2 CLPOA BOARD OF TRUSTEES MEETING Tuesday, March 14th, 2017 Choctaw Lake Conference Room Substantive Motions Approved in this Meeting: Motion : Brian Welch moved that the collection policy be changed. Brian Stewart seconded. The motion passed 8-0 and 1 abstain. Motion : Ken Petry moved that the Board confirm that a home can be built on Lot #529, on either the left or right side, according to the Choctaw Lake Building regulations and in accordance with set-backs and all other documented requirements. Sener Calis seconded. The motion passed 8-1. Motion : Suprena Lohrer moved that the Board approve a fireworks sponsorship with Joy Crace, Lot #172, as proposed. Sener Calis seconded. The motion passed 9-0. Motion : Suprena Lohrer moved that the Board approve the Fundraising and Volunteer Committee s proposal to repair the main lake sign and logo, to include replacement of the letters and painting. Sener Calis seconded. The motion passed 9-0. Motion : Brian Welch moved for the Board to recognize the Choctaw Lake Dog Club as an official club, with all rights and benefits as any other club. Suprena Lohrer seconded. The motion passed 8-0 and 1 abstain. Motion : Sener Calis moved to approve the Eagle Scout project presented by Cameron Stewart to restore the ball diamond. Vince Cyran seconded. The motion passed 8-0 and 1 abstain. Motion : Suprena Lohrer moved that the Board move $1,700 from the general budget to the Recreation Committee to be used for summer concerts. Vince Cyran seconded. The motion passed 8-0 and 1 abstain. Motion : Suprena Lohrer moved that the Board give Chief Joe Bell the authority to hire currently employed Madison County deputies to serve as Choctaw Lake patrol officers. Brian Stewart seconded. The motion passed 9-0. Motion : Scott Kutzley moved to raise the boat storage rates on Old Columbus Road to better align with the adjustments made to the Marina boat storage lot. Brian Welch seconded. The motion passed 8-0 and 1 abstain. Motion : Suprena Lohrer moved that the Board approve an update to Section 204 of the Employee Handbook. Ken Petry seconded. The motion passed 9-0. Motion : Sener Calis moved that the Board approve the Expenditure/ Contract Approval & Check Signing Policy previously revised March 8th, Brian Welch seconded. Property Owners Time: Jenny and Cameron Stewart - Lots #61 & 62: Cameron is a Life Scout with the Boy Scouts of America and is requesting permission to restore the Choctaw Lake ball diamond to fulfill his service project on his path to become an Eagle Scout. Dan Blazer - Lot #350: Mr. Blazer has been very involved with the summer concerts for the last six years. He requested additional funds for summer concerts. Dan noted that last year we had six concerts which typically draw 200 to 300 people. Bill Laney - Lot #716: Mr. Laney expressed his support for the fireworks, Community Days, and the summer concert series. He stressed that cancellation of these events would be detrimental to our lake community. He also mentioned that many residents and their friends and families look forward to these traditions. Dean Miller - Lot #98: Mr. Miller discussed the Choctaw Lake Utilities Board and the decisions that are going to need to be made here at the lake. He expressed his satisfaction with the Utilities Board and is encouraged that the members will make the right decisions for our community, but requested that the Board notify property owners of any plans or decisions so they can review and give input. Steve Gruzs Lot #557: Mr. Gruzs provided the Board with a list of people who would like to create a dog club. He read the group s bylaws and asked the Board to support the idea by giving their approval to a Choctaw Lake dog club, and, in addition, to maintain the funds on behalf of the dog club so the club doesn t have to select a treasurer and go through the process that would be involved. Joann Welch Lot #715: Mrs. Welch discussed the many activities and clubs they have supported. She expressed her support for the Board of Trustees and acknowledges that they serve long hours and put a great deal of work into sitting on the Board, which is not always appreciated by the property owners. Ryan Peters Lot #369: Mr. Peters

