8 INTRODUCTION Scope of this document This document, jointly approved by the BLUE MED FAB Member States, provides the information set out in the Annex to the Regulation (EU) No 176/2011 to demonstrate fulfillment of the requirements specified in Regulation (EC) No 550/2004. The document, in order to propose an easy consultation and cross check with requirements laid down the Commission Regulation (EU) No 176/2011, has been divided into two main sections: PART I - General Information, and PART II - Requirements of Article 9a of Regulation (EC) No 550/2004 All the information has been retrieved from the documents delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase. Malta FIR/UIR The BLUE MED FAB jointly designated Meteorological Service Providers and their respective areas of responsibility are the following: NOT APPLICABLE (d) the providers of air traffic services providing services without certification in accordance with Article 7(5) of Regulation (EC) No 550/2004 and their respective areas of responsibility Air Traffic Service Providers 4 authorized to provide ATS without certification in accordance with Article 7(5) of Regulation (EC) No 550/2004 within the BLUE MED FAB and their respective areas of responsibility are: Aeronautica Militare (Italian Air Force). Airspacess and Aerodromes within Milan FIR/UIR, Rome FIR/UIR and Brindisi FIR/UIR run by Military Administration 5 where some of Air Navigation Services are supplied by the Italian Air Force. The Hellenic Air Force (HAF). In certain airports/tmas, run by military administration within Athinai FIR/Hellas UIR, Air Traffic Service to GAT is provided by HAF. 12 2 The Member States concerned shall provide the following information on the arrangements concluded regarding the establishment of the functional airspace block, including: (a) copy of the documents which reflect the mutual agreement of the Member States concerned to establish the functional airspace block The BLUE MED FAB State Level Agreement is the document reflecting the mutual agreement of the Member States concerned to establish the BLUE MED functional airspace block and is attached to this report as ANNEX 1. 14 1 Functional airspace block safety case With regard to the BLUE MED FAB safety case, the following information is provided: (a) the common safety policy or plans to establish a common safety policy; The BLUE MED FAB Safety Policy 7 has been defined as the following: States commitment to Safety In order for the BLUE MED FAB to contribute effectively to the overall Pan-European Air traffic Safety, the States of Cyprus, Greece, Italy and Malta will:. jointly designate ATSPs to operate the FAB with the goal to increase Safety levels,. give the responsibility to their NSAs to develop their own arrangements so as to ensure efficient oversight of the FAB, thus ensuring continuous improvements of safety;. define responsibilitiess and accountabilities with their relevant Accident Investigation Boards as well as the required safety data flows; and. take initiatives to promote and continuously improve a common safety culture. NSAs engagement for Safety In order to ensure enhanced oversight of the BLUE MED FAB, the NSAs of Cyprus, Greece, Italy and Malta will:. make appropriate arrangements and commit the necessary resources to ensure the effective safety oversight of the ANSPs ; and. develop the necessary interfaces with the ANSPs. ANSPs active contribution to Safety achievement In order to ensure the required uniform safety standards within the FAB, ANSPs of BLUE MED will:. commit to give safety the highest priority in delivering their services. engage in the integration of their safety management system to ultimately design build and maintain the FAB SMS;. identify, co-ordinate, deploy and monitor common safety improvements 7 See Annex 1 of D3.2a BLUE MED FAB Safety Case Part A Regulatory aspects v2.0 (ANNEX 2) Page 14 of 46

15 (b) a description of the arrangements dealing with accident and incident investigation and plans on how to addresss safety data collection, analysis and exchange; BLUE MED FAB Member States agree, within the attached document BLUE MED FAB State Level Agreement, on the following arrangements dealing with Investigation of accidents and serious incidents, reporting and information dissemination 8. In the event of an accident or a serious incident according to the meaning of the Chicago Convention occurring in the airspace over the territory of a Member State or under its responsibility in accordance with ICAO rules (hereinafter referred to as the Member State of occurrence ) and controlled by an air navigation service provider other than the provider(s) whose principal place of operations is/are located on the territory of the Member State of occurrence (hereinafter referred to as the effective air navigation service provider ), the Member State of the effective air navigation service provider shall notify such event without delay to the competent authorities of the Member State of occurrence by the most suitable means. The