Location: 133a, 133b, 136a, 136b, Capel Street, Nos. 3-8 Meetinghouse Lane, Nos Mary's Abbey, Nos Arran Street East, Nos & 23 Little Mary's Street, Dublin 1 PROTECTED STRUCTURE-Permission for development of a mixed use retail/commercial, office, residential, cafe/restaurant and ancillary scheme on a site of ha, approximately, at Nos. 133a, 133b, 136a and 136b Capel Street, Nos. 3-8 Meeting House Lane, Nos Mary's Abbey, Nos Arran Street East, Nos and no. 23 Little Mary's Street, Dublin 7. No. 23 Little Mary's Street and the Chapter House of St Mary's Abbey (at no. 3 Meeting House Lane) are Protected Structures (Reference nos and 5166, respectively). The modern ground floor level and rear modern stair/lift accesses of No. 23 Little Mary's Street will be removed to provide new pedestrian access as part of the subject proposal, with no works proposed to the first and second floor levels. There are no works proposed to the Chapter House and Slype of St Mary's Abbey (this is outside the control of the applicant, but resides at lower levels to no. 3 Meeting House Lane). 9 Housing Issues- North West Inner City ORDER: Noted 4067(a)The following emergency motions were tabled That this committee agrees that a report be made available in relation the new development at Patrick Heaney Way, Sean McDermott Street, Dublin 1 re the collapse of a ceiling the defectiveness of the electrical works. ORDER: Agreed (b) That members of this committee recommends to the Planning Department that they refuse permission for Planning Application No: 5370/08, Temporary Car Park, East Wall Road (for O2 venue) on the following grounds: The developer of the O2 has failed to properly prepare for the opening of the venue, and the traffic management and parking issues should have been addressed as part of the original planning application. The opening of the venue, without adequate car parking, was premature. The impact of this volume of traffic onto this section of East Wall Road has not been adequately assessed in the application. Concert traffic traditionally begins to build up during the latter stages of rush hour traffic and this is already a chaotic period, when the local road network is operating to capacity. The impact on existing residents has not, at any point, been considered in the application. Other applications along East Wall Road that have been refused permission, with traffic concerns cited by the planning department. In particular an application for a Lidl store (favoured by the community) was refused. The entrance to the proposed car park is, in fact, a temporary road that was opened during the construction of the Dublin Port Tunnel to allow access for construction traffic. An assurance was given by D.C.C. that this road would be closed, once the tunnel was completed. Concerns about the continued use of this location have been raised at East Wall Forum meetings in the past. The proposed development will have a negative impact on the residential amenity of the surrounding houses in the East Wall area zoned Z1. The Committee further calls on Planning Enforcement to ensure that there is adequate parking provision at the venue before any further concerts are allowed to take place at this venue. ORDER: Agreed. The members requested that the Managing Director of O2 be invited to a meeting of Councillors and other public reps to be arranged as soon as possible. (c) That Members of the Central Area Committee call on Dublin City Council to extend the final deadline for the Canals Study by one month (to 6th March and that an awareness campaign of the Study be undertaken by Dublin City Council, the Dublin Docklands Development Authority and Failte Ireland to ensure greater participation in this survey. 9

Motions 4068 Motion in the name of Councillor Christy Burke That this Area Committee agrees to call on the Gardai to arrange to have extra Garda patrols at Fontoney Street, Geraldine Street and surrounding area given the amount of criminal behaviour of slashing of car tyres in this area. ORDER: Report to Councillor Motion in the name of Councillor Christy Burke That this Area Committee agrees to have extra Garda units at Play areas at the Phibsboro Boxing Clubs given the amount of people using the area to dump needles around where young children play and that Dublin City Council remove any needles that may be in the play area. ORDER: Report to Councillor Motion in the name of Councillor Seamas McGrattan This Area Committee calls for a detailed report as to which companies have permits to allow their trucks use Broombridge Road and how many prosecutions there have been since the ban was introduced on the road. We call on Dublin Bus to ensure that there will be no reduction to bus services in Dublin Central and to outline to this committee what steps Dublin Bus is taking to ensure that services are not reduced. We are opposed to the removal of the 172 service and request Dublin Bus to explain the rationale behind same. ORDER: Report to Councillor Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Irish Rail to advise when the long promised CCTV will be operational in Broombridge train station and to provide this committee with an update on what action Irish Rail is taking to improve the station. ORDER: Report to Councillor Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Dublin