1 1 Town Board Meeting August 12, 2015 Supervisor Walsh called the meeting to order at 7PM with the Pledge to the Flag at the Rondout Municipal Center. Supervisor Walsh asked to remain standing for a moment of silence for Joan L. Weir, George B. Regan and Kathleen Davis. EVENTS: Rosendale Runs- October 10 th Art Festival sponsored by WSW- Whole month of August Bill Brooks (Town Historian) - Hosting a walk on 8/16 at 3PM at Willow Kiln Park Supervisor Walsh had the following amendments to the July 8 th meeting minutes: *Deb Tierney s title should read Clerk to the Justice *page 2- should read 100,000 bottles *page 3- effective date for Chris Heimink s resignation should be 7/19 - correct spelling of Scott Schaffrick - correct to read Army Corp Supervisor Walsh made a motion to accept the minutes for the July 17 th meeting and as amended for the July 8 th meeting, seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES Councilman Pryslopski reported the Transfer Station bringing in $3, with $ in bottle deposits for the month of June and $3, for July with no bottle deposits. Councilman Pryslopski stated he was only able to review Judge Pape s books due to the change

2 2 of Justices and his books are reconciled. Judge McGinty s books will be able to be reviewed next month. The Chamber of Commerce has no news and the Environmental Commission will be hosting Creek Week with the Town of Rochester September 20 th. Councilman Ryan reported the Highway Department bringing in $25 and they have been out patching roads. The weed crew has been hard at work. Councilman Ryan stated the Water Department bringing in $29, and Sewer had $24, for a total of $53, He also said they are taking bids for the plant and Main Street work. The meters have changed as to what was in the original plans at the recommendation of the Water/Sewer Superintendent. The food pantry has nothing to report nor does the Zoning Board of Appeals. Supervisor Walsh wanted to comment on the work by Fann s Plaza by stating Highway Superintendent Gallagher has been working with DOT to fix the drainage problems and that NY Rising will be addressing it further. She also stated they have been using the weed crew to clean the drainage to the flood control since they were ahead of schedule. Councilman Hughes reported the Building Department has been very busy bringing in $4,381. He also said they are having a bit of a challenge with the Code Enforcement follow-ups. The Assessor s Office is preparing to move as soon as the Governor signs off on the Legislation and they had two assessment complains, both commercial. The Planning Board took in $ in July and had 3 Public Hearings at their last meeting. Their next meeting is 8/13 at 7PM and there are 2 Public Hearings on the agenda. The Economic Development Commission has no meetings for July and August as they didn t have a quorum for either. Councilman Hughes stated that they are in need of members and if anyone is interested volunteering for the Economic Development Commission please fill out a volunteer application and turn it into the Town Clerk s Office. The Bookkeeper s books have been reviewed and reconciled. Councilwoman Metzger said the Recreation Commission took a tour of the grounds to see what work needs to be done to try and figure out if it can be worked into the budget. They will be contacting an engineer to look at the tennis courts. The Recreation Department brought in $1, The pool construction is finally underway. The Youth Center will be getting donations from the food pantry for snacks. Camp is entering their third session and enrollment increased 50% over the past month. Camp has been getting good reviews. The Youth Commission is going to be putting together a monthly newsletter for the activities around town. They are putting together a fall field trip to go apple picking. The revenue was $3, which was mostly for camp. Councilwoman Metzger said the Town Clerk s office has been busy and had an income of $7,776.25, the Police Department took in $30 and Dog Control took in $95. Councilwoman Metzger said they are still looking for a Deputy Dog Control Officer and it is posted on the Town s website. SUPERVISOR S REPORT: Read and on file