notification shall have the same content as a notification of Annex 13 of the Chicago Convention. At its request, the Member State of occurrence or the State conducting the investigation according to Annex 13 to the Chicago Convention shall be provided with, and have access to, the necessary materials by all relevant air navigation service providers and competent authorities of the Member States in order to enable an investigation of the accident or the serious incident to be conducted. The Member State of the effective air navigation service provider shall therefore grant, in accordance with its national laws and regulations, the State conducting the investigation access to the premises, facilities, materials, personnel, documentation or any other information about the effective air navigation service providers and of its own competent authorities. The information provided shall not be made available or used for the purposes other than safety investigation. The Member State of the effective air navigation service provider shall have the opportunity to appoint an accredited representative to take part in the investigation. Any Member State whichh at the request of the State conducting the investigation provided information or access to its competent authorities or an air navigation service provider shall be entitled to appoint an accredited representative to participate in the investigation, as per the provisions of ICAO Annex 13 and relevant EU Legislation and related national law. The competent authorities of the State conducting the investigation shall provide the final investigation report in the language of that state and an English translation, together with any safety recommendations arising out of the investigation, to the competent authorities of the Member State of the effective air navigation service provider as well as, upon request, to the other Member States and to the BLUE MED Governing Board. 8 See Articles 26 and 27 of BLUE MED FAB State Level Agreement (ANNEX 1) Page 15 of 46

16 This Article shall supersede the provisions governing investigation of accidents and serious incidents in any existing bilateral agreements between any two Member States related to the provision of air traffic services. All Member States shall have in place appropriate incident, investigation and reporting mechanisms in conformity with international and European legislation. The Member States shall ensure that pertaining BLUE MED safety-related information is duly reported, collected, protected, stored, analysed, exchanged and disseminated. The sole objective of occurrence reporting is the prevention of accidents and incidents and not the attribution of blame or liability. Furthermore, in accordance with the documents delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, with regards to safety data collection, analysis and exchange the following actions are planned 9 : Harmonisation of national occurrence reporting and investigation processes shall begin, agreeing, as a minimum on the output of the processes. Implementation of the use of the Risk Analysis Tool (RAT) in the national occurrence investigation processes. Agreement on a method of archiving FAB relevant safety occurrences and investigation results in a commonly accessible repository (e.g. through the use of ECCAIRS or EUROCONTROL TOKAI - Tool Kit for ATM Occurrence Investigation) Creation of a repository of best practices resulting from lessons learnt (e.g. via BLUE MED website) shall be established where each ANSP uploads documents and procedures to learn from each other. This will be fully agreed and reciprocity shall be guaranteed Submission of a bi-annual BLUE MED FAB Safety Report to the BLUE MED high level Governance (first one to be produced early 2016). Any feedback received will be included and/or considered as an input to the bi-annual BLUE MED FAB Safety Programme for the next years. 9 See D3.3 - Saf Mat Analysis and FAB SMS roadmap v2.0 (ANNEX 3) Page 16 of 46

17 (c) a description of the way in which safety is being managed to avoid degradation in safety performance within the functional airspace block; As detailed in the attached BLUE MED FAB State Level Agreement the BLUE MED FAB Member States agree on the following arrangements 10 : The Member States, having regard to SES legislation, shall strive to harmonise their national rules and procedures with a view to achieving the development and implementation of BLUE MED FAB ANSP Safety Management Systems as well as appropriate safety oversight processes. To this end, Member States shall work on a regular basis by using any appropriate means through the ANSP and NSA Committees. The Member States recognize that each National Supervisory Authority, individually established or nominated by each Member State pursuant to the SES legislation and listed in Annex 2 to the present Agreement, shall carry out the tasks entrusted to such competent Authority pursuant to the Single European Sky legislation, thus ensuring appropriate supervision and safety oversight