D Arcy Grisier - Unit 55 D Arcy raised some issues he had with the WSTA Resolution No. 3, Fine Policy and Hearing Procedures. He did not understand why this was necessary and he thought the fines were too high. Faye explained that we are following Utah law and the advice of our HOA attorney. Sheila Green - Unit 89 Sheila said that she loves the new Pond 5. She also likes the Resolution although she didn t understand why the owners didn t get to vote on it as she claimed it was changing the CC&Rs. Section 11.3 of the CC&Rs states: The Board shall have the right to levy fines against owners and lots for violation of the provisions of this Amended Declaration, the Bylaws, or Rules and Regulations. The amount of the fines shall be determined by the Board. This document states the amount of the fines and hearing procedures. It does not change the CC&Rs. Sheila says that she will now consult with her attorney.

2 Sheila then presented the Board with a picture of the mailboxes near Pond 6 and said nothing had been done about them. It was explained to Sheila that the Board is on top of this project. Several cement projects will be done at the same time, and coordination is underway to get this accomplished. She wondered why nothing had been put in the newsletter about it. Linda Taylor - Unit 101 Linda stated she is elated to come back and see a pond put back in. She asked about fencing (what type) and landscaping. Judy Boyle - Unit 33 Judy stated she is always so delighted to come back from her time in Wyoming to see the great shape that West Springs is in. She did have some issues with her lawn, and Brian said he will check it. (Action: Brian) Brian Hatch - Got Sod The crew will be aerating today and tomorrow. With the fertilizer working so well and the warmer weather, we will mow longer than usual. He asked that when he is notified of a landscaping problem that we also text/ Jose. He was asked to check the leak between a pond and the grass, but he doesn t know which pond. (Action: PPM) Eighty percent of the lawns have the water turned off, but if the crew sees any issue, they will turn the water back on. Water is being left on to those area that have new seed. Brian will remind the crew to blow the pine needles off the tennis/pickleball court. Brian was asked to save some of the good parts of the old Pond 5 fencing (after we get the new fence) and store them in the shed. Brian will also clean out the shed. (Action: Brian) Faye reminded Brian that when the cement work is done at Unit 32, he is to bury the downspout (19 feet out to the curb). Brian will coordinate with Jeremy when this is scheduled. 3 Merritt stated that Ron from Southwest Asphalt said that the roadwork will probably be done in April since we need to avoid spring break in March. Faye suggested having Ron look at the RV Lot to see if it really needs to be done this time. (Action: Merritt) Approval of Minutes The Minutes of the Regular Session on October 3 and the Executive Session on October 3 were approved as written. Treasurer Faye gave the water report. Although the number of gallons we are using is down significantly, the cost has gone up so it is more expensive. It s $1.66 per 1000 gallons. John Richards is leaving Ball Janik, and we are happy with that. Faye said to go ahead and process the check for $45 for advice on Unit 103. (Action: PPM) We have not received the toilet rebate yet, but Rene Fleming said to look for it in the next billing. We have three CDs maturing this month. The Board approved letting them roll over. Faye said Brian could use $3000 to continue work on the pink line, but to let her know when he is getting close to using the money up. (Action: Brian) Management Karen said that Walker Plumbing will be out tomorrow between 3 and 5 to look at the broken a-c in the main clubhouse. Sally will let them in. Facilities The 75-inch projection TV will be picked up by Switchpoint. Cindy is still working the windmill palm donations on Pond 7. (Action: Cindy) ACC Nothing to report. Education Faye attended the 3-hour law forum on October 15, Tools for Dealing with the Expected and Unexpected. She said it wasn t worth the price of admission ($20). 3

4 On the other hand, she was impressed with the HOAs and Solar Legislation presentation held at the new Brio clubhouse on November 2. This was a panel discussion with Lowry Snow, Utah House of Representatives, Solar Legislation sponsor; Legend Solar representation; David Houston, Coral Canyon HOA Manager; Dara Tancredi, Entrada ACC Chair; and a Dixie Power representative. If the solar legislation passes as proposed HOAs could not prohibit its installation even if it is prohibited in their governing documents. Social Committee There will be an Hors D Oeuvres party on Saturday, December 3, and the annual Christmas potluck on Christmas. Ponds Pond 1 aerator is not as noisy as it was. We will keep an eye on it. Pond 5: Heber is waiting for the material to come in to do the fence. It will be 3 slats, not four, and every other post will be cemented. The noncemented post will enable flexibility should repairs be needed. A metal fence was ruled out because of the maintenance involved with repainting due to rust. Bob will talk to our possible benefactor about this. (Action: Bob) After the fencing is installed, we will contract for the mow strip curbing. Once the fence and mow strip are completed, we'll address the landscaping. It cost $66.84 for water to fill the pond. Bob reviewed the Pond 5 projection to date which will end up close to $50,000. Bob wants the Board to relook at Pond 5 at our December meeting. The pump on Pond 7 is out, and the part should be in next week. The float is out and Bob will take care of it. The aerator is shooting too high, and it must be clogged. (Action: Bob) A joint slipped on Pond 3, and Bob will put it back together. The water shutoff is where the fake rock is. Bob showed Shirley Surfus where it is and showed her how to shut it off if we can t get ahold of anyone else. Bob is looking at switching Pond 6 aerator with the one in Pond 5 as the one in Pond 6 emits a more narrow spray; the one in Pond emits a broader spray. Swapping aerators would fit better in the respective ponds. (Action: Bob) We will have some carryover on the chemicals but chemical budget for 2017 should 4

5 remain the same. Unfinished Business The proposed WSTA Resolution No. 3, Fine Policy and Hearing Procedures, was adopted by the Board. It will be put on the website. The document rescinding the Administrative Resolution regarding Schedule of Fines for Violation of Governing Documents was given to Jerry to sign and have notarized. Then Karen will have it recorded. The Resolution does not need to be recorded. (Action: Jerry) Next Meeting and Adjournment The next regular Board meeting will be held on Monday, December 5, 2016, at 9 a.m. in the clubhouse.
