Location: 133a, 133b, 136a, 136b, Capel Street, Nos. 3-8 Meetinghouse Lane, Nos Mary's Abbey, Nos Arran Street East, Nos & 23 Little Mary's Street, Dublin 1 PROTECTED STRUCTURE-Permission for development of a mixed use retail/commercial, office, residential, cafe/restaurant and ancillary scheme on a site of ha, approximately, at Nos. 133a, 133b, 136a and 136b Capel Street, Nos. 3-8 Meeting House Lane, Nos Mary's Abbey, Nos Arran Street East, Nos and no. 23 Little Mary's Street, Dublin 7. No. 23 Little Mary's Street and the Chapter House of St Mary's Abbey (at no. 3 Meeting House Lane) are Protected Structures (Reference nos and 5166, respectively). The modern ground floor level and rear modern stair/lift accesses of No. 23 Little Mary's Street will be removed to provide new pedestrian access as part of the subject proposal, with no works proposed to the first and second floor levels. There are no works proposed to the Chapter House and Slype of St Mary's Abbey (this is outside the control of the applicant, but 1

2 resides at lower levels to no. 3 Meeting House Lane). The development will consist of: the demolition of nos. 5,6,7,7a and 8 Meeting House Lane, nos. 136a and 136b Capel Street, Nos Mary's Abbey, Nos Arran Street East and Nos and part of no. 23 Little Mary Street (11,026sqm), principally comprising warehousing, distribution and commercial buildings; the change of use of disused gym to office use (552sqm), dressmakers to office use (431sqm) and part language school to office use (192sqm); the continued use of 1,114sqm (including renovation works where necessary); and the construction of a mixed use retail/commercial, residential and office development with a total gross floor space of 34,710sqm (over 1,875sqm at basement level (for the parking of cars, cycle parking, plant, waste storage areas and ancillary uses)), provided in 3no. blocks as follows: Block A: (10 storeys (including setbacks) mixed use building comprising 11no. retail/commercial units (to accommodate Use Classes 1 and 2 such as retail, professional/financial services) (1,161sqm), office units (523sqm), 77no. residential apartments (11no. 1 bed apartments, 35no. 2 bed apartments and 31 no. 3 bed apartments) (balconies/terraces are provided at north, south, east and west elevations at second, third, fourth, fourth mezzanine, fifth, sixth and seventh mezzanine floor levels and south, east and west elevations at seventh floor level) (7,299sqm) and ancillary floorspace (1,838sqm)); Block B/C: (Blocks B and C are linked at second to seventh floor levels, thus making their floorspace shared at these levels) (8-10 storeys (including setbacks) mixed-use building comprising 12no. retail/commercial units (to accommodate Use Classes 1 and 2 such as retail, professional/financial services) (2,147sqm), 3 no. cafe/restaurant uses (1,045sqm), 9no. office units (16,416sqm), the continued use of 576sqm of education facilities and ancillary floorspace (3,595sqm). Ancillary space includes areas such as refuse areas, service corridors, circulation, toilets, staff areas, plant areas, substations and switchrooms. The proposed development will also consist of: the provision of 63no. car parking spaces at basement level; provision of vehicular access via car lift from Arran Street East; the continued use of access points at Meeting House Lane and Capel Street; the provision of 2no. new pedestrian-only covered streets through the site to Arran Street East and Little Mary Street; cycle parking; associated waste areas; associated plant; lifts; hard and soft landscaping works; boundary treatments (including temporary hoarding (for the period of construction) to surround the site with associated lettering/signage employed for the purpose of advertising, announcement and direction); the provision of ESB sub-stations and associated switchrooms; services provision; diversion of services; changes in level; and all other associated site development and excavation works above and below ground. We call on Dublin Bus to ensure that there will be no reduction to bus services in Dublin Central and to outline to this committee what steps Dublin Bus is taking to ensure that services are not reduced. We are opposed to the removal of the 172 service and request Dublin Bus to explain the rationale behind same Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Irish Rail to advise when the long promised CCTV will be operational in Broombridge train station and to provide this committee with an update on what action Irish Rail is taking to improve the station Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Dublin City Council to remove the graffiti from the walls on the laneway between Ratoath Estate and Ventry estate and to work with the Gardai to address anti-social behaviour in the lane Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee acknowledge St Finbars GAA support for the building of a purpose built school on the present site of