of the air navigation services provided in the BLUE MED FAB. The Member States shall promote and facilitate close cooperation among their respective National Supervisory Authorities on the supervision of the air navigation services provided in the BLUE MED FAB in the framework of the Single European Sky Regulations and undertake to strive for the widest possible harmonisation of national rules and procedures governing supervision. BLUE MED FAB National Supervisory Authorities agree, within the draft document Agreement for National Supervisory Authorities of the BLUE MED Functional Airspace Block, some relevant arrangements. Furthermore, in accordance with the documents delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, is reported an additional description of the ways on how safety is managed to avoid degradation in safety performance within the BLUE MED FAB: In accordance with the FAB SMS Roadmap delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, a progressive harmonization of the BLUE MED SMS is foreseen, as presented in the diagram below 11 : 10 See Articles 15 and 17 of BLUE MED FAB State Level Agreement (ANNEX 1) 11 See D3.2a BLUE MED FAB Safety Case Part A Regulatory aspects v2.0 (ANNEX 2) Page 17 of 46

18 Furthermore, in accordance with the FAB Safety Case delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, the following actions are planned 12 : With regards to safety performance: A FAB-wide safety monitoring process shall be agreed (inputs and outputs as a minimum). Adoption of common tools will be recommended (e.g. APF); The SES II compliant leading indicators will be de facto adopted (e.g. effectiveness of safety management) and appropriate targets will be set. These will be further updated with the pan- European ones which are expected to be set by the EC for RP2 ( ). The effectiveness of safety management shall be measured, on an annual basis, by a methodology developed by EASA.. FAB wide safety maturity will be assessed using the method agreed and developed at pan- European level by EASA. 12 See D3.2a BLUE MED FAB Safety Case Part A Regulatory aspects v2.0 (ANNEX 2) Page 18 of 46

19 (d) a description of the arrangements clearly identifying and allocating the responsibilities and interfaces with relation to the setting of safety targets, safety oversight and the accompanying enforcement measures in regard to the provision of air navigation services within the functional airspace block; BLUE MED FAB Member States agree, within the attached document BLUE MED FAB State Level Agreement, on the following arrangements 13 : The Member States commit to achieve progressive convergence of their national performance plans pursuant to the SESS legislation. The BLUE MED FAB Governing Board endorse the Blue Med Performance Plan, if any, and the related performance targets according to SES legislation The Blue Med NSAs willl maintain their responsibilities at national level, whilst at FAB level, safety will be overseen in a coordinated manner by the FAB NSA Committee, in the framework foreseen in the State Level FAB Agreement and in accordance with what is contained within the BLUE MED NSA Agreement which at present is under development. Furthermore, in accordance with the FAB Safety Case delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, the following actions are planned 14 : The BLUE MED ANSPs shall relate and align the BLUE MED FAB Safety Programme with individual ANSP Safety Plans to ensure consistency with individual safety performance targets. The top 5 safety concerns/risks in BLUE MED FAB shall be established, based initially on expert judgment and, subsequently, complemented by data. Safety targets for the FAB shall be proposed to the BLUE MED high level Governance for formal adoption. (e) documentation and/or statements that the safety assessment including hazard identification, risk assessment and mitigation has been conducted before introducing operational changes resulting from the establishment or modification of the functional airspace block. 20 safety issues. Nevertheless, after establishment, a number of operational changes are planned and in this respect an initial safety assessment of these changes was done Optimum use of airspace, taking into account air traffic flows The BLUE MED FAB Member States provide the following information: (a) a description of the relations with the relevant network functions for airspace management and air traffic flow management referred to in Article 6 of Regulation (EC) No 551/2004 of the European Parliament and of the Council 16, including the coordination, arrangements and procedures to achieve optimized use of the airspace; In accordance with the provisions of the BLUE MED FAB State Level Agreement the States agree on the following arrangements 17 : The Member States shall closely co-operate in the provision of Airspace Management and Air Traffic Flow Management Services and make the most efficient use of available resources and capabilities within the BLUE MED FAB. The Member States undertake to jointly design the BLUE MED FAB airspace identified under Article 3. To this end, the Member States agree to ensure in particular: (a) the design of the airspace structures concerned to facilitate defragmentation and dynamic sectorization taking due account of collaborative processes at EATMN level; (b) the development and approval of a BLUE MED FAB airspace design policy, in close cooperation between civil and military authorities and in consultation with any relevant stakeholders with particular regard to airspace users; (c) the development, approval and implementation of a BLUE MED Airspace Development Plan; (d) the assessment of airspace modifications affecting the performance at BLUE MED FAB level. 