The report should also indicate approximately what savings could be made on a per minute basis if the turning on of the lights was to be delayed or the turning off brought forward Motion in the name of Councillor Mary Fitzpatrick The elected members of the Central Area Committee are critical of An Bord Pleanala for refusing to webcast their Oral Hearings into the Metro North Project and for refusing to post daily the official transcript of the hearings onto their website. Their refusal greatly 3

Agreed that it would be premature to put the proposed variation to the Development Plan on public display pending the results of the survey. Councillors requested that the Planning Department provide further information on the warning letter sent to O2 and whether they have complied with it s terms. Roads & Traffic Department Matters 4101 With reference to the minutes of the Traffic Advisory Group held on 19 th February, ORDER: Report noted. Environment and Engineering Department Matters 4102 With reference to drainage issues in the Central Area ORDER: Report noted. Senior Engineer from the Drainage Section attended and answered questions from the Councillors. The Drainage Section will provide copies of the report for circulation by the Councillors to the residents. It was agreed that the 6

7 Councillors could study the report and come back to the Senior Engineer with comments and this item would be placed on the agenda at a later date. 4102(a) With reference to Waste Management Issues ORDER: The Councillors requested that the Waste Management Section and Greyhound attend the next meeting of the Central Area Committee to deal with problems with green and brown bin collection. Also requested that clarification would be given to the Councillors on whether Ellesmere Avenue will be keeping their bagged waste collection or will a bin collection be provided. 12 Questions to the City Manager Central Area Committee March 2009 Q1 Councillor Seamus McGrattan To ask the city manager to investigate the introduction of permit parking in the cul-de-sacs of details supplied This matter has been referred to the Traffic Advisory Group and a report will be issued to a future Area Committee Meeting. Q2 Councillor Seamus McGrattan To ask the City Manager to have attics in details supplied insulated and for a report into what caused the cables to fall here recently. The Area Maintenance Officer has inspected this complex. The attics in the upper floor flats have insulation fitted. The cables that fell during bad weather were NTL cables. These have been restored. Housing Maintenance has no responsibility for maintaining these cables. Q3 Councillor Seamus McGrattan To ask the City Manager to install a litterbin beside the bus stop at details supplied Waste Management Services have arranged to have a litter bin installed beside the bus stop at details supplied. This work will be carried out by the middle of March Q4 Councillor Seamus McGrattan To ask the City Manager to install air vents at details supplied. The Area Maintenance Officer has inspected the ventilation in these dwellings and reports the following: A wall vent will be fitted in the kitchen of No. 18 within the next few weeks. A wall vent will be fitted in the living room of No. 20 within the next few weeks. Q5 Councillor Seamus McGrattan To ask the City Manager to have automatic gates installed to solve anti-social behaviour in details supplied The Housing Maintenance Division has reported that based on experience to date the operation of electronic gates is not satisfactory and thus is not in favour of the provision of such gates in City Council Housing complexes. 13 To ask the City Manager to contact details supplied to allow local community/sporting groups to use their facilities on the detail supplied, particularly their tennis courts. Dublin City Council suggest that interested community/sporting groups contact (details supplied) directly regarding the use of facilities at (details supplied). Q7 Councillor Seamus McGrattan To ask the City Manager to have dog litter bins/ warning signs erected on details supplied. Anti-dog fouling signs and dog bins have been ordered for (details supplied) and should be in place in the next 6 weeks. 14 , ,000 d) General There are 1570 L.E.D. (Low Energy Diodes) in the details supplied. These are housed within 5 sets of architectural lights and 1aviation light. All of these lights are swapped with a replacement set every 6 months which is kept as a standby set. As many as 30 to 40 and as little as 0 to 10 may have to be replaced every 6 months, as part of ongoing maintenance of the particular set which are taken down. Q9 Councillor Christy Burke To ask the City Manager if Dublin City Council will arrange the clean up of details supplied as residents say that no cleaning takes place. Waste Management Services had the small cul de sac at the details supplied cleaned up on the 3 rd March We will ensure that this location is monitored and cleaned on a more regular basis. Q10 Councillor Christy Burke To ask the City Manager how much funding has been allocated for redevelopment of details supplied. And when will work be due to start on details supplied Plans are currently being finalised for the redevelopment of this complex. As part of these plans detailed costings will be drawn up and appropriate funding allocated to the project. As building costs have changed considerably over the last 18 months it will not be possible to state an accurate figure until these costings have been carried out. A meeting will take place with the residents committee on 6 th March to discuss the revised plan. It is not possible to put in place a timeframe for commencement of works until agreement has been reached with residents and the detailed plan has been agreed by the Department and approved for inclusion in the Housing Construction Programme. Q11 Councillor Christy Burke To ask the City Manager to put a plan for details supplied, as this complex has been long overdue for redevelopment as all other complex in this area have been redeveloped. Reply There are no current plans to redevelop details supplied and no detenanting is currently taking place. Q12 Councillor Christy Burke To ask the City Manager when improvement works will start at details supplied. The Precinct Improvement Works for details supplied are scheduled to proceed to tender in June 2009 and should therefore commence in October 2009 at the earliest. Q13 Councillor Christy Burke 14

