1 5.C.2 LAND USE COMPATIBILITY According to FAR 14 CFR Part and Federal Interagency Committee on Aviation Noise (FICAN), 15 all types of land uses including residential are considered compatible with noise levels below 65 DNL. Areas exposed to noise levels exceeding the 65 DNL are considered incompatible with residential land uses, including mobile home parks and transient lodging. Public use facilities may be considered incompatible within the 65 DNL, depending on the use and noise attenuation methods incorporated into the structural design of these facilities. These noise-sensitive public facilities would include schools, places of worship (churches, synagogues, mosques, etc.), assisted living centers (nursing homes), hospitals, libraries, auditoriums, concert halls, and outdoor music shells/amphitheaters. The discussion of land use within the affected environment of this EIS includes a summary of existing land use patterns and noise-sensitive public facilities. Local comprehensive plans and applicable zoning regulations is summarized for the jurisdictions within Broward County that are located within the Study Area. 5.C.2.1 Land Use Pattern The existing land use pattern around FLL is graphically depicted on Exhibit 5.C.2-1, Study Area Existing Land Use. The general land uses located immediately east and west of the airport are largely compatible with airport operations (i.e., commercial and transportation). The areas north and south of the airport are more residential, with commercial uses located in a half-mile wide corridor running along both sides of Interstate-95 from Davie Road south to Sheridan Road. There are a number of noise-sensitive public facilities surrounding FLL. These facilities are graphically depicted on Exhibit 5.C.2-2, Noise-Sensitive Facilities Grid Point Location Map. The names and types of noise-sensitive facilities that are located within the EIS Study Area are provided in four tables (located at the end of this Section 5.C.2, Land Use Compatibility): Table 5.C.2-1, Schools in the Study Area, identifies the 35 schools within the EIS Study Area. 2 Table 5.C.2-4, Places of Worship in the Study Area, identifies the 84 places of worship (churches, synagogues, mosques, etc.) located within the EIS Study Area. Table 5.C.2-5, Performing Arts Centers and Museums in the Study Area, identifies two performing arts centers/concert halls, and four museums. No auditoriums or outdoor music shells/amphitheaters are in the EIS Study Area. Table 5.C.2-6, Hospitals in the Study Area, identifies the one hospital within the EIS Study Area. 5.C.2.2 Land Use Plans The land uses within each jurisdiction located within the EIS Study Area comply with the future land use designations contained in the Broward County 1989 Land Use Comprehensive Plan (County Land Use Plan). 16 Compliance with the County s land uses is enforced through the Broward County Planning Council and the Broward County Board of County Commissioners (the Commission). Objective of the County Land Use Plan states that the County will develop and implement land use programs to encourage the elimination or reduction of existing incompatible land uses and prevent future incompatible land uses. Ensuring the protection of residential areas from encroachment of commercial, industrial, and other non-residential areas (including airports) is of particular concern. Objective specifically addresses Airport and Heliport Land Use Compatibility by requiring the identification and reduction of incompatible land uses adjacent to existing and proposed airport/heliport facilities. Florida state regulations require that each jurisdiction establish a comprehensive plan. These local comprehensive plans serve as the basis for ensuring compatibility with the County Land Use Plan designations. Local government zoning and land use plans may be more restrictive or prohibitive of land uses within any of Broward County s land use categories. Therefore, future development or redevelopment within the Study Area is subject to both county and/or local zoning and land use regulations. Local zoning regulations provide these jurisdictions with the ability to enforce their land use controls to ensure compliance with county land use requirements. On that basis, any request for an amendment or building variance is subject to the review and approval of the local jurisdictions. The Study Area includes portions of the cities/towns of Fort Lauderdale, Hollywood, Dania Beach, Town of Davie, and Plantation; and the Hollywood Reservation of the Seminole Indian Tribe of Florida. 17 A summary of the applicable key policies in the Broward County Comprehensive Plan, (Amended) February 2002, Broward County Board of County Commissioners. The FAA held an information briefing with local municipality planning and zoning departments on February 8, 2007, to discuss local land use controls, policies, regulations, ordinances, and planning documents. The municipalities invited to this meeting included: Dania Beach, Davie, Hollywood, Plantation, and Fort Lauderdale. 3 local comprehensive land use plans and zoning ordinances for these jurisdictions, pertaining to airport and compatible land use planning, is provided in the following paragraphs. 