1 EX ALDERMAN NEWSLETTER 357 AND CHESTERFIELD UNAPPROVED 302 November 25, 2018 MAYOR JON DALTON HAS BEEN VIOLATING MISSOURI ETHIC RULES OVER A LONG PERIOD OF TIME: Here is Town and Country Mayor Jon Dalton s latest campaign bank account filing with the Missouri Ethics Commission 1

2 Now here is Dalton s on file registration as a Lobbyist in Missouri. THE PROBLEM: The problem is that according to Missouri law a lobbyist cannot have a campaign bank account and must terminate it. In the course of dissolving such committee, such person shall not disburse moneys from such committee, except for the purpose of: (1) Returning a contribution made to the candidate committee to the entity responsible for making the contribution to the committee; (2) Donating moneys to a nonprofit entity qualified as exempt from federal taxation under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended; or (3) Transferring moneys to a political party committee. By Missouri Law Dalton cannot have a campaign committee, something he has had for a decade. However this law went into effect in He has been in violation of it for two years. 2

3 Keep in mind Dalton is a lawyer and a registered lobbyist for his law firm, Armstrong- Teasdale and his own lobbyist firm, At Government Strategies, LLC. He has been a registered lobbyist for 20 years. You might think he would be up to date on the laws regulating lobbyists. In 2017, he accepted an illegal contribution from Allen Allred, a lawyer, who Dalton appoints to the Police Commission. By law Dalton as a registered lobbyist should have no longer had a campaign fund. It is odd that two high-dollar lawyers don t know the law or have no problem breaking the law. (We regularly report how Allred daily is breaking Missouri Law by refusing to place a front license plate on his Porsche sports car.) Under Dalton cannot give the money back to donors, but can only give it to a non-profit charity or a political party. It will be interesting to see if Dalton continues to break the law or if Armstrong-Teasdale tells him to pick working for them or being Mayor of Town and Country and making $6,000 a year. SLAP AND PUNCH YOUR WIFE OVER TWO DOZENS TIMES, PULL PATCHES OF HER HAIR OUT, GET ON TOP OF HER AND PUNCH HER, GO INTO A BEDROOM AND START BEATING HER WITH A GOLF CLUB. WHAT ARE THE PENALTIES? Well if you hire drunk driver and criminal defense attorney Scott Rosenblum you have apparently committed a minor misdemeanor that has a $500 fine. If you don t remember this case, a little over two years ago we wrote this up. Here is a review. On July 4, 2016 at 3:36 in the morning, Dr. Vivek Agnihotri, a psychiatrist, assaulted his wife Zina Thomas, also a psychiatrist who shared offices with her then 3

4 husband. He slapped her about 15 times, threw her on a couch and punched, ripped out some hair and after she fled to a bedroom he followed and beat her with a golf club. She managed to run to street in front of their home at 21 Huntleigh Woods Drive in the exclusive Village of Huntleigh where she used a cell phone to call the Frontenac Police. From the police report here is Dr. Thomas statement of what happened. Dr. Zina Thomas Dr. Agnihotri gave a much shorter statement to the police and then declined to say anything further. 4

5 Agnihotri was arrested that night and charged with Felony Assault with charges filed that same day on July 4 th. Within three weeks of the assault Dr. Thomas filed for divorce. It was granted on 11/15/17. Their house at 21 Huntleigh Woods was put on the market and sold on 01/11/18 for $1,510,000. Their shared office in Frontenac is no more and they have separate offices in Creve Coeur. The India natives are graduates of Yale and attended medical school in the Caribbean. AND NOW FOR THE OUTCOME: Agnihotri hired Scott Rosenblum, both a drunk driver and an expensive criminal defense attorney. Apparently Rosenblum was able to 5

6 convince the County Prosecutor s staff that slapping your wife, then punching her and then beating her with a golf club was just a minor offense. On May 25, 2018 Agnihotri pled guilty to an amended charge from felony to misdemeanor Domestic Assault. On August 16, 2018 he was fined $500 by Judge Kristine Kerr, who thinks punches, slaps and a beating with a golf club only deserves a cash fine. Now the green fees at Pebble Beach are $525 plus $44 a person cart fee or a $92 caddie fee. So you pay less to beat your wife in Huntleigh Village with your golf club than to play Pebble Beach. Here is a link to the police report: HERE TODAY, BUT NOT FOR MUCH LONGER: A single family ranch house built on one acre in 1960 at South Topping Estates is about to leave the face of the earth. The 2,058 square foot house with 3-bedrooms and two baths was recently sold as a tear down. 6