15 To ask the City Manager given the statement from Minister Gormley that funding is now available to improve roads will the City Manager arrange to have details supplied reinstated as the road is not in good state and is dangerous. Road Maintenance do not have funding for 2009 to carry out any new resurfacing works at the above location. Q14 Councillor Christy Burke To ask the City Manager when will works start on details supplied and if the City Manager would give a breakdown of the amount of housing units will be on the site and when is the completion date for this development. The builder commenced work on this site on 2 nd February The project consists of 53 units of accommodation and the contract period is eighteen months. Q15 Councillor Christy Burke That this Committee agrees to the reinstatement of the path at details supplied and cleaning of the cobble lock by the contractor as it was destroyed when work was being carried out by the contractor. Dublin City Council staff visited the above address and could see no signs of visible damage to the path and the cobble lock. If the resident wishes to take the issue further she may contact the Claims Unit at tel Q16 Councillor Maureen O Sullivan To ask the Manager to (a) provide information on the why the area of details supplied is having such problems with Greyhound collecting green bags; (b) if Greyhound are not fulfilling the terms of their contract, by non-delivery of services, will penalties be applied to them? (c) if certain streets and roads are narrower than the norm, what provision has Greyhound made to provide suitable trucks? There have been interruptions in the collections of green bags at details supplied by Greyhound Recycling since early January This matter was brought to the attention of Greyhound Recycling and they sent a surveyor to details supplied on Wednesday 25 th February 2009 to assess whether a small truck would be required to service this street. Greyhound Recycling have confirmed that a smaller vehicle will service details supplied from now on and no further disruptions to the collection service are anticipated. They also confirmed that the residents of details supplied received their green bag collection during that week. Senior management in the Engineering Dept are regularly in contact with senior management in Greyhound Recycling to ensure that teething problems with the new green bin contract are eliminated as quickly as possible and consideration will be given to implementing the penalty clause if the contract of service delivery does not meet the required standards after a suitable run in period expires. Q17 Councillor Maureen O Sullivan 15

16 Can the Manager request personnel from Clamping Operations to attend the next meeting of details supplied on Wednesday April 1st at 7 p.m., in view of continuous problems in relation to parking? It is not normal practice for officials from the Parking Policy & Enforcement Section to attend meetings of community fora. However, if the details supplied sets out the particular problems being experienced in the area, the matter will be examined with a view to resolving the situation. Q18 Councillor Maureen O Sullivan Can the Manager ensure that a Residents Only Parking sign be clearly displayed on details supplied? There are presently two Private Parking Residents Only signs on details supplied. The area traffic team is currently trying to establish if they are legally enforceable. Q19 Councillor Maureen O Sullivan Regarding Waste Management: can the Manager call for a review of services for the details supplied and adjoining streeets due to the continuous difficulties residents are experiencing with changes of dates, lack of information and mis-information? Due to the rationalisation of the bin routes, there were some change of bin days in the details supplied area towards the end of 2008 by Waste Management Services. There were some initial teething problems with these changes which have been resolved. Also Greyhound Recycling, Tel , took over the green bin collections at the beginning of this year. Again there were some initial teething problems involved in the handing over of the contract from Oxigen but these are now virtually resolved. If the councillor has any specific details of problems which still exist in this regard, she should contact Waste Management Services at tel: Q20 Councillor Maureen O Sullivan To ask the Area Manager what plans he has (if any) details supplied, and replace the railings with bolders. There are no plans to remove the railings at details supplied and replace them with boulders. A draft proposal to redevelop the area as a green space with provision of parking for local residents has been sent to the residents for their observations. Their response is awaited. Q21 Councillor Emer Costello To ask the Manager to clean out the laneway at details supplied(a) and to meet with residents for a long-term solution to this laneway, and to replace the litter bin at the corner of detail supplied(b) and to ensure that the area is cleaned on a regular basis 16

17 Waste Management Services had the laneway at details supplied cleaned on the 4 th March The litter bin at the corner of details supplied will be replaced by the middle of March The details supplied is scheduled to be cleaned on a daily basis. We had details supplied cleaned on the 4 th March 2009 and it is scheduled to be cleaned on a weekly basis. If the residents of details supplied wish to contact the Cabra Area office, a meeting to discuss their concerns can be arranged. Q22 Councillor Emer Costello To ask the Manager to liaise with Gardai regarding the enforcement of the no right turn on details supplied(a), to state when a review of the new system will take place and to state when the name plate for details supplied(b) will be erected and to have the graffiti in the area removed. (a) The Traffic Department will request enforcement of the No Right Turn. It is proposed to review the traffic movements along Phibsborough in approximately 6 months. (b) The Roads and Traffic Department have been requested to erect a name plate at details supplied. Dublin City Council will have the area inspected to assess the quantity of graffiti and thereafter arrange for its removal at details supplied. Q23 Councillor Emer Costello To ask the Manager to ensure that the green space at the side of details supplied (a) is kept clean and if he would consider incorporating it into the garden of same. Consideration will be given to the feasibility of incorporating this green space into the garden of details supplied. This would be dependent on a number of factors and we will revert to the Councillor when the matter has been fully assessed. Q24 Councillor Emer Costello To ask the manager what action is being taken to prevent an individual dumping cars at details supplied and to have the parking space outside the apartments at details supplied designated a residents parking space as it is being used to have cars dumped there and to remove the car that has been there for some time. Details supplied has been inspected and no dumping or parking problems were observed. Q25 Councillor Emer Costello That the Manager place a net covering on the playground at details supplied (a), to prevent balls going into gardens, and ensure that there is no access in the evenings as there are reports on anti-social behaviour and that he states what action is being taken to repair the wall at details supplied (b). 1. This Division shall arrange to install the top net over the M.U.G.A. within the next two weeks. 17

The area was designed to allow for access to interested parties for use of the M.U.G.A. facility during the evenings outside official park opening hours whilst leaving the playground area closed. However if this is now causing concern to local residents then the facility shall be closed as per normal official park closing hours. 3. This Division shall arrange to contact (details supplied) with a view to addressing the matter on site. Q26 Councillor Emer Costello To ask the Manager to restore the procedure of consulting residents of details supplied prior to making an allocation and to report on what measures are being put in place to prevent commuters parking their cars there. Residents are consulted before any allocation is made. While DCC take on board all information given by residents groups it is not their role to select an individual applicant for a vacancy. We will continue to consult with the residents in relation to vacancies and all allocations will be made in accordance with the Scheme of Letting Priorities. We are currently in discusion with residents in relation to the introduction of a Permit Parking Scheme in the complex. Q27 Councillor Aodhan O Riordain To ask the Manger report on the following in relation to details supplied a) what is the position in relation to installing security gates? b) Can the damp especially of outside flats, including details supplied be addressed, and also can the lights on the landings be repaired? c) Can a kitchen unit be provided for details supplied as there is no proper surface on which to prepare or store food? d) to assist details supplied with a transfer a) Funding has been secured for the installation of Security Doors at the complex. Quotes are currently being assessed and the project will commence shortly. b) The roofs in this complex have been examined and our engineer is currently preparing a report in relation to the repairs required, which will be carried out subject to funding. Our Electrical Services Section has been requested to check the landing lights, and carry out any necessary repairs. c) A double wall unit will be fitted in the kitchen of this dwelling within the next few weeks. d) The tenant of details supplied has 62 points on the transfer list. She was offered a three bedroom unit in the complex in October 2007 and refused this offer. Her points are currently insufficient to be considered for any other suitable vacancy within the area. The tenant of details supplied has 80 points on the transfer list. These points are quite low and it will be sometime before she is reached with an offer of suitable accommodation. Q28 Councillor Aodhan O Riordain To ask the manager if there are any plans to increase the use of CCTV footage at details supplied. 18

