1 CHAPTER ONE HISTORY, BACKGROUND, AND PUBLIC INVOLVEMENT 1.0 AIRPORT HISTORY The first airport for the Fort Lauderdale-Hollywood area opened on May 1, 1929, on an abandoned golf course located southwest of the city of Fort Lauderdale in Broward County, Florida. Merle Fogg, a pioneer aviator, operated the city s first flying service transporting passengers and goods, in addition to providing aerial surveys, aerial photography, and flying lessons. In 1929, one year after his death, the city dedicated the Merle L. Fogg Airport in his memory. The U.S. Navy purchased the airport during World War II and began improving the airfield and constructing military barracks. The airport, then known as the Naval Air Station Fort Lauderdale, was developed as a training facility for pilots of aircraft carrierbased torpedo attack planes. At the peak of the military training effort, 3,600 naval personnel were stationed at the naval air station. At the end of World War II, the airport was declared a surplus property by the Navy and transferred to Broward County as a public use facility. In June of 1953, the first commercial service was initiated by Mackey Airlines between Fort Lauderdale and Nassau, Bahamas, from the airport known then as Broward County International Airport. In 1959, the airport was renamed Fort Lauderdale-Hollywood International Airport (FLL). Since the airport s beginnings in 1929 as a private airfield, FLL has become one of the fastest growing airports in the U.S., employing more than 35,000 people and accommodating more than 22 million passengers in The FAA's Airport Capacity Benchmark Report of 2004 identified FLL as one of the 35 busiest airports in the U.S. (September 2004). 2 (Exhibit 1.A-1 Airport Location Map, graphically depicts the location of FLL in southeast Florida and the eastern U.S.) FLL is owned by the Broward County, a political subdivision of the state of Florida, and operated through the Board of County Commissioners (the Commission), which is a nine member Board elected from each of nine districts within the County. The Commission serves as the legislative body of the county government and is identified as the Airport Sponsor in this Draft EIS. The Commission delegates the management of daily operations at FLL to the Broward County Aviation Department. Fort Lauderdale is a major tourist destination, with Fort Lauderdale-Hollywood International Airport (FLL) as a connection point for airline passengers to many nearby attractions as well as islands in the Bahamas. 2 commuter and charter operators, national and international air carriers, national and international cargo carriers, airline-to-cruise ship transfer passengers, a wide range of associated transportation and aviation support businesses, and their local, national, and international employees and customers. FLL plays a major role in the economic viability and growth currently experienced along Florida s southeastern coast by providing access to local tourist attractions, Port Everglades, and regional corporate and manufacturing centers. Broward County relies on the availability of dependable commercial passenger and air cargo service including corporate and general aviation activity. It is important to the region for FLL to continue to provide the capacity necessary to accommodate the current, as well as, long-term aviation demand within the region through Broward County s planning horizon of FLL is served by more than 45 air carrier, commuter, air cargo, and charter airline companies, with flights to more than 40 U.S. and international destinations in Canada, the Bahamas, the Caribbean, Mexico, Latin America, and South America. 3 Annual aircraft operations at FLL have increased from 287,094 in 2000 to 308,343 in 2004 and 336,111 in 2005; 4 and operations are forecast to steadily grow into the future, with 341,877 operations forecast to occur in 2012 and 408,536 operations forecast to occur in PROJECT HISTORY The Airport Sponsor s 6 proposed redevelopment of Runway 9R/27L, the subject of this Draft Environmental Impact Statement (Draft EIS), was originally proposed in the FLL 1994 Airport Master Plan Update (FLL MPU). 