March 2, 2016 The Board of Elko County Commissioners met in regular session on Wednesday, March 2, 2016, at 1:30 p.m., in Suite 102 of the Nannini Administrative Building at 540 Court Street, Elko, Nevada. Randy Brown Deputy District Attorney Kristin McQueary Deputy Clerk Michele Merkley Undersheriff Clair Morris Library Director Jeanette Hammons Chairman Guttry called the meeting to order at 1:30 p.m. County Manager Robert Stokes led the meeting participants in the Pledge of Allegiance. 1:29:56 PM: I. COMMENTS BY THE GENERAL PUBLIC: Thomas Burney, Carlin Nevada, advised he spoke to the Commission a few weeks ago regarding the new Justice Court. Mr. Burney advised he had more PAGE 1

2 concerns, he had not seen anything addressing why it was needed other than the population numbers. Mr. Burney further advised that in 1995, in the US Supreme Court there was an issue over playground safety. He advised that the Supreme Court found that if the government said it was needed than the government should pay for it, and he didn t see what that did not apply here. He advised he didn t have formal education in the legal system, but knew the difference between right and wrong. He further advised he felt very strongly about this and felt it was a crime being committed against everyone. Mr. Burney stated there were 6 people who had applied for the position, and he had not seen anything from them regarding the issue of why the Court was needed. Commissioner Guttry advised that he did now know the history behind the legislature that allowed this to happen, but it was quite a while ago and never reared its head until recently. Commissioner Guttry advised there were legislators who were attempting to put together legislature so that the County Commission could have a say in it, but as of now they have no say in it whatsoever and had to fund it. Mr. Burney pointed out that there was a huge part of the population that did not have Saturdays and Sundays off, and advised that he thought the Court should function 7 days a week to accommodate the people. Commissioner Guttry advised there were people who could not accommodate a Monday through Friday schedule but then there would be an issue with overtime and additional support staff, and it would increase the cost even more. Mr. Burney advised at the very least the issue needed to be talked about. 1:37:41 PM: II. SOUTH FORK INDIAN RESERVATION SOUTH FORK BAND COUNCIL: Discussion and consideration of approval of a request from the South Fork Indian Reservation for a County permit to make improvements on 1.4 miles of County right-of way on SFIR/Lee Road from the intersection with Highway 228 as part of a resurfacing improvement project of 4 miles utilizing Bureau of Indian Affairs Safety Program funding. Randy Brown advised this was a request to resurface 1.4 miles of County road to the reservation boundary, all from BIA funding. He further advised the Band was basically just requesting the permission in lieu of an encroachment permit. Commissioner Guttry advised the road had been a problem for a long time and saw no reason why the Commission would not approve a generous offer from the Band Council. PAGE 2

3 Alice Tybo, South Fork Indian Reservation, advised she was the Chairman when the project was started and they didn t have funding initially but now have safety funds released to them to finish the project. Ms. Tybo provided a handout to the Commission of what the road would look like once finished. Randy Brown pointed out that this was brought to the Commission about 3 or 4 years ago for a grant application but they did not end up getting the grant. Ms. Tybo advised there was 1.1 million dollars from the fund to continue on another 3 miles of road that needed done. Tyler Reynolds, Vice Chairman of South Fork Band, advised they would like to finish the road from the highway to Woods Lane. Commissioner Andreozzi asked if this would be an encroachment permit. Randy Brown advised this would be in lieu of an encroachment permit. Commissioner Guttry asked if once the road was paved, if it would be put on the inventory of roads to maintain. Randy Brown could not say at this point, but stated it would make it easier to maintain the road. Alice Tybo advised currently the County did not maintain the road, the South Fork band did. Ms. Tybo advised a big concern was that the County school busses run on the road and it was a major safety hazard. MOTION: Commissioner Eklund moved to approve the request from the South Fork Indian Reservation for a County permit to make improvements on 1.4 miles of County right-of way on SFIR/Lee Road from the intersection with Highway 228 as part of a resurfacing improvement project of 4 miles utilizing Bureau of Indian Affairs Safety Program funding. Commissioner Steninger seconded the Motion. The motion passed unanimously. 1:43:49 PM: III. ELKO COUNTY LIBRARY BOARD OF TRUSTEES: Report and review of Board of Trustees activities and minutes including issues related to the operation of the County Library. Jeanette Hammons, Library Director, stated she would appreciate the South Fork Band resurfacing the road as the bookmobile travels that road as well. Ms. Hammons updated the Commission as to the statistics for the month of February. Almost all numbers have increased, the only thing that went down was internet use. Ms. Hammons advised of the March activities including story time, game time Thursdays, teen book club and after school crafts. Ms. Hammons stated there is a new Youth Services Librarian, Holly Whittle, who she hopes to bring to the Commission next month. Barrick will be sponsoring the summer PAGE 3