19 A proposal exists to increase CCTV coverage of the details supplied area in conjunction with An Garda Siochana. This is dependent on the levels of funding available to both DCC and the Gardai to carry out the necessary works. Q29 Councillor Aodhan O Riordain To ask the manager if the manhole at details supplied can be repaired so it no longer makes a noise every time a car drives over it. This is a telecommunications manhole, and is not the responsibility of Drainage Maintenance. This manhole will be referred to the relevant telecommunications operator for repair. Q30 Councillor Aodhan O Riordain To ask the manager what the position is in relation to permit parking at detalis supplied. The residents of details supplied rejected a permit-parking scheme in February 2008 (with 21 votes in favour and 46 votes against). Q31 Councillor Aodhan O Riordain To ask the manager to review the proximity of the roundabout to the footpath on the north side of details supplied. The space is extremely narrow and the roundabout is clipped by cars. This matter will be investigated by the Area Traffic Team and a report will be issued directly to the Councillor. Q32 Councillor Aodhan O Riordain To ask the manager to ensure that repairs are carried out to details supplied as a matter of urgency. The Area Maintenance Officer reports that the repairs to the bathroom of this dwelling will be carried out within the next few days. Q33 Councillor Brendan Carr To ask the Manager if he will have the kerb outside details supplied repaired. Please note that the repair work has been carried out at details supplied. Q34 Councillor Brendan Carr To ask the Manager if he will liaise with details supplied and NTL to look at the installation of new NTL cabling which is visually intrusive with a view to protecting the visual and architectural character of the area which is protected by the LAP 19

20 The Area Office has been in touch with representatives of this residents association on this matter. The area is not currently protected by having any statutory planning status in relation to conservation etc., and therefore, capacity for Dublin City Council to get involved, in what is essentially a private matter between the homeowners and NTL, is severely restricted. Q35 Councillor Brendan Carr To ask the Manager to ensure that the laneways in the details (a) are cleaned on a regular basis and that the promised road repair at details (b) and the pothole at the entrance to details (c) are completed as soon as possible. Grangegorman Waste Management Depot, Tel , have the laneways in details supplied monitored on a regular basis and cleaned when it is necessary to do so. There is a large network of laneways in this area and we give them as much attention as possible. Funding has been cut this year resulting in the cancellation of all carriageway resurfacing works, however Road Maintenance shall repair said pothole within a 4-6 week period. Q36 Councillor Brendan Carr To ask the Manager to have the necessary drainage work carried out in the laneway at the back of details supplied which was promised at the meeting held in January 2009 in St. Finbarrs GAA Club to ensure that the back gardens are not being flooded on a continual basis under normal weather conditions. The Drainage Division has prepared a report to be presented to the Area Committee meeting on 10 th March, which outlines measures which have already been put in place and also some proposed measures, resources permitting, which will improve the drainage in the details supplied area. Q37 Councillor Brendan Carr To ask the Manager to liaise with the developers in the details development with a view to having the large amounts of hoarding removed and the unused lands landscaped to meadow standard to improve the visual amenity of the area The site at the centre of the details supplied lands is the subject of a current application on which additional information is requested. The hoarding is erected to protect this site under development. Therefore it is exempt from requiring planning permission (Class 16 of Schedule 2 - Part 1 of the Planning and Development regulations 2001). There is no planning enforcement action open to the Council at this time. Q38 Councillor Brendan Carr To ask the Manager if it is true that 75 apartments are being sold to details supplied for social and affordable housing at half the original asking price; why DCC did not acquire some of these units in the context of the 187 social and affordable housing units which the DDDA agreed to provide to DCC six years ago. 20

This matter has been referred to the Traffic Advisory Group and a report will be issued to a future Area Committee Meeting. Q43 Councillor Mary O Shea To ask the Area Manager to arrange to have the tree which is blocking the driveway into (details supplied) removed The street trees on details supplied are well established and provide an important amenity to the area. The street tree outside details supplied is not considered to be blocking an entrance and this division has no record of any complaint regarding same to date. Accordingly this division does not propose to remove this valuable amenity. If the residents wish they may 21

Q45 Councillor Mary O Shea To ask the Area Manager to provide an update on the following (details supplied) (a) This Division is currently developing a juvenile pitch in details supplied which when completed will be available for letting. (b) Details supplied The new boundary wall/railing and access/egress area at details supplied Housing estate end is now completed. The new boundary wall/railing and access/egress are at details supplied end has commenced and should be completed over the coming weeks. Work on phase II of the park drainage, removal of the existing hard stand and installation of the new park footpath shall commence as soon as ground conditions improve. Consultation regarding the new pitch layout is still ongoing with the clubs. Q46 Councillor Mary Fitzpatrick Will the manager please provide a report on details attached? In the interests of water conservation DCC has introduced a number of initiatives aimed primarily at raising awareness of the importance of conserving this scarce resource and to encourage water users to take an active part therein. A Water Conservationist Officer has been appointed to advise and assist businesses, schools and householders on reducing the volume of water used by them. The initiative referred in the question related to the supply of water saving devices (HIPPO bags) suitable for use in older toilet cisterns to reduce the volume per flush from 9 litres to between 6 and 7 litres and bringing down water demand. An area containing approx. 400 properties was identified in the details supplied area and householders were provided with these devices and encouraged to fit them in their cisterns. The volume of water supplied to the area before and after their installation was measured and recorded a small reduction. It was felt that another benefit of the exercise was related to the raising of awareness of water saving within households. DCC is also involved with other water conservation initiatives such as the sale of water butts at cost, information packs for schools, Green Flag assistance and information packs for businesses. Leaflets on how to save water such as Tap tips have also been produced and circulated along with references to DCC's websites on water conservation. 22

