2 About The Airport Boulder City Municipal Airport (BVU) is the third busiest airport in the state of Nevada offering on demand commercial air service as well as general aviation. The airfield is situated on 530 acres of land at an elevation of 2204 MSL with two runways and three taxiways. BVU has approximately 234,000 passengers per year on scenic flight tours to the Grand Canyon. The airport has 140 privately owned hangars and three commercial properties with 13 companies operating within the properties: 5 Star Helicopter Tours Army Core of Engineers BFE Flight Support Black Mountain Avionics Boulder City Aviation Services Cactus Aviation Grand Canyon Scenic Airlines Grand Canyon Trading Company Helicopter Services of Nevada Papillon Airways PS Aviation Serenity Helicopter Tours SkyDiveLasVegas Purpose The purpose of this plan is to take reasonable steps to provide meaningful access to Limited English Proficiency (LEP) persons seeking to use the Boulder City Municipal Airport. This LEP Plan is enacted in compliance with 49 CFR Part21, Nondiscrimination in Federally-Assisted Programs of the Department of Transportation, Effectuation of Title VI of the Civil Rights Act of Boulder City Municipal Airport assures that no person shall on the grounds of race, color, national origin, sex or creed as provided by Title IV of the Civil Rights Act of 1964, The Civil Rights Restoration Act of 1987 (PL ), and the Selection 520 of the Airport and Airway Improvement Act of 1982 by excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity. Boulder City Municipal Airport further assures every effort will be made to ensure nondiscrimination in all of its programs and activities, whether those programs are federally funded or not. Anytime communities may be impacted by programs or activities every effort will be made to involve their leaders and the general public in the decision making process. Awards of contracting, concessionaires, and leases are made without regard for race, color, national origin, sex or creed. Boulder City Municipal Airport requires Title VI assurance from each tenant, contractor, and concessionaire providing an activity, service or facility at the airport under lease, contract or franchise from the airport. Boulder City Municipal Airport also requires that such tenants, contractors, and concessionaires require Title VI assurances of their subcontractors. 3 Analysis The following four factors are considered in assessing Boulder City Municipal Airport s balance of the needs of LEP persons to providing effective customer service: 1) Number or proportion of LEP persons eligible or likely to be served in the City of Boulder City Community. /community_facts.xhtml Total Population (2010 Census) 15,023 Quick Facts e/geo/boulder-city-nv/# Hispanic or Latino White alone Black or African American alone American Indian and Alaska Native alone Asian alone Native Hawaiian, other Pacific Islander alone Some other Race alone Language other than English spoke at home, percent of persons age 5+ ( ) Percent % Most common non-english languages Spanish Laotian French spoken (2014) Percentages unknown unknown unknown 2) Determine the frequency with which LEP individuals come in contact with the program There has been no way to track this data. 3) Nature and importance of the program to peoples lives Interaction with Boulder City Municipal Airport employees, passengers, and other users of the airport can range from giving directions to life-and death emergency response. Staff will adapt the specific application of the LEP Plan to correlate to the urgency of service provision as can be reasonably expected. 4) Resources available and costs to consider a. Google Translate is a website plug-in that will be utilized on the Boulder City Municipal Airport website, into the desired language. Summary of Language Assistance Efforts The current focus of Boulder City Municipal Airport s language assistance efforts are directed at Spanish speaking persons. At this time the percentage of Spanish speaking persons needing assistance is very low. Ongoing Efforts to Identify and Address LEP Population As part of the ongoing commitment to bridging gaps in communication with LEP persons, Boulder City Municipal Airport will Update census data as it becomes available Regularly review perceived LEP needs with employees, tenants and other businesses Document language assistance requests Boulder City Municipal Airport 2 Limited English Proficiency Plan
4 Monitoring and Updating Plan Boulder City Municipal Airport will monitor the LEP efforts annually and update the plan every three years or as needed. Efforts will include: Review the LEP Plan triennially, make adjustments, as needed; Pay particular attention to demographic changes in the area that have the potential to affect LEP Plan Review any LEP-related complaints regularly and develop programs to mitigate them; Post the LEP Plan and subsequent changes on the Boulder City Municipal Airport website. 5 Title VI Complaint Process These procedures are for complaints of discrimination, other than employment discrimination, by the Boulder City Municipal Airport. They apply to discrimination by airport employees, contractors, concessionaires, lessees, or tenants of the Boulder City Municipal Airport or at Boulder City Municipal Airport facilities based upon race, creed, color, national origin, or gender, including but not necessarily limited to complaints under Title VI of the Civil Rights Act of 1964 and the Civil rights Restoration Act of They cover any program or activity administered by the Boulder City Municipal Airport. Any person who feels that they have been subjected to discrimination of the basis of race, creed, color, national origin, or gender has the right to file a complaint with the Boulder City Municipal Airport. These procedures do not deny or limit the right of a complainant to file a formal complaint with an outside agency, such as the U.S. Department of Transportation or Federal Aviation Administration (FAA), or to seek private legal counsel regarding discrimination. Complaints must be filed within ninety [90] days after the alleged discrimination event, must be in writing, signed, dated, and must be delivered by one of the following: By mail to: OR By to: Boulder City Municipal Airport Attn: Title VI Coordinator 1201 Airport Road, Suite 200 Boulder City, NV madou@bcnv.org Complainants may also file a written complaint directly with the FAA: By mail to: Federal Aviation Administration Office of Civil Rights 800 Independence Ave. SW Washington, D.C If a complaint is initially made by phone, it must be supplemented with a written complaint within ninety [90] days after the discriminatory event. 1. If a complaint is received, the Title VI Coordinator will provide written acknowledgment to the complainant within ten [10] business days. 2. Upon the receipt of a written complaint, the Boulder City Municipal Airport will investigate and attempt an early resolution. 3. Within fifteen [15] days of receiving a written complaint, the Title VI Coordinator will forward a copy of the complaint to the FAA Regional Office in which the airport is located, along with a statement describing all actions taken to resolve the matter and the results of such actions. The Title VI Coordinator will work with the Regional Civil Rights Program Manager during this process. 4. The Title VI Coordinator will make every effort to complete discrimination complaint investigations within sixty [60] calendar days after the written complaint is received, but recognizes that some investigations may take longer. The Title VI Coordinator will document each investigation in an investigation report. 5. Upon Completion of the investigation, the Title VI Coordinator will issue either a closure letter or a letter of finding. A closure letter summarizes the allegations and state that there was no finding of a Boulder City Municipal Airport 4 Limited English Proficiency Plan
6 Title VI violation and that the investigation will be closed. A letter of finding summarizes the allegations and investigation findings and explains whether any disciplinary action, additional training, or other action will occur. 6. If the complainant disagrees with the conclusion of the investigation, the complainant may appeal in writing to Airport Manager. The written appeal, including all arguments, evidence, and documentation supporting the appeal, must be received within [10] business days of the decision letter. The Airport Manager will issue a final written decision in response to the appeals within thirty [30] business days. The Airport Manager s decision is final. 7. Copies of the complaint, summary of the investigation report, any response, and the Boulder City Municipal Airport s decision letter(s) will be sent to the FAA.