4 reading program, and the library had an author signing with Pam Flowers, who was the first solo woman to complete the Iditarod. Ms. Hammons stated the Spring Book Fair will be starting March 14 and will run through March 26. The fair raises funding for the story time crafts and afternoon crafts. The Spring extravaganza will be starting March 24. The Friends book sale is starting back up in April, Just Desserts will be May 7, and tickets are available. Ms. Hammons advised friends of the library get discounted tickets, and membership is $15.00 for 3 years. 1:50:25 PM: IV. ELKO COUNTY SHERIFF S OFFICE: Report of activities related to the operations and activities of the Elko County Sheriff s Office. Undersheriff Clair Morris advised they were 67% into the budget, 68% for patrol and 61% in the jail. Undersheriff Morris updated the commission as to the statistics for the month of February, including the number of felony and misdemeanor arrests, drug arrests, agency assists, traffic stops and citations. Undersheriff Morris advised the Rural Deputy Aitor Narvaiza had been promoted to Sergeant and gave a report of the number of events the Rural Deputies had been involved in. Undersheriff Morris gave a report as to the number of Concealed Carry Weapon Permits issued, the number of ex-felon and sex offenders registered, work cards issued, fingerprints done, and total customers. He also stated that CCW permits are issued Tuesday through Friday. A report was given regarding the School Resource Officers and the events they had been involved in, and Undersheriff Morris added that the truancy rate was down 57% from January/February of people were booked into the Jail during February, and 170 were in custody this morning. Commissioner Dahl advised he saw a letter in the newspaper about the drug problem in Elko and a drug dealer that hasn t been arrested. Undersheriff Morris stated isn t that easy, it takes time and they were working diligently. They now have 2 deputies assigned to the task force. Commissioner Dahl asked how big of a problem drugs are in Elko County and if it is getting bigger. Undersheriff Morris advised yes it is, and that most burglaries are drug related to support their habit. He spoke regarding the high speed pursuit near Jackpot which was drug related. Commissioner Eklund asked if heroin is on the rise in Elko. Undersheriff Morris advised it absolutely is, painkillers were overprescribed and now people have turned to heroin as it is cheaper and has the same effect. PAGE 4

5 Commissioner Eklund commented regarding an article he had read regarding a drug arrest in Twin Falls. Commissioner Steninger advised that on the yearend report, heroin went from less than a gram in 2014 to 365 grams last year. Undersheriff Morris advised doctors have cut back on prescribing painkillers so they are tougher to get so people turn to heroin. Commissioner Guttry thanked him for the report. Commissioner Andreozzi inquired if bath salts were still prevalent. Undersheriff Morris advised those were still being seen, but not as bad as they used to be. Heroin is the drug of choice. 1:59:11 PM: V. ELKO COUNTY TREASURER S OFFICE: Consideration of the authorization of a Treasurer Trustee Property Auction on April 14, Rebecca Erickson, Elko County Treasurer, advised she was asking for approval of the auction, and stated a list of the properties had been provided to the Commission. Ms. Erickson advised several had been paid since the list was given to the board and would be removed. Ms. Erickson added there was a mining claim on there, but that would be coming off the auction as well. MOTION: Commissioner Andreozzi moved to approve the authorization of a Treasurer Trustee Property Auction as identified in the delinquent properties on the subject list provided. Commissioner Dahl seconded the Motion. The motion passed unanimously. 2:00:47 PM: VI. ELKO COUNTY PLANNING AND ZONING: Road Dedication Request for a Parcel Map A. Discussion and consideration of approval of a Road Dedication request for public access but not for maintenance for the Antony Robert Brill and Diane Elisabeth Brill Parcel Map located in Sec. 5, T. 36N., R. 57E., MDB&M approximately 5 ½ miles north of the Ryndon Exit on I- 80 on Coal Mine Canyon Road. Randy Brown advised this was a parcel map that had been approved by the Planning and Zoning Department, and that it met all State and local ordinances. The staff recommendation was for approval and acceptance of the road for dedication for public use but not for maintenance. PAGE 5

