Frank Clark was arrested for domestic violence and was incarcerated in the Erie County Jail with out bond per Judge O'Brien. Page: 20 of 28

21 Narratives Subject: Supp. Type Date Time Author Approving Officer Supplement 11/16/ ADAMS, BRENT D Dispatch advised Perkins EMS was en route to Maui Sands for a female who passed out. Dispatch further advised the female was involved in a physical domestic. Upon arrival, Ofc. Curran and I made contact with a male who was walking through the parking lot. It should be noted, a Maui Sands employee was also walking with the male. Ofc. Curran and I made contact with the male, Mr. Clark, who was observed to have blood on his nose. Mr. Clark was asked about his nose with him stating there was nothing wrong. He was asked why Perkins EMS and Perkins PD were called to the hotel. Mr. Clark stated he did not know what happened. Mr. Clark further stated his girlfriend was, "trippin," because she may be pregnant. Mr. Clark then told Ofc. Curran to look at the scratches on his face. Mr. Clark advised we would not find anything on his girlfriend's face. Ofc. Curran asked the male where he was from with him stating he was from Cleveland and he plays football. Ofc. Curran asked the male where he plays football with him stating at the University of Michigan. Ofc. Curran patted down Mr. Clark and he was placed in the rear of cruiser #8. Ofc. Curran responded inside the hotel and I began speaking with Mr. Clark. Mr. Clark was asked about the incident with him stating he does not lie to his coaches and he would not lie to the police. Mr. Clark further stated his father was a Chief of Police. Mr. Clark was asked about the incident once again with him stating nothing happened. Mr. Clark was asked about the blood on his nose with him stating he did not want to get his girlfriend in trouble. Mr. Clark then stated nothing happened. I advised Mr. Clark that he made the comment that he would not lie. Mr. Clark advised his girlfriend had been drinking alcohol and she had been, "nagging" him all day. Mr. Clark stated when he walked into the room, his girlfriend kept, "nagging" him and he asked her what was her problem. Mr. Clark advised nothing else happened. He was asked about his nose once again with him stating, he walked into the room and the scratches just happened. Mr. Clark was advised he had blood on his nose and something happened with him stating he scratched himself. It should be noted, while I was speaking with Mr. Clark in the cruiser, his eyes were observed to be bloodshot and glassy and there was an odor of an alcoholic beverage emanating from his person. At that time, Perkins EMS responded to the cruiser and attended to Mr. Clark's nose. Mr. Clark refused to go to the hospital and later signed a refusal for Perkins EMS. During this time, Ofc. Curran advised he needed a camera and a PBT in the room. Ofc. Goscewski responded to the area and stood by with Mr. Clark. I obtained the items and responded to Ofc. Curran's location inside the hotel with Sgt. Musser. Sgt. Musser began taking photographs and Ofc. Curran asked I give the female on the bed (xxx) a PBT. xxx provided a breath sample and the result was.000. I stood by while Sgt. Musser and Ofc. Curran spoke with xxx. At one point, xxx stated she did not want to get off the bed because she was lighted headed. Sgt. Musser asked if she needed to go to the hospital, even though she refused treatment from Perkins EMS. xxx stated she did not need to go to the hospital. xxx mother, xxx stated she would keep an eye on her daughter for the rest of the night. Sgt. Musser began speaking with xxx while Ofc. Curran and I spoke with xxx. xxx was advised of the conversation we had with Mr. Clark when we first arrived about the two having an argument about her possibly being pregnant. xxx stated she took two pregnancy tests. One came back positive and one came back negative. She further stated she did not want her mother to know about it and she did not want to talk about the matter. A short time later, Ofc. Curran advised Mr. Clark was going to be charged with domestic violence. I responded back to the parking lot. Mr. Clark was placed in handcuffs and advised he was being charged with domestic violence. After Mr. Clark was secured in handcuffs, he was transported to the station by Ofc. Goscewski. While on station, I made contact with Judge O'Brien, who was advised of the situation. Per the Judge, Mr. Clark was to be placed in the Erie County Jail with no bond. Page: 21 of 28