Gaelscoil Bharra. We call on the department of Education to meet with the school and local public representatives and to outline the departments plan to address the urgent and critical need for proper facilities for the children and teachers of Gaelscoil Bharra Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Irish Rail to automate the level crossings at Ashtown and Reilly s bridge and to advise when this will be done. We also call on Irish Rail to advise on what plans they have to increase capacity on this line Motion in the name of Councillor Emer Costello That the Manager issue a Report on progress being made in publishing the final version of the Phibsborough/Mountjoy Local Area Plan, in particular progress being made in the setting up of the Steering Group which will oversee the implementation of the Plan. ORDER: Presentation noted. Councillor s comments can be summarised as follows: (a) Parking must be dealt with in all areas and not just in some areas, as it will push parking into others areas of the Central Area. (b) Residents only parking should be continued and not abandoned now, as it is the only way forward. (c) Park and ride must also be examined. 4017(a) With reference to web casting of the Central Area Committee meeting ORDER: Deferred until next meeting. Planning and Development Matters 4018 With reference to 7-10 Gardiner Street Upper ORDER: Report noted 4019 With reference to Derelict Sites Quarterly Report ORDER: Report noted. Councillors requested that the next list of derelict sites should include the date the site was entered on the register Planning Applications Application No: 5146/08 Applicant: Maylock Developments. Location: 12, Ballymun Road, Dublin 9 The development will consist of the construction of 2 residential units- terraced dwellings within the curtilage of a protected structure 12A Ballymun Road. The site extends to the rear property at 12A Ballymun Road. Development to be provided as follows: a) the removal of existing cow byres, b) hard landscaping, private open space, provision of 3 car parking spaces, c) the widening of existing farm entrance to rear of property at 12A. This widening includes the removal and reconstruction of a wall at the front of the protected structure at 12A, d) replacement of existing vehicular gate entrance to the site e) retention consolidation and lowering of the south facing 6

7 boundary wall f) connection to public utilities and all other associated development works. The proposed building will consist of 2 two storey residential units (ground floor and first floor) with east and west orientation and 3 car parking spaces to the west end of the site. Design proposal to ground floor includes a kitchen, a living room, utility and toilet per each residential unit. Design proposal to first floor includes two bedrooms one which is en-suite, study room, toilet and hot press per each residential unit. Roads & Traffic Department Matters 4022 With reference to the minutes of the Traffic Advisory Group held on 12 th December, ORDER: Noted. 4022(a) With reference to East Wall, Traffic Cell, Reilly s Bridge and River Road update. ORDER: Councillors queries as follows; (a) Members requested that a copy of the plan for River Road be ed to them. (b) Councillors requested that the plan be brought back to the Area Committee before the process is initiated and before it goes to public consultation with a report on timelines and process involved. (c) Request for the CEO of Iarnrod Eireann to be invited to the Area Committee meeting. (d) Councillors requested that the Traffic Advisory Group look at the possibility of installing a pedestrian crossing at Church Road, East Wall and that TAG also look at the yellow box request on Ratoath Road again. (e) Members want clarification on funding for Reilly s Bridge Central Area Matters 4023 The reference to HARP Community Gain Funding Proposed withdrawal of two grants awarded to the City Council. ORDER: Members indicated that residents are confused over days these bins will be collected 4024(c)With reference to the proposed EPROW at Shandon Road/Leinster Street ORDER: The members requested that this report would be on the Agenda for the next committee meeting and agreed to give update at the next meeting. 