In the matter of 2010 U.S.-Haneda Combination Services Allocation Proceeding ) ) ) ) ) ) ) APPLICATION SUPPLEMENT OF DELTA AIR LINES, INC. Delta has requested permission to move its Detroit-Haneda slot pair to the Seattle- Haneda route. Seattle is the largest U.S.-Tokyo O&D gateway that currently lacks Haneda service. Grant of Delta s request will enable Delta to provide its consumers with a more attractive schedule and improved product offering; it will also enhance Delta s competitiveness against the Star and oneworld alliances that dominate Haneda by virtue of the protected incumbent hubs of their immunized Japanese alliance partners. By Order , the Department instituted this proceeding to determine whether to grant Delta s motion, and called for additional facts and evidence to support its decision. Delta is pleased to offer this application supplement in response to the Department s evidence request. I. Executive Summary The Department s prior selection of Delta for two U.S.-Haneda slot pairs was correct and remains necessary to promote 3-way alliance competition between Delta and the immunized Star (United/ANA) and oneworld (American/JAL) alliances operating in the U.S.- Japan and U.S.-Haneda marketplace. By establishing new Haneda service at the Seattle gateway, Delta will be able to make more productive use of its limited Haneda slots, thereby generating greater public service and competitive benefits.

3 Delta Application Page 2 In all other open skies markets, Delta would be free to make the proposed service improvements without seeking regulatory approval. The unique bilateral compromise that was reached on Haneda requires the Department to conduct this proceeding. Developments in the U.S.-Japan bilateral relationship and the immunized alliance landscape since these slots were originally awarded in 2010 make Delta s request for Haneda relief all the more compelling. First, while restrictions have been lifted on all U.S.-Japan services except Haneda, Japan has not been willing to engage on true open skies access to allow all U.S. carriers to offer fully competitive service at Haneda. Instead, in the last bilateral round, Japan sought to limit any further opening of Haneda to advantage its flag carriers and, by extension, their U.S. alliance partners. Second, in the original Haneda proceeding, the Department declined to consider the competitive impacts of the U.S.-Japan immunized alliances on the Haneda awards, because those applications were pending and not yet granted. There is no longer any doubt that United/ANA and American/JAL have full immunity and must be considered as a single competitive entity. The Department accepted the elimination of all competition between the United-ANA and the American-JAL networks on the theory and expectation that the ATI alliances would generate metal neutral joint venture benefits. United and American should be expected to access Haneda though the metal-neutral transpacific JV flights and hub networks operated by their Japanese partners. Such efficiencies are the fundamental public interest rationale for granting and maintaining antitrust immunity. By contrast, Delta stands as an independent competitor and the sole network challenger to the Star and oneworld immunized alliances on U.S.-Haneda, U.S.-Japan, and U.S.-Asia routes. It is important that healthy 3-way alliance competition be preserved. Accordingly, it is in the public interest to grant Delta s request to make the best and most effective use of its limited Haneda slots by using them at the Seattle gateway.

4 Delta Application Page 3 The following points summarize the benefits that would be achieved by granting Delta s request: Seattle will be established as a new gateway for Haneda. With 114,000 annual Tokyo passengers, Seattle is the largest U.S.-Tokyo O&D market without Haneda service. 1 San Francisco and Los Angeles each have one or more Haneda flights, placing Seattle at disadvantage to other west coast gateways. Furthermore, ANA and JAL have discretion in the use of their Haneda slots, meaning that the Star immunized alliance is free to add service at San Francisco, and oneworld is free to chose another U.S. gateway. Delta cannot move its slots without permission, and Seattle will only receive Haneda service if the Department approves Delta s request. Consumers will benefit from more convenient Haneda schedules. DL U.S. cities will receive one-stop connecting service to Haneda via Seattle. DL-401. Seattle s geographic location provides the largest catchment area and best network coverage of the United States. Despite strong communities of interest with Tokyo, the Pacific Northwest lacks convenient access to Haneda because the existing west coast gateways are too far south and unreasonably circuitous. DL-204. Alaska Airlines will bring its Seattle network into play, improving service and competition for U.S.-Haneda passengers. Alaska and its employees will benefit from the additional traffic flowing across their system. DL-202, DL- 401; Answer of Alaska Airlines (August 8, 2012). Competition will be maintained among the alliances with transpacific Haneda slots distributed as follows: SkyTeam 2 slot pairs, Star 2 slot pairs, oneworld 3 slot pairs. DL-301. The Department s Instituting Order placed emphasis on maintaining alliance competition and improving the competitive market structure. Delta is the only effective network competitor to the immunized United/ANA and American/JAL alliances. DL-304. Haneda is dominated by the protected hub networks of ANA (which operates 262 Haneda departures) and JAL (which operates 211 Haneda departures). Exhibit DL-302. Delta operates just 2 Haneda departures. Any diminution of Delta s Haneda presence would be adverse to the competition and market structure benefits the Department seeks to promote. II. Evidence Request In response to the specific elements of the Department s evidence request, Delta states as follows: 1 See, DL-201 (MIDT data adjusted to account for direct sales).

