4 Investigative Report Supplement 06/15/2016 Reporting Officer: 4573 John Zelina On Wednesday 06/15/2016 at around 1210 am, I responded to Interstate 271 north bound at the 36.8 mile marker. Ptl. Mikolay requested assistance with a driver that was refusing to cooperate. Once on location, I observed Ptl. Mikolay, and Cpl. Dvorak speaking with a female driver. Ptl. Mikolay was attempting to get the driver to exit the vehicle to perform standardized field sobriety tests. While on scene I could see the female was being very argumentative. She would constantly interrupt when officers were speaking with her, saying she did not trust us. Her speech was very deliberate and exaggerated. I pulled Ptl. Mikolay aside and asked him details about the stop. He advised he observed the Lexus SUV the female was driving weave several times as it traveled north on 271, and at one time the vehicle came close to striking a wall. He also stated hat her demeanor had him suspect that she may be intoxicated. I approached the driver side of the Lexus, and spoke with the driver. She continued to assert that we could not be trusted, and she stated "I am done with you". I advised her that the officer suspected her of drinking and driving, and that if she did not take the tests, we would have no choice but to arrest her. She stated that she was not getting out of the car, and then stated to me, "what do you want?" while she pulled her shirt off her shoulder. I told her I wanted her to exit the vehicle. She again stated really what do you want?during my conversation with, the female, Identified as Ashley Lukingbeal, I noticed her voice was exaggerated, and garbled, There was also an occasional smell that hinted of an alcoholic beverage. She also stated her car had an alignment problem, and that's why she was weaving. She further stated the alignment warning light came on her dashboard. I spoke with Ashley for several minutes, and she continued to refuse to do anything we asked. I then advised her she was under arrest, and if she did not exit voluntarily, she would be removed from the vehicle. She told me she was not exiting. I reached in and grabbed her wrist, pulled her arm into a straight arm bar. Ashley then came out of the vehicle with little effort, and was cuffed by Ptl. Mikolay. 5 Investigative Report Supplement 06/15/2016 Reporting Officer: 4521 John Hanish On Wednesday, June 15, 2016, at approximately 0030 hours, I responded to Mayfield Heights Jail to assist in the booking of Ashley E. Lukingbeal. Ashley was uncooperative throughout the entire booking process. After refusing several times to complete the booking process, Ashley finally agreed to take photos and be fingerprinted. While I was fingerprinting Ashley, it should be noted that I could smell a strong odor of an alcoholic beverage emitting from her breath. 6 Investigative Report Supplement 06/15/2016 Reporting Officer: 4511 Matthew Mikolay On Wednesday, 06/15/2016 at approximately 12:05 AM, I entered onto IR 271 north from Brainard Road. I observed a dark colored SUV in front of me bearing Ohio registration GED6021. I ran the plate on my M.D. T near the Mayfield Heights south city limit line. The plate returned to a black 2008 Lexus with the listed registered owner as Ashley E. Lukingbeal. While traveling behind the vehicle at a distance, I noticed the vehicle fail to maintain marked lanes on at least three (3) different occasions. The first was near the Lander Road bridge where the Lexus went off the right side of the road crossing over the right lane marker. The vehicle then went off the right side of the road again, just after entering the construction zone on IR 271 local lanes. While in the construction zone and after crossing over Mayfield Road, I noticed the vehicle once again go off the right side of the road nearly striking the guard rail and noise barrier. I initiated a traffic stop on IR 271 north just past Wilson Mills Road. I advised Mayfield Heights Dispatch of my location and I approached the vehicle on the passenger side. As I approached the vehicle, I noticed that the vehicles right turn signal was left on and blinking. I also noticed that the female driver had something in her mouth because she was chewing rather quickly. Once I reached the front passenger window, the female driver, later identified as the registered owner, Ashley E. Lukingbeal made eye contact with me. She looked at me with a blank stare. I had to knock on the passenger window in order for her to roll it down. I first asked Ashley where she was coming. Her response was delayed but she said that she was coming from her friends house in Beachwood. She went on to say that she worked in Solon, as a Nanny and lived in Fairport Harbor. She then apologized for chewing pretzels. I advised Ashley for the reason I had stopped her vehicle. Ashley said that she needed a wheel alignment unfortunately. When I asked her if she had anything to drink, she looked down and said "No". Ashley said that she was headed back to Fairport Harbor. When I asked Ashley if she had insurance, she hesitated and said "Umm, I drive Progressive". While speaking with her, I noticed a container had spilled on the front passenger floorboard. I asked Ashley about this and she said that I had scared her so much because I had pulled her over. Ashley followed that response up by saying that otherwise she was a Nanny and she has kids. I again asked Ashley if she had anything to drink and she said No. When I told her that I had a Portable Breathaylzer and I would like her to submit a breath sample, Ashley said that she hadn't had anything to drink. She then paused, and started to sniffle as if she were going to cry. Ashley then tried to divert me from my line of questioning by asking me what my name was. She went on to say that she would give me whatever I needed or wanted from her. She said the reason that she looked the way she did was