4024(d)With reference to social housing available under Part V of Planning and Development Act in Pelletstown, Abercorn and Castleforbes. ORDER: Members requested that the Tony Flynn and Eoin O Sullivan attend the next meeting to give an update on Part V Affordable Housing in the Central Area. 4024(e) With reference to the Grangegorman Waste Management Depot Noise and air pollution. ORDER: The Manager to request that a notice be erected in the depot to ask the employees to consider the neighbouring houses when working after hours AOB 3789(b)The following emergency motion was tabled by Councillor Emer Costello. That the Area Committee calls on Dublin City Council to examine the pedestrian and vehicular routes in and out of Dorset Street/St. Mary s Place with a view to reducing the number of throughways and to work with the Gardai and residents to take whatever other estate management measures necessary in light of the incidents there on 12 th January, 2009 and make a report on proposed actions to the next meeting of the Area Committee. ORDER: Report to Councillor 4028 Motion in the name of Councillor Maureen O Sullivan To ask Area Manager to explain why residents on Ellesmere Road, Dublin 7 are only having bags collected fortnightly; as there is a need for a weekly collection; and to bring to his attention that the majority of residents there do not feel the need for a brown bin. 13 Questions to City Manager Central Area Committee January 2009 Q1 Councillor Seamas McGrattan Reply: Q2 Councillor Seamus McGrattan Reply: Road Maintenance inspected the above location & wish to advise that the missing name-plate shall be replaced within a 8-10 week period. Q3 Councillor Seamas McGrattan Reply: Waste Management Services undertook to provide a junk collection to every household in the Dublin City Council area during the three year period, Our records indicate that the junk collection was completed in the Central Area during 2007 and As we have to provide this service to all households in the City, there are no plans to hold a junk collection in the central Area in If the councillor is aware of any road or area in the Central Area which did not receive a junk collection in 2007 or 2008, he can contact me and I will make arrangements for the relevant collection in Q4 Councillor Seamas McGrattan Reply: (details supplied) and (details supplied) have been swept and are scheduled for sweeping weekly after bin collection. 14 Reply: The area around the shops are scheduled to be cleaned swept 5 days a week, Monday to Friday shop owners have a duty to insure that the outside of their property is cleaned regularly Q6 Councillor Seamas McGrattan Reply: Once the standard statutory process has been completed these double yellow lines will be extended. Q7 Councillor Seamas McGrattan Reply: All railings at (details supplied) were upgraded to a very high standard last Summer. The City Council is working very closely with the local community, which gives the very considerable benefits of a very positive atmosphere / image in the (details supplied) and reduced maintenance charges to the (details supplied) on this basis Q8 Councillor Seamas McGrattan Reply: The weeds on the pathways on (details supplied) have been removed. Q9 Councillor Seamas McGrattan Reply: Drainage section have investigated this area and have cleaned the following gullies. (details supplied) checked 23/12/08 10 of 10 gullies cleaned. We contacted the management of Oxigen in relation to this matter and they explained that they had experienced some operational problems on this route. They assured us that they would go back to this area and carry out the final collection. It is regrettable that they didn t notify the residents of when they were carrying out this collection. They emptied all the green wheelie bins and green bags which were out in this area at that time. We expressed our dissatisfaction to the management of Oxigen with their poor customer service during the final weeks of their contract with us. Greyhound Waste have taken over the green bin collection since the 1 st January If any areas remain uncollected from the last scheduled collection than details of same should be furnished to the undersigned. Q18 Councillor Maureen O Sullivan Reply: We are aware that there has been some incidents of anti-social behaviour in the playground over the last 18 months. There is however, a strong local division as to whether the playground should be locked. There has been meetings involving the local residents, community Gardai and local committees regarding this issue. At these meetings there has been no agreement on the closure of the playground as this would have a negative impact on the children of (details supplied) being able to access the facility. However we hope to revisit the matter shortly with a view to getting agreement. The smell of diesel emanating from the trucks and which lingers outside the homes of people in the vicinity and is causing distress to a number of residents 3. The rubbish spillage from trucks in the area which litters the street: - B) If he will consider moving the nighttime operations to another depot in the City. C) To state when the (details supplied) will move from this residential area to the premises in the (details supplied). D) What the planning procedure was followed for the new treatments to the wall and gate and if the wall is a protected structure? Q23 Reply: A. The City Council will ensure that all steps are taken to minimise any nuisance to local residents in relation to the operation of the (details supplied) B. There are no plans at this time to remove nighttime operations to another depot