1 BOARD OF SUPERVISORS AND VIRGINIA DEPARTMENT OF TRANSPORTATION JOINT PUBLIC HEARING Date of Hearing: September 14, 2016 #1 SUBJECT: ELECTION DISTRICT: Proposed FY2017-FY2022 Secondary Road Six-Year Plan and FY2017 Construction Improvement Budget Priority List Countywide CRITICAL ACTION DATE: September 30, 2016 STAFF CONTACTS: Susan Glass, Transportation and Capital Infrastructure Joe Kroboth, III, Transportation and Capital Infrastructure PURPOSE: To solicit public comment and Board of Supervisors (Board) input regarding the road segments and the priority ranking proposed in the draft FY 2017 FY 2022 Secondary Road Six-Year Plan (Attachment 1). RECOMMENDATIONS: Staff recommends that the Board approve the projects and priorities proposed in the FY 2017 FY 2022 Secondary Road Six-Year Plan and authorize the County Administrator to execute the Plan on behalf of Loudoun County. BACKGROUND: Each year the Board conducts a joint public hearing with the Virginia Department of Transportation (VDOT) on a draft Secondary Road Six-Year Plan ( the Plan ), which is developed through the combined efforts of County and VDOT staff. Funding for the draft FY 2017 FY 2022 Plan is derived from a formula authorized by the Commonwealth Transportation Board that was used prior to the implementation of HB 1887 which was enacted in the 2015 General Assembly session. HB 1887 established a new construction formula that applies to all state and federal construction. The new formula for allocation of construction funds starts in FY 2021 and provides for a transition from the previously approved FY 2016 FY 2020 plan. The draft Plan reflects funding changes resulting from HB There are only unpaved road funds available for allocation in the FY FY 2022 Plan and there are no secondary road funds of any type allocated in FY 2021 when the full implementation of HB 1887 takes effect.
2 Item #1, Proposed FY2017-FY2022 Secondary Road Six-Year Plan and FY2017 Construction Improvement Budget Priority List Board of Supervisors and Virginia Department of Transportation Join Public Hearing September 14, 2016 Page 2 The Adopted FY 2016 FY 2021 Plan estimated unpaved road revenues over the six-year timeframe at $5,072,139. The draft FY 2017 FY 2022 Plan estimates unpaved road revenues over the six-year timeframe at $9,382,638. The table below provides the composition of these funds. Fund Amount CTB Formula Unpaved State $6,032,272 District Grant Unpaved Roads $3,050,366 High Volume Unpaved Roads $300,000 Total $9,382,638 Road Paving Projects Completed, Underway, and Proposed: Using previously approved Secondary Road funds, VDOT recently completed paving portions of the following unpaved roads to a rural rustic standard: Bullrun Post Office Road, Waxpool Road and Shreve Mill Road. VDOT recently completed paving Fleetwood Road and commenced work on a portion of Scotland Heights Road on August 29, The Plan proposes to pave portions of the following unpaved roads to a rural rustic standard: Greggsville Road, Lockridge Road, Rocky Lane, Williams Gap Road, Nixon Road, Lakefield Road and Ticonderoga Road. Rural Road Committee Input: Staff recently met with the Loudoun County Preservation and Conservation Coalition Rural Roads Committee to review the proposed Plan. The purpose of the meeting was to foster improved communications and to better understand their position with respect to certain roads proposed in the paving plan. Finally, this meeting allowed for the Committee s position to be reported as part of the item prior to the Board s decision on the Plan. The Committee expressed opposition to the paving of three (3) unpaved roads: Scotland Heights Roads, Greggsville Road and Williams Gap Road. Based on the Adopted FY 2016 FY 2021 Secondary Road Six-Year Plan, VDOT has already issued a contract for Scotland Heights Road; work commenced in August The funds that VDOT received for paving Greggsville Road came from a special appropriation made by the General Assembly. Greggsville Road has experienced extensive maintenance problems and many residents have expressed concern over the condition of the road. At the VDOT public information meeting for the right turn lane from Route 7 to Williams Gap Road, local residents requested the paving of Williams Gap Road for safety considerations. ISSUES: HB 1887, 2015 General Assembly Session: HB 1887 requires that the highway construction district grant programs allocate funds for the improvement of non-surface treated secondary highways that carry more than 50 vehicles per day. As stated in of the Code of Virginia, the unpaved secondary highway funds shall be deducted from the allocation made to each highway construction district pursuant to subsection D of and such deduction shall be based on the ratio of non-surface treated secondary highways in each of the nine VDOT districts that carry 50 or more vehicles per day to the total number of non-surface treated

Total funds allocated shall not exceed $25 million annually. There are no dedicated funds for secondary roads. Counties will have to apply to their respective VDOT district to receive the grant funds, and proposed projects are required to be ranked through the HB 2 process. HB 416, 2014 General Assembly Session: It is noted that HB 416 enacted in the 2014 General Assembly Session directed VDOT to maintain the rural road network in Loudoun County by doing the following: 1) coordinating with the County and the affected residents to understand maintenance concerns and prioritize its maintenance budget; 2) continue to maintain rural gravel roads in traditional alignment; 3) applying Rural Rustic Road policies in paving programs; and 4) providing an annual report to the County detail how VDOT spent funds in the prior fiscal year to maintain rural gravel roads. FISCAL IMPACT: The funds discussed in this item are state funds allocated for use on Loudoun County roads. No local tax funding is directly impacted as a result of endorsing or modifying the proposed funding plan. Given the legislative changes promulgated in HB 1887, it is essential these funds be programmed for a specified project. Failure to adopt a plan by the critical action date could jeopardize the availability of the funds for this program. ALTERNATIVES: The Board of Supervisors could choose to remove a recommended road segment and suggest an alternate project. The unpaved road funds need to be used on improving an unpaved road. DRAFT MOTIONS: 1. I move that the Board of Supervisors forward the Proposed FY2017-FY2022 Secondary Road Six-Year Plan and FY2017 Construction Improvement Budget Priority List to the September 22, 2016, Board of Supervisors Business Meeting for action. OR 2a. I move that the Board of Supervisors suspend the rules. AND 2b. I move that the Board of Supervisors approve projects and priorities listed in the draft FY 2017 FY 2022 Secondary Road Six-Year Plan, and authorize the County Administrator to execute the Plan on behalf of the Loudoun County Board of Supervisors as provided in Attachment 1 to the September 14, 2016, Board of Supervisors Public Hearing Staff Report.