City Council to remove the graffiti from the walls on the laneway between Ratoath Estate and Ventry estate and to work with the Gardai to address anti-social behaviour in the lane. ORDER: Report to Councillor Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee acknowledge St Finbars GAA support for the building of a purpose built school on the present site of Gaelscoil Bharra. We call on the department of Education to meet with the school and local public representatives and to outline the departments plan to address the urgent and critical need for proper facilities for the children and teachers of Gaelscoil Bharra. ORDER: Report to Councillor Motion in the name of Councillor Mary Fitzpatrick The Central Area Committee calls on Irish Rail to automate the level crossings at Ashtown and Reilly s bridge and to advise when this will be done. Q4 Councillor Christy Burke Q5 Councillor Christy Burke To ask the City Manager if Dublin City Council will request the clampers to visit the small streets around details supplied to make sure that no illegal parking is taking place, as some residents find they can not get into their own streets on such events. The City Council operates a clamping and tow-away service in order to enforce parking regulations in the city. 14

15 During match days in details supplied an operation is undertaken by the Council s parking enforcement contractor, in conjunction with An Garda Síochána. The primary focus of this operation is to re-locate and clamp illegally parked vehicles which are parked in a dangerous manner or found to be causing obstruction. Q6 Councillor Christy Burke Drainage Division s gully cleaning crew last cleaned gullies in the above area as per details below. Our crews will tend to this gully over the coming week. Recent interruptions to the water supply in details supplied (b) were not planned and were as a result of breaks within the watermain network. This was caused by the recent cold weather and the age of the pipework. It resulted in low water pressure in the area. These leaks were promptly repaired once the locations were identified. Q7 Councillor Seamas McGrattan Arrangements have been put in place for the installation of dog bins at the green areas at details supplied. Poop-Scoops are no longer placed in dispensers at dog bins are they are a litter generator, poop-scoops are available at Area Offices, Public Libraries, Civic Offices and Waste Management Services at Marrowbone Lane, Dublin 8. 16 Under The Road Traffic (Traffic & Parking) Regulations, Section 36 paragraph (2) i, it is illegal to park on a footway, a grass margin or a median strip There is no funding available to erect bollards at these locations. Enforcement is a matter for the Gardaí and incidences can be reported to the local Garda Stations. Q9 Councillor Seamas McGrattan 1. A contractor was appointed to install a roofing membrane on the flat roof extension and to replace the ceiling of this dwelling some time ago. The tenant refused these works, as she wanted a transfer to alternative accommodation. On inspection there is no evidence of dampness, however there is condensation, due to the radiators being used to dry clothes, without adequate ventilation. The Area Maintenance Officer has advised the tenant on the future prevention of condensation and issued them with a booklet on this. The contractor will make contact with this tenant again in relation to completing the work to the extension roof and ceiling. The hall door needs to be re-fitted. Arrangements will be made with the tenant to carry out this work. 2. The Area Maintenance Officer has called to this address, but was unable to make contact. 17 As part of a route optimisation process, Waste Management Services brought forward the starting time for the refuse collection service in the Dublin City Council area to six am. This is the time that the refuse freighters leave their depots and not the actual collection time. These new collection schedules have settled down and the residents of details supplied should know how early they need to have their bins out. Many residents leave their bins out last thing at night to ensure that they don t miss their collection the following morning. Generally speaking we have had few reports of bins being stolen or vandalised since this new collection arrangement came in and there doesn t appear to be any greater risk of such incidents taking place. The only alternative for residents who are afraid to leave their bin out overnight is to put it out at six am on bin collection day. Upgrading of the lighting on details supplied was completed in October 2008 as part of our 2008 programme of improvement works. Upgrading of the lighting on details supplied is included in our provisional programme of improvement works for Completion of this programme and the programmes for the four other areas will depend on availability of finances in the current economic situation. Every effort will be made to ensure that the work is carried out, but it is not possible at this stage to give a timeframe. Q15. Councillor Maureen O Sullivan Each Brown Bin lift is charged at 2. This charge applies after the expiry of a three month s grace period from the date of delivery of the bin, when lifts are not charged, Customers covered by the Waiver Scheme are not charged for Brown Bin lifts. 