in the City. C. Legal formalities for the acquisition of premises in (details supplied) are being completed at present. The development of a Depot at this location would take approximately a year to complete and will depend on finance being available to complete this project. D) The wall is a Protected Structure and all works were carried out in consultation with the Conservation Section, Planning Department, Dublin City Council. Q25 Councillor Emer Costello To ask the Manager to relocate the pole for the pay & display at (details supplied) as it is causing a major visual obstruction to the resident Reply: Q26 Councillor Emer Costello Reply: The matter of anti-social behaviour in the public domain is a matter for An Garda Siochana. This issue is best dealt with through the Central Area Joint Policing Committee. Q27 Councillor Brendan Carr To ask the Manager to hold meetings in relation to flooding for the residents of Cabra who were flooded but were not invited to the previous round of meetings Reply: On the 4 th of December 2 separate public meetings on the August Flooding were held in St Finbarr s GAA Club in Cabra for residents of Glendhu Park and then residents of Dingle Road, Carnlough Road and Drumcliffe Drive. These areas had the highest reports of properties damaged in the Cabra Area with over 12 houses damaged as well as cars and gardens. These meetings were held at the request of residents in both areas and at the request of the Central Area Committee at its November Meeting. The Cabra Area Office distributed the invitations as follows (1) Glendhu Park: All 25 houses on Glendhu Park invited. 11 residents attended (2) Dingle Road, Carnlough Road and Drumcliffe Drive (311 houses). The affected relevant houses were identified by reports to city council at that 18

19 period and by the local residents who had requested the meeting. 40 Residents attended. All Councillors were also notified about the meetings. Dublin City Council has also met residents of Clonliffe Road and has arranged to meet the relevant residents in Blackhorse Avenue which were the two other areas most affected. While there were reports of road surface flooding in other locations in Cabra and across the Central Area Dublin City Council is not aware of comparable damage reports to properties which would necessitate a further public meeting. If there are individual properties that require to be examined then details should be furnished to the undersigned. Q28 Councillor Brendan Carr To ask the Manager to report on what action he proposes to take in relation to the antisocial issues at (details supplied). Reply: This matter has been discussed with the Gardai and joint meetings with the parents of the children involved and to involve other agencies (i.e. Social Services) to alert the parents (and the children) to the seriousness of their actions, have been arranged. Q29 Councillor Brendan Carr To ask the Manager to report on the status of the proposal for a (details supplied) and if he will meet with residents prior to putting any proposal to amend the Development Plan out to public consultation. Reply: The proposed variation concerns adding an objective to the Development Plan to allow the construction of (details supplied) across both the Royal Canal and mainline train tracks. Before the public consultation process can commence, the Planning Authority is required to consider whether the proposed variation would be likely to have significant effects on the environment by screening for and / or preparing a Strategic Environmental Assessment (SEA) under section 13K of the Planning and Development (Strategic Environmental Assessment) Regulations The screening report is currently being prepared in conjunction with the Roads Design Services of the Roads and Traffic Department for submission to the prescribed environmental bodies in order to inform the SEA process. These bodies have 3 weeks in which to assess the screening report. Following this the public consultation process will commence. Meetings can be held with residents in the context of this consultation process as to do so beforehand would not serve any useful purpose. Q33 Councillor Aodhan O Riordain To ask the Manager if the drains from (details supplied) leading on to the rear of houses on (details supplied) can be cleared regularly of leaves and rainwater as blocks have caused flooding in these houses in the past. Reply: (details supplied) gullies checked on the5th January 2009 and 7 of 9 gullies were cleaned. 2 gullies had parked cars on them and a second visit proved no more successful with the cars still parked there. Since February 2004 when the current Gully Cleaning Crew started this location has been cleaned a total of eight times, the last being on the 10th July 2008 which falls well within our remit of cleaning every gully in the city at least once every months. Q34 Councillor Aodhan O Riordain To ask the Manager if there is any provision for noise reduction or compensation for noise caused by the new docklands train now running at the back of houses on (details supplied). 