Upcoming Meetings: November 2012: 7th and 21st December 2012: 5th and 19th Welcome to the third issue of the Pharmacy Registration Board of Western Australia s newsletter Introduction by John Harvey, Presiding Member Welcome to the Board s latest newsletter in which the Board highlights matters within the Pharmacy Act and Pharmacy Regulations and advises proprietors of registered pharmacies of the Board s guidelines on various matters. In this issue the Board has also highlighted some recent or impending changes that all pharmacists should be aware of. The Board recommends that registered proprietors should ensure that they are aware of all of the issues raised in this newsletter and if they have any queries they should contact the Registrar. BOARD S GUIDELINES ON ITS INTERPRETATION OF THE ACT AND REGULATIONS Automatic Teller Machines: Section 59 of the Pharmacy Act 2010 ( Pharmacy Act or Act ) precludes another business being conducted within a pharmacy unless that business is owned by the person in whose name the pharmacy is registered. The Board has recently considered the position regarding Automatic Teller Machines ( ATMs ) operating within pharmacy premises. The Board has formed the view that ATMs can only operate in a pharmacy if they are owned by the proprietor, or are front facing, meaning that they are serviced from the front and the company that services the ATM does not ever need to enter the pharmacy premises. If ATMs are serviced from the rear of the machine (that is, from within the pharmacy) and are owned by a third party, they will be considered to be in breach of Section 59. The penalties for a breach of this Section are up to $10,000 for a first offence and $20,000 for any subsequent offence. If the ATM is excluded from the area of the registered premises, there is likely to be a breach of Clause 1 (b) of Schedule 1 of the Pharmacy Regulations 2010 ( Pharmacy Regulations or Regulations ) as the registered premises are to have no direct access to adjoining premises. Even if the ATM is owned by the registered proprietor of the pharmacy, the Board understands that there may be some insurance considerations for a pharmacy where it operates an ATM from within a pharmacy. Significant Alterations: The Regulations define a significant alteration as an alteration to the pharmacy that affects the construction, structure, layout or floor area of the pharmacy. In the opinion of the Board, any alteration to the layout or floor area of the pharmacy that impacts on the dispensary, the area for private consultation and/or the location and safe storage of scheduled medicines is a significant alteration.

2 Page 2 BOARD S GUIDELINES ON ITS INTERPRETATION OF THE ACT AND REGULATIONS (cont d) Direct Access to Adjoining Premises: Clause 1 of Schedule 1 of the Regulations prohibits direct access to any adjoining premises. The Board has had to make a number of determinations in regard to what is adjoining premises and offers the following examples of what is considered adjoining premises and what is not. Examples of what is considered to be adjoining premises include: Access from unregistered premises into adjoining registered premises from a doorway. Even though the adjoining premises may be owned by the pharmacist as they are not registered as pharmacy premises, they will be considered to be adjoining premises. A registered pharmacy operating from within other premises e.g. a pharmacy operating within a medical centre. Waiting areas are not considered to be common areas. Generally speaking the lease over the premises will define the common areas. Access from a stairwell or lift which opens directly into other premises. Examples of what is not considered to be adjoining premises include: Access from unregistered premises into adjoining registered premises via a public thoroughfare, e.g. a shopping centre mall. Another business operating within registered premises, where the other business is owned by the owner of the pharmacy in which it is located. Access from a stairwell or lift where the member of the public alights onto a common area before entering the other premises. It is also a specific breach of the Act if pharmacy premises are: Located wholly or partly within a supermarket; or Capable of being entered from a supermarket; or Capable of being used to gain entry to a supermarket. Barriers: The Board has recently amended its requirements for barriers. The change was to reduce the height requirement for barriers to a minimum height of 900mm. The Board has made this change in recognition of the standard heights of counters and service desks and believes that a height of 900 mm still provides a reasonable barrier without the proprietor having to incur additional costs due to differing heights for counters and barriers. The Board s guidelines relating to barriers can be downloaded from the Board s website at: <Link to Guideline to barriers> GENERAL INFORMATION Australian Pharmacy Approval Authorities: The Australian Pharmacy Approval Authorities is a National meeting of premises approval authorities that meet to discuss issues surrounding premises approval in each State and Territory. The purpose of the meeting is to attempt to standardise, as far as State and Territory legislation allows, the practices and procedures of registration in each jurisdiction. To date, two meetings have been held and the Board has been represented by the Registrar and the Presiding Member. Non-Compliance: Where premises do not comply with the minimum standards of fitness for the competent and safe practice of pharmacy, whether identified as a result of an inspection, or by self-declaration on the Statutory Declaration accompanying the annual licence renewal, the Board must cancel the registration of the premises. The Act is prescriptive in this regard and does not provide the Board with any discretion, no matter how minor the non-compliance may appear. The Board is, however, able to use the provisions of Section 48 in these circumstances, to maintain the registration of the premises by satisfying itself that it is in the public interest and imposing a condition requiring the matter(s) of non-compliance to be rectified. Where conditions are applied, they will have an expiry date that provides an adequate time period for rectification of any areas of non-compliance. Statutory Declaration: The renewal of registration of premises must be undertaken each year by June 30 in the approved manner and form. The Board has resolved that this approved form will include the requirement for the completion of a Statutory Declaration ensuring self-assessment of compliance with the minimum standards of fitness for the competent and safe practice of pharmacy. Similarly the Board requires the completion of a self-assessment form Notification of Completion Form following completion of works. The Board has noted that some of these Declarations appear to have been completed without this self-assessment having been undertaken. Proprietors are reminded that the penalty for providing false or misleading information to the Board is a fine of $24,000 or imprisonment for 2 years.