18 To ask the Manager for information on the laneway details supplied(a) - was the public right of way (which residents of details supplied(b) with houses directly adjacent to the lane had access to) legally extinguished? Who owns the laneway? Were these residents offered fobs and if so were there conditions attached? Was planning permission granted for erection of gates on the laneway and who paid for the gates? Who is on the Management Committee dealing with the laneway? A meeting took place between residents of details supplied and their representative on the 29 th of January 2009 A set of proposals to resolve current difficulties was tabled by Dublin City Council at the meeting. Councillor Maureen O Sullivan The City Council operates a clamping and tow-away service in order to enforce parking regulations in the city. During match days in Croke Park an operation is undertaken by the Council s parking enforcement contractor, in conjunction with An Garda Síochána. The primary focus of this operation is to re-locate and clamp illegally parked vehicles, which are parked in a dangerous manner or found to be causing obstruction. In the period 1 st January 2008 to 31 st December 2008 a total of 13 vehicles were clamped in details supplied for the offence of parking in a pay & display/residents permit parking area without displaying a valid permit. None of these enforcements took place on a day when an event was taking place in Croke Park. However, the parking enforcement contractor has been requested to patrol this street on future event days and carry out any necessary enforcement action. Q19. Councillor Maureen O Sullivan Road Maintenance shall have the above mentioned pot-holes filled within a 6-8 week period. Q20. Councillor Maureen O Sullivan 18

19 All maintenance carried out to Council dwellings is on a response maintenance basis. Repair requests are responded to when received, within the timeframe allocated to the nature of the complaint, i.e. routine, urgent, emergency. The common areas are cleaned on a daily basis, stairwells are cleaned down daily and the bins are emptied weekly. Specific maintenance programmes are not drawn up for flat complexes, however I can confirm that maintenance repair requests are responded to on the above stated basis in this complex. Q21. Councillor Maureen O Sullivan To ask the Manager is any progress has been made regarding the closure of the play centre on details supplied at such a reasonable time in the evening that it does not prevent young people using the facilities but will deter anti-social behaviour? Staff will now lock the gates of the playground when leaving the building. Notices will be erected at the centre to advise that the playground will be closed for public access from 5pm Monday to Thursday and from 4pm on Fridays. The Playground will only be opened on the Saturday that the Centre is open and will remain locked on Sundays. Notices will be erected to this effect. The Gardai in Store Street will have keys to access or lock the Playground should groups engaged in anti-social activity gain access to the playground after hours or fail to leave at the required times. These arrangements will come into effect from Monday 16 th February. Regrettably this will reduce access for local children to these play facilities. These arrangements will be monitored to see if they achieve the objective of reducing incidents of antisocial behaviour and nuisance to neighbours of the facility. Q22. Councillor Maureen O Sullivan To ask the Manager for further information why No left turns in areas cannot also contain the sign 'Access Only', in order to facilitate ease of access for local residents? If a No Left Turn sign is erected with an Access Only plate underneath, the only part of the sign that is actually enforceable is the left turn prohibition, which would apply to all motorists. Q23. 20 To ask the Area Manager to have ramps installed on details supplied to stop speeding. This matter will be referred to the Traffic Advisory Group and a report will be issued to a future Area Committee Meeting. Q24. The Area Manager has written to Iarnród Eireann and asked them to examine the request. A report will be issued as soon as possible. Q25. Councillor Emer Costello To ask the manager when the bollards at details supplied will be erected as there is a major danger to pedestrian safety in the area. The erection of the bollards on details supplied are part of a package of minor works, which should be completed within the next 6 weeks. Q27. Councillor Emer Costello To ask the Area Manager to arrange a meeting between residents of details supplied and the Area Manager and the water Engineers with a view to establishing a communications protocol to deal with water shutdowns in the area and to outline what procedures will be taken to implement the new water regulations to prevent unauthorised use of the water supply from the mains at certain building developments. The Water Division have been requested to meet with the (details supplied) to discuss the recent problems experienced with the water supply. Regular inspections are conducted to ensure unauthorised use of water is minimised. Q28. Councillor Emer Costello 20