6 MOTION: Commissioner Dahl moved for approval of a Road Dedication request for public access but not for maintenance for the Antony Robert Brill and Diane Elisabeth Brill Parcel Map located in Sec. 5, T. 36N., R. 57E., MDB&M approximately 5 ½ miles north of the Ryndon Exit on I- 80 on Coal Mine Canyon Road. Commissioner Eklund seconded the motion. Tom Ballew, High Desert Engineering, advised he had the map if the Board would care to sign it today. Randy Brown asked that Mr. Ballew provide the map to him. The motion passed unanimously. B. Road Dedication Request for JLJ Ranches Unit No Discussion and consideration of approval of Road Dedication requests for public access and public utility easements but not for maintenance for the JLJ Ranches, Unit No. 3 subdivision. Road dedication requests are for Third, Fifth, Seventh and H Streets located in Sec. 11, T. 37N., R. 69E., MDB&M, approximately 18 miles north along Pilot Valley Road and south of Montello, Nevada. Randy Brown advised this was a subdivision plat approved by the planning commission with conditions, accepting those same roads for dedication but not for maintenance. Staff and the planning commission recommend approval. MOTION: Commissioner Eklund moved for approval of Road Dedication requests for public access and public utility easements but not for maintenance for the JLJ Ranches, Unit No. 3 subdivision. Road dedication requests are for Third, Fifth, Seventh and H Streets located in Sec. 11, T. 37N., R. 69E., MDB&M, approximately 18 miles north along Pilot Valley Road and south of Montello, Nevada. Commissioner Andreozzi seconded the motion. Commissioner Andreozzi stated that the approval process is different that he s accustomed to. He appreciated the position that the planning commission took regarding responsibility of the maintenance, and asked if the wording could be changed to require rather than encourage to establish a homeowners association after 75%. Randy Brown advised the State statutes did not allow them to go that direction without an infrastructure. Mr. Brown advised the planning commission had been getting agreements from the developers, as part of the development PAGE 6

7 agreement. He advised they have managed to get it as far as being part the deed of record, which takes a little pressure of the County. He further advised he has seen a great improvement over the last 20 years. Commissioner Andreozzi asked if based on the action taken today, would that be recorded on the individual parcel. Randy Brown advised the verbiage was on the map. Commissioner Guttry advised it was buyer beware, that anyone who buys these lots will know that they will not receive any maintenance from the County. Randy Brown stated the verbiage was in the jurat stating that the road was accepted for public purposes but not for maintenance. Commissioner Guttry asked if there were over 100 subdivisions in the County. Randy Brown advised there were 64 official platted subdivisions and 38 platted subdivisions prior to any mapping requirements. Commissioner Guttry advised the County did not maintain any of those interior roads. Commissioner Guttry asked how many platted subdivisions have a homeowners association. Randy Brown advised approximately 6 or 7. Deputy District Attorney Kristin McQueary noted that very few people read the map that created the parcel on that deed. Commissioner Guttry asked if there was any way the County could pass an ordinance that upon closing a document would be signed saying the owner understands that there is no road maintenance. Randy Brown advised that may be something to take up with realtor s board. Commissioner Andreozzi asked if it was a jurat on the map, if it would not be transferred to the deed of record. Randy Brown stated most of the time it was actually on the deed. Tom Ballew advised he had the map if the Board wished to sign today. He provided the map to Randy Brown. The motion passed unanimously. 2:12:15 PM: VII. ELKO COUNTY COMMUNITY DEVELOPMENT: Pursuant to Notice , discussion and consideration to accept the Professional Services Statements of Qualifications and the Short list for 2016 to be available to all Elko County Departments. Randy Brown advised this was the yearly short list, and there were approximately 20 engineers and land surveyors and architects that have put in. PAGE 7

