That pursuant to Clause 11 (e) of the Tenth Schedule of the Local Government Act 1974, Council grants approval to close the following Roads and car parks to ordinary vehicular traffic from the dates and during the hours stated for the purposes of holding the following events. BREAST CANCER FUN WALK - CITY EVENTS The Strand Hamilton Street from Harington Street south to its intersection with Devonport Road but not including the roundabouts. from The Strand to a point just east of the entrance to the City Markets' Carpark. That access to the Mount Ocean Sports Club be maintained at all times throughout those events located in. That consultation with all affected residents and businesses be undertaken by each organiser prior to each event occurring. That a Traffic Management plan compiled by a recognised Traffic Management Company be supplied to Council's Street Opening Co-ordinator for approval prior to each event commencing. Background The following events are proposed over the next six to nine months which require Council to approve temporary road closures to ensure the events can be run with regard to safety to competitors. Many of the events are of national importance and eariy approval for road closures is required so that they can be included in the yeariy event calendars. Both Mainstreet organisations support these road closures.

8 Decision-Making Considerations 1.1 Significance of Decision, Issue and Matters The matters in this report have been assessed against the Significance Policy. In making this formal assessment Council is not seeking to assess the importance placed on this issue by specific individuals, groups, or agencies within the Community. Council acknowledges that all reports have a high degree of importance to individuals, groups, or agencies. 1.2 LTCCP/Annual Plan The decision/matter is consistent with the LTCCP/Annual Plan. Generally all costs associated with temporary road closures are borne by the organiser/applicant, and there is no cost to Council. Some events attract finance from Council's Events Fund due to their flagship status and benefits to the Community.

9 118 Legal and Regulatory Issues Temporary road closures can be approved by three of the following procedures: (i) Traffic Regulations 1965 (Vehicular Traffic Road Closures) This requires the Council to publicly advertise the road closures 42 days prior to the day of the event and any person affected may lodge an objection no later than 28 days prior to the event. (ii) Local Government Tenth Schedule Clause 11 (e) The Council may close any road or part of a road to all traffic for a period not exceeding an aggregate of 31 days in any year for any exhibition, fair, show, market, concert, race or other sporting event, or public function. (iii) Delegated Authority The Council may delegate authority (except for Clause 11 (e) to its Chairman (Mayor) or any authorised officer of Council.
