs, cotton candy, beverages and wine. Anthony Imperial and Casey Moreno, the principals, of NextArts, have done several successful events over the years including International Women s Day and Rock the Vote. Tony Imperial stated that he was available to answer any questions. On motion by Commissioner Levitan and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve a request by NextArts to: 1) produce five, free evening concerts at McLaren Park (September 22, 29, and October 6, 13, 20, 2007), 2) a request to modify the amplified sound policy and permit amplified sound between the hours of 6:00 to 9:30 p.m. and 3) a request to sell wine.

5 LAKE MERCED BOATHOUSE The Boathouse at Lake Merced is a 15, 200 square foot building built in The upper floor has a restaurant facility that has been vacant since The lower level of the facility included boat storage for boating clubs that use the lake. A separate concession in the past provided boating and fishing services including boat rentals and fish stocking of the lake. The completion of the Harding Park Golf course upgrades and the improved water levels at the Lake make this a good time to seek a new tenant to rehabilitate the Boathouse. Interest has been expressed in a wide range of uses that vary significantly in their economic feasibility. The building is in need of substantial upgrades and it may be better to rebuild than renovate. A mixed-use project is also possible. To evaluate the prospects for the Lake Merced Boathouse, staff prepared an analysis of comparable projects and use options. Comparable recreation projects have secured substantial grant or philanthropic funding for their capital costs. There is an inherent tension between the desire for low cost public recreation programs and need to generate enough revenue from the site to fund capital improvements. Prior operators failed to have viable commercial operations with the existing facilities. Although the Department does not have capital or operating funds for this project, a lease can be structured to require the tenant to upgrade the building and operate it, enhancing the recreational services available at Lake Merced. Given the expected need for substantial investment to upgrade the building a long-term lease is required. Additionally, the project will require CEQA review and other land use reviews. With the complexity of the project, a well-funded partner that can demonstrate real estate development and facility operations capability is necessary. On September 12, 2006, a public workshop was held to discuss the policy priorities for the project. Approximately 70 people attended. The community is very concerned about how long the building has been closed and would like it to be retuned to use. Questions were raised about how the Boathouse project relates to the master planning efforts for Lake Merced. Colleen Flynn with the Neighborhood Parks Council stated that they were excited about moving this forward, but believed that the Department should coordinate efforts with the PUC s Lake Merced master plan and that the Department should try and maximize the revenue at the boathouse along with the community s expectations of what the boathouse should be used for. Bert Polachi representing the owners and managers of the Park Merced Apartments and a board member of the Stonestown YMCA urged the Department to put the RFP out and to strongly consider recreational uses. Tim Colen, Vice Chair of the Lake Merced Task Force stated that they could not support the RFP without the approval of the PUC. He said that there was no context to put the RFP out without the master plan. Dick Allen stated that the Commission needed to move forward with the RFP. He stated that the one issue that has not been brought up is the convergence of traffic into Harding Park. Emeric Kalman stated that Lake Merced is the City s emergency drinking supply. Before anything is developed of a recreational nature the Department should be working with the PUC. Robert Strong believed this to be a golden opportunity to develop a most wonderful asset and natural habitat in San Francisco. Commission members commended staff and encourage them to move forward and find partnering opportunities. This does not necessarily have to be a cash cow but the priority should be as a recreational use and not compete with Harding Park restaurant. The Commission asked staff to find out within the next 30 days the status of the PUC master plan and if there is a way to participate with them without delaying the issuance of a RFP. MUSIC CONCOURSE SURFACE IMPROVEMENT PROJECT The Recreation and Park Department is undertaking the restoration and enhancement of the Music Concourse in Golden Gate Park with its Surface Improvements Project. Three acres of land are being added to park landscaping with the removal of on-site parking, narrowing of roadways and reduced building footprints of the de Young Museum and California Academy of Sciences.