21 The Air Quality Monitoring and Noise Control Unit have not received complaints to date regarding noise from trains at this location. In the first instance it would be necessary to carry out an investigation to determine if there is excessive noise present at such as levels as to constitute a breach of the Environmental Protection Agency Act Issues of compensation are not provided for under the statute dealing with noise nuisance. Q35 Councillor Aodhan O Riordain To ask the Manager if there is any plan for the derelict space on (details supplied) to be used as allotments, or any plans for allotments in the Dublin 3 area. Reply: It would not be appropriate for Dublin City Council to provide a temporary community garden at the (details supplied) as the site has a hoarding around it and to open the area would inevitably lead to anti-social behaviour problems. There are no plans to provide allotments elsewhere in the Dublin 3 Area. Reply: Waste Management Services provide a bag collection service in (details supplied) every Monday. Our litter warden includes this area as part of his regular patrol to ensure that illegal dumping is kept to a minimum. We have also targeted the problem of dog dirt in (details supplied) in the recent past by erecting dog bins and dog signs there. We also leafleted the residents in (details supplied) reminding dog owners of their responsibility to clean up after their dogs. We will continue to do all we can to keep (details supplied) as clean as possible. 21

Councillor Emer Costello Reply: The Environment and Engineering Department has had very detailed discussions with the developers since June 2008 on how to give effect to conditions in their planning consents that a pumping station be constructed as part of the overall development. Outstanding issues cover detailed design, layout, specification, funding, timescale and associated legal agreements. Discussions are at an advanced stage and it is expected that the necessary technical matters are capable of resolution but the issue of the quantum of funding and drafting of the required development agreement may prove difficult against the backdrop of the National finances. It is accepted that this pumping station and associated rising mains are essential to provide drainage to the National Conference centre and other developments including the Block M social and affordable housing development and consequently Dublin City Council are anxious to conclude matters. Report The Central Area Childcare Information Officer informs me that there are 18 childcare facilities in the broader Cabra/Phibsboro/Navan Road area with 9 of those facilities listed as private crèches, Dublin 7 has a total of 30 childcare facilities. 25 The Finglas Cabra Partnership (now the Tolka Area Partnership) published a Childcare Needs Analysis for the Finglas Cabra Area in September 2008 and reported that 1. There would be a need for an additional 205 childcare places in the Finglas Cabra Area in the next few years 2. There is a particular demand in the area for more fulltime flexible childcare spaces, more after school spaces and increased number of part-time morning spaces. Item 4028 Motion in the name of Councillor Maureen O Sullivan To ask Area Manager to explain why residents on Ellesmere Avenue, Dublin 7 are only having bags collected fortnightly; as there is a need for a weekly collection; and to bring to his attention that the majority of residents there do not feel the need for a brown bin. Report At the moment, the majority of residents on Ellesmere Avenue receive a black bag collection. Some of the residents there have a black wheelie bin collection. Waste Management Services are currently reviewing our collection arrangements throughout the city to ensure that the maximum number of residents are on a black and brown organic bin collection system on alternate weeks. This is to ensure that Dublin City Council meets both EU and national requirements for the diversion of organic waste from landfill. Ellesmere Avenue is one of the streets being considered for this black and brown bin collection system. At this point in time, we can assure the residents of Ellesmere Avenue that their black bag collection will continue to take place on a weekly basis as long as that remains the collection system on their street. Residents will be notified if there is to be any change to the collection system on their road. 25