5 Delta Application Page 4 1. Service Proposal A. Schedule Delta s Seattle s proposal creates consumer friendly schedules that fit well with the Haneda international nighttime operating window. Delta s proposed Seattle-Haneda schedule is as follows: Depart SEA 7:35 pm HND 12:00 am Arrive HND 10:00 pm SEA 5:00 pm Delta s proposal enables attractive new time channels. Existing Seattle-Tokyo flights depart mid afternoon in both directions. The proposed westbound flight enables Seattle originating passengers to work a full day and depart in the early evening. The proposed eastbound flight also enables passengers to work a full day in Tokyo, enjoy a business dinner, and save a night s hotel expense -- taking advantage of the overnight flight and onboard amenities including Delta s new lie flat BusinessElite seats. B. Network Connectivity Seattle s northwestern geography is ideal to serve as a connecting gateway for U.S.- Haneda passengers. Seattle lies on or near the Great Circle route to Tokyo for the greatest number of cities in the continental United States. DL-203. Together, Delta and its domestic codeshare partner, Alaska Airlines, will provide nonstop-to-nonstop connections to 42 U.S. cities. Full connecting schedules are provided at Exhibit DL-401 et seq. Seattle is a successful and growing international gateway for Delta, currently supporting nonstop service to Tokyo, Beijing, Osaka, Amsterdam and Paris. DL-205. Delta s proposal will open Seattle and the entire Pacific Northwest region for new service to Haneda. Existing west coast Haneda gateways at San Francisco and Los

6 Angeles involve more than 1,000 miles of backhaul in each direction, making them Delta Application Page 5 unreasonably circuitous for Seattle and Pacific Northwest passengers. DL-204. This is particularly unfortunate given the strong trade relationships and communities of interest that exist between this region and Tokyo. See, Answer of the Port of Seattle (August 8, 2012); Washington Congressional Delegation letter (August 6, 2012); Governor Christine O. Gregoire letter (August 7, 2012). Delta s domestic codeshare relationship with Alaska Airlines is another important attribute of Delta s service proposal. In December 2008, Delta and Alaska deepened their commercial relationship, with Alaska agreeing to provide additional dedicated feed to support Delta s international flights from the west coast. Alaska currently feeds more than 200,000 passengers annually to Delta s international service. Seattle is Alaska s largest hub, which continues to grow year after year. By authorizing Delta s Seattle-Haneda service, Alaska s Seattle domestic network will be brought into play, improving service and competition for U.S.-Haneda passengers. Alaska and its employees will, in turn, benefit from new traffic flowing across their system. C. Aircraft Delta plans to begin Seattle-Haneda service with newly renovated and reconfigured Boeing ER aircraft, equipped with 225 passenger seats (25 Business Elite, 29 Economy Comfort, and 171 standard economy). DL-103. Designed and built by Boeing in Seattle, it is fitting that the B767 would be used to open the Seattle gateway for new service to Haneda. Delta is investing $2 billion in customer product enhancements. As part of this program, Delta s B767 fleet is receiving all new interiors including lie flat business seats and on demand video entertainment at every passenger seat. As demand for the new service builds, Delta has the ability to upgauge to larger aircraft in its existing fleet, including the B777 (269 seats) and the B747 (376 seats).