6 Consistent with Golden Gate Park s Master plan, the Music Concourse has been redesigned to enhance pedestrian enjoyment, increase accessibility and improve safety. New utility infrastructure is being installed to serve the area. Coordination has been critical in accommodating re-construction of two major institutions in the Concourse, the de Young Museum reopened in October 2005 and the California Academy of Sciences is reopening An 800-car underground parking facility has been introduced to the Concourse to serve these institutions. Work for the Surface Improvements Project is situated between the institutions and over the garage. The Recreation and Park Commission previously approved the award of contract to Swinerton Builders, Inc. on November 18, Construction commenced in May 2005, with an anticipated completion date at the end of June Project costs, including planning, design, construction management, construction and contingency total $9,030,000. The Golden Gate Park Concourse Authority has secured a pedestrian and bicycle safety grant to re-stripe JFK Drive to accommodate parking, bicycle and vehicle lanes with traffic gores for calming and welldefined pedestrian crosswalks. The poor surface condition of the roadway makes re-striping impractical until JFK can be repaved. The Board of Supervisors originally approved the appropriation of $500,000 in the 2006/06 budget to repave portions of JFK Drive in July The Commission approved an increase to the Surface Improvement contract to facilitate this work since this repaving work was not part of the original scope in June Because of deteriorated paving conditions on JFK Drive and 8 th Avenue, these funds would pave JFK Drive between Conservatory Drive East and 10 th Avenue. The Mayor s Office and the Board of Supervisors are pursuing additional funds to extend the paving to include the entire area between Conservatory Drive East and Transverse Drive. If funds are made available, this work would proceed in early/mid-october 2006, with striping to follow. The revise project budget for the Surface Improvement contract would increase and additional $600,000 from $9,530,000 to $10,130,000. On motion by Commissioner Levitan and duly seconded the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve an increase to the base construction contract with Swinerton Builders, Inc. for the Music Concourse Surface Improvement Project by $600,000 (from $6,500,000 to $7,100,000) to repave JFK Drive from Conservatory Drive East to Transverse Drive (including 8th Avenue between JFK & Fulton). KIMBALL PARK This is a request by the San Francisco Redevelopment Agency to produce a free concert with local bands (jazz, swing, and salsa/mambo) and a BBQ cook-off contest on October 8, 2006 from 11:00 a.m. to 7:00 p.m. They are also requesting to sell food, beverages and alcohol. The event will be an amplified sound music event open to the public and free of charge. Reverend Arnold Townsend gave some history of this event spoke in support of this item. Alicia Bert with the Redevelopment Agency echoed the previous speaker s comments. On motion by Commissioner Levitan and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve a request by the San Francisco Redevelopment Agency to produce a free concert with big local bands (jazz, swing and salsa/mambo music) and a BBQ cook-off contest on October 8, 2006, from 11:00 a.m. to 7:00 p.m., and a request to sell food, beverages and alcohol. UNION SQUARE AND JUSTIN HERMAN PLAZA This is the third World Can t Wait event to be staged in San Francisco. Previous events were presented in Joseph L. Alioto Performing Arts Pizza, on November 2, 2005 and Union Square on January 31, 2006.