because she was distraught over she and her boyfriend breaking up. While speaking with Ashley, I noticed that she was slow to respond to my questions, had to think or concentrate on her thoughts and what she wanted to say and she seem to ramble on while speaking. I advised Ashley that I was going to have her exit the vehicle, once another police officer arrived on scene. I asked her to remain in the vehicle and I stepped toward the rear of her vehicle. I stood next to her car and observed Ashley once again chewing on something. She was also moving around in the vehicle and talking to herself. I walked back up to the passenger side window and spoke with Ashley again. Ashley said that her mom told her that her vehicle was veering over. She told me that she was having a hard time staying in the lane because of the alignment issues. While waiting for another officer to arrive, I asked Ashley what time she left her friends house. Ashley then said that she had nothing else to say to me. She continued to ramble on, became emotional and started crying. She said that she was taught in her life, not to fuck with us and that she was not going to give us anything. She advised that she did nothing wrong and all she wanted to do was go home to her boyfriend. Cpl. Dvorak arrived on scene to assist. I explained to Cpl. Dvorak what was going on and that I planned on having Ashley exit her vehicle so that I could administer Standardized Field Sobriety Tests (SFST's). I approached the driver side door, opened it and asked Ashley to step out of the vehicle, while being safe at the same time. Ashley refused to exit because she said she was not comfortable with me. After I opened the door, I could smell a strong odor of perfume, but when Ashley spoke in my direction, I could smell a slight odor of an alcoholic beverage. I advised Ashley that I needed to make sure that she was ok to drive and I repeatedly asked her to step to the back of her vehicle. Ashley refused my requests even after I told her that she would be placed under arrest if she did not comply. Cpl. Dvorak also tried speaking with Ashley through the front passenger window. Ashley made the comment that she trusted Cpl. Dvorak's eyes over the conversation. Sgt. Zelina arrived on scene to assist. I advised him of the situation. See Sgt. Zelina supplement. Sgt. 7 Investigative Report Supplement 06/15/2016 Reporting Officer: 4511 Matthew Mikolay eventually advised Ashley that she was under arrest after she failed to comply with his orders. He removed her from the vehicle and I placed her in handcuffs and advised her of her Miranda Warnings. Cpl. Dvorak completed an inventory of the vehicle, which was eventually towed to/by Ken' s Towing. I transported Ashley back to the Mayfield Heights Police Department. Lt. Rzeszut, Ptl. Hanish and a female Sergeant from Mayfield Village assisted. After searching a small brown multi-colored pouch, which contained Ashley's credit cards, I located two (2) pieces of an orange pill, at the bottom of the pouch, with the markings b973 / 20. The pill was identified using Drugs.com pill identifier as Amphetamine and dextroamphetamine which is a Schedule 2 controlled substance. This pill was later logged into evidence and placed into an evidence locker. Ashley advised me that she did have a prescription for the medication. She was advised that she needed to provide a prescription or she could face criminal charges. Ashley was uncooperative during the booking process and refused to take any photographs, answer questions or change into a jail uniform. Ashley refused to answer many questions, but when I asked her if she was pregnant, she said that she was and that she was 6 months along. She later said that she was not pregnant. Lt. Rzeszut advised Ashley that she would not be able to bond out of jail, until she completed the booking process. Despite asking Ashley to be cooperative and complete the booking process, she refused and was told she would be charged with Obstructing Official Business. Prior to offering Ashley to submit to a breath test, she said that she wanted to contact her Lawyer, which was her Uncle from Texas. She spoke with her Uncle, on speaker phone and at one point her Uncle said that she was probably lying about how much she had to drink because she sounded like she was drunk. He also said that if she did not have too much to drink, she should submit to a breath test. At one point Ashley made the comment that she went out with some friends but she only had a drink earlier. She mentioned that she and her friends had paid for an Uber to drive them around. I read Ashley the required BMV 2255 form, which she refused to sign. Lt. Rzeszut asked Ashley to submit to a breath test, which she refused. She was then immediately placed under an Administrative License Suspension (ALS). Her license was confiscated and forwarded to Lyndhurst Municipal Court. Ptl. Hanish eventually was able to take Ashley Lukingbeals fingerprints which he submitted to BCI. While taking her fingerprints, Ptl. Hanish advised me that he could smell a strong odor of an alcoholic beverage emitting from her breath. After continuously refusing to cooperate, I escorted Ashley to Detox Cell #1. While walking next to her, I could smell a strong odor of an alcoholic beverage coming from her persons. Eventually Ashley posted her bond and was released to her boyfriend. Ashley Lukingbeal was issued citation #MH68477 for Marked Lanes (ORC ), OVI (ORC A1a) and Refusal with Prior OVI (ORC A2). She is also charged with Obstructing Official Business (ORC ). She was given a mandatory court date with the Lyndhurst Municipal Court on Tuesday, 06/21/2016 at 8 AM. It must be noted that Ashley Lukingbeal, was very uncooperative and her mood would swing from upset and emotional (i.e. crying) to angry (i.e. calling officers inappropriate names and making other comments about officer 's family members.)