22 Narratives Subject: Domestic/Assault Type Date Time Author Approving Officer Facts Of Arrest 11/16/ CURRAN, MARTIN Dispatch advised the squad was enroute to Maui Sands room 3202 for a female that was passed out. Dispatch advised they then received a second call stating it was a physical domestic. While responding, the squad arrived on scene and advised they were staging. Upon my arrival, Ofc. Adams stated he heard radio traffic from the fire department stating the south east corner of the building. As I came around the south east corner of the building, I observed Paul Richerd, from maintenance, walking behind a black male and pointing at the black male. I exited my cruiser and I made contact with the black male who was later identified as Frank Clark, Ofc. Adams was also on scene. I asked Mr. Clark what was going on and he stated "not much, a disturbance", and stated "you can call it what you want." Mr. Clark then advised look at my face, look at everything on my face and look at everything on her face. He stated "I didn't do shit to her, I didn't touch that woman, she is a woman." I asked Mr. Clark how this started and he stated women, " I don't know what they do, what they go through, I don't know what she is going through, I know she is going through some crazy fits, and she may be pregnant. " I asked Mr. Clark why our agency was called to Maui Sands tonight and he just stood there not saying anything. Mr. Richerd then stated " because you were fighting in your room. " Mr. Richerd then advised to look at Mr. Clark's nose, it was all bloody. Mr. Clark then advised " look at me, I'm a big guy, do you think I'd let someone bust me in the nose. " I asked Mr. Clark if he had any identification on his person and asked where he was from. He stated Cleveland, Ohio and that he plays football. I asked who he played football for and he stated Michigan. I asked him who he was at Maui Sands with and he stated his girlfriend. I asked him if there was anyone else with him and he stated no. I advised Mr. Clark I was going to pat him down and I had him place his hands on the cruiser. While patting him down, I could detect an odor of an alcoholic beverage emanating from his person. I asked him if he was consuming alcoholic beverages and he stated yes. I asked him if his girlfriend had been consuming alcoholic beverages too and he told me to ask her. Ofc. Adams then seated Mr. Clark in the rear of his cruiser. It should be noted I shined my flash light onto Mr. Clarks face and I observed a piece of skin missing from his nose and it was bleeding. This injury was later photographed while on station. Mr. Richerd asked me if I was going to speak to the female and I stated yes while asking where she was at. Mr. Richerd stated she was still in the room, I was then met by Stephanie Burkhart in the parking lot who is an employee of Maui Sands. She advised she would take me to the room and the squad members also followed. While walking to the room, Ms. Burkhart advised the front desk received a phone call from the guest staying in room 3200 stating it sounded like a head was being bounced off the wall. Ms. Burkhart stated the guest also told her that small children ran from room 3202 to their room and stated " Frank is killing our sister. " Ms. Burkhart stated when she got to the room, she observed a broken lamp next to the bed. She advised she took the three small children to the front desk and called the police. Once at the room, I entered the room and I observed a lamp in several pieces on the table next to the bed. I also observed a lamp attached to the wall in the hallway that was damaged. I made contact with the female laying in the bed and she was identified as the victim, xxx xxx. I observed xxx had a large welt on the left side of her cheek, and blood near the left side of her temple area. The squad began speaking to xxx and I spoke to another male and female in the room. The female was identified as xxx xxx, xxx xxx xxx, and the male was identified as xxx xxx, xxx xxx xxx. I asked xxx if she observed anything and she stated she did not. She advised she was in a different hotel room with her boyfriend when her younger children came running to the room stating " Frank killed xxx." xxx stated he was in the shower in the same hotel room as xxx and Mr. Clark. He advised his younger brother, came into the bathroom and told him Frank was hitting xxx. He advised he came out of the shower and observed Frank punching xxx. The younger brother, xxx xxx, returned to the room and I observed he was still visibly upset as he was crying. I asked xxx what he observed and he advised he saw Frank hitting his sister. While speaking to xxx he became more emotional while trying to tell me what he witnessed. xxx then interrupted xxx and stated when he came out of the shower, Frank had his sister up against the wall. He advised his sister was trying to fight back and Frank grabbed her by the throat, picked her up off the ground, and slammed her to the ground while also landing on top of her.