7 This is the first event permit request for two sites and for an all-night vigil. The proposed event is to publicize and protest the national and international policies of the current presidential administration. The event s proposed program will include political rallies, speeches, a parade/march, artistic performances, and literature over the course of the requested 28-hours. Permit applications for both sites include request for booths to be set up at each location. The amplified sound request in this Permit Application would require modification of the current amplified sound policy for events at Union Square and Justin Herman Plaza. The current amplified sound policy states: Amplified sound may be permitted in Union Square, Embarcadero Plaza and Civic Center on weekdays, Monday through Friday, from 12:00 noon to 1:30 p.m. only. However, if the permittee is unable to schedule the event in Union Square between 12:00 noon and 1:30 p.m. on a weekday, amplified sound may be permitted in that unit for a maximum of two hours in the evening between 5:00 and 9:00 p.m. The additional staff concern regarding this permit application is the public safety issue regarding crowd capacity at Union Square. Per the San Francisco Fire Department, the event capacity at Union Square is 3,200. The following inconsistencies exist among World Can t Wait s declared attendance numbers for their Union Square permit request: 4,000 to 10,000 attendees stated to be gathering at Justin Herman Plaza (the starting point of the march to Union Square) 4,000 participants stated in the San Francisco Police Department Parade Permit Application as the number of marchers from Justin Herman Plaza to Union Square 3,000 attendees stated in the event Permit Application as the number of participants at the rally at Union Square As stated, the SFFD capacity at Union Square is 3,200. On any given day there are hundreds of people who gather or transit Union Square during the late afternoon- especially during the warm weather season. Factoring in such regular visitation, even the lowest number among the range of inconsistent attendance numbers for this event would be within Union Square maximum capacity. The Department s experience with the two previous World Can t Wait events included both Permit violations and event production problems: At Joseph L. Alioto Performing Arts Piazza the event violated their amplified sound permit by continuing amplified sound past the 1:00 p.m. cut-off time. In deference to Senator Migden s speech, a 30-minute extension to 1:30 p.m. was granted; however, amplified sound continued until 2:40 p.m. At Union Square, the Department participated in extensive event planning with World Can t Wait along with SFPD, SFFD, and MJM Management. Of particular concern was a 50 ft. paper mache effigy of President Bush that was to be the centerpiece of the rally and then toppled by rally participants. After several meetings and seeming agreement on fire retardant construction and public safety concerns, on the day of the event the permittee brought a 40 ft. metal ladder wrapped in chicken wire with an effigy head at the top which they wished to knock over onto Union Square during the vent. This unilateral change in event risk factors created a host of public safety concerns that all agencies then had to scramble to address. Stephanie Tang with World Can t Wait stated that they are demonstrating in cities across the country on the day of the request approximately 60 cities. She stated that they do expect large numbers of people to attend and the numbers on the permits were based on experience from last year. She discussed one of the issues that Mr. Kern brought up. Ima Davis an organizer with World Can t Wait, strongly feels that the event should take place at Union Square. Selywn Jones spoke on the current war, his opposition to it and explained why he is working with World Can t Wait. He asked for permission to use public space for this event. Giovanni stated that what a previous speaker was trying to say when her time ran out is that she received a call from the SFPD saying that they would deny all march permits on the grounds of homeland security. Mitch stated that it is important to have it at Union Square as it is in the heart of the City. The Commission members noted their support and addressed their concerns with the request. On motion by Commissioner Murray and duly seconded the following resolution was adopted:

NO RESOLVED, That this Commission does approve the following permit for World Can t Wait s application: 1) Justin Herman Plaza from 8:00 a.m. October 5, 2006 until 12:00 p.m. October 6, 2006 for an event consistent with the description in their Event Permit Application, 2) modification of the amplified sound policy to allow amplified sound at Justin Herman Plaza from 12:00 to 1:00 p.m. and then again from 7:00 to 9:00 p.m. on October 5; and also to allow amplified sound from 9:00 to 11:00 a.m. on October 6, 2006 with no use of handheld bullhorns permitted outside of these hours and does deny the Union Square Event Permit Request due to the public safety concern of stated anticipated attendance exceeding maximum venue capacity. ALAMO SQUARE This is a request by Sean Boyle to produce a free Alamo Square Movie Night on Thursday, October 5, 2006 from 7:00 to 10:00 p.m. and a request to modify the amplified sound policy and permit amplified sound