21 In doing so, the Member States, through the identified Governance structures, shall interface with the EU Network Management function in accordance with the SES legislation and following ICAO procedures. The Member States shall ensure the development and implementation of a BLUE MED FAB management policy of the airspace concerned with a view to achieving optimal coordination of air traffic flows. The BLUE MED FAB Governing Board shall, inter alia: (b) approve the BLUE MED FAB common policy for the airspace concerned pursuant to SES legislation; (c) identify any appropriate measures to support harmonisation of substantive national rules and procedures relating to air navigation services, air traffic flow and capacity management, air space management, training and licensing of related staff, interoperability of systems; and rules of the air, including the harmonization of the notified differences with the ICAO standards; (k) ensure the coordination of the BLUE MED FAB with adjacent functional airspace blocks, including efficient interfaces; (l) foster and facilitate cooperation between air navigation service providers aiming at the improvement of their performance; (m) ensure consultation with, and between, air navigation service providers, airspace users and other stakeholders, where appropriate establishing and/or modifying the relevant consultation mechanisms; BLUE MED FAB jointly designated ATS Providers agree, within the draft document BLUE MED FAB Arrangement between jointly designated ATS Providers for enhancing cooperation in ANS - ATM 1.0, on the following arrangements: The Parties undertake to implement a closer cooperation ensuring the best use of available resources and capabilities for the provision of the following air navigationn services within the airspace concerned: (a) Air Traffic Services (ATS); (b) Communication, Navigation and Surveillance Services (CNS); and, in the cases where practicable: (c) Meteorological Services (MET); and (d) Aeronautical Information Services (AIS). 22 The areas of closer cooperation for the provision of air navigationn services, airspace management and air traffic flow management, pursuant to the present Arrangement, may include, but are not limited to the following:. Airports;. Control Zones and Terminal Control operations;. En route operations;. Airspace Management and Design;. Communication, Navigation and Surveillance Services;. Air Traffic Flow Capacity Management;. Aeronautical Information Services;. Meteorological Services;. Flight inspection services;. Training;. Maintenance;. Research and Development;. Interoperable systems for air navigation services/ air traffic management ;. ATM/ANS Safety, Security and Quality Management. A BLUE MED FAB ANSPs representative to the Network Management Board has been defined and is already fully involved in the activities of the Network Management Board. In particular, BLUE MED FAB ANSPs are represented within the Network Management Board in accordance with the Terms of Reference 18 for the BLUE MED FAB ANSPs representative (and alternate representative) in the EC Network Management Board, in accordance with Regulation (EU) No 677/2011 agreed at BLUE MED FAB Member States level. The NMB Representatives will establish and maintain the necessary link between the Board and the BLUE MED ANSPs, providing the mechanism for a timely and appropriate consultation to reach the necessary consensus on a common position before the NMB is convened. For this purpose, at least one focal point per ANSP will be identified who will act as the representative of that ANSP (hereafter collectively referred to as ANSPs Focal Points ). The NMB Representatives appointment will be on a rotation basis. The rotation period has been decided as per BM Governing Body decision, with the aim to ensuring adequate stability and continuity to the Representatives activities and possible official roles in the NMB. 23 Alternate Representative will be the next in line to become Representative in the following rotating slot, in order to ensure continuity and adequate Representation of the BLUE MED FAB ANSPs. Another Alternative will then be selected to replace the previous one. The NMB Representatives shall act as advisors to the BLUE MED Governance structure, ensuring that all relevant information on the activity and