7 The proposed redevelopment of Runway 9R/27L was the subject of detailed study, local jurisdiction review, 8 and multiple public involvement and agency coordination programs conducted by the Commission. Subsequently, it was selected as the Airport Sponsor s Proposed Project. The proposed action was then subject to state environmental review under the Florida Development of Regional Impact (DRI) process beginning in Broward County and the cities of Fort Lauderdale and Hollywood issued development orders approving the Airport Sponsor s proposed project in (See Appendix I, Interlocal Agreements and Development Orders, for copies of the About the Airport FLL At A Glance. Internet web page: htm FAA Air Traffic Activity System (ATADS) Towers: Period Report From 2000 to 2006 (Fiscal Year). Internet web site: FAA 2006 Terminal Area Forecast, published in January 2007, provides projections through Federal Fiscal Year 2020 (the Federal Fiscal Year runs October through September). The Airport Sponsor also refers to the Broward County Board of County Commissioners (the Commission) which is the body responsible for requesting that the FAA initiate the Federal environmental process for their proposed project. See Appendix I, Interlocal Agreements and Development Orders. The DRI process subjects proposed projects of regional significance to state guidelines established under Chapter 380, Florida Statutes. The proposed project is reviewed by state agencies, the regional planning council and local governments with jurisdiction, to determine the regional impacts the development will have on the environment and other major regional facilities. To ensure compliance with the development orders, and in accordance with state guidelines, the county submits an annual monitoring report to the state, the regional planning council, and the local governments with jurisdiction. The Federal environmental process, under the National Environmental Policy Act of 1969 (NEPA), 10 was originally initiated by the FAA for this project in Since that time, three versions of a Draft EIS document have been published and the environmental process was stopped (in 2003) and then restarted again in This fourth Draft EIS document is the result of FAA restarting the EIS process in A chronology of the analysis produced by the FAA under NEPA up to the restart of the EIS process initiated by the issuance in January 2005 of the FAA Notice of Intent (NOI) 12 to prepare an EIS and to conduct public scoping is explained in the following paragraphs DEIS Draft Environmental Impact Statement: 13 The FAA conditionally approved the Sponsor s Airport Layout Plan (ALP) in December 2000, which included the proposed redevelopment and extension of the south runway to approximately 9,000 feet (8,920 feet was depicted on the conditionally approved ALP). 4 prepared and made available for public review and comment in February A public hearing was held on March 21, SDEIS Supplemental Draft Environmental Impact Statement: During the review of public and agency comments received on the February 2001 DEIS, the FAA determined that a number of factors used in the preparation of the DEIS had changed 16 and that the actual aircraft operational and passenger enplanement numbers were outpacing the forecasts used to prepare the DEIS. Accordingly, the FAA decided to re-issue the DEIS as a Supplemental DEIS (SDEIS) using updated data to reflect the actual FLL operational and enplanement numbers for 2000 as the baseline of aviation activity and using the updated forecasts in the FAA 2001 Terminal Area Forecast (TAF). Consequently, the analysis for some of the environmental impact categories was changed; specifically, noise, environmental justice, and air quality. The SDEIS was made available for public and agency review on March 15, A public hearing was held on April 15, SSDEIS Second Supplement to the Draft Environmental Impact Statement: Upon release of the SDEIS, and after reviewing agency and public comments, the runway use assumptions were revised for the Airport Sponsor s Proposed Project, which in turn required the re-evaluation of specific environmental impacts including noise effects on residences, compatible land use, socioeconomic, environmental justice, air quality, Section 4(f)/303(c) properties, and natural resources and energy supply. To fully assess and disclose the impacts of those revised operational assumptions, the FAA determined that a Second Supplement to the DEIS (SSDEIS) should be prepared. The SSDEIS was revised using the most current available population census data (2000 U.S. Census Block Data or field inspection) to determine the number of residents impacted by noise for all of the development alternatives under consideration. In addition to the re-evaluation of specific environmental impacts, the SSDEIS also clarified the proposed noise mitigation commitments made by Broward County. The SSDEIS was made available for agency and public review on November 29, Broward County Decision to Pursue Additional Airside and Landside Planning Studies: Between 2003 and 2004, the Commission made the decision to pursue additional airside and landside planning studies. 