1 BOARD OF SUPERVISORS PUBLIC HEARING Date of Meeting: June 15, 2016 # 1 SUBJECT: ELECTION DISTRICT: Proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County Revisions to Precinct s Name and Polling Place Location Blue Ridge CRITICAL ACTION DATE: July 19, 2016 STAFF CONTACTS: Judith Brown, Director, Elections and Voter Registration Richard Keech, Elections and Voter Registration PURPOSE: The purpose of this item is to bring forward the Office of Elections recommended amendments to Chapter 209 to change the name, number and voting location of the Old Arcola Volunteer Fire Department (Old Arcola VFD) voting precinct. RECOMMENDATIONS: Committee: At its April 12, 2016 meeting the Electoral Board of Loudoun County voted 3-0 to recommend that the Board of Supervisors enact the proposed changes. Staff: Staff recommends that the Board of Supervisors authorize the proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County (as presented in Attachment 1). BACKGROUND: On May 19, 2016, the Board of Supervisors voted (Chairman Randall absent) to send the ordinance changes (Attachment 1) to the June 15, 2016 Public Hearing. This item relays the following recommended changes to the Codified Ordinances of Loudoun County related to precincts and polling places: 1. Change the number, name and location of precinct 317-Old Arcola VFD to precinct 318- Madison s Trust, with voting to occur at Madison s Trust Elementary School. 2. Precinct Name/Number Changes: When a polling location is changed and/or the name of the precinct is changed, the number, which is used as an identifier in the Virginia Voter Registration system, is also changed to alleviate any voter confusion that might be caused by accessing old information or lists of polling places. The precinct number is assigned internally and requires no Board action. Names of precincts are assigned based either on

Safety: During the November 2015 election the Office of Elections received numerous calls and s from voters regarding safety concerns with the precinct located at the Old Arcola VFD. Traffic is extremely heavy on Gum Spring Road during both the morning and evening rush hour which lead to several near accidents as voters attempted to access or leave the facility. For the March 2016 Presidential Primary, Staff worked with the election workers, fire station, and Sheriff s office to try to mitigate some of the issues to varying levels of success. Staff believes, however, that it is in the best interest of safety that the polling place be relocated prior to the 2016 Presidential Election in November. 2. Parking: There have been complaints from voters concerning the amount of parking and the quality of the parking lot. This problem will be compounded during a Presidential Election when turnout is expected to be nearly double the turnout in March. 3. Voter Accessibility: An inspection conducted by the Disability Law Center of Virginia during the March 2016 Presidential Primary raised concern that doors were difficult to open and/or close for voters with disabilities. 4. Timing: Board action by the end of July is critical for these changes to be in place for the November election due to the statutory requirement that all changes to polling places be enacted no later than 60 days prior to any General Election. Office of Elections staff also needs time to process the changes in the state registration system and notify voters in a timely manner. Generally the office tries to avoid making changes to precincts and/or polling places in a Presidential Election year to avoid confusion, however, in this case staff believes the move is warranted. Proceeding with the move in June will allow staff additional time to advertise and notify voters in the precinct of the change. FISCAL IMPACT: Existing FY 2017 funds are sufficient to cover the approximate $2, cost of notifying voters of the proposed changes once adopted. ALTERNATIVES: 1. Choose to leave the precinct voting at Old Arcola VFD for the near future and direct staff to evaluate and revisit the issue after the Presidential Election. 2. Do not change the polling location of the precinct described above.

I move that the Board of Supervisors forward Proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County Revisions to Precinct s Name and Polling Place Location to the July 5, 2016 Board of Supervisors Business Meeting for action. OR 2a. I move that the Board of Supervisors suspend the rules. AND 2b. I move that the Board of Supervisors approve the proposed amendments to Chapter 209 of the Loudoun County Codified Ordinances, as summarized in the tables and map of Attachments 1 and 2 of the June 15, 2016 Board of Supervisors Public Hearing Staff Report that will change the name and voting location of the Old Arcola VFD precinct to the Madison s Trust precinct voting at Madison s Trust Elementary School. OR 3. I move an alternate motion. ATTACHMENTS: 1. Proposed Amendments to Chapter 209 of the Codified Ordinances of Loudoun County. 2. Map of existing and proposed polling place location.
