5 Planning and Feasibility New Court House dates to 1877 and was designed by Robert William Edis. The modern extension known as New Court dates from the 1980s and is to be retained. The site extends to approximately 0.22 ha. The Site lies in the Marlow Conservation Area ( CA ) and is located within Area 3 of the CA, which is described in Wycombe District Council s ( the Council ) Marlow Conservation Area Character Survey (2004) as consisting of predominantly Victorian and Edwardian residential areas of development that were developed to the east and west of the historic core of the town as it expanded in the nineteenth and early 20th centuries. There are no listed or locally listed buildings on the Site, but New Court House has been identified as a building of local significance in the CA character survey. The character and appearance of the CA is protected through section 72 (1) of the Planning (Listed Buildings and Conservation Areas) Act As a locally significant building New Court House does not have statutory protection but, being within a conservation area, is protected from substantial demolition and is classified as a non-designated heritage asset in the context of the National Planning Policy Framework (NPPF). of a high level of design quality by utilising the existing building of New Court House. Sympathetic landscaping should also be undertaken due to the nature of the designated green space, as well as the design for the Site making reference to the character of the conservation area. The Site is within Flood Zone 1 as shown on the Environment Agency s Flood Zone Map. In addition to S106 contributions, Wycombe District Council currently operate a Community Infrastructure Levy (CIL) charging schedule. The current rates for residential units within charging zone B, of which Marlow falls under, are priced at 150 per sq m. It is noted that the Councils ability to seek obligations through S106 is reduced due to the presence of CIL, and any requests would need to comply with CIL regulations 122 and 123. A planning brief has been made available in the dataroom.
