Keith Gurrola, Fillmore Fire Chief DATE: May 10, 2016 SUBJECT: Acceptance of Field Inventory of Properties Requiring Weed & Rubbish Abatement, Instruction to the Fire Chief to Notify Property Owners, and Adoption of City Council Resolution No Declaring Said Properties To Be a Public Nuisance and Setting a Public Hearing for the Abatement of Weeds & Rubbish for June 14, SUMMARY: The Fillmore Fire Department has conducted its annual survey of properties through the City and prepares an inventory of properties which are not in compliance with weed abatement regulations as these properties may pose a fire hazard to the community. This inventory, Attachment A to this report, is being presented to the City Council at this time for the City Council to declare that said properties are a public nuisance, to authorize notification of the owners of said property of this determination, and to set the Public Hearing date for the time for property owners to protest this determination. RECOMMENDATION: 1. Accept the Field Inventory List including property owner s names, addresses, parcel numbers and locations of hazards; 2. Adopt City Council Resolution No Declaring the Properties on the Field Inventory List to be a Public Nuisance and Setting a Public Hearing for the Abatement of Weeds & Rubbish for June 14, 2016; and 3. Instruct the Fire Chief to notify each separate parcel owner on the Field Inventory List of the hazard and the public hearing date of June 14, 2016, in the City Council Chambers, 250 Central Avenue, Fillmore, California. BACKGROUND AND ANALYSIS: According to Government Code Section 39560, et seq., a city council may undertake a process to abate public nuisances caused by weeds, rubbish, refuse and dirt growing upon private property in the city. It is that time of the year that properties experience extensive weed growth, which within a short time, becomes a very dangerous fire hazard if

Therefore, the City Council is requested to adopt the attached Resolution to declare the properties on the Field Inventory List to be a public nuisance and to direct staff to notify the applicable property owners that their property has been deemed a public nuisance which must be abated by the removal of the weeds, rubbish and refuse to be removed by the property owner prior to the public hearing to be held on June 14, Should any property owner on the List fail to do so, after the public hearing the City Council will be asked to direct the Fire Chief to contract for the removal of the weeds. The Fire Chief will then submit the bill for this service plus an administration fee to the City Council for confirmation at a City Council meeting. At the meeting at which the City Council receives the cost report the City Council will hear any objections of the property owners liable to be assessed for the abatement and the City Council may revise the report if necessary. The City Council will then confirm the report and will direct staff to send a copy of the report to the County Auditor who will add the amount of the assessment to the next regular property tax bill.. The Fire Chief has prepared a Field Inventory of properties (Exhibit A of Resolution ), including the property owner s names, addresses, parcel numbers and locations of hazards for review by the City Council. FISCAL IMPACT: The City General Fund will pay for the contract service to remove the weeds if needed. The General Fund will be reimbursed for these costs, plus staff time and other administrative costs, when the property taxes are collected by the Ventura County Tax Collector. This estimated cost is a budgeted item ($2,500.00). Attachment 1: Resolution No Attachment 2: Field Inventory Exhibit A

3 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FILLMORE SETTING A PUBLIC HEARING ON ABATEMENT OF WEEDS, RUBBISH, AND REFUSE WHEREAS, the Government Code provides (Title 4, Division 3, Chapter 13, Article 2) a procedure for abatement of weeds; and WHEREAS, the City Council elects for follow the procedures therein provided, and for the purpose of such procedure hereby designates the Fire Chief as the Superintendent ; and WHEREAS, the City Council is informed that there are weeds, rubbish and refuse upon certain private property in the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FILLMORE, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That a nuisance in the form of weeds, rubbish and refuse exists on those certain properties described upon Exhibit A attached hereto and made a part hereof. Section 2. That the Superintendent is directed to post notices of hearing pursuant to the said Article 2 before the City Council, and that hearing is set for June 14, 2016, at 6:30 p.m. in the City Council Chambers, 250 Central Avenue.