3 Page 3 GENERAL INFORMATION (CONT D) Pharmacy Registration Number: The Pharmacy Registration Board of Western Australia issues all registered pharmacies with a Pharmacy Registration Number. Please note that this number is unique to the Board and is NOT the Pharmacy Approval Number (PAN) issued by Medicare. The Pharmacy Registration Number (PRN) is recorded on the Certificate of Registration as a Pharmacy issued by the Board initially on registration of a premises and then annually on renewal of registration. GENERAL CONSIDERATIONS FOR REGISTERED PHARMACIES Consulting Rooms: The Regulations require pharmacy premises to provide an area for private consultation in any new pharmacy or any pharmacy that undergo significant alterations (refer previous section). The Board has noted that a number of recent applications have incorporated an area for private consultation that may be considered to be a minimalist position. The Board understands that it may become necessary in coming years, if additional services, such as medicine checks, diabetes screening, etc. are to be introduced to a pharmacy, for a consulting room to be provided. Pharmacists who are proposing to open a new pharmacy or undertake any significant alterations, should bear this in mind when planning their pharmacy. Reference Books: In August 2012, Therapeutic Guidelines Limited added the volume Ulcer and Wound Management, version 1, 2012 to the printed set of Therapeutic Guidelines. The release of this book increases the number of volumes in the complete series from 13 to 14. Registered pharmacies in Western Australia are required to have a copy of, or immediate electronic access to, the latest editions, and all published amendments or supplements to those editions, of the complete series of the Therapeutic Guidelines. The Board refers you to Schedule 1 of the Regulations and recommends you conduct an audit to ensure that the latest publications of all required reference documents are available at your pharmacy. To assist your audit of the Therapeutic Guidelines, the Board advises that at present your pharmacy should have immediate access to either the July 2012 update of an electronic version or a copy of all 14 printed volumes which are listed below as a checklist. Analgesic v5, 2007 Antibiotic v14, 2010 Cardiovascular v5, 2008 Dermatology v3, 2009 Endocrinology v4, 2009 Gastrointestinal v5, 2011 Neurology v4, 2011 Oral and Dental v2, 2012 Palliative Care v3, 2010 Psychotropic v6, 2008 Respiratory v4, 2009 Rheumatology v2, 2010 Toxicology and Wilderness v2, 2012 Ulcer and Wound Management v1, 2012 Pharmacists should note that whilst Schedule 1 prescribes the reference materials required under the Act, the Pharmacy Board of Australia ( PBA ) also requires up-to-date works of reference to be readily accessible to pharmacists. The list of references required by the PBA is more extensive than that prescribed in Schedule 1 and is recorded in the PBA s Guidelines on practice-specific issues - Guideline 1 (List of References). Whilst it is the pharmacy owner s responsibility to ensure compliance with the Act s reference requirements, it is the responsibility of the pharmacist to ensure prescribed references are readily available and accessed when required. <Link to PBA Guidelines> Inspections are Part of the Board s Normal Routine: Section 44 of the Act enables the Board to enter any premises during business hours and inspect the pharmacy or anything in or on the pharmacy to ensure the pharmacy meets the requirements prescribed by the Regulations for the minimum standards of fitness for the competent and safe practice of pharmacy. The Board s Compliance Officer routinely inspects premises for this purpose. One of the areas that the Compliance Officer reviews is that the premises have all the equipment and the latest editions of all the reference documents specified in Schedule 1 of the Regulations. As there are only minor differences between Appendix C of the Pharmacy Act Regulations 1976 and Schedule 1, in terms of the equipment and reference documents required to be on the premises, compliance with this requirement should be easily met.
