Motion in the name of Councillor Pat Crimmins Can the Manager ask the Traffic Department if there is any update on the right turn filter from the Howth Road to Donaghmede from Raheny Village as I am still receiving a lot of enquiries from local residents? In April 2009 the local residents in Raheny completed a petition with over 1300 signatures requesting this filter to be put in place Motion in the name of Councillor Seán Kenny That a report be provided to the area committee outlining the possible options for the development of Belmayne Town Square Motion in the name of Councillor Damian O Farrell This Area Committee agrees to honour the memory of the late Sean Dublin Bay Loftus former Lord Mayor of Dublin. In agreement with Mr Loftus s family and the Local Area Committee a suitable significant memorial will be decided upon. E.g. An existing walkway / promenade in his name Motion in the name of Councillor Damian O Farrell That this council holds the view that Public Domain manpower of one area of the city should not be increased at the expense of several other areas. We appreciate that managers be allowed manage and we are acutely aware that each and every area in the city is experiencing difficulties with lack of Public Domain resources. However the residents of each DCC area should be treated equally and all transferred staff should be returned to their original depots immediately Motion in the name of Councillor Damian O Farrell That this City Council believes in the theory that the polluter should pay. The current standing charge plus a small per lift charge should be replaced by an increased lift charge only. This would help to insure that Dublin City had a genuine Green waste collection system and would further reduce the amount of waste being collected. People are now very conscience of getting the maximum amount of light into their residence. Motion in the name of Councillor John Lyons That the Manager give an update on project to widen Santry Avenue at the eastern end, and will he further clarify the position with regard to funding this project and the time scale for completion of these works. 14 Chairperson and Members North Central Area Committee. 13 th September 2010 Priory Hall 1. Building Control; An investigation has begun under the provisions of the Building Control Act. This involves both a paper audit and on the spot inspections. 2. Planning Compliance issues: This case was mentioned in court on the 7th September. On that day, counsel for Coalport Ltd applied for a longer adjournment as the development is now in receivership and the receiver s legal team needed longer to examine the situation. The court re-listed the case for 12 October Fire Matters: Prosecution proceedings have started under the Fire Services Act. The fire prosecution is listed for the first time on 28 th September but the law agent advises that there is no certainty that it will proceed on that date. Given that this matter is before the courts the City Council is not in a position to make any further comment or report on the progress or otherwise of works associated with this issue. 4. Finances: A receiver has been appointed over the assets of Messers McFeely and O Mahony. We await further clarification from the Law Agent as to the implications of this position and will advise the councillors further when this information is available. 5. Communication with Residents' Association We attach a letter which was issued in late July to the residents' Association and local councillors in which the position of the City Council in relation to general regulatory matters was stated. 15 Flood Defence Unit & Projects Division, Strategic Planning & Project Management Divisions, Engineering & Environment, Dublin City Council, Room 409, 68/70, Marrowbone Lane, Dublin September 2010 Re: River Wad Catchment Study, Phase II Please find below an update on the proposals for the Wad Catchment:- 1. Nicholas O Dwyer Consulting Engineers are appointed as the consultant for the detailed design of the Clanmoyle scheme, and they are initiating detailed site investigation surveys. 2. We met some residents regarding the swale through the back gardens, (as part of the possible Clanmoyle scheme). We also had preliminary discussions with Clontarf Golf Club. Our consultants are drafting detailed drawings following these discussions. 3. Subject to the outcome of this process above, a formal application will be made to OPW for funding and approval. 4. Assuming local residents and golf club support proposals for Clanmoyle Scheme, Part 8 planning procedure is also required and statutory process will commence. Re: Motorcycle Track Project Alfie Byrne Road Open space Following presentation of the proposal to the North Central Area Committee, agreement was reached with Dublin City Motor Cross Club and Motor Cycling Ireland to carry out the construction of the proposed track at the open space at Alfie Byrne Road. Construction commenced on site in early summer and has consisted of the excavation of material, importation of suitable soil, the formation of the jumps and features of the motorcycle track, and the placement of boundary. The development of the track is nearing completion and Motorcycling Ireland through Dublin City Motorcycle Club, have been carrying out tests of the features constructed. Parks and Landscape Services Division proposes to grant a letting/licence to Dublin City Motorcycling Club to use this track. The proposed letting/licence(copy attached) which includes 15 no. conditions, including conditions relating to controls and insurances, has been forwarded to this club for their signing. It is anticipated that this club will hold their first events at this track facility towards the end of September 2010 subject to the licence agreement being completed. 