5 revise the its Proposed Project. These revisions were depicted on a conceptual Airport Layout Plan (ALP) drawing that included a new overall runway length defined for the south runway of 8,540 feet. 19 Broward County provided this conceptual ALP drawing and the County s Airfield Development Program Objective Statement to the FAA in November Restart of Environmental Analysis: Because of the Commission s decision to pursue additional airside and landside planning studies in 2003 and 2004, which resulted in the revised Proposed Project as depicted on the conceptual ALP drawing noted above, the FAA did not continue the NEPA process beyond issuance of the Draft for the previous three DEIS documents (the February 2001 DEIS, the March 15, 2002 SDEIS, or the November 2002 SSDEIS). 21 During 2004, the Commission conferred with the FAA to restart the environmental process to prepare a Draft EIS for the proposed expansion of Runway 9R/27L. In the preparation of this fourth Draft EIS, the FAA has relied on more recent planning and technical studies prepared by Broward County since the 1994 Master Plan Update. 22 These more recent planning and technical studies are identified and discussed in Chapter Two, The Proposal Conceptual ALP Drawing of Runway 9R/27L that was sent as an attachment to the letter to FAA Manager, Orlando Airports District Office from FLL Director of Aviation, Broward County Aviation Department, dated November 1, This responds to your letter dated December 24, 2003 requesting information necessary for the preparation of the revised Environmental Impact Statement (EIS) for the proposed extension of Runway 9R/27L at the Fort Lauderdale-Hollywood International Airport. However, the FAA has not relied on any of the environmental analysis contained in the three previous DEIS documents in the preparation of this fourth Draft EIS document. 6 The FAA issued a Notice of Intent on January 19, 2005 to restart the environmental process 23 under the Vision 100 Act 24 for the expedited and coordinated environmental reviews of airport capacity enhancement projects at congested airports. Information pertaining to the streamlining process for this Draft EIS is provided in Appendix A, Agency Streamlining. As part of the streamlining process and prior to finalizing the purpose and need statement and alternatives analysis, the FAA held meetings to gather consensus from the environmental review agencies at key decision points. Agencies 25 were also required to complete consensus forms at key consensus points indicating whether consensus had been achieved. Key consensus points include Study Area, Purpose and Need and Alternatives, Review Draft EIS findings and Documentation, and Preferred Alternative. All agencies have concurred with the Study Area, and the Purpose and Need and the range of Alternatives to be considered in this Draft EIS. By the time the Final EIS is issued the remaining consensus points will be addressed. The materials presented during the agency and public scoping meetings for the restart of the EIS process in January 2005 are provided in Appendix B.1, Scoping, of this Draft EIS document. The following list chronicles the events related to the development, planning, and NEPA environmental review of the Airport Sponsor s Proposed Project to redevelop and extend Runway 9R/27L from 1990 to 2005: September 1990: FAA initiates an Airport Capacity Enhancement Plan study that includes an option of extending Runway 9R/27L to approximately 9,000 feet October 27, 1992: the Commission initiates update of the 1987 Airport Master Plan and a Runway Feasibility Study May 1993: Runway Feasibility Study report recommends redevelopment and extension of Runway 9R/27L to approximately 9,000 feet as the preferred alternative May 23, 1993: the Commission accepts Runway Feasibility Study report recommendation Federal Aviation Administration Intent To Prepare Environmental Impact Statement, Fort Lauderdale-Hollywood International Airport, Ft. Congress states in Vision 100 Century of Aviation Reauthorization Act Public Law December 12, 2003, the importance of airports to the economy and the priority of capacity projects to ease congestion, and the need to assess environmental impacts associated with these projects. Congress directs the FAA as part of its overall air commerce missions, to encourage construction of capacity projects at congested airports. The Vision 100 Act requires the Secretary of Transportation to implement a process for expedited and coordinated environmental reviews for airport capacity enhancement projects at congested airports, and safety and security projects. Signatories to the Streamlining Agreement are the FAA, the U.S. Environmental Protection Agency, the U.S. Fish and Wildlife Service, the U.S. Army Corps of Engineers, the Florida Department of Environmental Protection, and Broward