decisions of the NMB, having an impact on the FAB, are correctly identified, transmitted and acted upon. For this purpose, an appropriate reporting mechanism shall be put in place by the NMB Representatives. The NMB Representativess shall: a) Promptly transmit to the ANSP Focal Points all relevant documentation regarding the convening of the NMB meetings (meeting agenda, supporting material). b) Before each NMB meeting, convene the BM NMB Preparation Meeting, with the objective of discussing with the ANSP Focal Points all the relevant issues for each ANSP and reaching, by consensus, an agreed position on all matters. d) When necessary, consult with other FAB relevant stakeholders (i.e. NSAs, States Defence Authorities Military, other States authorities) to assess their position on particular issues to be raised at NMB level. e) Attend the NMB meeting, presenting all the BLUE MED FAB relevant issues and points of view, as agreed with the ANSP Focal Points. f) Produce the appropriate reports for the BLUE MED Governance structure, highlighting the output of each NMB session as well as the resulting potential impact on the BLUE MED FAB. The ANSP Focal Points shall: a) Receive from the NMB Representatives all relevant documentation regarding the convening of NMB meetings (meeting agenda, supporting material) sufficiently in advance. b) Perform the necessary preparation work by duly analyzing the received documentation, identifying issuess relevant for each ANSP to be raised to the attention of the NMB Representatives. c) Prior to each NMB meeting, attend the BM NMB Preparation Meeting, with the objective of discussing all the relevant issues and reaching, by consensus, an agreed ANSP position an all matters. d) Identify possible issues requiring clarification or agreement by other FAB relevant stakeholders (i.e. NSAs, States Defence Authorities Military, other States authorities). 24 Furthermore, in accordance with the documents delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, an additional description of the plans 19 on the coordination, arrangements and procedures to achieve optimized use of the airspace within the BLUE MED FAB is described and presented: Airspace Management and Air Traffic Flow Capacity Management, in collaboration with Airspace Users, are responding to several tasks. Among them, they have to:. provide the better airspace allocation in order to fulfil with users requests;. dynamically adjust the airspace allocation in accordance with the real occupation of reserved areas;. manage in a flexible way airspace allocation for other purposes, ncluding the operation of state (military- government) aircraft. BLUE MED ATFM/ASMM in collaboration with Airspace Users shall identify potential flow problems, such as large-demand capacity imbalances, congestion, high degrees of complexity, and blocked or constrained airspace (e.g., for special use, weather), and collaborate at FAB level to develop flow strategies (i.e., aggregate trajectory solutions). BLUE MED FAB traffic flows shall be safely and efficiently managed, unconstrained by facility boundaries, through implementation of necessary communication, information management, and surveillance capabilities. Collaborative Decision Making is a concept that responds to the need for active collaboration of all ATM actors. Having an improved mutual knowledge of the forecast, current or even past situations, of each others constraints, preferences and capabilities, BLUE MED ATM actors, will pro-actively resolve any areas of potential conflicts of interest, in which the actor best able to make the decision is predefined and agreed in advance among BLUE MED members as the one to do so. An improved ASM-ATFCM process is considered one of the key elements to ensure a more efficient use of the airspace at FAB level in order to exploit available capacity and balanced traffic demand in collaboration with Airspace Users. The integration of ASM and ATFCM functions is the enabler to ensure the implementation of a process able to identify best solutions considering all possible opportunities offered by this integration. The ASM- ATFCM process will be driven by high level conceptual elements:. ASM and ATFCM functions will be gradually integrated, first on national base, then coordinated at FAB level, 19 See D1.1b Detailed Concept of Operations 2.0" (ANNEX 5) Page 24 of 46