17 Dublin City Council Motor Scrambling Track at Alfie Byrne Road General Conditions of Letting The letting of the Motor Scrambling Track at Alfie Byrne Road is granted to the Dublin City Motor Cross Club (DCMCC) on a year to year basis subject to the club undertaking to bide by the following terms and conditions: 1. The scrambling track at Alfie Byrne Road which is owned by Dublin City Council is being made available on an annual letting to Dublin City Motor Cross Club contact address :..on a year to year basis renewable annually on the 1 st January each year. 2. It is a condition of this letting that DCMCC is a properly constituted sporting club and is affiliated to Motor Cycling Ireland and in good standing with that body. 3. DCMCC accepts that the usage of the track is confined to bona fide members of the club only and approved visitors and will ensure as far as practicable that no other users will be allowed on the track. 4. DCMCC agrees that Dublin City Council is fully indemnified against all claims that may arise and that it carries full and adequate insurances in respect of both active participants, or involved in anyway in motor cycling activity. 5. It is condition of this letting that DCMCC accepts that the track has been constructed to an acceptable standard for motor scrambling by Motor Cycling Ireland under an agreement with Dublin City Council. 6. DCMCC members shall use authorised entrances only to gain entry and exit to the track. 7. DCMCC will provide adequate supervision and stewarding for all usage of the track. 8. DCMCC will be responsible for the behaviour of visitors using the track. 9. DCMCC shall satisfy itself that the track is fit for purpose and safe to use on an ongoing basis before usage. 10. DCMCC shall allow usage of the track from 10am each morning and no later than one hour before dusk each evening. 11. DCMCC shall be responsible for the removal of all litter generated in the track area. 12. No permanent signage can be erected or displayed unless with the express permission of Dublin City Council. 13. DCMCC shall ensure that noise levels generated through the usage of the track do not breach statutory requirements and that any conditions required by the City Councils Environmental Health Section be fully complied with. In this regard DCMCC shall carry out regular noise monitoring of the track when in full usage and shall not allow noise thresholds to be breached; and shall not permit any motor cycle not fully compliant with noise regulations to be used on the track. 14. No building or structure shall be permitted on the site unless it is fully compliant with requirements of the appropriate Planning Acts. 15. Dublin City Council reserves the right to terminate this letting should there be unacceptable breaches of the above conditions. 17

19 The Chairman and Members of North Central Area Committee. BUNRATTY ROAD PROGRESS REPORT Phase 1. Phase 1 consists of a total of 56 Social Housing units. ( 16 refurbishments and 42 new build ). An all weather playing facility and a playground. The all weather facility is open and work has commenced on the playground. To date 29 of the Social units are tenanted and the remaining 29 will be available to let within 2 to 6 weeks. ( Mid October ). Phase 2. Further to a meeting with the Departments Architectural Advisors on 9 th April2010 and a site meeting on 14 th April 2010, we sought approval from the Department on the 18 th May 2010 for the refurbishment of 32 existing maisonettes units on Bunratty Road, and the construction of 6 houses and 10 apartments ( all 48 social units ) on the Oscar Traynor road side and the demolition and fencing off of the remaining 6 maisonette blocks on Oscar Traynor Road. 21 6 th September To the Chairman and Members of The North Central Area Committee Meeting: 20 th September Clontarf Business Forum formed in February 2008 by DCC has a two monthly meeting schedule with very positive engagement from the businesses which also meet separately as Clontarf Traders Association. Community events have become part of activities promoted by businesses in close partnership with DCC. Advanced IT marketing strategies are in place in respect of local businesses. Future working agendas with this group will include the exploration of the tourist potential in Clontarf the possibility of twinning and crucially answering the immediate and medium to longterm interests /concerns of businesses in conjunction with DCC. Raheny Business Association know as RBA meets separately and the direct links are with DCC Raheny Tidy Group who promote Village enhancements and raise concerns /interests pertaining to both businesses and the community but with Village improvement as central to the Agenda. RBA