Report Broken yellow lines are used to indicate the presence of a hard shoulder and it would be inappropriate to use them in this location. However the area will be inspected and if parking is occurring in this area that is causing an obstruction or a hazard to other road users, double yellow lines can be recommended. It should be noted that such parking restrictions would apply to both residents and non-residents. Item 4030 Motion in the name of Councillor Maureen O Sullivan To ask the Area Manager to respond to the requests from the resident s of Rutland Cottages, Dublin 1 regarding re-surfacing of the square. Report Roads Maintenance have no plans to resurface the square within Rutland Cottages in 2009 due to budgetary constraints. Unfortunately costs for these works proved too prohibitive and beyond the funding of the Housing Maintenance department. Following meetings with residents a number of issues have been identified and work has already begun on addressing these issues: New signs have been installed on the Stairwells Repairs have been carried out to the exterior walls Overgrown trees have been cutback In addition it is intended to carry out the following works in 2009, funding permitting: Item 4034 Resurfacing of courtyard Repair of rear fencing Painting of complex Repair and height increase to front railings Extra Lighting to be installed Motion in the name of Councillor Aodhan O Riordain That the Manager outlines the schedule with details of dates and proposed areas for the roll out of the Brown Bin in the Central Area Report Waste Management Services are currently preparing a schedule of dates for the roll out of the brown bins in suitable areas in the Central Area. A copy of this schedule will be forwarded to the Councillor when it is completed. Item 4035 Motion in the name of Councillor Aodhan O Riordain That the Manager takes action to prevent the illegal parking on Dominick Lane at the back of the flats, and that a yellow box be installed at the junction of Dominick Lane/Dominick Street 27

28 Report It was recommended by the Traffic Advisory Group in December 2008 to extend the existing double yellow lines at the back of Dominick Flats. The request for a yellow box at the junction of Dominick Lane and Dominick Street will be examined by the Traffic Advisory Group and a report will be prepared for a future Area Committee meeting Item 4036 Motion in the name of Councillor Emer Costello That the Manager put in place a Plan B immediately for the remaining residents of Croke Villas and that he ensures that the 30 tenants wishing to remain in the area are accommodated Report The proposed regeneration of this complex using the Public Private Partnership model is not now proceeding due to external factors. Dublin City Council however remains committed to regenerating Croke Villas and in this regard representatives from the Area Office and the Project Management Unit met with the residents recently and discussed housing allocation preferences, ways to improve the complex in the short to medium term, and views on what needs to be retained from the original community charter. Dublin City Council is examining proposals for the redevelopment of the site. It should be noted however that the provision of social housing at this location is dependent on the necessary financial resources being made available from the DOEHLG. In the interim, every effort is being made to assist those who want to move out of the complex and DCC will continue to work in partnership with the residents. Item 4037 Motion in the name of Councillor Emer Costello That the Manager ensure that action is taken to prevent illegal dumping in Blessington Court Square, to ensure that bags dumped there are not left for weeks (as is currently the case), and that the covert CCTV be used to detect those responsible. Report Bags have been removed and our litter wardens will continue to monitor the area regularly. We are looking at a number of options for CCTV surveillance as our previous arrangement with the service provider has been terminated owing to excessive costs. Item 4038 Motion in the name of Councillor Emer Costello That the Manager report on the current status of the Methodist Church at Jones s Road, if the premises has been handed back to the site owner, if enforcement notices have been served and if the conservation section will make a recommendation to place the building on the record of protected structures. 28

29 Report The property has been handed back to the owners. An Enforcement Notice under Section 154 of the Planning and Development Act 2000 was served on the owners of the former Methodist Church, Jones Road on the 22/12/2008. This Enforcement Notice requires: 1. No further unauthorised works be carried out on site, including any further demolition work, in the absence of the prior written approval of the Planning Department of Dublin City Council. And 2. The reinstatement of the building at the Former Methodist Church at 2A Jones Road, Dublin 3, including the front boundary plinth and railings to their condition as existed prior to the partial demolition of the building and the removal of the front boundary plinth and railings having taken place. These reinstatement works must be carried out to the satisfaction of the Planning Department of Dublin City Council. This requirement must be