9 MASKED TOWN AND COUNTRY RESIDENTIAL BURGLAR ON VIDEO: A home security video system caught a fat guy who burglarized a Town and Country home on November 7. The crime was discovered when the residents returned home from an out of town trip on November 16. The crime happened on the block of Horton Lane off of Des Peres Road. The creepy thing is that he suspect is a white/male heavy set white male under 6-foot. Honestly most burglars are normally thin drug addicts. 10 CATHOLIC SUPPLY MURDER AND SEX ASSAULT CASE: We hope to post the court documents in the Catholic Supply Store murder and sex assault case by next week. For our out-of-town readers, on Monday November 18 at about 3 PM Thomas Bruce, 53, a trailer park resident in Imperial, Missouri entered the Catholic Supply Store on Manchester Road at Weidman, one block west of the Town and Country City Limits in unincorporated St. Louis County. Bruce left, but returned with a gun. He then forced two female employees s in the store to perform a sex act on him. A third female, 53-year-old customer, Jamie Schmitt refused and Bruce shot her in the head killing her. It was later reported that Schmitt was at the store to buy chains, crosses and beads so she could make rosary beads for Christmas gifts. Schmitt was a wife and mother. We have since learned that one of the store employees is a 19-year-old teenager. Bruce was charged with 17 different crimes including 1 st Degree Murder. He is being held with no bond. 11 DRUNK DRIVER EPIDEMIC IN CHESTERFIELD: Week after week we report on drunk drivers going off the road and hitting buildings, poles and businesses. This problem seems to be increasing. The city prosecutor Tim Let s Make a Deal Engelmeyer and Judge Amended Charge Brunk refuse to set standards where no deals will be made if there are DWI accidents, DWI Leaving the Scene of Accidents, Breath Test Refusal and BAC levels reading double the limit. But they only want to take care of fellow lawyers representing drunk drivers and not take care of the public. The Mayor and City Council have shown no interest in dealing with the problem. SEVEN SHOPLIFTERS TRY AND WIPE OUT PERFUME SUPPLY AT VICTORIA S SECRET BEFORE BLACK FRIDAY. WHILE MAKING THEIR ESCAPE THEY TAMPLED SMALL CHILD ON ESCALATOR: Seven women shoplifters made off with $8,000 worth of perfume from the Victoria s Secret at the mostly deserted Chesterfield Mall at 1:15 on Tuesday 11/20/18.. 21 A thief sprayed the responding mall security officer with pepper spray, which made this felony theft also a robbery. Here are video stills of the suspects: By 9:00 pm, less than 8-hours after the theft, Chesterfield Police announced they had identified all the suspects, but had not yet made any arrests. I m sure video from inside Victoria s Secret was good enough for Chesterfield Police to run the images in the photo mug shot data base which resulted in identification. Here is a continuing problem and is a reason that tax supporting retailers are victimized often and innocent shoppers including small children are made victims is the Chesterfield Municipal Court system. Three convictions of theft in Missouri means the suspect can then be charged with Felony Theft even if it is under the $750 line separating felony theft from misdemeanor. But the suspects have to be convicted. Municipal Prosecutor Tim Engelmeyer and Judge Rick Brunk keep allowing suspects to plead guilty to non-criminal amended charges of Littering if they are represented by lawyers. 21

22 I have to believe most of the seven suspects in this incident have been to Chesterfield to steal before and probably half or more have been arrested in Chesterfield. One officer mentioned to me after seven years of making hundred of arrests he has only testified in Municipal Court once. Another officer complained that the prosecutor and judge refuse to convict thieves of stealing, even if they give them a probation term. Engelmeyer likes to claim that store clerks come and go, but store security managers and store managers don t and they can testify to the video of the suspects stealing. Engelmeyer doesn t want to go to trial and wants to help out defense lawyers, screw the retailers and the public. The other problem besides Brunk and Engelmeyer is Mayor Bob Nation and the City Council. Nation reappointments these two and the Council confirms them. Councilpersons who formerly seemed to have common sense, Barry Flachsbart and Barb McGuinness both voted to retain Brunk and Engelmeyer. Councilman Dan Hurt actually praises them when he votes for their retention. Mary Ann Mastoraskos is a friend of Engelmeyer. So far only Michelle Ohley, Tom DeCampi and Ben Keathley (a lawyer) have recognized the problem and voted not to keep Brunk and Engelmeyer. WILDWOOD RESIDENT ALREADY WITH CHARGES PENDING IS ARRESTED BY THE HIGHWAY PATROL: You might think if you were out on bond on Felony Theft Charges from 2016 you would watch your Ps and Qs and do your best to avoid the police. Apparently Justin Rucker, 22, of Peppermill Drive in Wildwood next to Clarkson Valley hasn t figured that out. Justin Rucker Rucker was arrested for Felony Stealing and charged with Felony Receiving Stolen Property by the Richmond Heights PD on 07/13/16. The case has dragged on with a grand jury indictment in His next court date is on December 6. He is out of jail pending trial on a $5,000 bond. 22