8 This is as good of list as they have ever had as far as covering all disciplines and staff recommends approval. MOTION: Commissioner Andreozzi moved to accept the Professional Services Statements of Qualifications and the Short list for 2016 to be available to all Elko County Departments. Commissioner Dahl seconded the motion. The motion passed unanimously. 2:13:24 PM: VIII. ELKO COUNTY CODE: Elko County Building and Safety - Stairway Handrail Exception Discussion and consideration of the First Reading of Ordinance , entitled, AN AMENDMENT TO ELKO COUNTY CODE TITLE 3, CHAPTER 1, SECTION 4(A) TO CREATE AN ADDITIONAL EXCEPTION TO THE INTERNATIONAL BUILDING CODE RELATING TO HANDRAILS REQUIREMENTS FOR STAIRWAYS, which allows for handrails on one side only on certain private stairways. Thomas Ingersoll, County Building Official, advised that this was a unique situation, wherein the code requires a handrail on both sides for commercial use, but there was an exception with regard to private stairways that are not accessible to the public. Mr. Ingersoll stated a good example was the new Courtroom 105. There are 2 rises in the steps, and it has only 1 handrail on the wall as it would be very extensive to put a handrail on the new bench. Mr. Ingersoll requested that the current code Title 3, Chapter 1, Section 4 be amended to use verbatim the verbiage out of the 1997 building code. Randy Brown advised that the only people using the handrail would be the Judge himself or the Clerk, the public did not have access. Commissioner Guttry inquired regarding the width. Mr. Ingersoll advised it was addressed for the height of the elevation change. MOTION: Commissioner Dahl moved to approve the First Reading of Ordinance , entitled, AN AMENDMENT TO ELKO COUNTY CODE TITLE 3, CHAPTER 1, SECTION 4(A) TO CREATE AN ADDITIONAL EXCEPTION TO THE INTERNATIONAL BUILDING CODE RELATING TO HANDRAILS REQUIREMENTS FOR STAIRWAYS, which allows for handrails on one side only on certain private stairways. Commissioner Eklund seconded the motion. The motion passed unanimously. PAGE 8

9 2:19:07 PM: IX. UNINCORPORATED TOWN OF JACKPOT: A. Hayden Field - Jackpot Airport Discussion and consideration for authorization to purchase a Hanger Building from the Diane and Richard Olsen Estate for $7,000. The building has been located on Jackpot Airport property for several decades. Last August, the County Commission reviewed this issue and requested that the Jackpot Town Advisory Board review and make a recommendation to the Commission. The Town Advisory Board recommends the purchase of the building for the reduced price of $7,000. Randy Brown advised the advisory Board would like to offer $7000 for the building and that it can be utilized for storage. Per FAA standards, the runway has to be swept every other month and the sweeper could be stored in this building. Mr. Brown advised he had spoken to the owner and the owner is in agreement to $7000 if the board approves it. Commissioner Andreozzi inquired what fund this amount would come out of. Randy Brown advised it would come out of the airport contingency fund. MOTION: Commissioner Dahl moved to give authorization to purchase a Hanger Building from the Diane and Richard Olsen Estate for $7,000. Commissioner Eklund seconded the motion. The motion passed unanimously. B. Recreation Center Organizational Restructure Proposal Discussion and consideration of the re-organization of the management of the Jackpot Recreation Center in which the Recreation Center Program Manager will directly report to the Jackpot Public Works Director. This proposal includes a 10% ($6,059.50) salary increase for the Public Works Director, the reduction of the Assistant Recreation Center Program Manager position, reduction of parttime positions, reduction of hours of operation during little or no historical facility use periods and a modest increase of user fees for better operational efficiency and a significant budget reduction. The Town Advisory Board has reviewed and recommends approval of this proposal. Randy Brown advised he had spent approximately 9 months observing and had seen things that could and should be changed, for example, there were many as 14 part time employees. New hours will be implemented where hours of operation will be cut back to 30 hours per week during the off season and to 48 hours per week during the on season. Currently there is approximately 2.5 people per day visiting the center. The assistant manager position has been eliminated, which is a savings of approximately $45,000 per year, and the part PAGE 9