23 Q47 Councillor Mary Fitzpatrick Will the manager please advise if there are facilities for recycling rubbish in all details supplied complexes in details (a) and if not when they will be introduced? Will the manager advise when recycling facilities will be available in details (b) The facilities for recycling rubbish in details supplied are being examined at present and a report will issue directly to the Councillor as soon as possible. Q48 Councillor Mary Fitzpatrick Will the manager please provide a report on details attached. Details are minutes or summary of meetings held details (a)? Will the manager please outline what issues were identified in the meeting that need to be addressed before the Club can hand-over the site to the school for the purpose of building a school? Please identify who is owner for each action that needs to be undertaken and the estimated timeline to complete full handover of the site to the details (b)? The position with regard to the provision of a permanent site on details supplied for details supplied is as follows: Currently the site in question is leased to the Trustees of details supplied at an abated rent strictly for the provision of recreational and sporting facilities, this lease does not allow for the building of an educational facility. At a meeting between representatives of Dublin City Council s Development Department and representatives from the Department of Education and Science held in the Civic Offices on 29 th September 2008, Dublin City Council informed the Department that the only way this could proceed was if details supplied would be willing to surrender a portion of their lease to Dublin City Council to allow the disposal to the Department to take place. By way of letters dated 6 th October 2008 and 5 th December 2008 Dublin City Council wrote to the Trustees of details supplied with this request and the Council met with representatives of details supplied on 18 th December Details supplied stated that they were willing in principle to surrender a portion of their lease for the provision of a permanent Gaelscoil but the portion they were willing to surrender was different to the portion that the Department wanted. The Department were informed of this by way of letter dated 18 th December 2008 and suggested that the Department meet with details supplied and the area planners to try and draw up more concrete proposals. A meeting was held on the 9 th January 2009 between details supplied and the Council s area planners to discuss matters. On 23 rd January 2009 Dublin City Council held a tri-partite meeting with details supplied and the Department. It is understood that the Department met with details supplied prior to this meeting. The Council understood from the tri-partite meeting that it was agreed in principle to explore the new site layout as envisaged by details supplied. However a letter from the Department dated 6 th February 2009 indicated that this was not the case and the Department wanted to acquire the site originally proposed by them. By way of letter dated 11 th February 2009 the Council reiterated it s position that the property is currently leased to details supplied and the only way that a disposal can take place between the Department and Dublin City Council is if details supplied is prepared to surrender the portion required by the Department. As it stands details supplied has a different proposal and the Council has encouraged the Department to meet with details supplied to try and come to an agreement as a disposal cannot take place in the absence of an agreed site and the Council is currently awaiting a response to it s letter dated 11 th February

24 Q49 Councillor Mary Fitzpatrick Will the manager please arrange to have details attached addressed. This division shall arrange to have the grass verge inspected, assess the damage with a view to determining the actual cause and undertake the appropriate action. Q50 Councillor Mary Fitzpatrick Will the manager please provide a report outlining details attached? The works in question are part of flood prevention measures in the details supplied area. A new surface water pipe is being installed to replace the old combined sewer system. As well as flood prevention, it will remove rainwater from the combined system so that it will not be treated at our main works in Ringsend. The Drainage Division have arranged with the Parks Section to fully reinstate the excavated areas in the park. When all works are complete, any area excavated by the Drainage Division will be reinstated. The issue of the grass verges has been brought to our attention previously and will be discussed with the Road Maintenance Section at time of reinstatement. The area traffic team will review the pedestrian facilities in the area. However it should be noted that in December 2008 a controlled pedestrian crossing was not recommended across details supplied as the volume of pedestrians crossing the road were low throughout the day and did not meet the required warrant for the provision of a pedestrian crossing. Q51 Councillor Mary Fitzpatrick Will the manager please arrange for details provided. The Parks and Landscape Services Division shall arrange for the green to be cleaned and the damaged areas of footpath reinstated as soon as resources allow. Q52 Councillor Mary Fitzpatrick Will the manager please advise on details attached. The laneway in question and associated entrances are not in charge of the City Council. However, a public right of way exists over it. In order for it to be closed by any means, the right of way has to be extinguished. The signatures and addresses of the proposers and adjoinging residents/ landowners with properties abutting this laneway must support an application for extinguishment of the public right of way. The agreement of the residents of adjoining properties at the location of gates if proposed, is very important. As the extinguishment of a public right of way is a statutory procedure details must be published by Dublin City Council at the commencement and conclusion stages of the procedure, costs of which must be borne by the proposer of the extinguishment. There is a 24

25 public right of objection by local residents and members of the general public who may not agree with the proposal. These objections must be considered by Dublin City Council even to the extent of hearing the views of both proposers and objectors at an Oral Hearing should the need arise. The extinguishment of a public right of way is a reserved function of Dublin City Council. An application for extinguishment should also be accompanied by 1. A statement as to how the laneway will be maintained in the future by the fee simple owner(s) of the ground and/ or the adjoining owner/ occupiers and 2. How access will be provided for any private right of way, and to any public services- E.S.B., Bord Gais, Eircom, Water, Drainage etc., that may exist under the laneway if these services are not diverted at the proposers expense. Please note that the utility companies are also entitled to object to the closure. Upon receipt of this information and the undertaking as to future maintenance of the laneway and details of the proposed method of closure ie. Gates, wall etc the matter will receive further attention. It should be noted that if the public right of way is extinguished, Dublin City Council will have no further responsibility/ liability in respect of maintenance of the laneway and cannot undertake liability for any expense involved in effecting the physical closure. Planning Permission is not required for the erection of a gate, provided it does not exceed two (2) metres in height, in accordance with Class 5, Second Schedule, part 1 of the Local Government (Planning and Development) Regulations