25 . different organisational solutions will be considered and subject to validation before any planned implementation. ASM and ATFCM elements shall be applied in a common way within the BLUE MED FAB area of applicability. The enhanced ASM/ATFCM process, within the Collaborative Air Traffic Management, is expected to be fully applied among BLUE MED FAB Members, Associated Partners and observer States will be fully involved in the delineation and recommended to ensure the implementation of the enhanced ASM/ATFCM process at the earliest convenient. Taking into account the great initial differences existing within BLUE MED area, a modular application of the ASM/ATFCM process could also be foreseeable; in this case the application of best practice will be used as catalyst to promote further improvements in other geographical areas. The implementation of an enhanced ASM/ATFCM process at FAB level will involve all levels: strategic, pre-tactical and tactical, in collaboration with Airspace Users. In particular:. the strategic level shall include a widespread cooperation among the existing national strategic level bodies in order to regulate the use of the BLUE MED regional air space regardless of the existing boundaries and to address the related ASM-ATFCM activities;. the pre-tactical level shall use current national structures empowered with additional ATFCM functionalities and a wide spread coordination network among themselves for BLUE MED FAB purposes;. the tactical level shall be improved by a strong integration among the existing national civil-military structures necessarily at operational level with additional ATFCM functionalities and the flight plan processing and flight planning assistance with the purpose to guarantee each airspace modification as well as ATFCM measures affecting flight plans to be suitably addressed and the airspace users properly assisted when changes to the available routes require the recommendation of different options. Although for 2015 it is reasonable to consider a process managed throughh the existing national structures, new organisational solutions could be introduced for all the levels whenever considered feasible by the FAB members. Anyhow it will be a stepped implementation approach, subject to the decision of States. The management of the airspace at FAB level will include:. a widespread cooperation at strategic level,. a regional pre-tactical coordination process in the assumption thatt the pre-tactical level shall use current national structures empowered with additional ATFCM functionalities Page 25 of 46

26 and a wide spread coordination network among themselves for BLUE MED FAB purposes,. a tactical management of the airspace. The enhancement of the ASM/ATFCM processes is expected to ensure seamless operations from strategic planning to tactical usage through:. the intensificationn of the harmonization process between all the ATM partners, namely CFMU, Area Control Centres (ACCs), Flow Management Positions (FMPs) and Airspace Management Cells (AMCs) in collaboration with Airspace Users;. the adoption of a common procedure for the planning, the management of both route structures/sectorizations and reserved for military activities;. the extension of the pre-tactical ASM/ATFCM interventions closer to the time of operations;. the gathering, processing and distribution of ASM data;. the flight plan processing and distribution. The added value of the dynamic airspace management process will indeedd result in:. more equitable treatment in the management of airspace and trajectories required at short notice;. more accurate Aircraft Operators airspace situation awarenesss obtained through a better knowledgee on all the routing options. The civil/military cooperation and the integration of military requirements in airspace design and management is an overriding target in the deployment process of BLUE MED FAB area of application. The FUA concept fostered by ICAO and EU, which is a milestone for the civil/military coordination, considers airspace as one continuum aiming at catering for civil and military requirements, satisfying the demand for airspace capacity from aircraft operators and at the same time covering the military requirements. This is expected to deliver benefits stemming from current initiatives such as ICAO ANP, SESAR, DMEAN, EUROCONTROL concepts (advanced FUA, Advanced Airspace Scheme etc.) by dynamic modular airspace design forming airspace configurations and sector groups/families, integrated ASM/ATFCMM and combined FAB AMC(s) and FMPs, together with joint civil/military airspace design, leads to an optimized route structure for the airspace users and more options for placing military training areas at locations optimal for both civil and military users. 27 Additional information, elaborated within the BLUE MED FAB Project Definition Phase, concerning coordination, arrangements and procedures to achieve optimized use of airspace is described within D1.1b Detailed Concept of Operations 2.0 (ANNEX 5) and D1.4 BLUE MED Operational Scenario v1..0 (ANNEX 6). Moreover, in line with similar initiatives undertaken under the network functions umbrella, additional information regarding the BLUE MED airspace optimisation pursued via the implementation of Free Route operations can be recognised within D1.3 Real Time Validation Report v1.0. (ANNEX 7) The compliance with the requirement under item (a) is also based on the fact that BLUE MED member States participate and contribute to the development of the RNDSG airspace improvements Catalogue with the support of EUROCONTROL. The outcome of these activities is integrated in ARN V7 / ARN V8. (b) in respect of airspace management within