complied with by the 30 th of June The Planning Enforcement Officer for the Area will continue to monitor the site. The church is currently being assessed by the Conservation Officer and a report will be issued in due course. Item 4039 Motion in the name of Councillor Emer Costello To ask the Manager to have the lights in Avondale House and Mary s Mansion repaired urgently and to report on the proposed Precinct Improvement Plans for Avondale House Report Our Electrical Services Section repaired the lights in Saint Mary s Mansions on 11 th December On the 15 th December 2008 the lights in two blocks in Avondale House were vandalised and the photo-cell removed in the other. These were repaired, but on the same night were vandalised again, visors smashed and the photo-cell also removed. These were repaired the next day. Although the complex will be examined under the criteria driven Regeneration Prioritisation Scheme, which is being introduced by Dublin City Council, it is likely that it will be a number of years before the complex can be redeveloped. In the meantime DCC are examing means of improving the complex and to this end are liaising with the residents representatives. As part of these improvements we are currently seeking quotes for the installation of security doors in the complex, which will be provided subject to availability of funding. Please find report below: Thompson s Cottages Gullies checked 2/10/08 2 of 2 cleaned. Gullies checked 16/10/08 2 of 2 cleaned and flushed using Mini Jet to ensure working. Gullies checked 25/11/08 2 of 2 cleaned. During our visits there crews have talked to residents who stated that they knew of no flooding in this location. There are some very old disused vents in the middle of the road that are obsolete now. They look very similar to gully grids and are completely packed but they are not gullies and it is possible that those people complaining are of the view that they are gullies. We have given details of graffiti on walls in Thompsons Cottages and Rutland Place North to our contractor. As it is on private property waivers will have to be signed before it can be removed. Item 4044 Motion in the name of Councillor Brendan Carr To ask the Manager to have a notice erected in Phibsborough Post Office collection office-notifying people not to discard their packaging outside the post office, to have the potholes on Phibsborough Avenue repaired (this was promised two years ago and road markings were put down but no work was carried out). 31

Item 4045 Motion in the name of Councillor Brendan Carr 1) That the Manager report on whether the Gardai and DCC have met in relation to the recent spate of car crime in Ashford Street/Ross Street area, 2) if the CCTV cameras could be pointed in the direction of Ashford Street to detect those responsible, 3) if the grass verges at Ashford Street/Ross Street can be cleaned up and mowed, 4) if the gap in the railings at Ashford Cottages can be closed Report 1) The Gardai are aware of the recent spate of car crime in the area. Dublin City Council will become involved in the issue if there is any involvement in these crimes by our tenants. 2) If the Gardai are of the view that the utilisation of CCTV cameras would be beneficial then we would assist in this regard. However, it is unlikely that CCTV images would be of any assistance in identifying the culprits, as the acts are carried out mostly in darkness and images would be quite hazy on this basis and would be of no evidential use. 3) The area has been litter picked and mowed. 4) There is now a paved pathway through what could be considered a gap in the railings. It is our view that a right of way has now been created at this location and it is used regularly by residents of O Devaney Gardens. Any attempts to extinguish this right of way would meet with resistance from those residents and accordingly we have no plans to close off the area. Item 4046 Motion in the name of Councillor Brendan Carr That the Manager to confirm that planning for the new apartments on the Ready mix site, East Wall Road, will not have windows looking into the homes on Leinster Avenue, and to ask what the plans are for the disposal of asbestos. Report A letter has been issued to the Docklands Development Authority regarding the matter and a report will be issued in due course once a reply has been received from the DDA. 32