5.C BROWARD COUNTY The relevant policies pertaining to FLL and airport facilities in general, as cited in the Broward County Comprehensive Plan Transportation Element, 18 are provided in Appendix J.2, Land Use Policies. These policies state that the Broward County Planning Services Division will consider the objectives of major transportation facilities, including airports, when amending land use plans and that the County will take recommendations from the airport s FAR 14 CFR Part 150 Noise Compatibility Study Update documents when preparing land use recommendations, which may affect the airport. The policies state that Port Everglades shall coordinate expansion plans with FLL. Provisions that the Broward County Aviation Department review any development activities adjacent to the airport to protect the FAA navigable airspace and all locally approved aircraft air corridors from any obstruction are included. 5.C FORT LAUDERDALE The Fort Lauderdale Comprehensive Plan 19 (the Fort Lauderdale Plan) was developed to address the needs and aspirations of the community, and establishes the long-term direction of goals as well as short-term objectives and policies to guide implementation efforts. The purpose of the Future Land Use Element of the Fort Lauderdale Plan 20 is to..."promote the distribution of land uses that will preserve and enhance the character of Fort Lauderdale by establishing land development guides designed to promote environmental protection, meet social and economic needs, provide for adequate services and facilities, conserve natural resources, and ensure compatibility of land uses." Objective 40 of the Fort Lauderdale Plan deals with the coordination of land use and airport planning and establishes the policies for existing and future airport facilities to identify and reduce incompatible land uses adjacent to existing and proposed airport/heliport facilities. 4 5.C HOLLYWOOD The Transportation Element of The City of Hollywood s 2001 Comprehensive Plan 21 (the Hollywood Plan) indicates that the city of Hollywood respects the economic importance of FLL while wanting to limit its negative affects on the residents of Hollywood. The city s policies address connectivity of the airport with other transportation infrastructure, such as roads and the port, and address the need for thorough planning and consideration of negative airport impacts in the event of airport expansion. The policies cited in the Hollywood Plan state that proposed future land uses will be compatible with the effects of airport expansion. To help meet that objective, the city of Hollywood has established an Airport Advisory Committee to monitor the proposed expansion of the airport. The relevant policies as cited in the Hollywood Plan are provided in Appendix J.2, Land Use Policies. 5.C DANIA BEACH The Dania Beach Comprehensive Plan 22 (the Dania Beach Plan) policies state that areas surrounding existing and proposed airports shall be planned to promote compatible land uses consistent with the affected elements of the Dania Beach Plan. The Dania Beach Plan states that within areas surrounding existing or committed airports, Dania Beach shall not issue development orders for land uses or structures that are incompatible with airport/heliport uses. Dania Beach s zoning ordinance includes pertinent regulations on building height restrictions near airports. These state that the applicant for a permit for any structure of any type, proposed to be constructed in the city near or in proximity to any airport or within the flight path approaching the airport, must comply with all regulations of the FAA (and any other governmental agency having jurisdiction) and have the approval of the FAA (and any other governmental agency having jurisdiction) before the city shall issue a permit allowing the construction of the structure. In the event the city s building inspector believes that any proposed structure may be in conflict with any governmental rules or regulations governing the height and location of structures near FLL or in the flight patterns or approaches to such airport, the building inspector shall decline to issue a permit to allow the construction of the structure until first obtaining a favorable approval or recommendation from the manager of such airport. 5 5.C TOWN OF DAVIE The Town of Davie has established an Airport Advisory Board, like the city of Hollywood. The Town of Davie Comprehensive Plan 23 (the Davie Plan) includes Objective 16, which pertains to the compatible land use and development with airports. It includes provisions to identify and reduce incompatible land uses adjacent to existing and proposed airport facilities. Objective 16 states that areas surrounding existing and proposed airports/heliports shall be planned to promote compatible land uses consistent with the affected elements of the comprehensive plan, and that the town shall not issue development permits for land uses or structures that are incompatible with airport uses, pursuant to the development review requirements subsection of the plan implementation requirements section of the Broward County Land Use Plan. 24 The relevant policies, as cited in the Davie Plan, are provided in Appendix J.2, Land Use Policies. 