1 DONNER LAKE PROPERTY OWNERS ASSOCIATION August President s Column by Gardner Combs At last a Beach Clean Up with no snow on the Beach! Jim Saunders and crew oversaw a rapid and effective policing of the winter debris and we opened the Beach for the Memorial Day weekend. As August approaches we are settled into the familiar routine of summer at DLPOA. The BBQs are going, boats launched and plenty of sun and sand to go around. The General Membership Meeting and Election was held the weekend of the 30 th of June. Once again we have the opportunity to welcome a new member of the Board of Directors; Arthur Scotland. The association is always looking for ways to expand the participation of the membership. Our Election Committee chaired by Sandy Gustafson presided over the collection and counting of ballots. The results are presented in the body of the newsletter. leavings. As the other developments continue to require the use of the boxes we are becoming the buffet of last resort. The more boxes we install the less of a problem we will encounter in the future. So pick a color, green or brown, and let s keep the bears at bay. Please plan to attend the General Meeting on Saturday the 1 st of September as we are winding down the summer and getting ready for closing for the winter. Enjoy the Beach and the beautiful surroundings of Donner Lake. The annual Sand Castle Contest was a great hit this year. A record number of entries were accommodated at the water s edge and as usual much imagination and artistic talent was displayed in the final results. The Burden family did their fine job of organizing and preparing for the event. They solicit the prizes and prepare the certificates that will grace many a wall or refrigerator. Thanks again to them for the annual help with this tradition. We will include information on bear boxes in the next newsletter and on our website. Our ursine friends are becoming more and more interested in our leftovers and

2 2012 SAND CASTLE/SCULPTURE CONTEST The Burden Family would like to AGAIN THANK ALL the participants, volunteers and local merchants who helped us with this year s Sand Castle/Sculpture Contest, our Thirteenth Year the time does go fast when you are having fun!! We were very pleased with the participation since the contest had to be scheduled so early this year. There were 30 sandcastle/ sculpture entries which included 87 fun-loving participants!! We are greatly appreciative of Bruce Johnson and Bob Solazzi who again volunteered to help us set up the contest, starting at 7:00 A.M.! Also, great kudos to our outstanding and courageous judges: Sue Adkerson, Jeanette Grant, Donna Leek, Ken Leek and Fran Macomber. All the judges stated that it was extremely difficult to select the division winners again this year tight competition as usual!!! A special THANK YOU goes to the beach manager, Jim Saunders, for cleaning/raking the beach so the sandcastle/ sculpture crew could begin setting up the contest shortly after 7:00 A.M. Jim also made sure that we had the PA system to announce the division winners. Many thanks to all these volunteers!!! 7 Donner Lake Property Owners Association GENERAL MEMBERSHIP MEETING June 30, 2012 Preliminary Minutes A regularly scheduled meeting of the General Membership of the Donner Lake Property Owners Association (DLPOA) was held on Saturday June 30, 2012 at the DLPOA beach. Call to Order President Gardner Combs called the meeting to order at 10:05 AM. Board members present: President Gardner Combs, Vice-President Scott Denny, Secretary/Treasurer Barry Silberman, Barbara (Barb) Lewis, Sue Adkerson, Sandy Gustafson-Ripsteen, Greg Henderson, Robert Farnsworth, Juanita Schneider, Bill Faustine, Dick Anderson, and Chet Eccles Others present: Chief of Operations Raymond Hapai, Beach Manager Jim Saunders, Recording Secretary Judy Friedman and approximately 60 members. Approval of Minutes of September 3, 2011 General Membership Meeting Motioned/Seconded/Passed to approve the minutes of the September 3, 2011 General Membership Treasurer's Report Barry Silberman Barry reported that last year at this time there was $102,000 in the bank. This year there is $119,000. So far 68 members have not renewed. Chief of Operations Report Ray Hapai Ray reported there are 13 new DLPOA members and 9 inherited members. He reminded everyone that those who purchased boat stickers can pick them up at the beach. He clarified the entry procedures, noting the permanent ID card costs $5 and will be automatically renewed when dues are paid. A lot of Association information can be found at Gardner said Sharon and Ray work hard for the Association and field about 150 calls each month. Ray and Sharon were thanked by a round of applause. Beach Manager Report Jim Saunders Jim welcomed everyone to the new season at the beach. There was a wonderful turnout for the Beach Cleanup, which only took about 2 hours. He noted the loss of 1 tree and said there has been a bear on the property. Committee Reports 1. Beach Committee Greg Henderson Greg reported the tire boom has been repaired as much as is possible. He said the 5mph buoys that were stolen have been replaced. Greg explained some other repairs that have been done and said a new kayak rack and picnic tables are being ordered. Gardner explained the Town of Truckee ordinance requiring animal proof containers and encouraged everyone to consider installing bear resistant trash containers because more bears have been sighted in the area. Board Election The election tally was not available when the meeting adjourned, so the results will be posted on the website. 