10 time wages have been reduced to $40,000. The proposal suggested that a great deal of that money would go back into the building which is in need of a lot of maintenance. The 10% salary increase will be paid from the Jackpot recreation fund. Mr. Brown advised there will be 4 employees, and during the summer hours they will be allowed to hire 2 part time employees. Mr. Brown advised that over the past 10 years the Jackpot Recreation fund money had been depleting. Commissioner Andreozzi inquired about the public works director, as packet mentions a superintendent but the agenda referenced a director. Randy Brown advised that s was a typo, it is actually a superintendent. Commissioner Steninger inquired regarding the 2 different numbers mentioned for the salary increase. Randy Brown advised the second amount included benefits. Commissioner Steninger inquired which fund the salary would come out of. Randy Brown advised it would come directly out of the recreation center. MOTION: Commissioner Andreozzi moved to approve the Recreation Center Organizational Restructure Proposal as presented. Commissioner Steninger seconded the motion. The motion passed unanimously. 2:28:35 PM: X. ELKO COUNTY NATURAL RESOURCE INFORMATION HEARINGS: Discussion and consideration of the upcoming Resource Information Hearing scheduled to be to be held in March or April by the Elko County Commission. The selected topic by the County Commission for the first hearing is related to Sage Grouse Focal Areas and the potential impacts to the environment, wildlife and public land multiple uses such as hunting, ranching, mining and outdoor recreation. Potential presenters may include federal and state officials as well as members of the interested public. Commissioner Steninger stated it was his impression that the mid-month meeting may be too early and inquired if there had been any replies to the invitations sent out. Randy Brown advised he had tried to contact Rich Perry about coming the first of the month but had not sent out any invitations. Commissioner Steninger advised there was not much movement on the congressional hearings. Commissioner Eklund advised he and Rob Stokes had called congressman Amodei s office about the potential of holding a congressional hearing and the response was that they were in the midst of several hearings and it looked like it would be spring before hearing could be held in this area. County Manager Robert Stokes concurred and advised Commissioner Dahl had spoken to them as well. PAGE 10

11 Commissioner Dahl advised that he had talked to Congressman Amodei and Wyoming Congresswoman Cynthia Loomis about a field hearing that would include Idaho and Wyoming, and would be meeting to Congressman Amodei this coming week about setting a hearing here. Commissioner Guttry advised these hearings would be put off for the time being. Commissioner s Steninger and Dahl advised they would have to be postponed. Randy Brown requested to have Rich Perry and Tony Wasley come in to outline what the State is doing. Commissioner Steninger agreed and advised it should be kept on the Agenda. Randy Brown advised he would like to see them come and discuss how the maps were created. Commissioner Dahl advised it would be a good idea to have Tony Wasley come in. Randy Brown advised he would try to set that up for the mid-month meeting. No action taken. 2:33:29 PM: XI. NEVADA STATE ENGINEER ASSESSMENTS: In accordance with NRS Chapters 533 & 534, consideration of approval of the State Engineer s assessments as submitted by the Nevada Division of Water Resources and reviewed by the County Assessor s Office. Commissioner Guttry advised this issue would likely be tabled as they had not gotten answers as to how the water rights were assessed. Commissioner Steninger advised he had spoken to Daniel Randalls of the State Engineers office and had given his concerns in regard to Lamoille Basin. Mr. Randall s ed back saying he had answers to the questions but when Commissioner Steninger attempted to contact him again he was out of the office for the week. Commissioner Guttry advised it would be put back on the Agenda. PAGE 11