5.C PLANTATION The policies in the Plantation s Comprehensive Plan 25 (the Plantation Plan) state that areas surrounding existing and proposed airports/heliports shall be planned to promote compatible land uses and that the city shall not issue development orders for land uses or structures that are incompatible with airport uses, and to take into consideration adopted FAR 14 CFR Part 150 Noise Compatibility Study Update recommendations. The policies of the Plantation Plan support the efforts of Broward County to provide safe, convenient, and energy-efficient county airports and related facilities through implementation of programs and activities including: a) Continue to review all proposed plats for new development within Broward County for possible aviation impacts, and to advise developers and property owners of the need to submit FAA forms for airspace reviews. b) Support the provision of bus shelters to enhance transit and Tri-Rail ridership to FLL. The relevant policies as cited in the Plantation Plan are provided in Appendix J.2, Land Use Policies. 5.C HOLLYWOOD RESERVATION OF SEMINOLE INDIAN TRIBE OF FLORIDA The Hollywood Reservation of the Seminole Indian Tribe of Florida is located at 6300 Stirling Road in Hollywood, Florida. The Florida Seminole reservations, more or less as they exist today, were established at the end of the Great Depression. The 497-acre Hollywood Reservation is the headquarters for the Seminole Indian Tribe of Florida. As established in the Seminole Tribe of Florida's constitution, the Town of Davie Comprehensive Plan, (Amended) August 1998, Town Council. 6 Tribal Council is the chief governing body. The Tribal Council administers the Tribal gaming enterprises, citrus groves, the Billie Swamp Safari, and the Ah-Tah-Thi-Ki Museum. The Seminole Hard Rock Hotel & Casino encompasses approximately 100 acres of the reservation. Other facilities located on the reservation include the Seminole Casino Hollywood, and the Seminole Okalee Indian Village attraction and Ah-Tah-Thi-Ki Museum. 5.C OTHER LOCAL PLANS There are a number of local transportation plans that could potentially affect future development at the FLL. Airport Master Plan Update is being prepared in phases to evaluate the facility capacity needs at FLL based on a ten-year and 20-year growth projection. The baseline assumptions used in the development of the (per Broward County policies) are: the proposed south runway extension and the decommissioning of Runway 13/31; the redevelopment of Concourse A and exit roadway improvements; and a program to provide for international gate development. Broward County is continuing to review options for terminal redevelopment and preparing an update to the Airport Layout Plan (ALP), and define the follow-on Capital Improvement Program. Broward County 2025 Long-Range Transportation Plan consists of a number of transit and highway projects, including: rapid rail transit to the airport; improving Interstate-595, between Interstate-95 and Interstate-75, by widening to four lanes in each direction; and widening Ravenswood Road to two lanes in each direction south of the airport from McNab Road to Royal Palm Boulevard. Port Everglades Master Plan calls for an automated people mover (APM) connector with the airport. The Port s Master Plan cites the following, The overwhelming potential for cruise passenger volumes necessitates a vision for efficient intermodal transport of passengers between the FLL and the Port Everglades cruise terminals as well as the Broward County Convention Center. The proximity of the airport and its needs with regard to cruise passenger traffic is a driving factor behind the development of the 2020 Vision Plan. Port Everglades has the potential to provide premier cruise passenger service by capitalizing on the airlift potential at FLL. An Airport/Seaport Connector has been identified to be the key to capitalizing on this potential. The Airport/Seaport Connector is envisioned as an overhead Fixed-Guideway (possibly monorail) system. This system has formed the basis for the proposed Broward Intermodal Center (IMC). Page 5.C-26
7 The 2020 Vision recognizes the need for an APM connector to Port Everglades and an intermodal center. The IMC would serve as a regional transportation hub, housing such facilities as bus and train stations, kiss and ride areas, people mover connection, vehicle parking, and concession spaces. The IMC would facilitate transfers to other regional transit systems. The APM system would be designed to transport passengers within and between FLL and Port Everglades, with connections to other regional transportation modes at the IMC. South Florida East Coast Corridor Transit Analysis focuses on development of a transit corridor from Miami, at the Port of Miami to the Palm Beach/Martin County Line. The kick-off meeting for this study was held in December A Draft Programmatic Environmental Impact Statement (DPEIS) was submitted to the Federal Transit Administration in September This DPEIS for Tier 1 of the study lists 38 different possibilities, or alternatives, for transit within the three counties as well as a no action alternative. Conclusions as to likely corridor sections to be built out, types of transit service, and station locations will be considered in greater detail in Tier 2, currently underway (as of February 2008).
