Apologies 15/124P The clerk received apologies from Cllr Lane. 2. Declarations of interest 15/125P Cllr Stainton-Burrell declared a pecuniary interest in agenda item NPA 15/00714 Barn at Hockey s Farm. She completed the relevant form and will leave the room whilst this item is being discussed. 3. Minutes of the last meeting 15/126P The minutes of the last Planning Committee meeting on 8 September 2015 were approved and signed as correct. Proposed by Cllr Errington, seconded by Cllr Webster. 7 in favour, 2 abstentions as not present at that meeting. 15/127P Cllr Burtenshaw asked for a correction to be minuted in the 11 August meeting minutes, minute reference 15/91P to state that model aircraft have been flown over the corner of a resident s paddock, not their home as stated in the minutes. Clerk to copy this minute with the 11 August minutes. 4. Matters Arising 15/128P 15/86P Picket Post parking on verge and access road. The clerk has been advised the meeting is delayed clerk to chase for it to be rescheduled with a representative of the Highways England and Burley Parish Council. It was noted that the parking issue is beoming more dangerous with lorries continuing to park illegally on the white lines. 15/120P - Serious concerns of the impact of the cycling sportives on held within the parish. 2 Cllr Errington is re-drafting his letter to organistions including the Safety Advisory Group, NFDC, NPA, NFALC, and copy in other organisations expressing our dissatisaction with the proposed (then withdrawn) Gorley Road closure and also the frequency of these sportives through our parish. 15/121P Newtown Orchard. Concerns have been raised to the clerk relating to the development of Newtown Orchard not as per the planning permission granted. Cllr Spark advised the Enforcement team have reviewed the development and are happy it is being completed as per the planning permission granted. Cllr Spark has contacted the resident. 15/122P Cllr Errington advised the free NPA Planning Training event held by Steve Avery was a resounding success, and the NPA has plans to hold similar events in the future. 5. Public Forum 15/129P An attending resident enquired what is being done to protect the verges throughout Mockbeggar. Cllr Errington responded the Western Escarpment Steering Group is in the process of producing a leaflet to be sent to all houses advising of the special conservation status of the verges and how to look after them. 6. Development control and TPO applications: Please note: applications are minuted in the order they were discussed. 15/130P NPA 15/00709 Redlynch, 8 New Road, Mockbeggar outline application for two detached single storey dwellings & two detached garages (all other matters reserved for later approval). Cllr Loader explained the location and showed aerial pictures and photos of the existing property and its immediate locality. - The existing dwelling was built in 1935 and is built of red brick. - This outline application is to demolish the existing dwelling and build two detached single storey properties each with their own detached garage and driveway. - The Planning Officer s briefing note states this application is contrary to policy CP12 as the creation of any new residential development within the National Park must comply with one of four criteria: either located within one of the defined New Forest villages, or the replacement of an existing dwelling, or an agricultural or forestry workers dwelling, or affordable housing for local needs. - the Design & Access statement refers to Rose Cottage and Meadow Walk which are within 100m of Redlynch s site, stating they are of a comparable width and depth to Redlynch. This was noted, however a member suggested that development is not relevant as it was before the creation of the National Park status. The following concerns were discussed:- - The proximity of the proposed two new dwellings to the neighbouring properties; - The resulting intensification of this site and the impact on the street scene; - How such a development was contrary to very specific planning regulations. The applicant advised this development would result in two more affordable properties as opposed to an extension to the existing property which would increase the size and cost of such a property. It was proposed to recommend refusal under option 4 to the NPA, with the following reasons:- The Parish Council has concerns on:- - The proximity of the proposed two new dwellings to the neighbouring properties; Chairman Planning Committee 2 10 November 2015