26 Motions to the City Manager Central Area Committee March 2009 Item 4108 Motion in the name of Councillor Seamus McGrattan This area Committee calls for the trees to be reinstated on Fassaugh Avenue and for the planned upgrade of the footpaths around the shops here to go ahead. Report The street trees on Fassaugh Avenue (semi mature mountain ash) have been in a state of decline over the past few years and as part of the ongoing street tree maintenance for the area, this division removed a number of dead trees and trees that were in a serious state of decline in late One of the main contributing reasons for the trees condition are the planting locations/ areas. These areas were not initially constructed for tree planting, being confined to a very restricted area and poor planting substrate. Accordingly it is not proposed to undertake replacement planting on this road until adequate provision is provided to accommodate tree planting, and this should form part of the overall road design. The previously planned upgrade at this location will not be taking proceeding owing to budgetary constraints. Item 4109 Motion in the name of Councillor Seamus McGrattan This area committee commends the great work being done by the Dunard/ O'Devany gardens soccer team for children in the area and acknowledging the support the communities give to the teams, calls on the parks department to convert the green area in Dunard to a soccer pitch. Report This division recently met with representatives from O Devaney / Dunard F.C and explained that the existing open space at Dunard was not designed to accommodate a full size soccer pitch given its current layout, configuration, contouring and proximity to existing public roadways. The issues were discussed and it was agreed that before the proposal could be brought forward, that the issue of public safety would first have to be examined with regard to both players and road-user safety. It was agreed that the club would undertake an external assessment of the safety issues pending a drawing being submitted to them by DCC parks Division of the proposed pitch area. This information has since been forwarded to the club and we are awaiting their findings for consideration and discussion Item 4110 Motion in the name of Councillor Seamus McGrattan This area committee calls for a report into the flooding in Villa Pak last summer and for the gullies to be cleaned to prevent further flooding, also for details of any plans to plant more trees on the green area here in the future. 26

27 Report Significant road/garden flooding occurred in the vicinity of 141/143 Villa Park gardens during the August 9 th flooding incident. The rainfall event of the 9 th August has been categorised as having a return frequency of 1:150 Years. The sewers in the immediate vicinity of these houses has been camera surveyed and pressure cleaned. The gullies in the area have also been cleaned. In view of the flooding at this location the gullies will be placed on a priority listing and will be inspected and cleaned as required. This division has plans to undertake additional tree planting on this open space. Our current tree planting programme is fully committed for 2008/2009, however the area will be listed for consideration in the 2009/2010 tree planting programme. Item 4111 Motion in the name of Councillor Seamus McGrattan This area committee calls on Dublin Bus to reinstate the bus shelter on Fassaugh Avenue now that this location is covered by CCTV camera. Report This matter will be taken up with Dublin Bus if the members agree to the terms to the terms of the motion. Item 4112 Motion in the name of Councillor Christy Burke That this Committee agrees that a regular report be made to the CAC re Markets Area Development Plan and that a local newsletter goes out to local area given giving an update on the plan. Report While discussions continue to take place with the preferred bidder, no contract has been signed to date in connection with Phase 1 of the Markets Area Development Plan. Progress reports will continue to be given to the Central Area Committee and updates, as appropriate, will be published in the Central Area newsletter. Item 4113 Motion in the name of Cllr Aodhan O Riordain That the manager report on what is being done to deal with rubbish being dumped on Emmet Street, and under the bridge at Jones Road and to the frequency of the bin collections. Report The Environmental Crew attached to the Central Area Office remove the dumped rubbish and bags from Emmet Street and from under the bridge at Jones Road as often as is necessary. 27

28 A litter fine is issued to anyone found to be dumping at these locations. Waste Management Services provide a refuse collection on Emmet Street every Thursday and on Jones Road every Wednesday. Item 4114 Motion in the name of Cllr Aodhan O Riordain That the manager report if there are any plans to build a playground in the flats on Hill Street. Report It is proposed to carry out Precinct Improvement Works at the Alfie Byrne/Hill Street complex. The works include the provision for a new play area. The invitation of tenders for this project is currently scheduled for June Item 4115 Motion in the name of Cllr Aodhan O Riordain That the manager report on proposals to introduce permit parking at Russell Street and May Street Report No request has been made by residents on Russell Street to introduce parking controls on the street. Any request for permit parking will be initially subject to the street meeting the required parking occupancy of 80% and it being physically suitable for a permit scheme. Only at that stage would a scheme be recommended by the Traffic Advisory Group subject to a survey of the residents. On a site inspection during May 2008 of May Street, parking occupancy was approximately 65%, less than the 80% required for a permit-parking scheme. Consequently the Traffic Advisory Group did not recommend a parking permit scheme at that time. Item 4116 Motion in the name of Cllr Aodhan O Riordain That the Manager arranges for the keyhole on Seaview Avenue to be resurfaced Report Road Maintenance investigated the above matter & could find nothing untoward at this location and accordingly no work works are required. Item 4117 Motion in the name of Cllr Aodhan O Riordain 28