4 had questions about the relationship between this Board and the Choctaw Lake Utilities Board; how the decisions about a water plant will be made; and if property owners will be given the right to vote. As of this date, Choctaw Utilities has the authority to make these decisions in accordance with their by-laws. Joan Greco Lot #583: Ms. Greco requested that she be given the right to speak before the new Board about several issues which concern her property. President Niemeyer will refer this matter to the Constitution, Rules and Regulations Review Committee for further investigation into the rules. She requested that Ms. Greco work with that committee and come back before the Board in conjunction with that committee when they have a recommendation. Bob Sisco Lot # 529: Mr. Sisco is requesting a letter of confirmation from the BOT stating that he has the right to build on Lot #529. The Board discussed the issue and will provide Mr. Sisco with a letter as requested. Zan Broyles Lot # 114: Ms. Broyles supports the summer concert series. She asked if there are rules and fines that can be implemented when cars and boats are being parked on the grass and in yards. She feels that the fines collected could go toward the summer concert series. Al Wilderman Lot #128: Mr. Wilderman wanted people to know that the more activities and events we have going on make Choctaw Lake that much more attractive and marketable and encourages us to continue to do this because it is important for the value and sale of our homes. Clem Estrada Lots #263 & 265: Ms. Estrada wanted to know if anyone is looking for an area for the dog park. That will be considered after the club is formed. She also wanted to know if chain link fences are allowed. The Board told her they are but she would need a permit. Brian Stewart requested a Point of Order to inform the Board and property owners that the agenda is inaccurate in advance of the meeting. This will be discussed later in new business. Minutes: The February minutes were approved as submitted. Patrol Report: Chief Bell asked the Board to consider approval to streamline the hiring process for his deputies. This will be brought up in new business. Chief Bell says the Patrol has suspects with regard to last month s break-ins, but no one has been charged, arrested or prosecuted at this time. No additional reports of car theft have been reported. Maintenance Committee: Mike Hexamer submitted a report. Two docks are being repaired. The Memorial Garden gazebo roof is being replaced. Office Report: The Board and Carla discussed paper billing and fees, the office procedure for , preparation and distribution of the Board packet, and the possibility that an office volunteer may be a consideration for the future. The foreclosure procedures were also discussed and clarified. Treasurer s Report: Suprena Lohrer informed the Board about the need to review the books once a year, by using either an accountant or a committee of property owners. The policies for writing checks, general expenditures, the profit and loss state- SPRING IS HERE! NOW IS THE TIME! If you are thinking of selling your home... this is a GREAT time to be listed. It is a SELLER S MARKET... As of today ( ) there are only 10 active homes listed at our lake. 5 ment and the budget were also discussed. Manager s Report: Mike Hexamer provided pictures and reported on some of the projects being worked on. Scott and Barb discussed a new work plan database which Mike will implement for the planning and status of past and future projects, repairs, and preventative maintenance, including start dates, time frames and work hours expended per activity. They discussed having volunteers or one of the clubs assist Mike with clean-up prior to mowing, painting, and other duties around the lake which do not involve liability issues. Constitution, Rules and Regulations Review Committee: Brian Welch informed the Board that the committee met and looked at the bylaws and the building codes. They made revisions which he gave to the members. This will be discussed after all the Board members have reviewed the changes and a vote will be taken at the April meeting. The permit fees have increased in several of the code activities. Investments: The committee will meet March 13th and will be making a recommendation on policies to be developed. Lake Drainage & Roads Review and Dam Committee: Ken told the Board that they will have their first meeting on March 21st at 7:00 p.m. to discuss officers and plans. Lake Water Quality: The committee is discussing May 13 as the first lake clean-up date. They are hoping a volunteer group will be able to help. We are waiting for the contractor to finish a project and contact us to begin the dredging. Long Range Plan: Suprena Lohrer is the Chairman of the Committee which will be meeting monthly. She presented a summary. The goal is to complete a reserve study of 5 or 10 year plans for the budget by September 20th. Patrol: Ken Petry and Vince Cyran met on March 8th and will be submitting a mission statement. Personnel Committee: These matters will be discussed in Executive Session. Beautification: Sener Calis provided an update and the budget was discussed. He will submit a list of expenditures and a mission statement outlining plans the committee has. Recreation: Ken Petry said the committee will be having first meeting on March 16 at 7:00 p.m. and will be making recommendations for several events, depending on finances. Public Relations: Brian Welch gave the Board a summary of future plans and discussed the status of the Peace Pipe newspaper and the new website. The website is still in development. The Madison Press will not print The Peace Pipe this month, nor will it be delivered to our homes in the future. The new Peace Pipe will soon be accessible on the website, and copies can also be picked up at the office or at Lakeside Plaza. Volunteers will deliver a copy to residents who need to have it delivered. 