3 3 Councilman Pryslopski said he received an application for the Environmental Commission for Danyelle Davis. He said Danyelle works for New York State Department of Environmental Protection and previously served on the Town of Rochester Environmental Commission before she moved to Rosendale. Councilman Pryslopski made a motion to appoint Danyelle Davis to the Environmental Commission with a term ending 12/31/2016, seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. Chief Soule introduced an officer that he would like to hire. He said Janay Gasparini has been a police officer for 10 years with the last 5 being with City of Poughkeepsie where she then went into being a teacher at SUNY Dutchess with the Criminal Justice Department. Councilwoman Metzger made a motion to hire Janay Gasparini as a part time Police Officer at $17.45 per hour, seconded by Councilman Pryslopski. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. Chief Soule also wanted to mention a picture that was posted on the police department s Facebook page. He said the picture of an eagle on Main Street received 36,000 views. Supervisor Walsh made a retroactive motion to hire Joseph Galewaler for the weed crew at $8.75 per hour, seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. Town Clerk opened the Public Hearing for the Chicken Ordinance at 7:28PM with the reading of the publication. Debra Foley (Main Street Bloomington) - likes aspects of this law with what it is trying to do. She said it is trying to balance needs with the people who want chickens and people who don t. She is concerned it is so detailed and requires so much that it takes away from individuals. She is concerned about needing to get the approval from neighbors when there are things in there to make sure it wouldn t inconvenience the neighbors. She is concerned that it will give her neighbors so much power and that it takes away ones right to have pets. She also doesn t feel that a special use permit is necessary. Kelleigh McKenzie (Mountain Road Rosendale) - As a ZBA member she would like to express her gratitude to the Town Board for finally taking up this legislation because it has been a difficult issue for the Zoning Board for a number of years. As a resident she agrees with Debra Foley. She doesn t believe a special use permit is necessary and that just a building permit should be okay. She doesn t agree with the legislation about not keeping the manure for composting when it is one of the key components of having chickens. She doesn t see a logical reason for it. If it is a reason for odor then maybe having to enclose it would be okay. Another of her concerns is the neighbor consent requirement. It could possibly open up allegations for

4 4 discrimination and it isn t specific if a neighbor can change their mind. Also, if there are two owners on the deed do you need permission from both? What happens if there is a foreclosed or vacant lot next to you? She said that the owners should notify the neighbors of the number of chickens, the rules and how to get ahold of them if there is ever an issue. Eileen Brophy (Davis Street Rosendale) - glad that it is finally getting addressed. Her concern is the size of the property. She thinks there should be a one acre minimum to have 6 chickens. She likes the no rooster part. Nick Mercurio (Cottekill) - said it seems heavy handed and that if there is limitations for chickens then there should be limitations on other animals as well. He asked if the existing chickens would be grandfathered in. He believes that ownership should be a right without having to jump through hoops. Anne Mardiney (Rosendale) - said she has had chickens for years. She feels that needing to get permission from neighbors should be dropped. She also feels that having to get a special use permit is heavy handed. She has never had an issue with the smell from the compost. She does believe that the food should be kept in a building and not just in a container. She also wanted to know if the existing chickens will be grandfathered in. Naja Kraus- (Park Crest Rosendale) - said she is a member of the Environmental Commission and while she is happy that this is being addressed this was not the law that the commission handed in three years ago. She said this proposed law seems heavy handed. She said she also has an issue with the consent and she has never had smell from the compost. She said she was unclear about the area and what needs to be covered or just the coop needs to be closed. She said that a coop would fall under the existing building permits. She would also like to see the number of chickens increased to possibly 10 since you can only buy chickens by the half dozen. Robert Skerritt (Park Crest Rosendale) - he said that he loves chickens and that he feels the size restriction is small. Supervisor Walsh said she will leave the Public Hearing Open at 7:53PM. After a discussion among the board it was decided for written comments only. Supervisor Walsh made a motion to keep the Public Hearing open until 7PM September 9 th for written comments only, seconded by Councilman Ryan. Roll vote done by Town Clerk. ROLL VOTE: 5 YES.