12 No action taken. 2:34:43 PM: XI. CONSENT AGENDA: A. Presentation and review of claims for approval which are available for public review at the Elko County Manager s Office. B. Approval of Minutes: January 20, 2016 MOTION: Commissioner Dahl moved to approve the Consent Agenda. Commissioner Eklund seconded the motion. The motion passed unanimously. 2:35:31 PM: XIII. COMMISSION AND COMMITTEE REPORTS: A. Demar Dahl, District 1 Commissioner Wells, West Wendover, Jackpot, Montello, Owyhee, Mt. City, Jarbidge Liaison, Nevada Association of Counties (NACO) Board, NACO WIR Board, Central Nevada Regional Water Authority (CNRWA), Humboldt River Basin Water Authority, USFS / BLM Liaison, American Lands Council / Western Counties Alliance. Commissioner Dahl advised the Humboldt River basin water authority was a good meeting. He stated he was recently in Washington and there was a lot of discussion regarding public land issues, but the 2 that were most important to Elko County were the sage grouse and the field hearing. Commissioner Dahl advised he would meet with Congressman Amodei and discuss it further. He stated he thought there was an opportunity to make some headway and it needs to be explored. Commissioner Dahl advised there were always concerns in regards to PILT because there is concern it may not be funded. He further advised that the more that people find out about the 1484 Bill, the better it is for Elko County. Commissioner Guttry advised the Fair Board had requested a 20% increase in operations, new bucking chutes and roofing material. Commissioner Dahl advised they could not allow it to become a dilapidated facility. Commissioner Steninger inquired if the fair board was getting share of online betting money. Commissioner s Guttry and Eklund advised they were but it can only be used for purses and prize money. Commissioner Guttry advised that money had gone down significantly and horse racing was on the decline. Commissioner Steninger asked about attendance numbers for the local fair. PAGE 12

13 Commissioner Eklund advised the numbers for first weekend were not high but during second weekend the grandstands were full. B. Delmo Andreozzi, District 2 Commissioner Highway Board Clerk, Nevada Department of Transportation (NDOT) Liaison, Auditorium Authority Board (ECVA), Hospital Board, Elko City Liaison, Museum Board, Regional Transportation Commission (RTC), Railport Committee. Commissioner Andreozzi stated he had a meeting set up with the local NDOT on Friday to follow up on a variety of issues, and would not be able to attend next commissioners meeting as he would be attending a Health Ranking workshop in Washoe County. Commissioner Andreozzi stated he had spoken to a gentleman from White Rock regarding the roads, and the gentleman advised he would be calling the EPA when his road gets dusty. Commissioner Andreozzi suggested a GIS map that would indicate what County roads were accepted for use but not maintenance or pre-subdivision rules. C. Glen Guttry, District 3 Commissioner Commission Chair / Liquor Board Chair, Highway Board Chair, Recreation Board, Railport Committee, Humboldt River Basin Water Authority, Elko Senior Activity Programs Board Liaison, Budget Committee, Veteran s Affairs, Northeastern Nevada Regional Development Authority (NNRDA), Sheriff Department Liaison / LEPC Liaison, Fire District Committee. Commissioner Guttry stated the Humboldt River Basin Water Authority was the biggest meeting going on in the last few months, and that there were several updates including stream flow and run off predictions. The weather service was there talking about El Nino and La Nina. Commissioner Guttry stated that Rick Felling, Assistant Director of the Nevada Division of Water Resources, gave a presentation on what the Governor s office has asked them to look at concerning water. Commissioner Guttry stated one thing that stood out to him was that the idea of use it or lose it was not going to be pursued any longer. It was found that there was an extreme amount of waste over the years by doing so. Commissioner Guttry advised the meters had been in place since the 1980s. He advised another issue was that you cannot have a water barrel coming off of your roof to collect, but they are not going to pursue that either. Commissioner Guttry further advised that Rye Patch had a complete fish die off from a cold water algae, and that Walker Lake fishery were dead and not expected to come back. PAGE 13