6 and encouraged to purchase ad space in either the paper, the website, or both. Collections: Suprena Lohrer informed the Board that the goal of the mission statement for the Collections Committee is to collect monies, stay organized, and be proactive instead of reactive. A discussion regarding returned checks and late payments was initiated by the Office due to an increase in both. The check return and late fee policy is being revised to: A property owner who writes two checks to CLPOA which are returned by the bank for insufficient funds shall no longer be permitted to pay by check. Thereafter, the CLPOA will only accept payment from the property owner by cashier s check, credit card, debit card, or cash. An administrative late charge shall be levied when a payment is received after midnight on the due date. The charge for a late fee is increased from $25.00 to $ The motion to change the policy was approved. Fundraising and Volunteers: Brian Stewart is Chairperson and other members of the committee were identified. A mission statement and the goals of the committee was submitted. Old Business: Bylaws and building codes will be discussed at the April meeting. New Business: The Board discussed what to do with Round-Up funds received to date of $1,925, which have been generously donated by property owners for the fireworks. Since the fireworks are being sponsored by Joy Crace, President Niemeyer requested that Angi Watson contact each person who contributed to the fireworks fund and ask whether the donation should be returned, placed in the general fund, recreational fund, or used for some other event or project. Suprena Lohrer requested that Dean Miller assist the Board to reprise the 25th year anniversary document. The Board had no concerns with the request. The rental rates for the Old Columbus boat storage area were discussed. The rates have not been adjusted since 2008, and the rates for the Marina boat storage lot were raised this winter. A motion to raise the rates for each space by $25 was approved, resulting in the rate for the small spaces to go from $100 to $125, for the medium spaces to go from $120 to $145, and for the large spaces to go from $175 to $200. Other Business: A process audit will be discussed as Old Business next month. Brian Welch moved and Ken Petry seconded the motion to go into Executive Session to discuss personnel issues at 11:12 p.m. The Board came out of Executive Session at 12:49 a.m. on March 15, Motions and were passed. 7 Trash Pick Up Contract We renewed our contract with Rumpke for another four years. The new contract runs from July 1, 2017 to June 30, The increase is a modest.075% or $1.63/month. The current quarterly rate of $64.95 is going to $69.84 July 1st. The current rate has been in effect for eight years. There is no charge to the CLPOA for emptying the dumpsters at the various association buildings. During the meeting with the Rumpke representative, Michael Darling, he reminded us of the equipment they offer: 1. One brown 95-gal trash cart and one red recycle bin are included with each residential service. 2. Additional units of each are available: 95-gal trash cart -- $2.00 per month; recycle bin no charge. 3. Also, available: lid for recycle bin no charge; green 65-gal recycle cart -- $2.00 per month. Rumpke picks up these bulky items (please call Rumpke and let them know you have a bulky item to be picked up): 1. Furniture (upholstered pieces must be wrapped in plastic) 2. Mattresses (must be wrapped in plastic) 3. All appliances (except refrigerators) 4. Appliance Warehouse picks up refrigerators; call (the Freon does not have to be drained. Please contact Rumpke at 888-rumpke1 ( ). When a major holiday falls on Monday, trash collection will be the next day, Tuesday. (New Years, Memorial Day, 4th of July, Labor Day, Christmas)