3 - The resulting intensification of this site and the impact on the street scene; - That such a development was contrary to very specific planning regulations. 15/131P NPA 15/00714/PAFL Barn at Hockey s Farm, South Gorley determination as to whether Prior Approval is required for proposed change of us of agricultural building to retail (Class A1). Cllr Stainton had declared a pecuniary interest and she left the room. Cllr Errington explained the location and showed an aerial picture of the barn. - The barn is approximately 1500 sq.m however this application is to change the use of one section of it at the eastern end, the area being 440 sq.m. - The barn is already subdivided into three sections. - Hockey s Farm is buying a local feed and haylage business, so this section would be for a retail use to store the feed and haylage, with some repairs required to the external walls, which will be completed in tin and the concrete floor. - There is a difference of opinion between Planning Officers on whether or not part of an agricultural barn can be converted. The following concerns were discussed:- - Would there be an increase in traffic movements to Hockey s Farm? Any increase would be minimal, as many of the customers of the feed and haylage business are customers of Hockey s Farm aswell. It was commented that the members understand it is down to planning law, however it seems a perfectly acceptable change of use in connection with the existing business. It was proposed to recommend permission under option 1 to the NPA, with the following comment:- - The Parish Council support the change of use of the 440 sq.m of the barn as it is in connection with the existing business, which we want to continue to support. Seconded and all in favour (8). 15/132P NPA 15/00715 Forest Edge, Linford Road, Shobley single storey extension. Cllr Spark requested Cllr Errington to chair this application. Cllr Spark explained the location of the property and showed photos, aerial pictures and the elevations. The following was discussed:- - The single storey extension can be built under permitted development rights with a flat roof, however the applicants would like a more attractive pitched roof, which requires planning permission. - The increase to the habitable floor space is within the 30% permitted - The extension is not visible from the street scene, and it would be timber clad. - The proposed materials were agreed as a pleasing contrast to the existing property. It was proposed to recommend permission under option 3, with the following comments:- - The Parish Council would like the applicants to consider taking steps to mitigate any light pollution from the glazing on the extension, and for any external lighting to have Passive Infrared Sensors (PIRs). - The proposed materials were agreed as a pleasing contrast to the existing property. 4 The Chairman brought forward agenda item:- 7 Lawful Development Certificate for Existing Use application: 15/133P NFDC 15/11374 Compton Cottage, Ivy Lane, Blashford - Continued use of outbuilding as ancillary accommodation (Lawful Use Certificate for retaining an existing use or operation). Cllr Errington explained that the application was for the continued use of an existing outbuilding located within the curtilage of Compton Cottage as ancillary accommodation. The applicant was in attendance and stated the following:- - The property has been used as living accommodation for au pairs and the family s children since their purchase of it in 1994; currently two of the applicant s children are living in the outbuilding. - The applicant s elderly mother will be moving into the outbuilding and they wish to formalise its use. - The outbuilding has bedrooms and some bathroom facilities and requires repairs to the roof and external cladding. Members commented as follows:- - The outbuilding is located within a private domestic curtilage and members have no evidence to support or refute the current use of the outbuilding. It was noted, however, that with no evidence of kitchen facilities on the drawings, the building's use could more accurately be described as incidental to the main dwelling. - Concerns were raised and discussed on the use of the term ancillary use within the application, as this can include all activities which could normally be carried out in a standard house. The members requested the term incidental use be used instead, as this would cover the outbuilding s use as described by the applicant, with sleeping and Shower/W.C. facilities. - The Council wished to avoid the possibility of the outbuilding becoming a self-contained unit, separate and apart from the principal dwelling, and thus a stand-alone planning unit with a separate boundary demarcation. It was proposed to comment as follows to NFDC:- - The outbuilding is located within a private domestic curtilage and the Parish Council have no evidence to support or refute the use of the outbuilding for ancillary use to the primary residence. It was noted that there was no evidence of a kitchen, suggesting the building's use is incidental to the main dwelling, though with sleeping and some bathroom facilities. - The Parish Council would prefer the outbuilding to remain classed as incidental to the principal dwelling, but continuing to enjoy the existing facilities. The Chairman returned to item 6 Development control and TPO applications: 15/134P NPA CONS/15/0877 Newlands Farm, Rockford fell 2x Oak, pollard 1x Horse Chestnut, pollard & prune 1x Oak, prune 2x Oak. Cllr Burtenshaw briefed members that the NPA Tree Officer will be visiting the site on 7 October, so no comments were available from them. The following was discussed:- - Newlands Farm have full consent from the Somerley Estate to manage the trees on the land they occupy. Chairman Planning Committee 4 10 November 2015