21 To ask the Area Manager to outline the planning conditions attached to parking/traffic management for concerts at the details supplied to prevent traffic using this route to the venue or from parking their cars there. A Section 25 certificate for the redevelopment of (details supplied) was granted on 7 December 2006 by the Dublin Docklands Authority. Condition 2 of the decision states: The developers shall comply with the requirements of Dublin City Council as Roads Authority with regard to access to the public road (including any safety requirements and the payment of any special charges to the City Council arising from compliance with those requirements). The following requirements shall be complied with: a) The applicant shall put in place a system whereby car parking tickets for the detail supplied car park are sold in connection with and at the time of purchase of event tickets in order to ensure that on-site car parking capacity equals demand. b) The applicant shall liaise with the city centre car parks with a view to these facilities accommodating overspill demand. The applicant shall provide information on other car parks in the vicinity at the point of sale. c) During construction and operational phases, the proposed development shall have minimum interference with the effective operation of detail supplied. In this regard, no construction access shall be provided from detail supplied and all construction activity shall take place away from detail supplied. Bus drop-off/pick-up shall be accommodated at detail supplied or along the new North/South Street and shall not take place along detail supplied. d) Construction access details shall be agreed with the Roads and Traffic Department prior to commencement of development. In this regard, the applicant is advised that construction access may not be permissible from detail supplied. e) The applicant shall consult with Dublin Bus with a view to providing a shuttle bus connection from the upgraded venue to the city centre. This service would provide additional linkage to and interchange with public transport facilities. Condition 13 states Prior to the occupation of the development a mobility management plan shall be submitted to the Authority for agreement. This shall include details of an agreement between all relevant parties regarding access to the 700 parking spaces reserved for public use for both the detail supplied A Warning Letter pursuant to Section 152 of the Planning and Development Act 2000 was served on the owners of the Arena on 9 January 2009 concerning compliance with the aforementioned conditions. The recipients were given four weeks to address the issues raised in the letter. A decision will be made as quickly as possible after the expiry of the four weeks on what, if any, enforcement action should be taken. The matter of the erection of barriers is an issue for An Garda Siochana. Q29. Councillor Aodhan O Riordain 21

Councillor Aodhan O Riordain To ask the manager why the local authority property at details supplied has been left empty for approximately two years and allowed to deteriorate, when so many people are on the housing list? A contractor has been assigned to refurbish this property. At commencement of works serious structural site difficulties were identified. An Engineer has been engaged to re-examine the refurbishment proposal for this dwelling. Work will recommence as soon as the engineer s report and redesign is approved. Q31. Councillor Aodhan O Riordain Given that the government has recently published new standards for the details supplied and the responsibility for inspection and enforcement of these standards rests with the local authority, to ask the manager how much Dublin City Council spent on inspections last year (2008) and how much they have budgeted to spend this year? Dublin City Council enforces the Housing (Standards for Rented Houses) Regulations 2008 through the Environmental Health Section in Housing & Residential Services. In 2008 environmental health officers inspected 2,822 rented houses and undertook 4,303 inspections of rented houses, which included rented houses under the Rental Accommodation Scheme. The budget for the environmental health section in 2008 was 1,069,277. The budget for the environmental health section in 2009 is 1,126,605. Q32. Councillor Aodhan O Riordain To ask the manager to report on progress for the refurbishment of details supplied and to ensure that the grants are not lost through delays in planning permission. The Deputy City Architect has been requested to proceed with the Part 8 procedure in respect of this development. Contact has been made with the Department of Arts, Sport and Tourism with a view to confirming that the original funding grant remains available in light of government cutbacks. Councillor Aodhan O Riordain supplied (b) hold meetings with residents from details While there were reports of road surface flooding in other locations in details supplied and of a small number of properties flooded on detail supplied, Dublin City Council is not aware of comparable property damage reports, which would require further public meetings. There are, therefore, no plans to hold any further public meeting on this topic in the Central Area. 24 In respect of details supplied (a), for the upgrade and maintenance of the details supplied (b), the payments received in levies from