8 DLPOA General Membership Meeting June 30, 2012 continued from page 7 round. A round of applause followed. A question was asked about a member directory. Gardner explained the current directory is purely voluntary and includes only those members who want to be included. The forms are included in the renewal package. A member suggested the directory be posted on the members section of the web site. Chuck Perez, who is updating the Beach Track directory, said updated information has been compiled. An owner asked about picking up their cards. Gardner explained the cards can be done at any time as long as the names are on the membership form and the person requesting the card has ID with them. A question was asked about renter s passes versus the daily fee. Gardner clarified the renters card is available for those owners who rent their homes A guest card is for member s guests who will be at the beach but unaccompanied by a member. Greg explained how memberships and geographic boundaries are outlined in the Bylaws. A question was asked about how the guest card works. Gardner explained the rules state that members must be on the beach with their guests; however that is not always practical all day long. If the guest pays the daily fee, they can come and go as they please. Date, time and location of next General Membership meeting: Saturday, September 1, 2012 at 11:00 A.M. on the beach, west end of Donner Lake Adjournment There being no other issues to come before the Membership, the meeting was adjourned at 10:42 AM. An owner asked if the new policies and procedures regarding renter cards should have come to the membership for a vote. Gardner explained that the Board is elected by the membership and empowered to make those decisions. Legislating by a committee of 745 members is very difficult. He noted the ground swell of sentiment last summer having to do with rental issues and some of the arrogance and disregard for rules the staff had to deal with, the preponderance of which was from renters. At the October Board meeting there was quite a bit of sentiment to establish ways to acquaint renters with the rules and be respectful of the beach. That led to setting the fee relatively high. There was a quick response from the membership about the fees and the Board revised the renter and guest card fees at a special Board meeting. An owner asked for the changes to be clarified. Greg explained the Board s decision that the rental card is $200 and an additional $50 for every week the card is used. With the new card system, use can be easily tracked. The other option is to pay $8 per day of use. The information is available on the website. 8

10 Donner Lake Property Owners Association BOARD OF DIRECTORS MEETING June 29, 2012 Minutes A regularly scheduled meeting of the Board of Directors of the Donner Lake Property Owners Association was held on Friday June 29, 2012 at the Cedar House Sport Hotel, Brockway Road in Truckee, California. Call to Order / Introductions President Gardner Combs called the meeting to order at 1:04 PM. Board members present: President Gardner Combs, Vice-President Scott Denny, Secretary/Treasurer Barry Silberman, Robert (Rob) Spies Barbara (Barb) Lewis, Sue Adkerson, Sandy Gustafson- Ripsteen, Greg Henderson, Robert Farnsworth, Juanita Schneider, Bill Faustine, Dorothy Dube, Chet Eccles, and Dick Anderson Others present: DLPOA Member Karl Von Tagen, Beach Manager Jim Saunders, Chief of Operations Raymond Hapai, Sharon Hapai, and Recording Secretary Judy Friedman. Approval of minutes of May 26, 2012 Board meeting It was moved by Scott and seconded by Juanita to approve the minutes as presented. Motion carried unanimously. Secretary - Treasurer's Report Barry Silberman Barry reported the Association financial situation is a bit better than last year at this time. As of June, there is $119,000 in the bank. Chief of Operation s Report Ray Hapai Ray presented his report, indicating that income from yearly dues are $3800 under that of last year. At this point 68 members have not renewed. Sales of renter cards are down, but guest cards are up. There has been a $22,000 increase in revenue from new members, which brought revenue over budget. Expenses are lower than budgeted because the erosion control project has not commenced, the Beach Manager is keeping a better eye on payroll, and utilities are lower than anticipated. Sharon fields about 150 