That the officer recommendation be overruled and the application be refused for the following reason:- 1. The Local Planning Authority considers that the proposal will have a detrimental effect on the residential amenity of properties on Seagrave Drive having regard to overshadowing, massing of the building and outlook. The proposal is therefore considered to be contrary to policy HSN5 of the Replacement Chesterfield Borough Local Plan. CHE/07/00026/FUL - REPLACEMENT OF EXISTING SALES BUILDING, PUMPS AND CANOPY AND REVISED FORECOURT LAYOUT AND SERVICE AREA AT BIRDHOLME SERVICE STATION, DERBY ROAD FOR ESSO PETROLEUM COMPANY LTD. In accordance with Minute No. 299 (2001/02) Mr. Rogers of Andrew Martin Associates (agent for the applicant) addressed the meeting. That the application be refused for the following reasons:- 1. The Local Planning Authority considers that the proposed convenience retail store fails to satisfy the sequential test and would harm the vitality and viability of the nearby Derby Road local centre, contrary to Policy SHC 6 of the Local Plan and Government Planning Policy Statement The Local Planning Authority considers that the proposal is an over development of the site. The increase in activity including the increase in deliveries to the site is considered to be detrimental to residential amenity and highway safety.
