Snakes on a plane was fiction, but rattlesnakes in Tucson As if the are scene a reality. was suddenly "Photoshopped", the ticketing traffic cameras were quickly removed from Tanque Verde Road before they were ever activated. The cameras were placed during the reconstruction of the road just at the top of a small rise in the street. The cameras were not part of the construction plans and the Community Advisory Committee knew nothing of the intent to install the cameras. Pima County officials said that the cameras will be "relocated" somewhere else, but a decision as to the new location has not been announced. The cameras were removed after the Bear Canyon Neighborhood Association (of which the Lakes is the largest member) and some citizens complained that there has been little traffic problems on Tanque Verde Road that would necessitate stronger traffic enforcement. They also noted that the flash from the camera would shine into resident's homes. Fun in the Lakes According to KVOA, the County will modify its selection process to ensure impacted residents have an opportunity to voice any concerns prior to installation. The process will also include both pre- and post-construction speed studies. The Pima County Sheriff's Department will be directly involved in recommending appropriate placement of the cameras. Repairs Repairs to the west gate house, caused when a truck that was too tall to fit under the overhang, have been finished. The offending company s insurance covered all costs. In addition, the $6,000 cost of replacing the mechanism at the exit only gate (when a car hit it) has also been reimbursed by the owner s insurance company. Soon the ghosts & goblins will appear on the streets of Castle Rock. In addition to opening our doors to all those Trick or Treaters that come by, the Lakes is having our 4th annual community haunting. How does it work? You adorn the exterior of your house in the best All Hollows Eve decorations and a panel of judges will come around the evening of Saturday, October 29th to view your handiwork and give out prizes for the top 3 winners. Our annual Yard Sale will be held on Saturday, Nov 5 (7:00 am - noon). We will advertise the sale in local media and open the gates at 7:00 am. Anything you don't sell and you don't want should be brought to the Rec Center at noon for donating to Value Village. They will have a truck to collect the "leftovers" (or anything else you wish to donate) from the yard sale.

Emergency vehicles would not be able to get close enough to an incident if vehicles are parked there. This is especially true if the cars are left perpendicular to the curb. Cars and trucks parked in such a manor are subject to ticketing and towing. Please remind your guest not to park in the cul-de-sac. Do not let your dogs and cats roam. Coyotes, bobcats and other various predators (to say nothing about cars) are a constant in the neighborhood. Domestic pets are to be carefully watched over when outside in this area. Dogs must be on a leash at all times (city and neighborhood regulation). Annual Lakes Community Yard Sale Saturday, November 5 7 am - 12 noon The yard sale will be advertised and the gates will be open. 5 P A G E 5 Volunteer Now The Homeowners Association invites you to participate on one of our several community committees. These committees help create plans and solve issues in regards to many important projects. Openings include: Newsletter - gathers, writes and helps publish this new formatted, electronic newsletter. Design Review Committee - Reviews and approves requests from homeowners to make design changes to their properties such as changing their house color, putting on an addition, putting in a pool, etc. Landscaping Committee - Addresses issues with and makes future plans for the landscaping within our community. Lakes Committee - Addresses issues with and makes future plans for the lakes within our community. Parking Committee - Addresses issues with and makes future plans for the parking rules and provisions within our community. Security / Gate Committee - Addresses issues with and makes future plans for the security within our community, including issues with the entrance and exit gates. Roads / Walkways Committee - Addresses issues with and makes future plans for the roads and walkways within our community. Recreational Facilities Committee - Addresses issues with and makes future plans for the recreational facilities within our community including the Rec Center, Fitness Center, and surrounding areas. Social / Welcome Committee - Plans community events, such as the annual yard sale, and coordinates activities for welcoming new homeowners to the community. Reserve Study Committee - Determines long-term budget needs for the community in regards to capital items. Many of these committees have only one or even no representatives. Board welcomed homeowners. HOMEOWNER INPUT The Board introduced themselves to the homeowners who were present. Flappers are missing on the skimmers at the pool. The irrigation in the median at the west lawn gate is not working properly. There is some broken curbing by the lake. Resident needs a key to the tennis court. The right hand turn lane onto Tanque Verde has been backing up to the street. Dogs have been running lose on the property. One homeowner was attacked while riding his bike. A dog station is needed near the west gate. Homeowner questioned when the construction on Tanque Verde would be finished. It is due to be finished at the end of September. Homeowner was complaining about weeds on a property near her home and inquired as to how long it takes for the Association to make a homeowner clean up their property. The Board explained how the first notice, second notice, etc., works. Homeowner has an issue with parking on her cul-de-sac. Board discussed options to take care of the problem. Homeowner also commented that homeowners who pay their dues