14 Commissioner Dahl advised the first time there was a die off at Rye Patch, there were lawsuits and it was drained, and there were questions as to who built the dam. Commissioner Steninger advised the Pershing farmers had built that dam. Commissioner Guttry advised Pahrump was over the allocation just in domestic wells. It was mentioned that recently Washoe County had water rights sell for $58,000 a foot acre. There are 50 basins in the Humboldt that are over appropriated. Commissioner Guttry stated there was an interim committee that Pete Goicoechea has set up, and the next hearing will be March 9, 2016 in Winnemucca. The capture models for the Humboldt River Basin area are underway and will be done end of 2018 for $1.4 million dollars. D. Cliff Eklund, District 4 Commissioner Commission Vice-Chair, Regional Transportation Commission (RTC), Carlin, Midas, & Tuscarora Liaison, Spring Creek Association Alt Liaison, Budget Committee, California Trails Center Board Liaison, Northeastern Nevada Stewardship Group, Juvenile Department Liaison / China Spring Advisory Committee, Library Board of Trustees Liaison, School District Liaison / CIS Communities in Schools, Nevadaworks, Debt Management Commission. Commissioner Eklund stated he had a meeting with the oncology board, and that Huntsman Cancer Center is referring local people back to the Cancer Center in Elko, which says a lot for the facility. They do not have the ability to do chemo treatments but are looking for a doctor that will come in to administer it. They are in the process of obtaining a patient house as they have a lot of out of town patients coming to Elko to take treatments. There was discussion about someone donating land to build on or putting in a RV park sites at that facility. They will be doing fundraising to come up with money to build it, and most Elko hotels that have given hospital discounts for the patients. Commissioner Eklund stated that Q&D Construction started their facility in the Carlin industrial park and they are setting up a hot batch plant and offices. Commissioner Eklund stated he was at the Nevada Works meeting in Reno, and one discussion was that Humboldt County is proposing a bill to get 11% of diesel fuel tax collected by the State returned back to the counties for road work and maintenance. Reno and Las Vegas already have the agreement with the State. Concerning public lands, Commissioner Eklund there is a lot of false information out there. He found one publication that the Federal Government had sold out public lands to the States including National Parks and National Forest Lands so the States could sell it off. He stated there is no such bill, so we need to be very cautious and try to educate people. He stated he is very adamant about promoting that this Commission will PAGE 14

15 not advocate nor condone any violent action against State or Federal Employees. He believed the Commission needs to try to get the public educated on what they are really trying to do. E. Rex Steninger, District 5 Commissioner Spring Creek Association Liaison, Te-Moak Tribe of Western Shoshone Indians Liaison, Shoshone-Paiute Tribes of Duck Valley Liaison, Northeastern Nevada Regional Development Authority, Alt. (NNRDA), Natural Resource Management Advisory Commission Liaison, Fire District Committee, American Lands Council Alt Liaison, Sage Grouse Pilot Project, Elko County Conservation Districts Liaison, Wildlife Chair / Wildlife Advisory Board / Nevada Division of Wildlife Liaison. Commissioner Steninger reported that Spring Creek was working on their water line and hoped to begin construction on the club house by end of the month. They are getting pressure to allow ATV use on roads, it was discussed and the issue was tabled. Commissioner Steninger stated that if they do approve it, it will have to come in front of the Commission. On the lines of the American Lands Council, a letter was sent to the Commission and will be put on the next Agenda. Commissioner Steninger advised there was a letter to the editor in the newspaper regarding Last Chance Road and questioned if the County should respond. Randy Brown advised it was on their 2018 maintenance schedule, it was something that would have to be decided on by the commissioners. Commissioner Steninger stated he thought the County should respond. Commissioner Guttry advised he and Commissioner Andreozzi had responded to s they had received, and that any Commissioner could contact someone themselves to address the issue. 3:03:46 PM: XIV. COUNTY COMMISSIONERS AND COUNTY STAFF COMMENTS: County Manager Robert Stokes thanked Michele for taking minutes today. Commissioner Guttry advised there will be a ribbon cutting for NV energy on March 9 th, as well as the Elko County Republican Convention and the Winnemucca Water meeting. Commissioner Dahl advised the Amodei fundraiser was the same date. Commissioner Guttry encouraged all commissioners to attend the ribbon cutting at NV Energy as well as the water meeting in Winnemucca. Commissioner Guttry clarified that the ribbon cutting was April 9 th. Commissioner Eklund advised NV Energy had donated furniture to the Cancer Center. PAGE 15