Castlethorn/Capel Devlopment and Ballymore Properties in respect of rail and parks payments are as follows: Total Rail Payments: 1,712, Total Parks payments: 1,335, ,000 of money has been spent on temporarily securing the boundaries of the park. While the design work on details supplied(b) is completed it is not envisaged that the works phase on this large scale project will commence until the completion of the Road Widening Scheme, as it would be inappropriate to carry out works to the park which may be undone because of works to the road. Dublin City Council has a current planning application in for the redevelopment of some of the privately owned land currently surrounded by hoarding. Dublin City Council has no authority to ask for the hoarding to be removed from private sites unless there are breaches of planning procedures or other licensing conditions. Q36. Councillor Brendan Carr To ask the Manager to set up a schedule for regular cleaning of the laneways in details supplied (a), to state when the long-promised promised road repairs on details (b) to the bus terminus will be carried out and to put CCTV in place at the re-cycling centre at details(c) to stop dumping (b) All resurfacing works for 2009 have been cancelled due to budgetary restraints. (c) It is not intended to install CCTV at the bottle bank at details supplied at this time. The Inspector responsible for the bottle banks has already moved the facility to the right hand side of the shops, which has greatly reduced dumping at this site. The Inspector will monitor the facility for the next number of weeks. Q37. Councillor Brendan Carr To ask the Manager to have the footpaths repaired at details supplied (a) as they are broken up and not suitable for wheelchair users or prams and to have the footpath at details supplied (b) dished for wheelchair users / prams / walking frames etc. Q38. Councillor Brendan Carr To ask the Manager to inspect the laneway at the rear of details supplied(a) with a view to providing additional drainage to stop flooding in the back gardens and to have extra drainage provided at the 7 a side pitch in details supplied(b) (a)the drainage Division has recently completed some pipe laying work at detail supplied (a) which will improve the drainage in the area. The existing drainage infrastructure in the laneway will be examined and additional gullies will be installed if required. (b) The existing pitch at detail supplied(b) open space was designed as a 7 aside pitch for passive use by the local residents. As such given favourable conditions and responsible play the pitch is adequate for the initial use intended. However the pitch has since been let to Navan Road United Football Club who now require the pitch to be playable on a regular basis. This Division is aware that the pitch can become unplayable during times of prolonged wet weather and given the very inclement weather that we have experienced over the past year the problem has become more frequent. Q40. Councillor Brendan Carr To ask the Manager to ensure that the lights in the common areas at details supplied are working and to ensure that the electricity fuse room is secure that only authorised personnel have access. The lights in the common areas of this complex are working. The lock to the meter room will be changed to ensure its future security. Q41. 26 The Dept of Environment (DOE) requested information on three aspects of the proposed project for the detail supplied and this was submitted last year. Following the review the DOE requested changes and the Architects Department are currently working on these. The revised plans will then be submitted to the DOE for approval. Tenants are currently being selected for no. details supplied and the shutters will be removed when the tenants move in. Q42. Councillor Mary Fitzpatrick Will the manager please outline what progress Dublin City Council has made with regarding providing collection and recycling of details supplied. Since the new green bin contract commenced with Greyhound Recycling on the 2 nd January 2009, all plastics, including details supplied, are now accepted in the green bin for recycling. Q43. Councillor Mary Fitzpatrick Can you the manager please outline what action Dublin City Council have taken to resolve the problem with surface water leaks at details provided. Drainage Division carried out repairs to the pipeline serving the gully at the junction of details supplied over the past fortnight. A utilities company had damaged the pipeline, however both the gully and pipeline are now in good working order. The water rising along detail supplied is from a leak on the supply to details supplied as well as ground water from an artesian well of long standing. Both householders were sent Notices to repair the leaks on their supplies and an on site meeting was held with them recently with a view to resolving the matter. The water rising on details supplied was sampled by our Laboratory and is not mains water. In addition to this, 4 extra gullies were installed alongside the detail supplied during November Q44. Councillor Mary Fitzpatrick Will the manager please explain the delay in publishing the details supplied and advise when the final document will be available to the Public? Will the manager also please outline when and how the details supplied implementation committee will be formed? 26

