1 939 ARDIGH PARISH COUNCIL MINUTES OF THE MEETING OF THE COUNCIL HELD ON 12 th January 2015 AT THE VILLAGE HALL AT 7.30PM PRESENT: Cllr Barrott (Chairman) Cllrs Talbot, Sinclair, Chase-Gardner, Thompson, Josselyn, Halsey, Smith, Scott-Barrett and Andrews. In attendance: Clerk Mrs L Edwards 96 Chairman welcomed the Councillors. Action 97 Apologies for absence Cllr Whitfield, Cllr Gueglielmi 98 Declaration of Interests None 99 Public participation There were no public attendances. District and County Councillors Neither District Councillor Neil Stock nor County Councillor Carlo Guglielmi was present. Police No police representative was present and no reported incidents for December 100 Minutes of the last meeting Minutes of the meeting 10 th November and 8 th December 2014 were approved by the council and signed by the Chairman. It was noted that 39 Harwich Road had been entered twice under planning and one entry would need deleting. Clerk to action 101 Clerks report on the last Minutes The Clerks report had been circulated prior to the meeting and feedback given was to chase the Village Hall car park quotes and give an appropriate deadline. The Chairman including Cllr Halsey and Cllr Talbot agreed to speak to the landowners of the alternative land suggested for the Cemetery extension. In addition the Clerk had received three letters for discussion. Essex County Council local highways panel had written to all parishes requesting information on any works and projects to be considered for the 2015/16 budget. It was agreed that all the outstanding highways issues listed on the Clerks report should be submitted in addition to the replacement bus stops that had been put forward on our behalf by Adrian ECC. A letter had been received from a neighbouring parish who had participated in a community speed watch scheme and were offering support to the parish if Ardleigh was considering a similar scheme. It was discussed and agreed that Ardleigh would not participate with this. Tendring District Council had sent an requesting feedback on the part night street lighting scheme. It was discussed and agreed no negative feedback had been received but as a rural parish many of the Ardleigh residents are already in areas with no street lighting resulting in this change having little impact on the parish.

The use of land will change to B8 Fairfields Colchester Road Construction of a single detached bungalow with new access to Colchester Road. Ardleigh Parish Council objects to this application. A previous, similar application to develop this site was refused permission a few years ago, and an appeal was dismissed by the Inspector and the Parish Council considers that nothing has changed since the dismissal The proposed development will have a significant impact on the open character of the site and the area and will unacceptably change the rural character of the area. The site is in the open countryside and is outside the defined settlement limits, and such development is strictly controlled by the 2007 Local Plan and by the emerging Local Plan in order to protect the natural open quality of the countryside. The proposal will create a visible and intrusive form of infilling in a rural locality and would represent an unwelcome precedent for development in the area. The Council is also concerned that an additional vehicular access onto this stretch of Colchester Road, where the speed limit is generally exceeded, will be detrimental to highway safety. The Parish Council considers that the significant harm that will be caused to the character and appearance of the area by the proposal substantially outweighs any perceived benefits that the development might create The Parish Council notes that the claims made in the "supporting statement" about services and facilities available within the village are incorrect and out of date and are therefore mis-leading The Bungalow 20 Harwich Road Use as a single dwelling house with amenity and parking areas Ardleigh Parish Council remains in agreement with the comments for the previous refused application on this site, on the basis there is still not sufficient evidence to support this application. Land adjacent 1 Station Road T1 Walnut reduce lateral spread on property side to provide 1m clearance from property, raise crown to 3m removing sub laterals only. Comments submitted prior to the meeting 19 Harwich Road Ardleigh Parish Council strongly objects to this application. The application fails to refer to the newly adopted Minerals Local Plan which clearly sets out the policy requirements for such uses - and the proposal is in direct contravention of the requirements of the MLP. The MLP has clearly set out the sites within Essex which will, for the life of the MLP, constitute the locations for mineral extraction, re-cycling aggregate etc - this site is not included as one of these and was never under consideration during the preparation of the MLP, and such "windfall" sites are not required to meet the mineral needs of the County, and should therefore be rejected. The proposal is incompatible with surrounding existing and permitted neighbouring land uses and will create issues of