and express concerns seem to get nothing but lip service from the Board. CALL TO ORDER Meeting was called to order at 7:00 p.m. LANDSCAPE COMMITTEE Chris Kaselemis informed the Board that he had had a meeting with the landscape committee two weeks ago. He also informed the Board that sometimes the crew does not always see the big picture on the property and requested that the field crew drive through the main street when they are on site and take care of big things, such as broken branches, etc. Chris Kaselemis also requested that Management Representative provide John Henry with some business cards that can be handed out to homeowners who sometimes interrupt the crew with issues. That way, homeowners can contact Management Representative and problems can be addressed. Chris Kaselemis also had informed the landscaper that sometimes it seems like Jason puts small, new jobs ahead of work that needs to be done on the property and since The Lakes is a big account; he requested that not happen in the future. 8 P A G E 8 Board Minutes Continue From Page 7... Chris Kaselemis also discussed the price of the bid for the eucalyptus trees. Landscape representative informed the Board that the company had dropped the price to $200. Board requested that the landscaper send the invoices to the Management Representative. There is also a dead tree behind the fitness center. Some of the branches on the sidewalks are low and should be trimmed so that everyone has enough headroom to get under trees. APPROVAL OF MINUTES Motion (Kellman/Schuldenfrei) to approve the minutes from July as amended. MOTION PASSED. FINANCIAL REPORT The financial report shows that the Association is in good financial shape. Motion (Schuldenfrei/Baker) to accept the Financial Report for July MOTION PASSED. MANAGER S REPORT Written report submitted to the Board. COMMITTEE REPORTS DRC The committee had approved a 10 x 14 sail shade for one property. The committee had also received a request from one homeowner to install a flagpole and a flag. According to policy, the flag pole cannot be higher than the eaves on the home. Board made a decision to include information regarding installation of flagpoles and flags in the Association s guidelines. Landscape Previously discussed. Lakes - The lakes are in good shape. Security/Gates The pavers at the east gate are uneven. The security company is trying to contact the original contractor to repair. Antech is also installing a camera at the west gate on Thursday to help establish responsible parties that are hitting the arms at the gate. Roads/Walkways There are broken curbs that need to be repaired but the cost was not in the budget. The Board will have to review next year. Recreational Facilities The Board is concerned about making sure that the skimmer at the spa is not leaking. There was a homeowner who was fishing in the lake whose line kept getting hooked. He eventually discovered 16 chairs that had been dumped in the lake but the chairs were so damaged that they had to be thrown out. Communications Steve Schuldenfrei furnished a report to the Board. He noted that the mailing to homeowners whose is not on file (and therefore not receiving notices and the newsletter) was very successful. A 30% return was achieved and now we are reaching over 80% of the homeowners via . Social/Welcome Shirley Henning did not attend the meeting. She had informed the Board that there was one new homeowner she planned to meet the following week. Motion (Schuldenfrei/Kellman) to request that Shirley join the Board. MO- TION PASSED. OLD BUSINESS Proposed Collection Policy from Cadden Management Decision had been postponed from the last Board meeting. Motion (Kaselemis/Schuldenfrei) to accept the proposed collection policy. MOTION PASSED. SO/Carpenter Hazelwood s Homeowner Pays Collection Plan Motion (Baker/ Schuldenfrei) to accept the collection plan. MOTION PASSED. Cadden will send certified letters to those homeowners affected. The following month, those lots will be turned over to Carpenter Hazelwood for collection. Two homeowners will not receive letters at this time because the amounts owed do not meet the minimum amount owed. Next month the Board will review the list of foreclosure and previous owners to determine if those lots will also be turned over to Carpenter Hazelwood. Letter to owners concerning the gate arms Board decision is to not poll the owners at this time. Other Board discussed the parking issue on Country Court. Board was informed that the Association cannot assess monetary penalties without disclosing the date and time of the offense, the first and last name of the witness, citing the section of homeowner documents that prohibit the parking in common areas (CC&R 8.11), and advising the homeowner of their right to appeal. The Association can send letters to the homeowner of the violation and hope that the homeowner corrects the situation before resorting to inviting the homeowner to a covenants hearing. John Price (Cadden Management) will assist the Management Representative Tony Bluto in drafting a letter to be sent to all the homeowners on Country Court informing them of the situation and that the Board intends to take action if violations keep occurring. The CC&R s do allow the Board to designate specific areas to be used for parking for visitors. John Price will also draft a suggested enforcement policy for the Association to be reviewed by the Board. NEW BUSINESS + Dog Attack After reviewing the situation, Board agreed to put the telephone number to Animal Control in the next newsletter. Homeowners who allow their dogs to run free and not on a leash must be identified before any action can be taken. + Delinquency Notices Previously discussed. Fido Jazz Prodigy Grant Cherry, Grandson of Lakes residents Joyce and Mike Cherry, is a high school sophomore and also a popular Jazz Pianist in Tucson. He returned in late July from a two week