Deputies determined an assault took place and the male half is arrested. On at approx 0013 hrs, Assistant Transit chief T. Stephens #66 and I responded to the area of st St S (East Hauge parking lot) to assist PLU campus safety, regarding a Domestic Violence event. Assistant Transit Chief Stephens and I were working off-duty at Pacific Lutheran University (PLU) from 2100 to 0200 hrs. At approx 2338 hrs, PLU Campus Security received a call about an unidentified male and female yelling at each other in the East Hauge parking lot. There was also a white pickup truck (WA- ) associated with them. I drove in the area to look for the individuals/vehicle and didn't see anyone. At approx 0013 hrs, PLU Campus Security, which included Campus Safety Officer B. Lunniss, requested for 'County Units' to respond to the East Hauge parking lot for a domestic violence event. It appeared the individuals and vehicle from the earlier call had returned to the parking lot. Assistant Chief Transit Stephens and I responded to the area. At this location, we contacted (A) and his girlfriend, (V), who is a freshman at PLU. (A) is not a PLU student. It appeared both individuals had been drinking alcohol. There was the odor of intoxicants, blood shot eyes, sluggish speech and movements from both individuals. I spoke to (A), while Assistant chief Stephens spoke to (V). (A) told me that he and (V) had gone to a friend's house for a small party with friends. (A) told me he had "one" beer and went to sleep while (V) socialized with their friends. (A) said he drove (V) back to her dorm at PLU and on the way back they stopped off at McDonalds (11000 block of Pacific Ave S) for some food. At McDonalds, (A) said (V), who was intoxicated, started flipping out about her missing cell phone upon which she started throwing things around in his vehicle (WA- ). (A) said (V) accidentally hit him in the head with a plastic water Printed: 12/10/ :38:04

After arguing at McDonalds and not finding (A) 's cell phone, (A) said they drove to PLU where they argued some more about the cell phone. (A) said he and (A) then left and went back to McDonalds looking for (V) 's cell phone upon which they didn't find it. They then drove back to PLU where they started arguing again in the East Hauge parking lot and that's when Campus Security contacted them. (A) said he had tried to physically restrain an out-of-control (V) but did not assault her and that the water bottle by (V) was not intentional but an accident. I asked (A) if he had (V) 's cell phone, which sounded like a possible jealous issue ( talking to another male). (A) told me he did not have (V) 's cell phone. Campus Security Officer Lunniss informed Assist Transit Chief Stephens and me that she had seen the video of (A) and (V) in the parking lot and it appeared (A) had assaulted (V) more than trying to restrain an out-of-control person. Assistant Transit Chief Stephens went to campus security' s office to review the video. Assistant Transit Chief Stephens returned and informed me the video showed (A) throwing (V) against the truck and onto the ground. It appeared (A) was the primary aggressor and assaulted (V). We placed (A) into custody without incident. I handcuffed (A), which were finger gauged for tightness and double locked. I told (A) he was under arrest for Assault 4th Degree DV, which he told me he understood. (A) was placed into the backseat of my patrol vehicle, where I advised him of his Miranda Warnings from a prepared card. (A) invoked his rights (remain silent) and declined to talk to me further about the event. I did not question (A) any further about the event. (A) did make the statement to me, "I'll go to jail for her ( ) because I love her". I spoke to (V), who believes (A) took her phone due to a jealousy issue, which has happened in the past. She also informed me that (A) didn't just drink 'one' beer but drank about a fifth of hard liquor and that's why he was sleeping at the party they went to. (V) also told me the water bottle being thrown at (A) was an accident. (V) willingly-filled out a Handwritten Statement form and a DV Supplemental Report form. I forward the forms to South Sound 911 Records. (V) was given a DV pamphlet and informed how to obtain a DV Temporary Order. I transported (A) to the 'Old Safeway Parking Lot' th ST S where he was handed over to Deputy C. Kurkowski #518, who was already enroot to the jail with a prisoner. Deputy Kurkowski transported and booked (A) into the Pierce county jail for Assault 4th degree DV, rcw 9A I filled-out a booking form and Probable cause form, which were given to Deputy Kurkowski to hand over to jail booking personnel. See Assistant Transit Chief Stephens' supplemental report for additional details, regarding the event. I obtained a copy of PLU's campus surveillance video, which showed the assault event. We both arrived about the same time. I talked to the male who identified himself as (A). He was sitting on the curb next to his truck with his head down. I had him stand up and could smell the odor of alcohol emitting from him. told me that he and his girlfriend (V) of 2 years were arguing about where her cell phone was at. believed that her cell phone was inside his truck and that was hiding it from him. denied this and said that she may have lost it when they were arguing about 15 minutes earlier at the McDonald's on Pacific Ave S. and 112th St S. said that kept going into his truck and that she would throw things out of the truck and a bottle ended up hitting him in the head. They both stated that this was unintentional. kept saying that all he wanted was her to go to bed since she was very intoxicated. I talked to next. She told me that must have her phone. seemed very intoxicated and smelled of alcohol. She said she kept trying to get into the truck to find it since she had looked in her bag and it wasn't there. When she tried to get into his truck he threw her down several times. I asked if she was injured and she said she wasn't. said all she wanted was her phone so she could go to bed and go to work in the morning. She did say that was jealous that he thought she was cheating on him. I went to the PLU Campus Safety office and review the video. Some of the video was blurry to begin with. The video shows that continually tried to get into the passenger side of ' s white Ford pickup. The video was somewhat grainy and I could see that while Star was at the passenger side he would pick her up. After a few moments she would go to the ground. I couldn't tell if he threw her or not. This happened about 3 times. At one point you could see that picked up and in his arms and tried to carry her from the parking lot. had his arms under her back and her legs when he carried her. After a short distance she got out of his arms and tried to get back to the truck. grabbed her by his arms and tried to pull her away from the truck. again tried to go the truck. I asked questions from the PCSD DV form which in filled on the form. Deputy Blumenschine had already had her complete a hand written statement on another form. Both forms were given to Deputy Bluemenschine. When I returned back to the parking lot Deputy Blumenschine and I conferred. I told Deputy what I saw on the video. We placed under arrest for Assault 4/DV. Deputy Blumenschine placed handcuffs on. Deputy Blumenschine checked for tightness and double locked them. We walked to the back of Deputy Blumenschine vehicle and had him sit in the back. Deputy Bluemenschine then transported to meet with another Deputy to transport to the Pierce County Jail.