5 - Tree 21 is an oak which is dead and the application requests for it to be felled. It was noted that in the past, the Parish Council has notified the NPA Tree Team and Newlands Farm that horses where ring-barking this particular tree and it has not been protected by being fenced off. - Tree 5 is an oak near the track opposite the Moyles Court School entrance/exit. This tree appears to be in a better condition, and it was the members opinion that this tree would not require felling. - The members would recommend a replanting program to replace any trees felled. It was proposed for a member to liaise with the NPA Tree Officer to raise the below concerns once the Tree Officer has visited the site:- - How trees need to be protected from the horses. - Tree 5 is thought not to require to be felled. - A replanting scheme should be agreed. 15/135P NFDC 15/11334 Communications Site, Land adj. to Grey Gables, Blashford Installation of 20m high mast; 4 cabinets (Prior Notification to carry out Telecommunications Development). Cllr Spark explained the location, advising the applicant had approached the Parish Council earlier this year in June for our comments on their proposals. - The application is identical to what was proposed previously. - The top of the Current mast is just visible from Headlands Business Park, and visible from some of Snails Lane with the tree cover almost as high as the receivers. - The top of the extended mast will be clearly visible from Headlands and very clearly visible to some Snails Lane residents with the receivers and the mast top being over 3m above the treetops. - The members would want the mast and antennae to be camouflaged to blend with both the tree cover and the sky. It was proposed to recommend permission under option 1 to NFDC with the following comments:- - The Parish Council would insist the mast and antennae to be suitably camouflaged/painted to help it blend in with the trees and the sky (as at 20m it is well above the tree canopy). This was made very clear when the applicant approached the Parish Council for its opinion earlier this year. 15/136P NPA CONS/15/0941 Lavender Farm, Highwood Lane, Highwood prune 2x Oak, fell 8x Silver Birch. Cllr Spark explained the location and advised our nominated tree representative, Mr John Stokes, had reviewed the trees and advised the proposed works would be good husbandry. It was proposed to raise no objections. 15/137P SFLA/15/0959 Greenford Bottom fell areas of scrub, gorse and mature trees encroaching on lawn habitat & burn arising. Cllr Shand explained the location and showed maps and photos of the proposed trees. - The areas of scrub gorse and mature trees are growing along the bank of the stream. - This is not thought this is part of any restoration plans for Linford Bottom. 6 - Some members were concerned about the felling of mature trees, specifically oak and pine, and suggested mature trees can be kept within a lawn habitat. It was proposed to raise objections with the following comments:- - The Parish Council would prefer mature trees to be left as part of the lawn habitat. Seconded, 7 in favour, 2 against. 15/138P SFLA OF15-11 Linford (to the rear of Great Linford Cottages) fell selected scattered birch and thorn bushes to restore the open lawn area. Cllr Shand explained the location and showed photos, one of which was from the Great Linford gate. There were discussions as in the photo from the Great Linford gate the vegetation appeared thick, and concerns were raised of the felling of the more mature trees. The scattered birch and thorn bushes were ascertained by reviewing an aerial map. It was proposed to raise no objections. 7. Consider Application for a Certificate of Lawful Development for Existing Use (LDCE): Discussed under minute reference 15/133P. 8. Planning Authority Committee meetings, Appeals and Enforcements 15/140P Meeting Oaks APP/B9506/D/15/ (circ.7sep) appeal dismissed All were advised to read the decision notice for interest. 10. New Forest National Park Building Design Awards 2015 new annual Building Design Awards scheme 15/141P Any nominations for this award scheme closes on 30 October Update from Cllr Spark regarding name of the Gorley Road/Highwood Lane 15/142P Cllr Spark has received feedback from 5 residents, 4 of which request the name be corrected on mapping from Highwood Lane to Gorley Road. He has been in touch with Ordnance Survey who provide all the mapping data for google maps, sat navs, etc. The have acknowledged that there has been a mistake when transcribing from larger scales to smaller maps and they were grateful for the mistake being pointed out. Ordnance Survey are now in the process of changing the next print back to the correct Gorley Road but inform that it will take a very long time for Google and satnavs to catch up. Correspondence: 15/143P The Clerk had received photos from Kelvin Winch at Ringwood & Fordingbrisge Footpath Society advising of a fallen tree blocking FP26 in Harbridge, and it could be a job for the forthcoming Lengthsman visit. Cllr Burtenshaw ageed to walk the path to try and establish whose land the tree is on and report back to the clerk. Other Lengthsman jobs suggested are a finger post in Harbridge and a repeat of the nettles on FP701 between Snails Lane and Ivy Lane. 14. Other Business 15/144P Cllr Webster advised the restoration works have been halted several times on the River Avon following complaints from residents. The meeting closed at 9.29pm.