European tour with the Ellington Band of the Tucson Jazz Institute. They played to sold out crowds and standing ovations. Grant travels to multiple Jazz Festivals around the country performing with T JI, including to Lincon Center last year. He plays with the Ellington Band every New Years Eve at Star Pass Resort, opened in the lobby of the Sheraton Hotel for Kyle Eastwood when he brought his Jazz Band to Tucson, and played last year twice a month at Tremelo Cafe in Foothills Mall. If you would like to catch Grant playing, he has a regular Saturday night gig at Old Pueblo Grill on Alvernon with the Pete Swan Trio from 7:00-10:00 pm and occasionally on Sunday. COLLECTION POLICY WHEREAS, Article lll.h of the Articles of Incorporation of The Lakes at Castle Rock (the Association) authorizes the Association "to exercise all of the powers and privileges and to perform all the duties and obligations" of the Association; and, WHEREAS, Section 10.2 of the Association's Covenants, Conditions & Restrictions (CC&Rs) stipulates that "the Board shall have the power and authority to determine all matters in connection with assessments...", and further, as per Article 3.1.G, shall "fix, levy, collect and enforce assessments... " and; WHEREAS, Article 3.2.E of its Bylaws grants the Board of Directors the powers and duties "to collect delinquent assessments from any person by suit, foreclosure of assessment lien or otherwise and to enjoin or seek damages from any person for failure to pay assessments", and; WHEREAS, The Board of Directors of the Association desires to adopt a procedure to collect assessments and other charges due and payable to the Association; NOW THEREFORE, BE IT RESOLVED that the Association hereby adopts the following procedures for the collection of assessments and other charges due and payable to the Association: 1. Due Date. The annual assessment shall be due and payable in 12 installments due on the 1st day of each month. Pre-payment of assessments are permitted, and will be credited to the Lot account. 2. Late Charge. As per section of the CC&Rs, unless the monthly assessment is paid within fifteen (15) days of the due date, a late fee equal to ten percent (10%) of the amount of the monthly assessment shall be charged the Owner. 3. Interest. As per section of the CC&Rs, unless the monthly assessment is paid within fifteen (15) days of the due date, any such unpaid amounts (assessments and late fees) shall bear interest at a rate of twelve percent (12%) per annum. 4. Invoices. The Association may, but shall not be required, to issue payment coupons or statements to owners as a reminder of an owner's obligation to pay assessments or other charges of the Association. The non-receipt of a payment coupon or bill by an owner shall not relieve an owner's liability for assessments. 5. Return Check Charges. A thirty-five dollar ($35.00) fee shall be assessed against an owner in the event any check or other instrument paid by the owner is not honored by the bank or is returned by the bank for any reason whatsoever, including but not limited to, insufficient funds. If two or more of an owner's checks are returned unpaid by the bank within any fiscal year, the association may require that all of the owner's future payments be made by certified check or money order. 12 P A G E 1 2 Policy continues from page Attorney's Fees on Delinquent Accounts. As per Article of the CC&Rs, "owners shall pay reasonable attorneys' fees incurred by the Association in connection with the collection of assessments, interest, late fees and other amounts owed the Association." 7. Application of payments made to the Association. Payments received from an owner will be applied in the following order of priority, and consistent with Arizona Revised Statutes, (B): First toward the principal amount unpaid. All late charges and interest accrued. Charges for legal fees, court costs and other costs. All other charges incurred by the owner and/or Association as a result of any violation by an owner, his/her family, employees, agents or licensees. 8. Collection Notification After a monthly assessment or other charge due the Association becomes 30 days past due, the Association may cause, but shall not be required, to send a "late notice" to the owner who is delinquent in payment. After a monthly assessment or other charge due the Association becomes 60 days past due, the Association may cause, but shall not be required, to send a "demand notice" to the owner who is delinquent in payment. If payment in full is not received within 90 days, the Association may, but shall not be required, to send a "Notice of Intent" to the owner to refer the account for legal collection action. The Association may simultaneously send a copy of the notice to the mortgagee of the home. 9. Use of Certified Mail / Regular Mail. In the event the Association shall cause collection or demand letter or notices to be sent to a delinquent owner by regular mail, the Association may also cause, but shall not be required, to send an additional copy of that letter or notice by certified mail. 10. Liens. The Association may file a Notice of Lien against the property of any delinquent owner in accordance with the terms and provisions of the CC&Rs. 11. Referral of Delinquent Accounts to Attorneys. The Association may, but shall not be required, to refer delinquent accounts to its attorney for collection. Upon referral to the attorney, appropriate action to collect the delinquent account shall commence. 12. Referral of Delinquent Accounts to Collection Agencies. The Association may, but shall not be required to refer delinquent accounts to one or more collection agencies for collection. Upon referral to a collection agency, the agency shall take all appropriate action to collect the accounts referred. This policy shall replace all prior policies and procedures pertaining to assessment collection matters.