Parking: (1) No motor vehicle or miscellaneous vehicle may be parked, placed in a position where it is blocking the flow of traffic or permitted to stand for an excessive period of time on any Choctaw Lake road or right-of-way. (2) Motor vehicles and miscellaneous vehicles shall not be parked on another property owner s property without permission. (3) WHERE A DWELLING IS CONSTRUCTED ON A LOT, ALL MOTOR VEHICLES OWNED BY THE PROPERTY OWNER SHALL BE PARKED EITHER ON THE DRIVEWAY OR INSIDE THE GARAGE. (4) Where no dwelling is constructed on a lot, motor vehicles and miscellaneous vehicles may be parked thereon for up to twelve (12) continuous hours; parking for longer periods of time may be permitted with the prior written permission of the Lake Manager. (5) Motor vehicles, miscellaneous vehicles, trailers, campers or other types of vehicles, whether recreational or commercial, may be parked on Choctaw Lake recreational, boat launch and parking lot areas for up to eight (8) hours only, unless a written consent is obtained from the Lake Manager. 10 2017 Choctaw Lake Summer Concert Series By Dan Blazer We are very excited about this year s lineup for our Choctaw Lake Summer Concert Series. It is headlined by a Country/Rock and nationally touring recording artist (Ashley Martin), includes a Nashville recording and nationally touring artist (Scott Arnold), and includes three other bands all of which have many years of experience in the music business (The Trains, Soul Express and The Alexander Band). A great variety of music will be on display including classic rock, country, southern rock, soul, funk, pop, swing and classics (e.g., Frank Sinatra). This year we are thrilled that our stage will have a roof on top and removable sides so that we can survive rain showers. The funds to buy the materials for the new stage roof have been donated by the Campbell Family who own and operate the Lakeside Market. If you have a chance, please thank the Campbell family for being so generous. Check out the write-ups and the pictures of our summer concert series artists within this edition of the Peacepipe. Their unique approach to Rock & Soul makes them one of the most sought after bands in the area. They play a unique brand of 70s and 80s classic rock. Many of the band members have performed as band members for nationally famous acts including Dilbert McClinton and Waylon Jennings. Many of the band members have over 25 years of experience in playing. They are sure to get you rockin and rollin with their brand of classic rock. Ashley now tours the country with her four-piece band. She has created a unique style all her own a mix of country, rock and pop. Her shows are high-energy musical experiences. She has traveled thousands of miles to perform over 500 live performances in the last three years. She has opened for the likes of Brett Eldridge, The Band Perry, Tracey Lawrence, Dustin Lynch, Frankie Ballard, Trick Pony and Zac Brown Band. Ashley released her third CD entitled Take 2 in October Her latest single He s Mine has generated much excitement much excitement Country and Rock/Pop

11 The Scott Arnold Band (July 22nd) The Scott Arnold Band is a hi-energy country and crossover southern rock band that will electrify the evening. Scott is now a Nashville recording artist that is touring nationally. Through Nashville influences Scott has created his form of country sound from the likes of Chris Cagle, Chris Stapleton, Dierks Bentley and Randy Houser. Scott looks to follow up his very successful concert from last year in this year s first concert in May. Contact: Dave Alexander (614) Classic Rock, Country, Classics The Dredge Report Heartland Dredging will begin the lake s dredge project this month and will remove 40,000 cu. yds. of sediment from the south end of the lake over the next 2-3 months. Heartland personnel will make every effort to minimize the impact of its operation on lake users. Hydraulic dredging machinery will be used. In that process, a cutter with steel blades dislodges sediment, and a pump moves a sediment/water mix through pipe to a disposal basin. Water is drained off in the disposal basis, and sediment is left to dry. The disposal basin will be located south of the lake and will allow the sediment/water mix to remain in the basin long enough for solids to settle. Relatively clear water will be returned to the lake. After drying for a year or two, solids will be available for use as fill or topsoil. Heartland will begin the project a few weeks later than planned. An early-spring start date was intended, but completion of a Wisconsin project took longer than expected. Goose Deterrent Planting The peninsula next to the boat docks, north of the beach, is going to look a bit shaggy this summer. It is an experimental plot to determine if the natural growth is sufficient to prevent the geese from inhabiting that particular piece of land. Please be patient as we study the effects of this natural growth area.