phone calls and 150 s each month, mostly answering questions about the new rules. Overall, members like the new entry system. He offered kudos to Jim s crew, who is doing a great job with the system. Gardner thanked Ray and Sharon for all they do for the Association. Beach Manager Report Jim Saunders Jim reported 125 people helped with the Beach Cleanup and it took only 2 hours to do the whole beach. Because of the windy, cool weather, not a lot of people have been coming to the beach. Bears have been sighted on the property. Jim reported on a domestic squabble that started at the beach, but ended at the person s home. Truckee police responded. Beach Committee Report: Greg Henderson Greg reported he and Bill Faustine have repaired the tire boom as best it can be.. The missing 5mph buoys have been replaced. Greg showed samples of logoed hats and sweatshirts that could association members could buy from the vendor if we posted it on the website. Greg noted that although nothing new has been ordered for the beach, new picnic tables are needed and at least 1 more kayak rack. Discussion followed. Bill Faustine noted that the tire boom is going to be a continuing problem and will have to be replaced at some point. Dick asked whether some bumpers or other material could be added to the boat ramp to better protect boats from damage there.. Discussion followed regarding potential alterations to the dock and other options, but basically boaters should use their own bumpers to protect their own boats. continued on next page 10

11 DLPOA Board of Directors Meeting June 29, 2012 continued from page 10 Membership Committee Report Barbara Lewis Barbara had nothing to report, other than the issues to be discussed in Executive Session. Old Business There was no Old Business presented. New Business 1. Possible need for lawyer on retainer Barbara Lewis This item was discussed in Executive Session. 2. Reschedule October Board meeting Barbara Lewis The October Board meeting was changed from October 20 to October 27 at Cedar House Sport Hotel.. 3. Bear-proof garbage containers Greg Henderson Greg referred to an he sent to Board members about property owners keeping their trash in bear resistant garbage containers since there has been an increase in bears in the area. He has since learned Town has an ordinance requiring trash to be kept in an animal resistant manner. He suggested a meeting with people from the Town and sending a letter noting the ordinance to DLPOA members. Discussion followed on ways to advise members of the ordinance and encourage compliance. Gardner pointed out DLPOA is not a homeowner s association and has no authority to enforce the rule. An article will appear in a newsletter with suggested providers for bear-resistant containers. It was moved by Scott and seconded by Robert to approve planting a tree to be provided by the family. Motion carried unanimously. Mr. Von Tagen addressed the Board explaining why his membership has not been paid since Discussion followed regarding possible remedies to the situation. Mr. Von Tagen was asked to submit a proposal for Board review. Executive Session was convened at 2:12 PM Open Session was reconvened at 3:00 PM and the following action taken: It was moved by Juanita and seconded by Scott to notify a member of the intent to suspend her membership for 365 days from the date of the Board voting to do so because of destruction of DLPOA property. Motion carried unanimously. Remarks and Criticisms There were no additional remarks. Date, time and location of next board meeting: Friday, August 31, 2012 at 3:00 PM at Larkspur Motel in Truckee, California. Adjournment There being no further business to come before the Board, the meeting was adjourned at 3:00 PM. Gardner reported DLPOA has been acknowledged as a major sponsor of the fireworks show. He said the Town of Truckee is initiating a quagga mussel boat inspection program. At this point, the plan is to have Town staff at the DLPOA boat launch next summer directing people to inspection stations. Sue submitted a request for the Board to consider a request to plant a tree at the beach in memory of an owner s daughter. 11

Call to Order / Introductions President Gardner Combs called the meeting to order at 1:00 PM. Board members present: President Gardner Combs, Vice-President Scott Denny, Secretary/Treasurer Barry Silberman, Barbara (Barb) Lewis, Sue Adkerson, Sandy Gustafson-Ripsteen, Greg Henderson, Robert Farnsworth, Juanita Schneider, Bill Faustine, Dorothy Dube, and Dick Anderson Board members absent: Robert (Rob) Spies and Chet Eccles Others present: Beach Manager Jim Saunders, Chief of Operations Raymond Hapai, Sharon Hapai and Recording Secretary Judy Friedman. Members present were: Jon Weatherwax, Virginia and Michael Genovese, Jim and Diane Chesler, Glen and Linda Common, and Neil Didrikson Approval of minutes of October 20, 2011 Board meeting These minutes were approved at a Special Board meeting on November 14, Secretary - Treasurer's Report: Barry Silberman Barry reported renewals and boat registrations have been coming in, which is improving the cash flow. The bank balance is $119,000. Chief of Operation s Report: Ray Hapai Ray presented his report dated May 26, There are 9 new members and 8 inherited memberships. There are currently 771 memberships. Ninety-two members have not yet renewed and there are 28 memberships available. Guest and renter cards have been reactivated as appropriate and many new family members have been added. He explained the procedures he and Sharon are doing for the summer opening. Election packets have been sent to the printer. There are five candidates for the four seats available. Beach Manager Report: Jim Saunders Jim reported there are 3 new staff members and 4 returning employees. One additional position will remain vacant for now. Beach Committee Report: Greg Henderson Greg reported there are no major projects planned for this summer, except maybe work on the tire boom. Three of the five 5 mph buoys need to be replaced. The only way to prevent the suspected vandalism is to take them in every winter. Dick asked if more padding could be installed around the docks. Greg will check into it. Old Business There was no Old Business presented. New Business Jim and Diane Chesler thanked the Board for their time and efforts for the Association. Mr. Chesler was an organizer of the Horseshoe Tournament and although he appreciated the time they used the beach, he questioned the $1000 fee being charged for rental cards to owners who rent their homes and suggested the fee was instituted to make up for the loss of the Tournament fee. He has friends who have lost rentals as a result of not being able to pay for the rental card. Mrs. Chesler presented two s she has sent about the issue but did not receive any response. She questioned the communication between the Board and membership. continued on next page 12

13 continued from page 12 DLPOA Board of Directors Meeting May 26, 2012 Mike and Virginia Genovese thanked the Board for their time. Mr. Genovese echoed Mrs. Chesler s comments about the lack of communication between the Board and membership. Of particular concern is the rental card fee. He does not feel $1000 is reasonable and suggested the high fee sends a message that renters are not welcome on the beach. Linda Common stated that although she does not rent her home, she has 5 children and 7 grandchildren and is concerned that at some point, one of her children will not be able to inherit the right to use the beach. She offered to be part of a discussion regarding that issue. On behalf of the Board, Gardner responded to the concerns raised. A point had been raised about rental agents advising renters of the rules and Gardner said the Association has no control over how renters are advised of the rules, noting that most infractions are caused by renters. There had been no sentiment expressed by Board members to stop the horseshoe tournament, but there had been many issues discussed relating to the tournament such as parking, beach access, and enforcing rules. Among the issues most discussed by the Board are the budget, how to enforce rules, and inherited memberships. Discussion followed regarding how to advise renters of rules, enforcement, and the rental card fee. Beach Manager Jim Saunders described instances where staff has had problems enforcing rules, saying that about 60% of the problems on the beach are from renters. It was suggested that the members be asked about allowing renters on the beach, but there was caution that many members may vote for no renters at all. Discussion continued as possible solutions were considered. Gardner acknowledged that communication between the Board and membership needs to be improved. Intermittent communications via blasts may be one option. 1. Memorial brick for Pat Sutton/ Scholarship Sue Adkerson Sue reported Pat Sutton, a great supporter of DLPOA in particular and the community in general, passed away. Her husband Bob has started a garden in her name at the Donner Lake Public Utility District building and Sue suggested the Association purchase an engraved brick. The cost is $140 and ½ is donated to a high school scholarship in Pat s name. It was moved by Sue and seconded by Bill to approve $140 to purchase an engraved brick in the garden and scholarship honoring Pat Sutton. Motion carried with Barb abstaining. 2. Review property transfer/gifted properties - Membership criteria, discuss continuing problem of hijacked memberships and membership numbers w/examples Barb Lewis Barbara presented her written report outlining issues she is dealing with to clarify how the Bylaws are interpreted as regards memberships. Part of the confusion has to do with the fact that the revised Bylaws went into effect December 31, Before that time there was just a membership. Secondly, the age of the children needs to be addressed because some people are falsifying forms by listing their children as siblings, because of the numbers immediate family members can inherit. Gardner suggested those who were involved in the revision of the Bylaws be included in a meeting about addressing these issues. That meeting will be convened the weekend of the Annual Membership Meeting. Gardner asked for action to approve the Beach Manager s contract. The renewal has the same terms as last year. It was moved by Juanita and seconded by Greg to renew the Beach Manager s contract. Motion carried unanimously. Sandy volunteered to be on the Elections Committee. continued on next page 13