Start Date Delta is prepared to meet any startup condition ordered by the Department, and could begin Seattle-Haneda service as soon as 90 days from the date of a final decision in this proceeding. However, as the Department is aware, winter is the low season for mainland U.S.-Tokyo traffic, and a winter start date is not optimal. For this reason, Delta would prefer to begin service on March 31, 2013, the start of the IATA summer season. Delta must maintain its Seattle-Narita hub schedule to provide connectivity to the rest of Asia. Therefore, the proposed new Seattle-Haneda flight represents true new capacity. By contrast, Star and oneworld can add Haneda flights while rationalizing Narita service and relying on Japanese partner flying. This is exactly what American did at JFK, dropping its Narita flight, adding Haneda service, with JAL continuing to fly Narita. For this reason, other applicant benefit claims of additional Haneda capacity and/or an early start date are offset by the likely rationalization of Narita flights. In any event, as stated above, Delta will meet any startup condition required by DOT. 2. Description of Delta s U.S.-Tokyo Service Delta has a substantial Tokyo presence. Though its Tokyo/Narita hub and two existing Haneda flights, Delta provides the only effective broad-based alliance competition to the immunized Star and oneworld alliances. DL-304. However, in order for Delta to continue to provide this competitive discipline, it is essential for Delta to maintain and expand its Haneda presence to achieve competitive parity with Star and oneworld. Delta s Tokyo hub generates large scale consumer benefits and supports high quality U.S. aviation jobs. Narita is the focal point of Delta s transpacific network, connecting eight mainland U.S. cities to Tokyo with onward service to eight destinations in

Delta s network provides competition to Star and oneworld in the thousands of U.S.- Asia city-pairs linked by Delta s U.S. hub gateways to Tokyo and beyond: U.S.-Tokyo Gateways Detroit New York Minneapolis Atlanta Los Angeles San Francisco Portland Seattle Asia Beyond Destinations Singapore Bangkok Manila Hong Kong Taipei Shanghai Beijing Seoul Delta also competes for beach traffic in the Tokyo-Honolulu and Guam/Saipan markets. However, Delta is disadvantaged in the Honolulu beach market because it is the only Tokyo- Honolulu competitor that does not have the ability to offer service at Haneda. (United/ANA, American/JAL, and Hawaiian all serve Haneda-Honolulu). Haneda is highly preferred for local Tokyo passengers. Given Japan s desire to expand Haneda into a 24-hour international airport, ultimately Delta will require the slots and facilities necessary to relocate its Tokyo hub. In the meantime, until Japan is willing to make Haneda a true open skies airport with fair and equal competitive opportunity for all carriers, the Department must manage the limited Haneda opportunities to maximize competition against the immunized Star and oneworld alliances and their dominant incumbent hubs at Haneda. Granting Delta s request to relocate its Haneda slots to the Seattle gateway will help to achieve this important objective. 3. Public Interest Benefits of Delta s Seattle-Haneda Service A. Delta s Proposal Will Preserve 3-Way Alliance Competition at Haneda and Enhance the Competitive Market Structure. In the 2010 Haneda proceeding, the Department excluded consideration of the impact that the pending United and American ATI applications would have on the allocation of Haneda slots. (Order to Show Cause, , page 8; Final Order , page 6). Now that United and American have been granted antitrust immunity with ANA and JAL,