County. February 23 and 24, 2005: FAA conducts agency and public scoping on the preparation of an EIS for the Commission s revised Proposed Project March 2005: FAA collects and organizes comments received during scoping 1.2 SCOPING, FOCUS GROUPS, AND INTERIM PUBLIC WORKSHOP Early in the environmental process, Federal, state, and local governmental agencies, as well as the public, were afforded an opportunity to be briefed on the Proposed Project and to provide input on the potential environmental impacts that could occur if the Proposed Project were implemented. A series of meetings and workshops were conducted throughout the preparation of the Draft EIS to brief Federal, state, and local governmental agencies, and the general public on the Proposed Project. This series of meetings is summarized in the following paragraphs and more detail is provided in Appendix B, Public Involvement (Appendix B.1, Scoping; Appendix B.2, Focus Group Meetings; and Appendix B.3, Interim Public Workshop) SCOPING As a requirement of FAA Orders E, B and CEQ Regulations, 40 CFR , a scoping process must be conducted to provide the opportunity for maximum public and agency participation during the conduct of an EIS. The guidelines for conducting such scoping are contained within the CEQ Regulations, 40 CFR , which provide: There shall be an early and open process for determining the scope of issues to be addressed and for identifying the significant issues related to the proposed action. This process shall be termed scoping. March 2007 Page 1-8

9 The FAA, with the cooperation of Broward County, conducted a number of scoping activities to determine the range of issues to be analyzed and the scope with which each would be treated in the environmental document. Those activities included: Early written coordination with Federal, state, and local resource agencies; Filing of a Notice of Intent to Conduct a Scoping Meeting on the Environmental Impact Statement; and Conducting an agency scoping meeting that was followed by a bus tour of the Airport Sponsor s Proposed Project site. In an effort to identify potential issues associated with the Airport Sponsor s Proposed Project, coordination letters were mailed to key governmental agencies responsible for resource protection and public policy. The letters requested responses from those Federal, state, and local agencies that might have information pertaining to natural and human resources within the airport environs. A copy of the FAA coordination letter and list of agency addresses are included in Appendix B.1 Scoping, along with a summary of the comments received during the scoping process. Copies of the letters received from these agencies are also provided in Appendix B Agency Scoping The FAA conducted an Agency Scoping Meeting on February 23, 2005, for Federal, state, local agencies, and representatives of local units of government. Copies of the presentation used for the Agency Scoping Meeting and the sign-in sheets are provided in Appendix B.1, Scoping Public Scoping The public scoping workshop provided the public with the opportunity to review information about the Airport Sponsor s Proposed Project and the environmental process. The Public Scoping Meeting was held on February 23, 2005 from 2:00 p.m. until 8:00 p.m. at the Sheraton Fort Lauderdale Airport Hotel, 1825 Griffin Road, Dania, Florida, Information presented to the public and the comments received are included in Appendix B.1, Scoping FOCUS GROUPS Several different venues were offered throughout the preparation of this EIS for the general public to meet with the FAA and the FAA s consultant to discuss issues important to them. One of these venues included Project Focus Group meetings. The Project Focus Groups were specifically designed as small gatherings of the public who represented their community or homeowner association s concerns from neighborhoods surrounding the airport. This kind of intimate setting was intended to allow for the greatest opportunity to have open and honest exchanges of information between the public and the FAA. Although Focus Group participants were not extended policy-making authority, they were assured that their concerns were heard and evaluated as an integral part of the NEPA process. 10 Four Project Focus Groups were proposed for the five communities located in the Study Area: Fort Lauderdale, Plantation, Hollywood, Davie, and Dania Beach. In advance of each series of Focus Group meetings, an invitation letter from the FAA was sent to the current contact lists inviting them to become on-going participants in this process. Meetings were planned with each group at key project milestones: (1) Scoping, and (2) Purpose and Need and Alternatives.