23 Perkins Fire Fighter Mason advised he they were complete with xxx and she refused to be transported to the hospital. I asked xxx if she was sure she wanted to refuse and I pointed out how large the welt on her face was. I also pointed out the blood on the side of her face and she advised that was Franks's blood while wiping it away. After she wiped the blood away, I observed red marks on the ride of her face. She then used her cell phone to look at her injury's and she again refused transport. Even though she stated she was light headed. I asked xxx who Frank Clark was to her and she stated her boyfriend. I asked her how long they had been together and she stated two years. I asked her if they had any kids together and she stated no. I asked her if they lived together and she advised they have an apartment together in Michigan and she provided me with the address. Mr. Clark also provided Ofc. Goscewski the same address while in the parking lot. I asked xxx to tell me what occurred tonight. She advised Frank and her were on the bed and began to argue. She stated she has been short tempered, she got mad, and she threw the T. V. remote at him. She advised Frank tried restraining her on the bed and that is when she bit his nose. She advised he then pushed her head down into the bed and then they both got off the bed. She advised Frank then punched her in the face and she fell back breaking the lamp. She stated she then threw an alarm clock at him and he was trying to gather his belongings to leave. I asked if Frank had been drinking tonight and she stated yes. I asked her how much and she stated she did not know. xxx then stated at least a fifth of hennessy. I asked xxx if she had been consuming alcohol tonight and she stated no. I could detect the odor of an alcoholic beverage emanating in the room. I asked xxx to take a portable breath test and she agreed. The portable breath test was given to her by Ofc. Adams and her result was.000%. xxx and xxx were asked to leave the room while we spoke to xxx. As xxx was walking by her, he stated " if you have anything else to do with that man, it will be bullshit. " Sgt. Musser then arrived on scene and began taking photographs of xxx injury's and the damage to the room. xxx advised she also had a scuff or rug burn on her right hip area. Sgt. Musser also observed several marks on her red marks on her neck and those area's were photographed. xxx was asked about the marks on her neck and she stated they must be from when Frank grabbed her by the shirt. It was pointed out that her brother stated Frank grabbed her by the neck and slammed her to the ground. xxx stated he didn't grab her by the throat and that he grabbed her by the shirt. She stated she was also wearing a necklace with a pendant. The pendant was found in the bed and the necklace was found on the floor, to the right of the bed. I asked xxx when Frank grabbed her by the shirt, where did she end up on the ground at and she pointed to the left side of the bed. Due to the visible marks and injury's on xxx face and neck, her accounts of what occurred, and what the brothers stated they witnessed, it was determined that Frank Clark would be arrested for domestic violence. I asked xxx if she wanted to pursue a criminal charge of domestic violence against Frank and she stated she did not. She advised with what Frank has going on, she didn't want him arrested. I advised xxx in Ohio when a domestic violence victim does not want to pursue a criminal charge against the offender and there are signs of physical violence, we are guided by law to charge that offender with domestic violence. I advised her Frank would be arrested, he would be incarcerated in jail, and he would be charged with domestic violence. I again asked xxx if she was sure she didn't want to be checked out at the hospital. She paused for a few seconds and stated she did not want to go to the hospital. Sgt. Musser spoke to xxx and advised he she should pay close attention to xxx due to her injury's. It was learned from xxx that xxx xxx age 5 and xxx xxx age 3 were also in the room when the incident occurred. xxx advised none of the kids were involved in the altercation and none of them were injured. Ofc. Adams responded to the parking lot and made contact with Mr. Clark who was with Ofc. Goscewski. Ofc. Adams secured Mr. Clark into handcuffs and Ofc. Goscewski transported him back to the station. While on station, I went into the holding cell, photographed Mr. Clark's nose, and I did not observe any further injury's to his face. I tried taking a mug shot photograph with a camera, as our mug shot camera would not work, and Mr. Clark would not look at the camera. I read and explained his domestic charge to him and Mr. Clark stated he did not touch xxx and that her family was taking her side because they were family. I showed him a photograph of xxx face and he stated she received that injury by falling. It should be noted Mr. Clark had a strong odor of Page: 23 of 28

She advised she did not want anything done about the matter either. The also included the guest's name staying in room 3200, Kristie Colie. I called Ms. Colie and asked her what she witnessed. She advised she was in the room with her friend and they began hearing a lot of noise to the room next to them. She stated her friend said something was going on in the room and when they opened their door, a small child came running out of room 3202 stating " he's killing my sister. She advised her friend knocked on the door and someone opened the door briefly. She advised her friend observed the female laying on the ground, unconscious, only wearing a t-shirt. She advised the male was yelling at everyone while one of the younger males kept asking " why did you hit my sister." Ms. Colie agreed to me a statement of what she heard and observed and stated she would also have her friend contact me.