Zander revocation vote & how to handle any attempts of other DLPOA members to bring any revoked member to beach; Von Tagen membership Barb Lewis Open Session was reconvened at 2:52 PM. The following action was reported: It was moved by Juanita and seconded by Dick to revoke the Zander membership. Motion carried unanimously. Remarks and Criticisms There were no additional comments. Date, time and location of next board meeting: Friday, June 29, 2012 at 1:00 PM at Cedar House Sport Hotel, Brockway Road, Truckee Donner Summit Saved from Development The Trust for Public Land and Truckee Donner Land Trust reached an agreement last week with a court-appointed negotiator to purchase the 3,000- acre Royal Gorge property at Donner Summit after a proposed 950-home development at the site slipped into foreclosure. "This is the most important conservation acquisition in the Sierra Nevada in a generation," said Tom Mooers, director of Sierra Watch, a nonprofit in Nevada City. "Some people call it the most important square mile in the American West. It's that important." 15 Flashes from the Past in DLPOA by Robert Farnsworth and Tom Murphy Picnic Committee Report by Scott Denny (The following is extracted from the DLPOA Newsletter of June, 1981, written by Bill Hauck, President of DLPOA at that time.) After a good member turnout for our workday during the Memorial Day weekend, the Beach is ready for your use and enjoyment. John Nickelson who managed the beach in 1979 has just graduated from Chico State and will manage the beach for us once again this summer. He will be assisted by Kathy Larsen and Andy Clark. The beach will be open and supervised seven days per week from 8:00am until 9:00 pm. The gates will be closed and locked each night at 9:00pm. The walk-in gate will remain open at all hours Guests and Renters: The following fees will apply: Daily Adult: $1.00; Daily Child: $.50; Weekly Adult: $5.00 (seven days beginning on any day); Weekly Child: $2.50.Renters must present the Renters Card at the gate for admittance. Guests (of members) are admitted without charge when accompanied by a member or when a member is physically present in the Donner Lake area and telephones or writes a note to the Beach attendant to introduce his guests. If the member is not at the beach or in the Donner Lake area, the guest must pay a fee in accordance with the schedule outlined above. Improvements: The Board has authorized the purchase and installation of new gates for the Beach entrance. Two 12 feet wide gates will be installed which should make vehicle and boat entry much easier. July 4 th Picnic: This year for the first time we are going to combine our General Membership meeting with our Annual July 4 th Picnic. The Membership meeting will be conducted on Saturday, July 4 th at 10:00am on the beach followed by the picnic at 12 noon the same day. As we did last year, we will conduct the Picnic informal. Soft drinks and beer will be sold as well as hot dogs. We would ask everyone to bring one dish of your choice to contribute to the event. 15 This year s DLPOA barbeque was on July 3; we returned to a format of previous years of cooking the main course ourselves. So we cooked hot dogs and hamburgers and otherwise provided potato salad, macaroni salad, and cookies. We charged one price for each person: three bucks. A soft drink would cost you another $.50 or a beer for a buck. Since our costs were low we were able to provide a meal with a drink for under $5.00 without outspending our receipts. Over the two days we served approximately 350 meals and had a good time in the process. I personally would like to thank the volunteers who helped make this possible. On the grill were Jack Ripsteen, Bruce Johnson, and Gardner Combs. Juanita Schneider, Bill Faustine, Laura & Leonard Wait were at their usual post selling tickets and Cathy Farnsworth collected them at the entry spot. Drinks were under the watchful eyes of Dick Anderson and Dennis Austin. Serving at the tables were Debby Denny, Cathy Farnsworth, Shelly Henderson and Margo Combs Robert Farnsworth (picnic committee co chairman) lumped supplies from the store room to the serving areas and/or took tickets at the entry, as needed. And Beach Manager Jim Saunders and his crew did a terrific job keeping things the premises spotless by timely emptying trash cans and otherwise helping us to set up and break down the tables, rope lines, and other props. Hopefully we will see you all next year!
