2 MINUTES RESOLVED - That the Minutes of Planning Committee passed at the meeting held on 5th November, 2012 be signed by the Chair as a true record APPLICATION FOR PLANNING PERMISSION - PLANS DETERMINED BY THE COMMITTEE (P030) *The Committee considered the under-mentioned applications in light of reports by the Group Leader, Development Management and resolved as follows:- CHE/12/00587/FUL - INSTALLATION OF AN ATM AT WHITE HORSE PUBLIC HOUSE, HIGH STREET, CHESTERFIELD FOR TESCO STORES LTD Councillor Lowe, having not attended the site visits, took no part in the consideration of these items. In accordance with Minute No. 299 (2001/2002), Mr. G Hutchinson, Agent for the applicant, addressed the meeting. That the officer recommendation be upheld and the application be refused for the reason:- 1. Due to the siting of the ATM on the frontage of the building, facing onto High Street, it is considered that the proposal will lead to vehicles stopping on the classified road at the front of the premises in order to use the facility. This has potential to impede the free flow of vehicular movements which would be against the best interests of highway safety and the safe and efficient movement of traffic on a classified road. CHE/12/00588/ADV - TWO EXTERNALLY ILLUMINATED FASCIA SIGNS AND 1 EXTERNALLY ILLUMINATED PROJECTING SIGN AT WHITE HORSE PUBLIC HOUSE, HIGH STREET, CHESTERFIELD FOR TESCO STORES LTD In accordance with Minute No. 299 (2001/2002), Mr. G Hutchinson, Agent for the applicant, addressed the meeting. That the officer recommendation be upheld and the application be approved subject to the following condition - 1. The degree of luminance of the sign shall not exceed 700 candelas per square metre and the illumination shall not be intermittent or flashing. REASON FOR DECISION 1. The signage scheme proposed is considered to be acceptable without detriment to the building, the streetscene or visual amenity. The illumination proposed, in the form of the trough lights, is considered to be acceptable and their form relates well to the architectural style and appearance of the building. The scheme is considered to accord with the objectives of the adopted SPD

CHE/12/00589/FUL - INSTALLATION OF PLANT, EQUIPMENT AND TIMBER FENCE ENCLOSURE AT WHITE HORSE PUBLIC HOUSE, HIGH STREET, OLD WHITTINGTON, CHESTERFIELD FOR TESCO STORES LTD. In accordance with Minute No. 299 (2001/2002), Mr. G Hutchinson, Agent for the applicant, addressed the meeting. That the officer recommendation be upheld and the application be approved subject to the following conditions:- 1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. 2. All external dimensions and elevational treatments shall be as shown on the approved plans with the exception of any approved non material amendment. REASON FOR DECISION 1. The plant proposed for installation on site is considered to be acceptable in terms of its visual appearance and its impact on the character of the green belt in this location. It is not considered that the proposed plant will result in any detrimental loss amenity for surrounding residents and the works are considered to accord with Policies EVR1 and GEN10 of the Replacement Chesterfield Borough Local Plan. CHE/12/597/COU - CHANGE OF INDUSTRIAL UNIT INTO CATERING FACILITY SANDWICH BAR/CAFÉ AT UNIT 59 M1 COMMERCE PARK, MARKHAM LANE, DUCKMANTON, CHESTERFIELD, DERBYSHIRE, S44 5HS FOR MR KEVAN BANNISTER In accordance with Minute No. 299 (2001/2002), Mr K Bannister, the applicant, addressed the meeting. That the officer recommendation be upheld and the application be approved subject to the following conditions:- 1. Permission is hereby granted for a temporary period of 2 years. The use hereby permitted shall be discontinued and the premises restored to their former use on or before the 31st December Prior to the installation of any fume extraction and/or ventilation equipment on site details of the fume extraction and/or ventilation equipment shall be submitted to the Local planning Authority for consideration. Only the approved fume extraction and/or ventilation equipment shall be installed and thereafter retained.
4 172 REASONS FOR DECISION 1. The principle of the development proposals are considered to accord with the provisions of Policies EMP7 and SHC10 of the Replacement Chesterfield Borough Council Local Plan (adopted June 2006) in so far as they are considered to be appropriately sited and designed to serve a recognised catchment area. Furthermore the proposals do not present any adverse impacts upon neighbouring amenity, character or appearance of the surrounding area. 2. The proposals do not give rise to any immediately adverse highway safety issues and are adequately served by parking available in the wider area of Markham Vale and the M1 Commerce Park.