from 7:00 to 10:00 p.m. Local residents and neighborhood organizations are in support of this request. This event is designed for the local community. There will be no advertising of this event in an effort to maintain attendance from local residents. The movie shown will be a classic. Donations for popcorn and hot chocolate will help to offset the costs of the permits and movie licenses. Emmett Gilman President of the Alamo Square Neighborhood Association spoke in support of this item. He stated that the board did hear the proposal by Mr. Boyle and voted to support it. On motion by Commissioner Murray and duly seconded, the following resolution was adopted: RES. NO RESOLVED, That this Commission does approve Sean Boyle's request to produce a free "Alamo Square Movie Night" on Thursday, October 5, 2006 from 7:00 to 10:00 p.m. and a request to modify the amplified sound policy and permit amplified sound from 7:00 to 10:00 p.m. President Bonilla acknowledged and welcomed Supervisor Mirkarimi. The Supervisor extended his appreciation to the Commission for their work in expediting the consideration of the Hayes Green renaming to Patricia s Green. RECREATION AND PARK DEPARTMENT- PERMITS AND RESERVATIONS Staff gave a power point presentation discussing: 1) Permits and Reservations Issues, 2) Findings, 3) Resolutions to Building Capacity and 4) Direction. Permits and Reservations Issues Works with paper trail systems and/or computer systems that are under utilized There are more teams and organizations demanding the use of the fields than the supply Very little agency cooperation exists between the City, the school district, and the private schools located in the City in all areas of facility use Adult non-resident use San Francisco fields Findings Supply is less than demand Difficult to quantify reservations use without computer systems Little time to improve field conditions due to demand Without large land mass availability, solutions are difficult Potential of athletes playing for more than one team is great Permits and reservations tracking will be corrected with the implementation of the CLASS reservation software Important to determine how to manage field use by non-resident users Fields are used when weather and field conditions are not favorable Fields need to be reserved equitably base on actual need Need to program for girls and women is imperative

9 Resolutions to Building Capacity CLASS Reservations System Installation of Field Turf on destination fields Change the game rules to economize time Required closures to restore soccer fields Fee increases for reservations has helped ration fields Field Turf on lighted fields Maximize Directions Staff asked for direction on the following: 1) how to position the Department for non-resident play and fees, 2) strategies for youth fees for field reservations, school district and parochial school use, 3) staffing up for field maintenance and 4) the need to increase field programs for girls and women. The Commission members discussed their concerns with staff: 1) the collecting of information from the users of the fields and look at what people want vs. what we are booking, 2) enforcing the permit usage, 3) basis for charging fees, 4) when, if ever are fees not charged, 5) no fee for youth groups, 6) breakdown of organizations that charge the youth groups, 7) non-resident leagues playing each other on Department fields, 8) effective control of use of fields, 9) going directly through the recreation director and not through the system, and 10) the Department staff s response time in confirming reservations. Patricia Vaughey stated that one of problems was that on the application form there was not but should be a place to list the name of the coach and if the group is for profit or nonprofit. PUBLIC COMMENT Margaret with the Golden Gate Seniors Club spoke of their concerns of where they will go once the Moscone Recreation Center is closed for renovation. Patricia Vaughey stated that her concern with this is that another park the Department gave the community trailers. They have been asking for trailers also. She also stated that she thought the Department should have public comment at the beginning of the meeting. Donald Bird stated that on behalf of the Mexican Consulate of San Francisco, Safe Clean and Green, the Dolores Heights Improvement Club and Friends of Dolores Heights he is presenting to the City and County of San Francisco a grant of $5,000 to construct a new enclosure to surround the Father Miguel Hidago statue in Dolores Park. Bill Palmer discussed two items: 1) parking in the Marina Green has become intolerable since Fort Mason changed to paid parking and the commuters that park take most of the parking and 2) life safety issues in the Marina. William Wilson talked about the ground breaking at Sunnyside. COMMISSIONERS MATTERS Commissioner Murray requested that staff report back to the Commission on possible alternatives in regard to golf that will resolve the problems the Department has before the six-month allocation is gone. Commissioner Lazarus asked that 1) the Brooks Park issue come back to the Commission, 2) the commission attendance policy come forward, 3) at Boeddeker Park on the Ellis Street side at night it is a camping zone and 4) in regard to the Marina Green, he hoped that the Department would revisit time limitations or revenue sources for the Marina Green.
