DA Case No.: 2011SB Assigned DA/ADA: Joel Urmanski Agency Case No.: C Court Case No.: 2011CF Cassandra Wohlgemuth, Sheboygan Police Department, being first duly sworn on oath deposes and says on information and belief: Count 1: POSSESSION WITH INTENT TO DELIVER THC (TETRAHYDROCANNABINOLS) (<=200G), REPEATER The above-named defendant on Tuesday, May 31, 2011, in the City of Sheboygan, Sheboygan County, Wisconsin, did possess with intent to deliver a controlled substance, to-wit: Tetrahydrocannabinols (THC), in an amount of two hundred grams or less, or 4 or fewer plants containing tetrahydrocannabinols, contrary to sec (1m)(h)1, (3)(i), (1)(b) Wis. Stats. Upon conviction for this offense, a Class I Felony, the defendant may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than three (3) years and six (6) months, or both. And further, invoking the provisions of sec (1)(b) Wis. Stats., because the defendant is a repeater, having been convicted of at least 3 misdemeanors during the five year period immediately preceding the commission of this offense, which conviction(s) remain of record and unreversed, the maximum term of imprisonment for the underlying crime may be increased by not more than 2 years if the prior convictions were for misdemeanors and by not more than 4 years if the prior conviction was for a felony. And the Court may suspend the defendant's operating privileges for not less than six (6) months nor more than five (5) years. If the defendant's driving privileges are already suspended, any suspension imposed must be served consecutively.
2 Page 2 The basis of complainant s charge of such offense is: Official reports prepared by Officers John Samuels, Todd Danen, Sarah Barman, Michael McCarthy, and Sgt. William Adams, all of the Sheboygan Police Department, which reports indicate that on May 31, 2011 at approximately 1:00 a.m., Officer Samuels was driving northbound on South 14th Street, approaching New Jersey Avenue, in the City of Sheboygan, County of Sheboygan, State of Wisconsin, when he observed a gray colored Ford Taurus traveling eastbound on New Jersey Avenue and turning north on South 14th Street, in violation of a red traffic light. Following behind the Ford Taurus was a Sheboygan County Sheriff's Department vehicle that had it s red and blue lights activated. Officer Samuels followed the vehicle to assist. The Taurus finally came to a stop in the 600 block of South 14th Street, just south of Jefferson Avenue. Officer Samuels stopped his vehicle behind the deputies car and made contact with the deputies. Deputy Chad Baumann of the Sheboygan County Sheriff's Department advised Officer Samuels that he and his partner, Deputy LaPean, observed the vehicle that they stopped traveling eastbound on New Jersey Avenue with its lights off and began following the vehicle in an effort to perform a traffic stop. Deputy Baumann added that he and Deputy LaPean had been further west on New Jersey Avenue when they heard what they thought was a gunshot and saw the Taurus drive away. Officer Samuels assisted with the traffic stop, identifying the front seat passenger of the vehicle as Anthony J.E. Bell, d.o.b. 11/24/91. Bell very quickly told officers that he and the driver of the vehicle, Moriah L. Miller, d.o.b. 03/24/93, pulled away in their vehicle quickly because a man fired a gun in the air. Bell went on to say that they had been further west at the time, describing an area that seemed consistent with South 15th Street and Maryland Avenue, in the City of Sheboygan, County of Sheboygan, State of Wisconsin. Bell advised that he had been trying to sell marijuana to an African-American male in the described area. At the time, an additional African-American male produced a pistol and fired it in the air. Officer Samuels spoke to Bell, asking him to describe what occurred. Bell stated that he had a friend, known as Mikey, who told him to go and deliver some marijuana for him. Mikey told Bell that Bell would receive a phone call from a man who wanted to buy the marijuana. Thereafter, Bell and Miller ended up meeting a man at South 15th Street and New Jersey Avenue, in the City of Sheboygan, County of Sheboygan, State of Wisconsin, just inside the 1500 block of New Jersey Avenue on the southwest corner of the intersection. They stopped their vehicle, with the man coming up to the passenger