29 That the manager report on the cleaning schedule of Ostman Place and Olaf place, Dublin 7, and whether public litter bins can be put in the area and if the pothole in front of 7 Halliday Road, Dublin 7, can be repaired. Report Temporary reinstatement will be carried out in the next few days. Permanent reinstatement/missing sets will be carried out the next time a crew is in the area. Ostman Place and Olaf Place are both scheduled to be cleaned once a week after the bin collection. Public litter bins will be installed on Ostman Place and Olaf Place in the next fortnight. Item 4118 Motion in the name of Cllr Emer Costello To ask the manager to liase with the Gardai and Luas Operators to ensure that people using the Luas at Connolly Stop are not abused and threatened by groups loitering and drinking at the stop. Report This matter will be taken up with An Garda Siochana if the members agree to the terms to the terms of the motion. Item 4119 Motion in the name of Cllr Emer Costello To ask the manager to have the graffiti removed at the Church in East Wall and the surrounding streets (Church Road & St Mary s Road) Report The graffiti removal contractor engaged by DCC has been instructed to remove graffiti from the church in East Wall and Church Road and St Mary s Road Item 4120 Motion in the name of Cllr Emer Costello That the manager report what actions are being taken to manage and maintain the playground at Fairview Park, to ensure that the equipment is repaired that the playground is cleaned out and that it is closed to prevent anti-social behaviour Report 1. There are two temporary playgrounds at Fairview Park. These playgrounds were put in place because it was required to remove the existing playground at the park as a result of the Dublin Port Tunnel works which were present in Fairview Park until the end of

30 2. These temporary playgrounds are regularly maintained, cleaned and inspected and damaged equipment is replaced as quickly as available resources permit. and should the equipment require to be removed from use the necessary arrangements are put in place. The playground is closed at park closing time however it can suffer from after hour abuse and damage. It is proposed to carry out the planning phase of the replacement playground at Fairview Park in the coming months, with procurement, supply and installation proposed before the end of 2009, subject to the confirmation of the necessary resources. In the meantime Parks & Landscape Services Division will continue to maintain the two temporary playgrounds in the park. Item 4121 Motion in the name of Cllr Emer Costello That the manager undertake to inform people in surrounding streets if a ballot is being undertaken to change the hours of residents parking in one street in the district and that he conducts a survey of residents in the Berkeley Road area (particularly St Vincent Street) to ascertain if residents wish to change the times, and to change the maximum length of parking time for non-residents from three to two hours. Report Under current procedures the Traffic Department ballots residents on a street-by-street basis before the introduction or modification of permit parking schemes. Informing residents on an area-wide basis of possible changes to parking operational hours on a particular street would place a considerable extra demand on the recourses of the Traffic Department. The present system requires a resident to make a request for the hours of a particular scheme to be modified (either directly or indirectly through a Councillor, Local Residents Association etc.). Balloting residents on changes to parking schemes is an expensive, time-consuming operation and is something Dublin City Council only instigates when there is a perceived desire from residents for such changes. Without a request from a resident of a particular road there is no evidence of any initial support for the request locally. Furthermore if changes to parking schemes are proposed on an area wide basis there is a likelihood that certain residents will perceive that there is an attempt by Dublin City Council to impose changes that they have not requested. As a result there is also an increased likelihood of changes being rejected by residents when balloted. For these reasons the Traffic Department would not recommend considering changes to permit parking schemes on an area wide basis but would propose continuing dealing with requests on a street by street basis. A request to change the operational hours of the permit scheme on Vincent Street has been forwarded to the Traffic Advisory Group. Item 4122 Motion in the name of Cllr Emer Costello That the Manager report on the proposals for Blessington Court Square, to commit to completing the long-promised work this year Report 30

31 These works will be costed in the coming weeks and will be carried out as soon as funding becomes available and a contractor appointed. Item 4123 Motion in the name of Cllr Brendan Carr That DCC agree to designate Upper Drumcondra Road for precinct improvement and traffic management; that the shopping area be upgraded to the status of a village centre so as to restore the residential amenity of the area; and that a delegation from the All Hallows Area Residents Association be invited in to the Area Committee to present their views. Report The existing shopping areas on this part of Drumcondra Road are zoned Z4 in the Development Plan, which provides for retail uses and a range of mixed services. Drumcondra is also a Category C District Centre in the Development Plan Retail Strategy i.e. a smaller district centre servicing areas of limited population. They are larger than neighbourhood centres and generally service a local population. It is considered that Drumcondra s current status, as a small District Centre is equivalent to that of a village centre. The designation of this area as a village centre Could be considered in the context of the new City Development Plan. Dublin City Council has recently initiated the review process for the Development Plan. A Draft Plan will be prepared later this year and will go out for public consultation in January Submissions from the various residents groups etc regarding any specific planning issues such as land use zoning, would be welcome at that time. Regarding precinct improvement and traffic management, the Roads and Traffic Department will consider any specific requests for changes to traffic management. It is a matter for the members to decide to invite a delegation into the Central Area Committee meeting. Item 4124 Motion in the name of Cllr Brendan Carr That DCC agree to dish the footpath at the entrance to St. Josephs swimming pool on the Navan Road to allow wheelchair access and to repair the footpaths at Downeys Pub on Charleville Road to facilitate wheelchair/pram users where the trees have broken the paths Report A dishing is required to be constructed at the junction of NCR/Charleville Rd. Road Maintenance will construct this dishing within a 8-10 week period. The Parks and Landscape Services division will arrange to inspect the location in consultation with the Roads Maintenance division to assess the damage with a view to undertaking the necessary repairs subject to the availability of necessary funding. Report The Drainage Division is presenting comprehensive report to the March 2009 Area Committees on the various locations that experienced flooding in the North City in August This report is also the relevant area committees in the Central, North Central and North West Areas. Among the priority locations identified and examined by the Drainage Division are Cabra, Glendhu Park, Clonliffe Road and Park House Apartments in Blackhorse Avenue. There were reports in august of road surface flooding in other locations in Cabra, Navan Road and Jones Road and of a small number of properties flooded on Botanic Road, Dublin City Council is not aware of comparable property damage reports, which would require further Investigation. Any Resident with individual drainage or flooding concerns should be encouraged to contact Colin Egan, Area Engineer in the Drainage Division directly on tel Item 4126 Motion in the name of Cllr Brendan Carr To ask the manager to report on the non collection of bins on the North Circular Road. Report Our Area Supervisor and Litter Warden from Grangegorman Waste Management Depot, Tel , will investigate all the uncollected wheelie bins on North Circular Road. If bins are not emptied due to non payment of waste charges, they will ensure that their owners remove them from the footpath. If the bins are not properly registered, they will ensure that they are properly registered in order that they can be emptied on bin collection day. They will keep this situation under review. Item 4127 Motion in the name of Cllr Mary Fitzpatrick The elected members of the Central Area Committee support the building of a purpose built school for Gaelscoil Bharra in the current location. We call on Dublin City Council to expeditiously proceed with the renegotiation of the lease to allow the GAA club to handover legal title of the site to the school and we request a monthly report on this item until such time as the lease is agreed. Report The position with regard to the provision of a permanent site on Fassaugh Avenue for Gaelscoil Bharra is as follows: Currently the site in question is leased to the Trustees of St. Finbar s GAA Club at an abated rent strictly for the provision of recreational and sporting facilities, this lease does not allow for the building of an educational facility. At a meeting between representatives of Dublin City Council s Development Department and representatives from the Department of Education and Science held in the Civic Offices on 29 th September 2008, Dublin City Council informed the Department that the only way this could proceed was if St. Finbars GAA Club would be willing to surrender a portion of their lease to Dublin City Council to allow the disposal to the Department to take place. 32