noise, vibration, pollution, loss of amenity, disturbance and of serious adverse environmental impact This is not an appropriate location for such a land use and is not a facility that is required by the market - there are already at least 3 existing aggregate re-cycling facilities within Ardleigh and none of these is working to anywhere near capacity - so a further recycling facility is not required and the "need" has not been justified by the applicant. In addition all the existing sites are better located from an environmental and traffic point of view. Most re-development sites these days carry out the aggregate re-cycling on site, thus considerably reducing the need for individual small re-cycling sites, which raies questions about the viability of this proposal. The Parish Council considers that it is unsustainable to move a mobile crusher to site for a few days each month: the regular movement of this very large piece of equipment will be detrimental to highway safety through the village of Ardleigh and especially at the turning into Home Farm Lane, which is already a dangerous junction.the Parish Council notes that a few years ago, ECC and Tendring DC agreed an Industrial Land Brief for Martells, which included reference to the fact that Martells is ideally suited to "nonneighbourly" industries such as aggregate re-cycling - the proposed site is completely the opposite and is totally unsuitable for aggregare re-cycling It is also considered to be a totally inappropriate use of top quality agricultural land, one which would represent unacceptable industrialisation of the rural environment. There has been no mention in the application of any effort to mitigate the resultant environmental damage and or to introduce any form of dust control which will have a huge, detrimental impact on the surrounding businesses which include fruit farms. The site is in a dangerous location, with HGV's having to negotiate narrow rural lanes and enter the main highway network at a very dangerous bend
4 in the road with restricted visibility in both directions. The proposal will therefore have an unacceptable impact on the efficiency and safety of the local road network, which is contrary to the requirements of the MLP. The claim that the site is screened by mature trees is incorrect: the trees in question are not on the applicant's land nor are they under his control, indeed, they have recently been substantially reduced in height which has actually exposed the site to the area. There are contradictory statements within the documents submitted with the application about the number of HGV movements to / from the site, but regardless of which figure is used, the number of HGV movements is unacceptably high for the local road network and for the village of Ardleigh.The Parish Council is concerned by the amount of work that has already taken place on this site in connection with the proposal, despite the fact that there is no permission: a large bund of soil has been created and a large section of hedging has been ripped out to create a wide, unlawful access from the site onto the highway. These works have also resulted in a substantial number of HGV movements to and from the site on a very frequent basis.. It was discussed that the Parish Maintenance contracts were all due for renewal this year and agreed that some of them needed reviewing and updating. Invitations for tenders will be placed in the parish magazine and specifications can be requested from the Clerk. Clerk to action Recreation, Play and Open spaces Colchester Road play area Risk assessments received from Cllrs Sinclair and Talbot with no issues reported. The Chairman reported the meeting to discuss the progress of the former squash club was taking place at the Village Hall on Friday 16 th January. Environment and Maintenance It was reported that the light road bollards in the village centre had been damaged. Clerk to contact Highways. Cllr Talbot reported the conifer hedge in Blacksmiths lane was still obstructing the street lighting despite attempts to contact the owner and have the hedge cut back. It was agreed top contact Bland Landscapes and have the hedge pruned for security. The Chairman reported the amount of complaints being received for the landfill site and the smells had reached unacceptable levels over the Christmas period. The environment agency had given notification of a temporary flare being fitted on 9 th January until a new bigger flare can be fitted at the end of the month. Sarah McCarney was still the contact for the environment agency and all complaints need to be directed to her to monitor. Footpath between Dead Lane and Wick Lane has been reduced to half RT

Although the figure remains the same there is an increase of 0.56% as the LCTSS grant has reduced slightly from 2014/15. It was discussed that 2015 is 70 years since VE day and it would be an ideal opportunity to hold a village day. Clerk to include in the Millennium Green Trust meeting agenda for 26 th January. The Clerk had circulated the NALC pay scales from prior to the meeting. These were reviewed and accepted Accounts for payment, cheques to be approved and signed.