23 He just had a criminal charge from March of 2018 in Ellisville amended to a non-criminal charge of Littering with a $200 fine on 09/13/18. He also has a Speeding Charge of 26 MPH over the limit in St. Louis County pending since 08/26/17. Rather than being extremely careful on the before Thanksgiving (11/21/18) he was driving a car without valid license plates, while speeding and possessing marijuana. The Highway Patrol stopped him in Northeast Missouri and booked him on all three charges. DEER GETTING HIT BY THE TWOS: This is from the End of Watch report on Wednesday 11/14/18. OTHER DEER REPORTS FROM OUTSIDE OF TOWN & COUNTRY AND CHESTERFIELD: From the Kirkwood-Webster Times: Des Peres A deer with a mangled leg was reported stuck on a fence in the block of Wynfield Pines Court Nov. 2. The deer was shot and Des Peres Street Department removed it. 23

24 A motorist struck a deer Nov. 6 on eastbound Manchester Road near Des Peres Road. The deer left the scene and no injuries were reported. From Missouri Highway Patrol: We can check Highway Patrol crash reports involving deer. However there are far more handled by city police and county sheriff departments that are not listed online. The Highway Patrol only enters crashes in their public database if there is an injury or fatality involved. Here are some of the Highway Patrol Deer-Vehicle incidents from last week: Deer struck causing car to overturn and driver taken to hospital for treatment of injuries on Friday 11/16/18 at 11:45 AM. MOTORCYLIST HITS DEER, TAKEN TO REGIONAL HOSPITAL FOR INJURIES: A 47-year-old man from Otterville, Mo was operating his 2008 Harley Davidson motorcycle on Saturday 11/17/18 at 5:05pm (Dusk) on Hwy J east of MO Rt 5 in Cooper County when he hit a deer. He was taken by ambulance to the Regional Hospital in Columbia, MO. DRIVER SLOWS FOR DEER IN ROAD AND IS STRUCK FROM BEHIND. On Friday 11/16/18 at about 5:26pm a 22-year-old Jefferson City woman was driving a 2008 Ford Taurus on Hwy M near Hwy Y in Cole County when the driver in front of her slowed for deer in the road. The Ford driver read end the SUV that stopped for the deer and was 24

25 then rear ended by a third vehicle. She was taken by ambulance to St. Mary s Hospital in Jefferson City. WOMAN PASSENGER TAKEN TO HOSPITAL AFTER VEHICLE HIT A DEER IN CAPE GIRARDEAU COUNTY. On Saturday at 8:45PM the 35-year-old occupant of a 2014 Chevrolet Silverado was injured after the vehicle struck a deer on RT 72 west of Millersville. She was both take to a hospital for treatment of her injuries. HANNIBAL MAN TOTALS CLASSIC OLDSMOBILE IN FIREY DEER RELATED CRASH: On Sunday at 3 AM 21-year-old Lucas Tourney of Hannibal attempted to avoid a deer on Hwy 79 in Ralls County, only to have his 24-year-old Oldsmobile Cutlass overturn and catch fire. The car was totaled. Tourney received minor injuries. 25

26 23-YEAR-OLD FROM FULTON TAKEN BY AMBULANCE TO HOSPITAL AFTER A DEER RELATED EVENT: The driver of a 2005 Dodge Stratus from Fulton was transported by ambulance from Route H in Ralls County to a hospital in Hannibal. On Monday 11/19/18 at 8:40 AM she swerved to miss a deer in the roadway and slammed into a ditch. Damage to the car was extensive. 35-YEAR-OLD WOMEN TAKEN BY AMBULANCE TO HOSPITAL AFTER DEER RELEATED CRASH: On Tuesday 11/20/18 at about 9:50AM on Highway N in Franklin County Heather Knipe swerved her 2013 Ford Edge to avoid a deer, only to run off the road into a ditch. OLDER COUPLE BOTH INJURED AFTER STRIKING A DEER OUTSIDE OF KANSAS CITY: Helen Gallardo, 64, and her husband Hurberto Gallardo were treated for injuries after their 2013 Chrysler struck a deer on US Highway 24 in Jackson County on Tuesday 11/20/18 at 5:50pm. 26