3 Page 3 side front door. The male, described as an African-American male, asked Bell if he could look at the marijuana. Bell handed over the bag, letting the African-American male examine its contents. A second African-American male walked up to the first male, at which time the first male handed the bag of marijuana to the second male. The second male handed the marijuana back to the first and then produced a pistol. The second male said to Bell and Miller, You know what you can do? Get the fuck out of here. The second male then raised the pistol and fired it once in the air. Bell described the pistol as a Beretta. Miller then drove off eastbound on New Jersey Avenue. Bell later told Officer Samuels that he was planning on selling the marijuana for $50.00 to $ Deputies Baumann and LaPean searched Miller s vehicle, finding a quantity of marijuana inside. Officer Samuels asked Bell about the marijuana found inside of the vehicle, with Bell stating that Miller had pulled the marijuana from her jacket and he put it in the glove compartment of her vehicle. Officer Samuels also spoke with Miller. She advised that Bell had offered to buy her an energy drink if she would take him for a drive. The two left Bell s residence when Bell received a phone call. Bell then gave her directions for driving, which resulted in their arriving in the area of South 15th Street and New Jersey Avenue. Miller pulled over in the area, at which time Bell began talking to an African-American male. She heard the African-American male say, I want to look at it. She then saw Bell produce a bag, which she believed to contain marijuana, and hand it to the African- American male. The African-American male called a second African- American male over and showed him the marijuana. The second African-American male produced a pistol and said, You better leave. The second male then fired the gun into the air. Miller got scared and drove away. Miller further told Officer Samuels that Bell never told her that he needed to drop off marijuana to anyone and that she thought what he had in the bag was marijuana because it looked like it. When asked about the marijuana found inside of her vehicle, Miller initially stated that she did not lock her vehicle and that friends of hers placed it in the glove box. She later told Officer Samuels that she had, in fact, had the marijuana in her jacket and that when she was pulled over, she took it out and gave it to Bell who put it in the glove box. Sgt. Adams reports that he made contact in the area of 15th and New Jersey where he was able to locate a brass casing determined to have been for a 9mm cartridge.
4 Page 4 Officer Barman heard over the radio that Officer Samuels was involved with a shots fired into the air complaint in the area of 15th and New Jersey. She further heard an assisting officer indicate that a red colored Dodge Durango was quickly turning southbound onto South Business Drive with an African-American male driving the vehicle. Officer Samuels advised that witnesses observed three African-American males involved in the incident last seen running in the same direction from the incident. Officer Barman observed the described red colored Dodge Durango traveling southbound on South Business Drive from Broadway Avenue. The vehicle was observed continuing at a higher rate of speed. The license plate of the vehicle showed the plates to be suspended and registered to Trevell D. Meeks, d.o.b. 07/27/90. Officer Barman followed the vehicle as it pulled into the first driveway of Camelot Manor, in the County of Sheboygan, State of Wisconsin. She activated her emergency lights to perform the traffic stop. Officers were able to identify the occupants of the stopped vehicle. The driver was identified as Trevell Meeks. The front seat passenger was identified as Bobby J. Meeks, d.o.b. 10/07/92. A back seat passenger side occupant was identified as Ronnie B. Vann, also known as Ronnie VannBeets, d.o.b. 01/17/94. Officer McCarthy assisted Officer Bahr with the traffic stop, ultimately performing a search of the vehicle. While searching the vehicle, Officer McCarthy found numerous fake one-hundred dollar bills in the rear passenger seat map pocket. In the same pocket was a black canvas-type bag with a drawstring at the top. Inside of the drawstring bag was a plastic bag tied off at the top with a large amount of green, leafy, plant material that Officer McCarthy recognized, based on training and experience, to be marijuana. As Officer McCarthy continued to search the stopped vehicle, he pulled back on a large, black, rubber, floor mat on the front passenger side of the vehicle. Placed on the floor in front of the front passenger seat was a silver/stainless steel handgun with a black rubber-style grip. Sgt. Adams reports that he assisted officers by performing an interview of Bobby Meeks. Bobby advised that he, Ronnie, and Trevell were in Sheboygan, having come up from Milwaukee. Bobby identified Trevell as his brother and Ronnie as his cousin. Bobby went on to tell Sgt. Adams that since there was nothing to do and he was bored, he wanted to buy some weed. Bobby advised that a friend named Mikey was able to put them in touch with someone who would