13 Choctaw Utilities Inc. Update Choctaw Utilities Inc. (CU) provides water to over 900 homes in the Choctaw Lake community. Last year, the plant produced 75 million gallons of water. The plant is capable of producing 400k gallons of water per day. The highest daily demand last year was 371k gallons in one day. Last year, numerous water quality complaints resulted in an engineering firm, IBI Group, being hired to investigate. After a comprehensive study, IBI Group gave a 37 page report which detailed the status of our plant. This report has been made available on the Choctaw Lake website, Next Door, and Facebook. The report says that our plant has been well maintained, but is well past its design life. Numerous violations have resulted in the plant being placed on an EPA Conditional License. The CU Board is currently exploring the various options that could be implemented to resolve ongoing issues. Numerous releases have been posted to Next Door and Facebook that detail current lines of effort. The CU Board is also meeting on a monthly basis to ensure any challenges will be resolved in a timely manner. Everyone is welcome to these meetings. 16 New Fishing Rules Reminder & Upcoming Tournaments! (by Brian Stewart) The current Fishing Rules are as follows: * Large/Smallmouth Bass: Catch & Release Only. * Wipers: Catch & Release Only. * Crappie: No minimum length, limit 10 per resident per day. Property owner guests are restricted to catch and release only. * Carp: No minimum length or limit. Carp are an invasive species harmful to our lake s water quality, and the habitat the fish we desire use for cover. Please do not release Carp back into the lake. For all other types of fish caught, such as Bluegill and Catfish, please practice good judgement in conserving this valuable natural resource. Spring has sprung, and for anglers that means it s time to get a line wet! Recently the Lake s fishing rules were updated to help preserve our precious natural resource, and to give the game fish species we stock the lake with an opportunity to recover their strength and numbers. Last season the Fishing Committee recommended making both Smallmouth & Largemouth Bass catch and release only. New signs were purchased and erected at the boat ramps, and at the dam. This year the Board of Trustees is officially adding Wipers to Bass as the catch and release only species. Wipers are a hybrid fish, a combination of a White Bass and a Striped Bass. The benefit to stocking them in our lake is they grow large quickly, and are tremendous fighters. The drawback is they do not naturally reproduce. The Fishing Committee also stocks the lake with Bass, and while they do reproduce, their numbers and size has declined over the last several years. It is believed these efforts will help bring the game fishing back to what it once was here at Choctaw Lake! There are two Fishing Tournaments on the 2017 Calendar so far. The first will be a Carp only tournament held Saturday, June 10th. This will be a hook & line or bow fishing tournament with a goal of helping to reduce the Carp population in the lake. This tournament is being put on by the Fishing Committee, and the Fundraising & Volunteers Committee who will provide the prizes which will be award for the three largest Carp weighed in. Also, the annual 4th of July Choctaw Lake Fishing Tournament is scheduled for July 3rd. This is a catch and release only tournament with multiple categories. More details will follow on both of these events. Guests fishing without a Proper Owner present must have a Guest Pass with them, and practice catch and release for all species at all times. The Lake Patrol is encouraging Property Owners to contact them if you see someone fishing that you have reason to suspect does not live here, for instance their vehicle does not have the proper Choctaw Lake decal, or is not displaying a Guest Pass. You can reach them at the Guard Shack at , or call the Sheriff s dispatcher at who will contact them for you. Enjoy the fishing, and catch a big one!

19 There They Go Again See those old men out on the lake in a boat? They are out there testing the lake water again this year. The key to controlling the growth of blue-green algae is to stay one step ahead of it which is exactly what they are trying to do. One of those old guys is testing WATER CLARITY because when the algae increase the clarity decreases. This is a warning sign that things are changing in the lake, and not in a good way. Another is taking the lake s TEM- PERATURE. As the days get warmer the water gets warmer. As the water warms the blue-green algae get more comfortable and start to multiply. Ph (a measure of acidity) is being recorded to set a baseline for the lake this year. If the ph changes more than incrementally the reason for that change needs to be determined. When algae are actively growing they produce oxygen due to photosynthesis. By routinely measuring the OXYGEN CONCENTRATION in the water a baseline is established. If oxygen levels were to begin increasing rapidly it would indicate that algae are also increasing. The blue-green algae that we worry about is really a bacterium, and it is different from green algae, which is actually a plant that feeds the fish. Blue-green cyanobacteria produces the microcystin toxin this toxin is the real worry and why we do all the testing. The blue-green pigment that gives the cyanobacteria its color is phycocyanin. Measuring PHYCOC- ANIN tells us how much pigment is in the water. If it increases it is telling us the blue-green algae is increasing and there may be a problem. Those are the five measurements that are routinely being taken by those old men in the boat. If they have results that tell them the blue-green algae are actively growing they can decide to send samples for testing to determine exactly what kind of algae are growing and the concentration of the microcystin toxin (the main concern). That takes several days and definitively determines if the lake needs to be treated. Or, if significant changes occur rapidly in just the few days between measurements, the water can be treated immediately to stop the algae growth before it becomes a problem. By using results from these five tests, and by tracking changes in the test results over time, the people doing the testing begin to see patterns in the lake s behavior. The idea is to watch for the kinds of changes that often precede algal growth and go for an early intervention while being very careful not to treat unnecessarily.