the functional airspace block not covered by the network functions referred to in Article 6 of Regulation (EC) No 551/2004, information on: the arrangements for an integrated airspace management, At this stage, no arrangements are foreseen for an integrated airspace management within the BLUE MED FAB. the provisions for sharing of airspace management data, BLUE MED FAB Member States agree, within the attached document BLUE MED FAB State Level Agreement, on the following arrangements 20 : The Member States shall closely co-operate in the provision of Airspace Management and Air Traffic Flow Management Services and make the most efficient use of available resources and capabilities within the BLUE MED FAB. The Member States undertake to jointly design the BLUE MED FAB airspace identified under Article 3. To this end, the Member States agree to ensure in particular: (a) the design of the airspace structures concerned to facilitate defragmentation and dynamic sectorization taking due account of collaborative processes at EATMN level; (b) the development and approval of a BLUE MED FAB airspace design policy, in close cooperation between civil and military authorities and in consultation with any relevant stakeholders with particular regard to airspace users; 20 See Articles 7 of BLUE MED FAB State Level Agreement (ANNEX 1) Page 27 of 46

28 (c) the development, approval and implementation of a BLUE MED Airspace Development Plan; (d) the assessment of airspace modifications affecting the performance at BLUE MED FAB level. (e) the coordinated establishment of cross border airspace within the BLUE MED FAB. In doing so, the Member States, through the identified Governance structures, shall interface with the EU Network Management function in accordance with the SES legislation and following ICAO procedures. The Member States shall ensure the development and implementation of a BLUE MED FAB management policy of the airspace concerned with a view to achieving optimal coordination of air traffic flows. Information, elaborated within the BLUE MED FAB Project Definition Phase, concerning the provisions for sharing of airspace management data is described within D2.1a - Early FAB Technical Implementation Quick Wins 3.0 (ANNEX 8). The Cross border radar coverage and possible integration is the technical enabler to achieve several Operational Requirements such as the establishment of minimum radar separation and the separation at transfer of radar control. Furthermore, within the BLUE MED FAB Project Definition Phase, an effective exercise of sharing of airspace management data has been initiated and is being carried out within ATFCM domain regarding ATFCM statistical Reports (Daily, Weekly, Monthly, Summer, Annual). These activities have been progressively extended up to including non-eu States involved in the BLUE MED FAB Project Definition Phase (Albania, Egypt and Tunisia as Associated Partners). All the above mentioned Reports are available on the BLUE MED FAB website ( the arrangements for an effective cooperative decision-making; The documents delivered by the BLUE MED FAB Project Member States within the framework of the BLUE MED Definition Phase, contain an additional description of the Page 28 of 46

30 In cases wheree cross-border services in the airspace concerned are provided, the Member States shall encourage close cooperation between the civil and military air navigation service providers. Any such written agreements or equivalent legal arrangements concerning cross border Air Traffic and/or MET services in the airspace concerned shall be approved by the Member States after consultation with the BLUE MED Governing Board. Once approved, they shall be notified to the BLUE MED Governing Board. The Member States shall promote and facilitate close cooperation among their respective National Supervisory Authorities on the supervision of the air navigation services provided in the BLUE MED FAB in the framework of the Single European Sky Regulations and undertake to strive for the widest possible harmonisation of national rules and procedures governing supervision. 31 3 Consistency with the European route network In order to provide information to demonstrate that route design and implementation for the BLUE MED functional airspace block is consistent with, and completed within, the established process for overall coordination, development and implementation of the European route network referred to in Article 6 of Regulation (EC) No 551/2004, the BLUE MED FAB Project Definition Phase has prepared the BLUE MED Route Network Catalogue 23. The Catalogue contains over 230 new airspace design proposals that are in line and beyond the scope & timefram of ARN (version 7 and following). The Network Manager (RNDSG Secretariat) provided support to the development of this Catalogue and the assessment of the benefits of the proposals made. The abovementioned Catalogue is being updated, since within the BLUE MED FAB it has been agreed that the Catalogue will normally be revised every 6 months.