33 By way of letters dated 6 th October 2008 and 5 th December 2008 Dublin City Council wrote to the Trustees of St. Finbar s GAA Club with this request and the Council met with representatives of St. Finbars GAA Club on 18 th December St. Finbars GAA Club stated that they were willing in principle to surrender a portion of their lease for the provision of a permanent Gaelscoil but the portion they were willing to surrender was different to the portion that the Department wanted. The Department were informed of this by way of letter dated 18 th December 2008 and suggested that the Department meet with St. Finbars GAA Club and the area planners to try and draw up more concrete proposals. A meeting was held on the 9 th January 2009 between Gaelscoil Bharra, St. Finbars GAA Club and the Council s area planners to discuss matters. On 23 rd January 2009 Dublin City Council held a tri-partite meeting with St. Finbars GAA Club and the Department. It is understood that the Department met with St. Finbars GAA Club prior to this meeting. The Council understood from the tri-partite meeting that it was agreed in principle to explore the new site layout as envisaged by St. Finbars GAA Club. However a letter from the Department dated 6 th February 2009 indicated that this was not the case and the Department wanted to acquire the site originally proposed by them. By way of letter dated 11 th February 2009 the Council reiterated it s position that the property is currently leased to St. Finbars GAA Club and the only way that a disposal can take place between the Department and Dublin City Council is if St. Finbars GAA Club is prepared to surrender the portion required by the Department. As it stands St. Finbars GAA Club has a different proposal and the Council has encouraged the Department to meet with St. Finbars to try and come to an agreement as a disposal cannot take place in the absence of an agreed site and the Council is currently awaiting a response to it s letter dated 11 th February Item 4128 Motion in the name of Cllr Mary Fitzpatrick The elected members of the Central Area Committee call on DCC to provide a report outlining what rezoning and planning processes will be required to allow for the construction of a school on the current site for Gaelscoil Bharra. Every person bringing a dog into any park or open space shall be responsible for its conduct and shall be liable for any damage or injury which may be caused by it. Any person bringing a dog into any park or open space must remove it from the park or open space if so directed by an employee or agent of the Council. Breachs of these regulations may be reported to the Control of Dogs Section on The parks division shall erect signage at both access and egress points to the new Broadstone facility requesting dog owners to keep their dogs on a lead at all times while using this section of the park. Also the park warden and dog warden service will be instructed to patrol the area frequently with a view to enforcing the bye laws as requested. Item 4131 Motion in the name of Cllr Mary O Shea That the Area Manager arrange for the provision of double yellow lines on one side of the road in the Cul De Sac that commences at 196 Quarry Road to enable waste management vehicles and emergency service vehicles to gain access to houses in the Cul De Sac. 36 Motion in the name of Cllr Mary O Shea That the Area Manager issue a Report on the time scales for provision of brown organic bins in the Cabra/Glasnevin area, in particular the Manager to report on when areas such as Iona Road (which does not have a black bag collection, the existence of a black bag collection appearing to be an impediment to the provision of a brown organic bin collection) will be getting a brown organic bin collection. Report Dublin City Council will only issue brown bins where the whole collection route comprised wheeled bins only. It is not practical to issue brown bins where a mix of collection methods (bags / bins) is in operation as bagged areas have a continuing need for a weekly collection. In relation to Iona Road, while this area is on a wheeled bin collection the entire collection route is mixed. Dublin City Council has reviewed mixed routes in the Cabra / Glasnevin area and those customers availing of a wheeled bin collection who were not provided with a brown bin during the initial roll out will now be supplied with brown bins. At their meeting of 9/12/08 the Committee agreed to initiate the statutory procedure and asked that a timeframe of the statutory process be sent to them (copy of that timeframe that was issued to the Members is appended herewith) Screening report to Environmental Bodies was sent on 7/1/09 The Advertisement appeared in the Public Press on 6/2/09 inviting submissions over a 4 week period ending 5/3/09. 2 submissions were received (National Conservation & Heritage Group and Jim Brogan on behalf of Graceavon Holdings Ltd). A nonstatutory display was also held in Phibsborough Library. Details were also on our website. The variations were proposed arising from the Phibsborough/Mountjoy Local Area Plan and were subject to widespread consultation and support during the Local Area Plan process. Also details of the proposed variation were made available on the Dublin City Council website at For convenience, a non-statutory public display was held at the Phibsborough Library, Blackquire Bridge, Dublin 7, during the library s normal opening hours, and in the Cabra Local Area Office, 97 New Cabra Road, Dublin 7, from Monday to Friday between the hours of a.m. to 4.00 p.m. Notice and copies of the proposed variation of the Development Plan were issued in accordance with Section 13 of the Planning and Development Acts, Members of the public were invited to make submissions regarding the plan. The closing date for receipt of submissions was 05/03/09 and two submissions were received during this period. Strategic Environmental Assessment The Planning Authority determined, using the criteria set out in Schedule 2A of the Planning and Development Regulations , Department of Environment Heritage and Local Government SEA Guidelines and Annex 2 of Directive 2001/42/EC, that a Strategic Environmental Assessment was not required for the proposed variation to the Dublin City Development Plan The prescribed bodies were notified of this determination and no objection was received within the prescribed period. The relevant issues raised are summarised below, together with a response and the recommendation of the Manager. The National Conservation and Heritage Group This submission is made by The National Conservation and Heritage Group and raises a number of concerns, the key points of which have been summarised below. Any development on the eastern boundary of the Mater Hospital site should be sympathetic to the Georgian nature of the street and should avoid high-rise buildings. There are elements of the Mountjoy Prison building which should be respected and preserved due to the historical and heritage importance of the building. Dalymount Park is not seen as a Key Development Site as described in the Plan but rather as a heritage site, important to the local residents and the city generally. The bridge at Crossguns is a historical bridge and should not be interfered with. Hedigans has been the subject of recent planning applications and An Bord Pleanala have made their view clear relating to the site. No account has been taken of the heritage or national monument value of any of the Key Development Sites. It is unclear if an Environmental Impact Assessment has been carried out taking account of the conservation requirements of the Department of Environment, Heritage and Local Government, An Taisce and various other groups such as the Georgian Society. Before the adoption of the plan there should be an opportunity for an oral hearing of the proposals so that the greatest possible input can be made before properties described as development sites disappear or are compromised in any way. Response and Recommendation The proposed variation will enable the implementation of the adopted Phibsborough/ Mountjoy Local Area Plan so that all future development taking place on the Key Development Sites, including the 45