33 Item 4047 Motion in the name of Councillor Christy Burke That this Committee agrees to remove the no left hand turn sign on Johnny Cullen s Hill at the request of local residents. Report This matter will be investigated by the Traffic Advisory Group and a report will be prepared for a future Area Committee Meeting. Item 4048 Motion in the name of Councillor Christy Burke This Committee receives a report as to what plans Dublin City Council have for the future of Croke Villas, Dublin 3. Report The proposed regeneration of this complex using the Public Private Partnership model is not now proceeding due to external factors. Dublin City Council however remains committed to regenerating Croke Villas and in this regard representatives from the Area Office and the Project Management Unit met with the residents recently and discussed housing allocation preferences, ways to improve the complex in the short to medium term, and views on what needs to be retained from the original community charter. Dublin City Council is examining proposals for the redevelopment of the site. It should be noted however that the provision of social housing at this location is dependent on the necessary financial resources being made available from the DOEHLG. In the interim, every effort is being made to assist those who want to move out of the complex and DCC will continue to work in partnership with the residents. Item 4049 Motion in the name of Councillor Christy Burke That this Committee agrees to place a camera at the rear of Sean O Casey Ave to identify people who are dumping rubbish in this area. Report We are currently undertaking a review of our CCTV portable camera system in an effort to improve the quality of the footage and the cost of gathering it. The structure is located in a terrace with the main axis of the building running in an east-west direction. Summary Description of Structure This description outlines the key components of interest in the following order: (i) Exterior Terraced two-bay four-storey house, built c.1830 with shopfront to ground floor. Roof concealed behind parapet (parapet higher than building to south). Rendered 35

36 chimneystack with red terracotta pots, shared on party wall. Render capping to parapet. Painted brick walls. Square-headed window openings with windows blocked to third floor. Six-over-six pane timber sliding sash windows to second floor, timber shutters visible south window to second floor. Six-over-six pane timber sliding sash windows to first floor, with cast-iron balconies. All windows having painted sills. Windows diminish in size with height. Replacement shopfront to ground floor, comprising of render plinth with timber stall riser supporting display window, flanked by render pilasters, having oversized timber fascia above. Roller shutter to shop entrance door. Side entrance to north end of façade having timber panelled door with overlight flanked by rendered pilasters. ii) Interior Access to the interior of this building could NOT be obtained as it is currently vacant. Assessment of Special Interest Under the Planning & Development Act 2000 This building is of both Architectural and Historical interest in terms of its category of special interest A fine regular brick-faced Georgian townhouse, adapted as the centuries progressed to accommodate a shopfront at ground floor level. This area has witnessed much change and this house forms one of the few remaining houses along Marlborough Street of terraced Georgian houses. The house historically was one of the few structures in this area which escaped destruction during the troubled period in Ireland at the beginning of the twentieth century. Fronting directly onto the streetscape of Marlborough this building forms an integral part of the history of the area as well as the street. The fact that the building is taller and wider than it s neighbouring properties-gives it a domineering presence on the streetscape. Recommendation 109 Marlborough Street, Dublin 1 is considered to be of Architectural significance within the meaning of Part IV of the Planning and Development Act, It is therefore recommended for inclusion in the Record of Protected Structures. 36

Windows diminish in size with height. Replacement shopfront to ground floor, comprising central door flanked by display windows with timber end pilasters having pointed box cappings. Timber and glazed shop entrance door to south end of façade. ii) Interior Returning stairs with half-landings between floors, located to southwest corner of building. Original risers intact to upper floors, having original timber banister running length of stairs. Render cornice visible to ceiling at all levels. Third floor accessed via narrow timber staircase. Replacement windows to half- landing floors. Third floor Two rooms to third floor, one front, one back, having central landing. Chimneybreasts visible to both rooms with fireplaces blocked. Replacement window to rear room. Original timber floorboards throughout. Original timber door architraves to both rooms. Second Floor Two rooms to second floor, one front, one back, having central landing. Rear room subdivided by partition wall. One-over-one pane timber sliding sash window to rear room. Chimneybreasts visible to both rooms with fireplaces blocked. Original timber door architraves to both rooms. Intact render cornicing to both rooms. Ground Floor This floor has been significantly altered and modernised to accommodate café and kitchen, including insertion of suspended ceiling.