5 5 Supervisor Walsh made a motion to send a copy of the local law to the Rosendale Planning Board and the ulster County Planning Board, seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. Town Clerk opened the Public Hearing for the Outdoor Heating Appliances law at 7:55PM by reading the publication. Deborah Weltsch (Tillson) - wanted clarification on a few things. She received it from the Board. She said she was on the Environmental Commission when the law was reviewed. She said they have dangerous health hazards and would like to see the burn period to stay as is. She proceeded to give examples of emissions. Julie Novak (River Road) - said she is against amending because of the health dangers from the particular and pollutants. Naja Kraus (Park Crest Rosendale) - said she is against amending because she feels it ruins the balance. She said that neighbor s rights aren t being considered by extending the burn period. Public comments ended at 8:05PM. Supervisor Walsh made a motion to keep the Public Hearing open for written comments only until 7PM on September 9 th, seconded by Councilman Hughes. Roll vote don t by Town Clerk. ROLL VOTE: 5 YES. The Tillson School Site Plan was discussed with the steps that need to be taken. Attorney Christiana joined the discussion on the procedure. Attorney Christiana suggested having the Ulster County Planning Board look at it and give input as they are working on it. Supervisor Walsh said she had no objections to that. It was mentioned by the developer that the unit count decreased from 60 to 48 which made it possible to make the other units bigger. The updated plans were shown to the Board and they had a discussion with the owners. Mary Alroy presented the Rosendale Runs Site Plan with Tara Burke. Mary said she has contacted Chief Soule and Highway Superintendent Gallagher already. Supervisor Walsh said she needs to talk to Williams Lake and Wallkill Valley Land Trust. Town Clerk said she would need to contact Ulster County since County Roads are involved and to forward all the letters to her so she has them on file with the site plan. Mary said there will be a fitness expo from 4:30PM-9PM the night before the run (10/9) at the Recreation Center. She has invited health related businesses to come to it and there will a pumpkin carving contest as well. Town Justice

6 6 McGinty will be choosing 5 winners which will be lit and line the cave for the run. Councilman Hughes asked if the run will be held rain or shine and Mary said yes. Councilwoman Metzger asked the times the races will be starting. Mary said the half marathon will be starting at 8AM, the 4.4 mile run/walk is at 8:30AM and the kids run is in the ballpark starting at 10AM. Tara said there is a 2 hour free DJ dance party. It was asked if any of the roads will be closing to which Tara said no. Mary said they will be doing raffles for donated gifts/ gift certificates from various businesses. Shawangunk Adventures Site Plan will be reviewed and there should be a representative present next month to go over the details. Supervisor Walsh said she received a letter from UCRRA saying that only 11 towns have signed the contract with them. Supervisor Walsh asked if the Town should make a commitment with them. She explained that the rates may increase however they will have a public hearing for those increases. Supervisor Walsh said towns are looking for alternatives. She said she thinks we should go forward. The Board discussed options. Supervisor Walsh made a motion for the Supervisor to draft and send a letter stating we are interested in staying with the contract. Motion was seconded by Councilman Hughes. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale authorizes the Supervisor to sign agreement with Hudson Valley Office Equipment for the Justice Court on behalf of the Town of Rosendale. Motion was seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale hereby authorizes the Supervisor to enter into contract with Williamson Law Book Company for the software program for the Town Clerks Office, seconded by Councilman Hughes. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale hereby authorizes the Supervisor to enter into contract with Williamson Law Book Company for the software program for Water/Sewer Department billing, seconded by Councilman Ryan. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale authorizes the Supervisor to sign agreement with Greenleaf Energy Solutions for interior lighting upgrades at the Rosendale Recreation Center on behalf of the town of Rosendale, seconded by Councilwoman Metzger. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale authorizes the Supervisor to sign agreement with Greenleaf Energy Solutions for interior lighting upgrades at the Rosendale Youth Center on behalf of the town of Rosendale, seconded by Councilman Hughes. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale authorizes the Supervisor to sign agreement with Technical Building Services, Inc. for the maintenance service agreement for the Rondout Municipal Center on behalf of the Town of Rosendale, seconded by Councilman Ryan. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. RESOLUTION : Supervisor Walsh made a motion that the Town Board of the Town of Rosendale/ Location code hereby establishes the following standard workdays for these titles and will report the officials to the New York State and Local Retirement System based on time keeping system records for their record of activities: Elected Officials: Town Supervisor, Town Clerk, Highway Superintendent, Town Council and Town justice. Appointed Officials: Police Chief, Clerk to the Justice, Assessor, Deputy Dog Warden, Water and Sewer Superintendent, Deputy Highway Superintendent and Deputy Town Clerk. Motion was seconded by Councilman Pryslopski. Roll vote done by Town Clerk. ROLL VOTE: 5 YES. Councilman Ryan made a motion to take a 5 minute break, seconded by Supervisor Walsh. All in Favor. Break Started at 9:04PM and ended at 9:10PM. Supervisor Walsh made a motion to enter into Executive Session at 9:10PM to discuss the employment of particular employees, seconded by Councilman Hughes. 8 8 Executive session ended at 10:15PM. Supervisor Walsh made a motion to increase Debra Tierney to 40 hours per week effective immediately until 12/31/2015, seconded by Councilman Pryslopski.