46 Mater Hospital Site, Mountjoy Prison complex, Dalymount Park and Cross Guns Bridge, takes place in accordance with objectives of the Local Area Plan. It is a requirement that a detailed site specific masterplan be prepared as a pre-requisite to any planning application to address the future development of each site with regard to such issues as design, building height, architectural treatment and to ensure any future proposals are sensitive to local context and protect established residential amenity, character, and historic buildings and structures of conservation merit. This approach will ensure that future development will contribute to developing a coherent and appropriate urban form locally and will not have a negative impact at a local or citywide level. With specific reference to Hedigans Public House, the scope and content of the individual site masterplan must be agreed with the Planning Department in advance. It is normal planning practice that any masterplan prepared provides a full assessment of the planning history of the site to inform the context of future development proposals. No planning applications for large scale development in the plan area will be progressed until such time as an agreed site masterplan is in place which provides a full planning history assessment and addresses other key issues including, but not limited to height, density, landuse, environmental impact assessment, heritage conservation etc. Phibsborough / Mountjoy s rich and varied architectural and historical heritage was fully considered in the plan preparation process. The Local Area Plan seeks to protect the built heritage of the Phibsborough / Mountjoy area and to allow for, where appropriate, the sensitive adaptation of buildings and structures of conservation merit for viable alternative and sustainable new uses. A number of Key Heritage and Conservation Objectives have been explicitly included in the plan to ensure that local architectural heritage is conserved and enhanced, to preserve it for future generations and to drive the sustainable rejuvenation of the Local Area Plan area. This provides an additional layer of protection in addition to that provided by the existing City Development Plan. The Phibsborough / Mountjoy Local Area Plan was adopted by Dublin City Council on the 6 th of October Full public consultation was carried out during the preparation of the Local Area Plan, at which time the views of residents and all stakeholders were invited in addition to formal statutory referral to the prescribed bodies including An Taisce and the Department of Environment, Heritage and Local Government. The submissions received fully informed the plan making process. No change recommended. Jim Brogan on behalf of Graceavon Holdings Limited This submission is made on behalf of the owners of the P. Spain and Sons Furniture Factory which is identified as Key Development Site No. 10 within the Local Area Plan and in the proposed variation. The site is subject of a proposed zoning change in the variation from zoning objective Z9, To preserve provide and improve recreational amenity and open space to zoning objective Z1, To protect, provide and improve residential amenities. The site is also the subject of a proposed site specific objective. In summary, the submission welcomes the proposed variation. The rezoning of the P. Spain and Sons Furniture Factory site to residential and the inclusion of a site specific objective is seen as essential if the policies/objectives of the Phibsborough/ Mountjoy Local Area Plan are to be achieved and if legal requirements are met that the Local Area Plan is consistent with the objectives of the Development Plan. Graceavon Holdings Limited request that the proposed variation be adopted by the City Council. Response and Recommendation The submission made is in support of the proposed variation. No change recommended. Recommendation to the City Council Having regard to the submissions received and the Manager s response to the issues raised therein, it is recommended that the City Council adopt the proposed variation (No 35) of the Dublin City Development Plan Michael Stubbs 46

Site Location/Zoning map: 68 Queen Street, Dublin 7 Summary Description of Building Modern red brick four-storey, five-bay apartment building built in The structure is not considered to be of any special interest. Assessment of Special Interest Under the Planning & Development Act 2000 The building dates to 1993 and is not considered to be of special interest under Part IV of the Planning and Development Act It would appear that No. 68 Queen Street was included on the Record of Protected Structures in error of No. 69 Queen Street. It has been recommended that No. 69 be assessed for inclusion on the RPS (Add 305). Dublin Civic Trust has noted that No. 69 dates from (Dublin Civic Trust Architectural Inventory). Recommendation The protected structure is not considered to be of special significance within the meaning of Part IV of the Planning and Development Act, It is therefore recommended that the building be deleted from the Record of Protected Structures. Site Location The building is located on Parnell Square. It is found on the north east corner, and comprises of about three properties. It is the second building from the corner of the street and is part of a red brick terrace. Location of Parnell Square Summary Description of Building The original houses on this site on Parnell Square were demolished c1980. The present undistinguished building was designed by Desmond Fitzgerald Architects with three reproduction facades fronting modern office building. Assessment of Special Interest Under the Planning & Development Act 2000 These buildings have no architectural interest apart from their streetscape value in Dublin s first and grandest Georgian Square.