9 Delta Application Page 8 respectively, the DOT has properly indicated its intent in this proceeding to consider the overall competitive environment and market structure. Order , page 3. On these grounds, Delta s proposal to serve the Seattle gateway best serves the public interest. Fundamental to the Department s consideration of the competition for Haneda slots is the fact that the two immunized U.S.-Japanese alliances have inherent advantages over Delta, which does not have a Japan alliance partner. As a SkyTeam member and major U.S.-Japan competitor, Delta is the only carrier capable of offering a competitive alternative to the west coast Haneda services of American/JAL at San Francisco and United/ANA at Los Angeles. The DOT has consistently sought to foster inter-alliance competition. 2 This case presents an opportunity to ensure that the two large immunized alliances are not allowed to eliminate competition in the U.S.-Haneda and U.S.-Japan markets. Permitting Delta to serve the Seattle gateway in competition with San Francisco and Los Angeles with satisfy the DOT s competition and market structure enhancement objectives in this proceeding. United has already taken the position that it should be permitted to serve the San Francisco-Haneda market with its own aircraft -- ignoring its prior benefit claims for antitrust immunity with ANA based upon the principle of metal neutrality. 3 ANA operates the single largest hub operation at Haneda and United enjoys the benefit of ANA s dominant position at the airport. ANA is free to use its Haneda slots to serve any gateway in the U.S. -- and to that extent United has flexibility to offer Haneda service to its customers at San Francisco or any other gateway of its choosing through its partner ANA. It matters not whether United or ANA operate the aircraft under the principle of metal neutrality. 2 See Order , page 17 ( We also examined the changes in inter-alliance competition. 10 Delta Application Page 9 It is worth recalling the benefits of metal neutrality found by the DOT, as urged upon it by United and ANA, after the award of Haneda slots in this Docket: Metal neutrality eliminates these barriers [to investing in service improvements] by allowing carriers to value revenue on the network instead of revenue on their individual aircraft (metal). With immunity, carriers can achieve these efficiencies and pass benefits on to consumers. (Order , Docket OST , page 14) By United s own assertion, there is no economic difference whether United or ANA operate the San Francisco-Haneda route. To the extent United is now suggesting this is not the case, the DOT may wish to reconsider the wisdom of having granted United immunity with ANA. However, since United and ANA presently enjoy the protection of antitrust immunity and continue to coordinate their U.S.-Japan services, the transfer of a slot pair to United at Delta s expense would not be consistent with the DOT s objective to enhance competition in the U.S.-Japan market. B. Delta s Seattle-Haneda Proposal Will Create Important Service Benefits for the Traveling Public A key public interest consideration favoring Delta s request to move to the Seattle gateway is the fact that Seattle is the largest U.S.-Tokyo O&D market without Haneda service. DL-201. In addition, the Seattle gateway competes with San Francisco and Los Angeles for U.S.-Tokyo traffic and is disadvantaged in not being able to offer service to Haneda. The DOT s emphasis on market structure considerations and inter-gateway competition between the alliances supports the selection of Seattle as a new Haneda gateway. Delta, in conjunction with its partner at Seattle, Alaska Airlines, will be able to offer convenient nonstop-to-nonstop service from 42 points in the United States extending the benefits of Haneda service to the Pacific Northwest region and throughout the United Sates. DL-202, 401. Delta has built a successful international gateway at Seattle and will succeed in the Haneda market as it has in other international markets. DL-205. Seattle s demographic and business metrics also favor the establishment of Haneda service at the

11 Delta Application Page 10 Seattle gateway. Seattle s GDP ranks near the top of 50 U.S. metropolitan areas in categories such as exports, growth, and household income. DL-206. Yet, unlike the other major west coast business centers of San Francisco and Los Angeles, Seattle does not have any service to Tokyo s preferred downtown airport. These strong economic metrics support the Delta request to operate from Seattle. DOT can best achieve the public interest objectives it seeks to attain in this proceeding by allowing Delta to offer Haneda service at the Seattle gateway. This will enable Delta to better compete on the west coast with the services of the immunized alliance carriers. Conversely, an award to any other carrier would diminish broad based alliance competition for U.S.-Haneda and U.S.-Tokyo passengers. 4. Aircraft Statement Delta has B ER aircraft available and on hand in its existing fleet. Delta s B767s are widely deployed in its international network, and additional reserve aircraft are currently undergoing interior refurbishment as described above. All of Delta s aircraft comply with FAR Part Fuel Consumption Fuel consumption data is provided at Exhibit DL-102. Delta anticipates no difficulty obtaining fuel for the proposed services from its regular suppliers at Seattle and Haneda. The environmental impacts of the service will be de minimis. Because Delta would otherwise deploy these aircraft elsewhere in its network, there will not be a near term net change in aircraft fuel consumption of more than 10 million gallons. 6. Start-Up Condition Delta will accept any start-up condition ordered by the Department, and could begin service as soon as 90 days from the date of a final award. Delta would prefer to start

12 Delta Application Page 11 service on March 31, 2013 at the beginning of the IATA summer season, to coincide with the normal upswing in seasonal demand. III. Conclusion Delta s proposal to establish Haneda service at the Seattle gateway will improve Delta s utilization of its limited Haneda slots, thereby enhancing consumer benefits and competition on U.S.-Haneda routes. For the forgoing reasons, we respectfully urge that Delta s motion be granted.