27 AND THEN THERE WAS A HORSE OUT FOR A MIDNIGHT STROLL: A Peterbuilt Tractor Trailer and a 2013 Toyota were totaled and the 79-year-old truck driver was injured after the truck struck a horse in the road on Hwy 5 North of Lebanon, MO on Tuesday 11/20/18 at 11:20PM. The horse was forced into the path of the Toyota after being hit by the truck. CITY COUNCIL ALLOWS 18-MONTH DELAY IN SUBMITTING PLANS FOR THE NORTHWEST CORNER OF CHESTERFIELD AIRPORT ROAD AND SPIRIT OF ST. LOUIS. The owners/developers of 16 acres on the NW corner of Chesterfield Airport Road and Spirit of St. Louis Blvd. have not submitted a development plan and have asked for an 18-month extension to do so. 27

28 EMERALD ASH TREE REMOVAL: A long term plan was developed and approved in 2015 as the Emerald Ash Bore (a tree killer) reached Chesterfield. In the last three years 2,922 ash trees have been removed. There are approximately 3,787 Ash trees remaining to be removed. Part of the overall plan included sidewalk repair around the trees and reforestation. The request for replacement trees (not Ash trees) has been less that staff had expected. bore infected tree In the original plans it was estimated that $583,000 per years should be budgeted. After three years of review staff is now recommending $419,000 be budgeted for The 2019 ash tree removal project will use leftover funds from the 2018 budget. IN A YEAR HOMEWOOD SUITES GUEST WILL BE ABLE TO GO ANY DIRECTION LEAVING THE HOTEL: A settlement between the General Hotels Corporation in Indianapolis and the Arco Construction, who is building a pre-school and nursery on the 7.4 acre lot between the hotel and Hilltop Center Rd has been made. 28

29 Arco is building The Kiddie Academy and hopes to start in early spring on 2019 and be completed in late November of Currently guests at the hotel have to make only a right turn onto Chesterfield Parkway. Under this agreement there will be a driveway from the hotel through the Kiddie Academy property allowing guests to exit onto Hilltop Center Drive and use the electric signal at Chesterfield Parkway to go right (toward entrance to WB I-64) or left (toward entrance to EB I-64 and Olive Blvd). The yellow line would be the driveway from the hotel to Hilltop Center Drive. COUINCIL APPROVES 2019 CONTRACT WITH POLICE: For a number of years Chesterfield Police Officers wanted stronger representation and a contract with the city. Last year they succeeded in getting the first ever contract for police officers and police sergeants, bargained the local Fraternal Order of Police chapter. The contract was good for just one year. At the November 19 City Council meeting the Council voted to approve the contract. The contract includes a clause that salaries can be reduced if a natural disaster occurred causing a significant loss in business revenues. Most places in the Midwest that would be tornado damage. In Chesterfield however, it would more likely be Missouri River flood damage. NOT CLOSED FOR THE WINTER CUSTARD STAND IS SIMPLY CLOSED: 29

30 Sheridan s Frozen Custard didn t do like many custard stands do, which is close for 3 ½ months during the winter. Sheridan s on Chesterfield Parkway at Hilltop Center Drive is CLOSED period. When we took these photos on November 10 th they had already removed most of the interior fixtures. Chesterfield s Director of Planning Justin Wyse told us this week there have been no plans submitted for a new business. AT MONARCH FIRE A LOW BID WAS REALLY A LOW BID: I was at a recent Monarch Fire Protection meeting when three bids for eight Thermal Imagining Cameras for all the fire stations/primary response trucks were received. The cameras tell firefighters where the hottest part of a fire is located. Often bids are a few hundred dollars apart from the top bid to the lowest. That was not the case this time. The difference was huge. Here are the bids: Banner Fire Equipment $9,198 per unit $73,584 total 30

BOOKS: MY MESSAGE TO THE WASHINGTON POST BOOK REVIEW OF JONATHAN FRANZEN S NEWEST BOOK: I may have shared this before, but I posted the story on the Washington Post website after a review of Jonathan Franzen s latest book. I enjoyed Franzen s first three books including one that was set four doors from where I grew up in Webster Groves. However, since then I have not been about to get past 100 pages without giving up. Jonathan Franzen MUSIC: Last weekend belonged to Dean Christopher. On Sunday he sany the National Anthem at the St. Louis Ambush indoor soccer game and on Monday it was a pre-thanksgiving Rat Pack and More night at the One-19-North in Kirkwood. 31

32 Three weeks earlier just before Halloween the One-19-North was full to capacity with Dean fans. This last Monday, there were only about 16 of us there. 35 BUSINESS: If you occasionally go to the Office Depot Store hidden away in the iconic old National Food Store off Manchester west of Highway 141, you will find an empty building, with no sign telling you where they moved. However they store did not move far away. They relocated to the Lafayette Center next to the Dierberg s Supermarket on Manchester Road at Baxter Road.
