Dear Director: The purpose of this request is to obtain a deviation from the City of Cape Coral Land Use and Development Regulation Bl (2) No part of and marine improvement, which extends more than six foot into a waterway shall be located less than 12 feet from the end of the water frontage line (2) No part of and marine improvement, including but not limited to docks, mooring posts, boat lifts, lift structures, and or walkways shall project into a waterway to a point more than 25 % of the calculated waterway width or 3 feet, whichever is less, as measure from the water frontage line. The deviation requested is to install (4) piling and a lift. The northern most lift piling will be located 8'-6" from the North property line. The top beams of the proposed lift will project 4' -6" past the maximum projection of a 178' wide canal. (3') As per regulation Bl, these piling must not be within 12 feet from the property line. f approved, the deviation would allow the lift piling be installed within the 12 feet setback. As per regulation to (2) All ofthe marine improvement must be within 3 from seawall. f approved, the deviation would allow the lift top beam to encroach into the canal 4'-6".

2 The hardship that requires the deviation is as follows: The owner will be purchasing a 45 foot boat and a 28 foot boat. The 45 foot boat is loaded from the stern. The owner desires to leave his current dock configuration unchanged. The dock is 8' -4" wide at the stern of the 45' boat and the owner deems that this width is the appropriate width for the safe loading and unloading of people and equipment for the vessel. The proposed boatlift would then be added to the North side of the loading dock. This lift would extend 3' -6" into the 12 foot setback. Additionally, the owner wishes to be able to safely walk from property line to property line on his existing dock. Placing a 28 foot boat on the proposed 1, lb. lift and to allow the vessel to sit properly and safely it would require the boatlift piling to be set 34'-6" out into a 178 foot wide manmade canal. The surrounding area consists of single-family homes. The site and all surrounding properties have a Single Family Future Land Use Classification and Single Family Residential (R-1B) Zoning. The site has 8 feet of water frontage on Keats Canal. This waterway is about 178 feet wide at the applicant s property. Project Description: The applicant proposes to install four mooring pilings and a boat lift that will extend north and east of the existing marine improvement. The marine improvement will extend 4.5 feet past the maximum projection allowed in the canal and 3.5 feet into the side setback. The applicant requests a 4.5 foot deviation from LUDR, Section B2 that limits the projection of marine improvements to 25% of

The applicant also requests a 3.5 foot deviation to Section B1, to allow a marine improvement to be 8.5 ft. from the north property line. Analysis: The Planning Division has reviewed this application based on LUDR, Section 3.16, Marine mprovements, and offers the following analysis: LUDR, Section C allows for deviations for marine improvements based upon the following: That the deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section and where conditions exist that are not the result of the applicant and which are such that a literal enforcement of the regulations involved would result in unnecessary or undue hardship. This section further states that the Hearing Examiner shall consider factors such as the effect the deviation would have on the navigability of the waterway; the design, size, and proposed location of the marine improvement; and the effect that the proposed deviation would have on any extant marine improvements in the subject waterway. General Deviation Review Criteria Pursuant to LUDR Section C 1. The deviation is not contrary to the public interest. The proposed marine improvements will extend an additional 4.5 feet into the waterway. The canal width along the site averages 178 feet. There is sufficient width in the canal to accommodate the marine improvements, and therefore should not interfere with navigability or views of the waterway. The marine improvements will also extend 3.5 feet into the 12-foot setback. The applicant provided a letter of no objection from the owner to the north at 2716 SE 22 nd Avenue. 2. The deviation will be in harmony with the general intent and purpose of this section. The intent of the regulation that restricts the projection of marine improvements to 25% of the waterway, or 3 feet maximum, is to ensure that safe navigability is maintained throughout the waterways of Cape Coral. The majority of canals within the City are less than 1 ft. wide, therefore, maintaining an appropriate distance between marine improvements on opposite sides of these waterbodies is important. The marine improvements once completed would extend less than 2% of the canal width. The intent of the setback regulation is to ensure that there is proper spacing between adjacent marine improvements to allow for safe ingress and egress of vessels to each property. The owner to the north has stated no objection to the proposed boat lift. This neighboring property is at the intersection of two canals and the marine improvements on site are on Shakespeare Canal, about 135 feet from the marine improvements on the applicant s property. There should be no navigation or safety issues accessing the marine improvements on either property.

The applicant will be purchasing a new 45- foot long boat requiring changes to the existing marine improvement. 4. A literal enforcement of the regulations involved would result in unnecessary or undue hardship. Constructing the boat lift to meet City regulations would require a major modifications to the existing dock, thereby creating a hardship on the owner. Specific Deviation Review Criteria Pursuant to LUDR Section C 1. Effect of proposed deviation on navigability of the waterway involved. An additional 3.5 foot projection into the canal should have no effect on the ability of others to traverse the waterway or affect the view of neighboring properties. 2. Design, size and proposed location of the marine improvement for which the deviation is sought. Other dock configurations remain available that would allow the lift to meet city regulations. However, this would require major modifications to the existing dock without noticeable improvements in public safety, navigability, or visibility. 3. Effect, if any, that the proposed deviation would have on any extant marine improvements in the subject waterway. The deviations will have no negative effect on the existing marine improvements in the canal. Comprehensive Plan: The project is consistent with Objective 1.3 and policy of the Conservation and Coastal Management Element of the Comprehensive Plan Recommendation: Staff finds that the request is not contrary to the public interest and is in harmony with the general intent of the LUDRs. While conditions exist which are the result of the applicant, a literal enforcement of the regulations involved would result in an unnecessary hardship. Therefore, the Planning Division recommends approval of the requested deviations.