5 Page 5 sell the marijuana. Bobby used Mikey s phone to contact the dealer and was told to meet at 15th and New Jersey. Bobby told Sgt. Adams that he was intending to buy $ worth of marijuana. He was aware of the counterfeit one-hundred dollar bills located in the vehicle and indicated that he was going to use them to buy the marijuana. However, he said that he wanted to check out the marijuana first. Bobby went on to tell Sgt. Adams that Ronnie and Trevell were on the corner of 15th and New Jersey seated on a porch a couple of doors down. A vehicle pulled up and Ronnie was on the corner first and approached it. Trevell walked up to the vehicle second. Bobby stated that he could not hear everything, but heard the drug dealer, who was inside the vehicle, say something to the effect of, You guys already know what it is. Bobby then saw the dealer pull a handgun on Ronnie and Trevell. It was then that Trevell pulled a gun out and shot it in the direction of the car. The car then sped away, with the marijuana being dropped on the ground. Ronnie, Trevell, and Bobby recovered the marijuana and left the area. Bobby went on to tell Sgt. Adams that as he, Ronnie, and Trevell left the scene in the red Durango, Trevell put the gun underneath the floor mat in front of Bobby. Sgt. Adams also spoke with Ronnie. Ronnie stated that a man named Mikey helped them get in touch with a dealer who would sell the marijuana. Ronnie stated that before leaving his son s mother s residence in Sheboygan, he had been looking for a toy cap gun that his son used to play with to take with him. Ronnie advised that the gun had been thrown away and he could not find it. When asked why he wanted the gun, Ronnie stated that he just wanted to carry it. Ronnie told Sgt. Adams that he, Trevell, and Bobby went to the area of 15th and New Jersey. Bobby and Trevell were near the porch where Bobby was sitting until Ronnie walked towards the intersection. A vehicle pulled up and Ronnie made contact with the driver. Sgt. Adams reports that given the position of the vehicle, it appeared that Ronnie was actually on the passenger side of the vehicle. Ronnie indicated that the African-American male was the one who handed him a bag of marijuana. The dealer asked $ for the marijuana. Ronnie told the dealer that they did not want that much and asked if he had a blunt so he could try it. The dealer said he did not have a blunt. Ronnie then asked if he had a scale so that he could weigh it. The dealer said that he would have to go back home and get it. Ronnie told the dealer not to worry about it. Trevell then approached Ronnie. Ronnie asked Trevell what he wanted
6 Page 6 to do. Ronnie handed the weed to the dealer, but it was later passed from the dealer to Trevell. Trevell said to Ronnie, What do you want to do? Ronnie stated that he then turned around and walked away, at which time he heard a gunshot and they ran from the area. Ronnie told Sgt. Adams that when he saw Trevell take out the gun, he thought it was a toy gun until he heard it go off. When asked if at any time the dealer made any threatening statements, Ronnie said no. Ronnie advised that it appeared the dealer was upset when he realized they were not going to buy the marijuana, but he never did anything threatening. Officer Hendrikse reports that the seized firearm was a 9mm handgun. The handgun contained a magazine, which contained 13 rounds of 9mm ammunition and had one round in the chamber. Officer Hendrikse tested the suspected marijuana seized from both Miller and Meeks vehicles with NARC II test kits. The test results were positive for the presence of THC, the active ingredient in marijuana. Your Complainant has been informed by Assistant District Attorney Joel Urmanski that a check of records on file with the CCAP System, which the Sheboygan County District Attorney s Office relies upon to accurately reflect court appearances, indicate that Anthony J.E. Bell, d.o.b , has been convicted of the following three misdemeanor offenses within the preceding 5 years: Disorderly Conduct, in violation of Wis. Stat. sec , in Sheboygan County Case 2011CM93, with plea and sentencing having occurred March 29, 2011; Disorderly Conduct, in violation of Wis. Stat. sec , in Sheboygan County Case 2010CM79, with plea and sentencing having occurred June 01, 2010; and Battery, in violation of Wis. Stat. sec (1), in Sheboygan County Case 2010CM12, with plea and sentencing having occurred February 23, The three misdemeanor convictions remain of record.
