1 Canadian Transportation Agency Decisions & Orders * ISSUE October 23, 2017 Sunwing Airlines Inc. (Sunwing), Thomson Airways Limited Thomson Airways (Thomson Airways) and TUI Airlines Belgium NV. carrying on business as Jetairfly (Jetairfly) Section 60 of the Canada (CTA), and section 8.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR). s have applied for approvals to permit: 1. Sunwing to provide its nonscheduled international service between Montréal, Québec, Canada and Freeport, Bahamas; and to provide its scheduled international services between Canada and each of the following countries: Antigua, the Bahamas, Costa Rica, Cuba, Dominican Republic, Jamaica, Mexico and the United States of America using two aircraft with flight crew provided by Thomson Airways, beginning on December 9, 2017 to April 12, 2018; Application granted, subject to the conditions set out in the 2. Sunwing to provide its scheduled international services between Canada and each of the following countries: Cuba, Dominican Republic, Jamaica and Mexico using one aircraft with flight crew provided by Jetairfly, beginning on November 16, 2017 to April 3, 2018.
2 October 23, 2017 Air Transat A.T. Inc. Air Transat (Air Transat), on behalf of itself and Travel Service, a.s. (Travel Service) Section 60 of the Canada (CTA), and section 8.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR). Air Transat, on behalf of itself and Travel Service, has applied for an approval to permit Air Transat to provide its scheduled international services between Canada and each of the following countries: Cuba, the Dominican Republic, Jamaica, Mexico and the United States of America, using three aircraft with flight crew provided by Travel Service, beginning on November 17, 2017 to April 30, Application granted, subject to the conditions set out in the Air Transat is licensed to operate the relevant scheduled international services Jet There, LLC of Cedar Rapids, Iowa, United States of America Subsection 73(2) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA). has applied to the Agency for a licence to operate a non-scheduled international service in accordance with Annex III of the Air Transport Agreement between Canada and the USA signed on March 12, 2007 (Agreement). Licence issued, subject to the conditions set out in the
3 Order No A- 175 Tyrolean Jet Service Nfg. GmbH & Co KG Tyrolean Jet Services (Licensee) Paragraph 80(1)(c) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA), and paragraph 33.1(b), subparagraph 73(2)(c)(i) and section 33.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR). Licensee for exemptions to permit it to: 1. operate Canadian originating entity charter flights using its executive type aircraft without being issued a program permit by the Agency; or 2. operate each charter flight or series of charter flights originating in Austria using its executive type aircraft without giving notification prior to departure. Exemptions granted for one year effective from the expiry of the exemptions granted by Order No A-171. All other charter flights must be applied for in the normal manner as outlined in the ATR.
4 Air Canada also Air Canada rouge and as Air Canada Cargo (Air Canada) Section 77 of the Canada (CTA). AC has applied for an approval to permit it to offer an additional capacity of 700 seats per week while operating its scheduled international service between Canada and Argentina, for a period of one year beginning on December 20, 2017 or such period as may be authorized by the Agency. Application granted. AC is licensed to operate a scheduled international service, large aircraft, in accordance with the Commercial Air Transport Agreement between Canada and Argentina signed on May 8, 1979 (Agreement).
5 United Airlines, Inc. c.o.b as United, as United Airlines, as Continental, as Continental Micronesia and as Air Micronesia (United), on behalf of itself, SkyWest Airlines, Inc.; ExpressJet Airlines, Inc.; Republic Airline Inc.; GoJet Airlines LLC; Trans States Airlines, LLC; and Mesa Airlines, Inc., all c.o.b as, among others, United Express (United Express), and Aerovias del Continente Americano S.A. c.o.b as Avianca (Avianca) Section 60 of the Canada (CTA), and section 8.2 of the Air Transportation Regulations, SOR/88-58, as amended (ATR). United, on behalf of itself, United Express and Avianca, has applied for an approval to permit Avianca to provide its scheduled international service between Colombia and Canada by selling transportation in its own name on flights operated by United and United Express between US and Canada, for an indefinite period or such period as may be authorized by the Agency. United has also requested an exemption from the application of subsection 8.2(2) of the ATR, which requires the filing of an application for an approval at least 45 days before the first planned flight. Exemption granted. Application granted, subject to the conditions set out in the Avianca is licensed to operate, through code sharing, a scheduled international service in accordance with the Arrangement between Canada and Colombia set out in a Memorandum of Consultations, signed on March 16, 2012.
6 Mayo Clinic of Rochester, Minnesota, USA Subsection 73(2) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA). has applied for a licence to operate a non-scheduled international service in accordance with Annex III of the Air Transport Agreement between Canada and the USA signed on March 12, 2007 (Agreement).
