3 s Bylaw Title This bylaw is the Auckland Transport s Bylaw Purpose Auckland Transport makes this bylaw to set speed limits within the Auckland transport system, as specified in the schedules. Explanatory note Speed limits on roads that are not within the Auckland transport system are set under the Auckland Council Traffic Bylaw 2015, or in the case of State Highways, are set by NZTA under their bylaw. 3 Commencement This bylaw comes into force on 20 August All speed limits come into force on that date unless a different date is specified in the schedule that sets the speed limit or designates the urban traffic area. 4 Interpretation (1) In this bylaw, unless the context otherwise requires, Auckland has the same meaning as in the Local Government (Auckland Council) Act 2009 Explanatory note the definition of Auckland in the Local Government (Auckland Council) Act 2009 is: the area within the boundaries determined by the Local Government Commission under section 33(1) (as that determination is given effect to by Order in Council under section 35(1)) Auckland transport system has the same meaning as in the Local Government (Auckland Council) Act 2009 Explanatory note the definition of Auckland transport system in the Local Government (Auckland Council) Act 2009 is: (a) means (i) the roads (as defined in section 315 of the Local Government Act 1974) within Auckland, (ii) the public transport services (as defined in section 5(1) of the Land Transport Management Act 2003) within Auckland, (iii) the public transport infrastructure owned by the Council, (iv) the public transport infrastructure owned by or under the control of Auckland Transport, (b) does not include (i) State highways, (ii) railways under the control of New Zealand Railways Corporation, (iii) offstreet parking facilities under the control of the Council, (iv) airfields. 4 s Bylaw 2019 designated location has the same meaning as in the s Rule Explanatory note the Land Transport Rule: Setting of s 2017 defines a designated location as any of the following: (a) a car park: (b) an educational or scientific institution: (c) a commercial or industrial facility: (d) a health facility: (e) a residential facility: (f) marae land: (g) a camping ground: (h) a sports facility or other recreational area: (i) a botanical garden: (j) a cultural reserve: (k) a port or wharf area: (l) an airport: (m) a beach: (n) a cemetery or urupā: (o) a facility operated by the New Zealand Defence Force: (p) a facility operated by the Department of Corrections: (q) any other location approved by the Agency by notice in the Gazette. holiday speed limit has the same meaning as in the s Rule and refers to the speed limits specified in Schedule 5. Explanatory note the Land Transport Rule: Setting of s 2017 defines holiday speed limit as: means a maximum speed limit set in accordance with this Rule that is in force 24 hours a day for a specified period or periods. speed limit has the same meaning as in the s Rule Explanatory note the Land Transport Rule: Setting of s 2017 currently defines speed limit as: (a) means (i) an urban, rural, permanent, holiday, temporary, emergency, or variable speed limit; and (ii) the maximum speed at which a vehicle may legally be operated on a particular road; but (b) does not mean the maximum permitted operating speed for classes or types of vehicle specified in any Act, regulation, or rule. s Rule means the rule made under the Land Transport Act 1998 for the setting of speed limits that is in force at the time any speed limit is set by this bylaw. Explanatory note the current rule is the Land Transport Rule: Setting of Speed Limits urban traffic area refers to the areas specified in Schedule 1 Page 4

5 s Bylaw 2019 variable speed limit has the same meaning as in the s Rule and refers to the speed limits specified in Schedule 6, part B of Schedule 7, and parts B & C of Schedule 8. Explanatory note the Land Transport Rule: Setting of s 2017 currently defines a variable speed limit as: means a set of one or more defined alternative speed limits set under this Rule, one of which may be operating for a particular road at a particular time depending on the presence of specified conditions at that time. (2) Any undefined words, phrases or expressions used in this bylaw have the same meaning as in the Land Transport Act 1998 and/or the s Rule. 5 Speed limits set by this bylaw (1) The roads or areas described in Schedules 1 7 or as shown on a map referenced in Schedules 1 7, are declared to have the speed limit specified in those schedules and maps, which are part of this bylaw. (2) The speed limits specified in Schedules 1 7 were determined in accordance with the s Rule. (3) For the avoidance of doubt, unless a different speed limit is set and in effect under Schedule 2 8, or an emergency speed limit or temporary speed limit is in force, the speed limit on roads within the Auckland transport system is: (a) within the urban traffic areas specified in Schedule 1; and (b) 100km/h outside the urban traffic areas specified in Schedule 1. 6 Revocation and savings (1) On commencement of this bylaw, the Auckland Transport s Bylaw 2012 is revoked. (2) The speed limits on the roads or areas described in Schedule 8, which is part of this bylaw, being set or in effect under the Auckland Transport s Bylaw 2012, will continue in force under this bylaw unless and until a new speed limit is in effect under this bylaw or the s Rule. (3) All existing speed limits on roads within the definition of the Auckland transport system, other than those specified in Schedule 8, are revoked and replaced with the speed limits set by this bylaw. (4) In relation to any matter occurring before this bylaw was made, all speed limits on roads within the definition of the Auckland transport system that were in effect before this bylaw was made, continue to have effect for the purposes of: a. Investigating an offence or breach: b. Commencing or completing proceedings for the offence or breach: c. Imposing a penalty for the offence or breach. Page 5

7 Schedule 1 Schedule 1: Urban traffic areas s Bylaw 2019 The areas described in this Schedule or shown on a map referenced in this Schedule are designated urban traffic areas on and from the date specified in column C, and all roads within these areas have a speed limit of 50 km/h, unless: (a) the road is not within the Auckland transport system; (b) a different speed limit is set and in force under Schedule 2 8 of this bylaw; (c) an emergency speed limit or temporary speed limit is in force. The roads outside the areas described in this Schedule or shown on a map referenced in this Schedule, have a speed limit of 100 km/h on and from the date specified in column C, unless: (a) the road is not within the Auckland transport system; (b) a different speed limit is set and in force under Schedules 2 8 of this bylaw. (c) an emergency speed limit or temporary speed limit is in force.