27 The details supplied as adopted is currently being finalised with regard to a final proofing of changes to the text, indicative site maps and also the concept sketches. This final version of the plan will include, as a composite document, all the amendments arising from the Manager s Reports and also the Councillor Motions. The Environmental Report (ER) is also being revised to incorporate and take account of the various Addendums to the ER and also to include a Strategic Environmental Assessment (SEA) Statement as an integral part of the overall SEA process for an LAP. It is envisaged that a final version of the LAP and the ER will be available to the public by the end of February. Q45. Councillor Mary Fitzpatrick Will the manager please provide a schedule for details attached. There is currently a backlog in implementing Permit Parking Schemes in the Dublin Area as the traffic department is awaiting the delivery of new ticket machines. The ticket machines are due to be delivered at the end of February. It is expected that the schemes in the details supplied will be implemented from the end of March. Residents of adjacent roads where parking is severely restricted can apply for parking on roads with Pay and Display Schemes after schemes have been implemented. Only at that stage will it be possible to assess whether there is capacity in the Pay and Display area to accommodate cars from neighbouring streets. Applicants should contact the Parking Policy and Control Section as appropriate. Q46. Item 4069 Motion in the name of Councillor Christy Burke That this Area Committee agrees to have extra Garda units at Play areas at the Phibsboro Boxing Clubs given the amount of people using the area to dump needles around where young children play and that Dublin City Council remove any needles that may be in the play area. Report Waste Management Services had the road and footpaths outside the play area at Phibsboro Boxing Club cleaned on Thursday 29 th January We will ensure that this location is cleaned on a regular basis. Since the opening of the refurbished play area at Royal Canal Bank / Broadstone park this Division has not encountered any problems regarding discarded Needles / Sharps.The area is cleaned on a daily basis and as part of this work priority would be given for the removal of discarded Needles / Sharps in accordance with best practice. Item 4070 Motion in the name of Councillor Seamas McGrattan This Area Committee calls for a detailed report as to which companies have permits to allow their trucks use Broombridge Road and how many prosecutions there have been since the ban was introduced on the road. Report Broombridge Road is not within or listed as a cordon entry/exit point for 5+ axel HGVs, therefore the traffic section would have no information regarding the number of trucks using Broombridge. As An Garda Siochana are the enforcing body, questions regarding prosecutions should be directed to them. Item 4073 Motion in the name of Councillor Emer Costello That the manager report on when the delay introducing the pay and display parking at Great Western Villas, Avondale etc. and to report when the ramps on Avondale Road will be erected. Item 4079 Motion in the name of Councillor Emer Costello That the manager report on the reasons for the delay in signing the contracts with the preferred bidder for the Markets Area Framework Plan; if the proposals will proceed what form of public consultation will be held with local residents and if there is a Plan B if the original proposal does not now go ahead. Report Detailed discussions have been held with the preferred bidder and these will continue to take place. Given the present economic circumstances, however, it is not possible to state when any contract may be assigned. Extensive public consultation was carried out during the formulation of the Markets Area Framework Plan and this will be revived prior to the implementation of any of its proposals. Item 4080 Motion in the name of Councillor Aodhan O Riordain That the Manager state when the report from the Traffic Advisory Group regarding a weight restriction on traffic on Little Strand Street will be available as traffic continues to mount the pavement on Arran St. East. Report Our records show that a response to this issue was sent to the Councillor on 22 nd December The Traffic Advisory Group did not recommend a 3 Ton Limit on Little Strand Street as: Due to the one-way system in operation in the area it is considered that a 3-ton limit on Little Stand Street would result in excessively onerous detours for traffic wishing to enter Arran Street East from the Capel Street Area. Item 4081 Motion in the name of Councillor Aodhan O Riordain To ask the Manager to state the number of new houses that were built in the Sheriff Street area during the detenanting process in the 1990's; the number of tenants who have applied to purchase their houses and the number which have managed to do so. We call on Dublin Bus to ensure that there will be no reduction to bus services in Dublin Central and to outline to this committee what steps Dublin Bus is taking to ensure that services are not reduced. We are opposed to the removal of the 172 service and request Dublin Bus to explain the rationale behind same.