are represented on the two monthly meetings through Raheny Tidy Association as concerns /interests regarding the Village are in many respects shared. Recent success of Raheny in the City Neighbourhoods is to be built upon widening the engagement with partners in GAA and other sporting organisations seen as the starting point. A meeting to advance this level of co-operation involving young people in Raheny is imminent Drumcondra Business Initiative is a grouping to support and promote businesses in Drumcondra. The group have a customer loyalty scheme in place and organise events /speakers for businesses independently. DCC interest in the area spans two area offices. The most recent meeting with the group was on the possibilities of running a community event at Christmas time. This is being supported jointly by both area offices. Potential exists to improve the area with engagement of businesses through the DBI. Fairview Business Forum The most recent business forum in Fairview was established in May It caters for businesses on Marino Mart, Fairview Strand and Annesley Bridge. Since then there has been a meeting in July and the next one will be in October The meetings were productive and covered a range of City Council responsibilities. Business agenda items and actions have covered ; Fairview Park Redevelopment, security in Fairview Park, parking and traffic difficulties in Fairview, Westwood/Barcode planning enforcement, water meters,drainage, flagpoles, and public lighting standards. It is considered that there has been a satisfactory start to the forum in that relevant local issues across a range of DCC services were raised and discussed in a constructive manner with positive engagement. A copy of this application is attached. The mediation service has provided services to tenants in the area over the past 3 years and it is considered that the service is a valuable one and one that offers an alternative to the more costly, lengthy and adversarial legal route. 23 Background to Mediation Northside Mediation Northside was set up by the Northside Community Law Centre in 2004 when a need for alternative dispute resolution process dealing with conflicts within the Community was identified. The Community includes individuals or groups that reside within the North East of Dublin. Community mediation supports people to deal with disputes early and encourages them to engage in working out their difficulties through a face to face meeting and negotiation at a local level. The service is available to all people in the catchment area, but we are particularly concerned with social inclusion and target vulnerable or marginalized people who would not otherwise be able to assess such service. Mediation Northside is a non-profit organization and relies on Government Grants Donations from Organisations Voluntary Contributions, and The voluntary services of its trained mediators Mission Statement: Mediation Northside provides an accessible dispute resolution and mediation service for local community. We recruit, train and support volunteer community mediators and empower community members and groups to resolve conflict at the earliest possible point in a dispute. Vision Mediation Northside is an innovative organization that constantly looks at ways to develop, to match the needs of the people we are in contact with daily, and to position ourselves to evolving situations and opportunities. Our vision is to be a driver in empowering people to live and work together in a safe and inclusive environment through mediation and training and to be a centre of expertise in community-based mediation, alternative approaches to dispute and conflict resolution, and related training. Values MN believes that: People should be able to live in their Community without fear or threat A mediation service should be available to all people within the Community People should be treated with respect and dignity People should be treated equally Structure of MN MN currently has one employee, who is the Manager of the Service and who reports to the Managing Solicitor of the Law Centre. Administrative support, including accounts and payroll tasks, offices are provided by the Law Centre. Currently we have 4 administration staff from community employment & 70 volunteers that deliver the service to the community. The mediators are trained by Mediation Northside. Over a 3 year period disputes that were resolved within the catchment area of North East Dublin: Tenants of DCC 2007 Community Mediation: 17 - Agreements: 8 (6 withdrew 3 were giving options to help resolve the dispute) 2008 Community Mediation: 62 Agreements; 41 The 11 cases that did not go to mediation were resolved through my self contacting the DCC team to help with ways of giving the clients options Community mediation 54 agreements cases referred back to DCC as there was no dispute they were just looking for options. 23

24 Mediation Northside have resolved a large number of disputes in other areas such as parental / elder mediation to DCC tenants. Current Climate The economic climate presents very real challenges to the organization. We are fortunate that our model of volunteering is working well. This allows us to provide the service within the community, where more than ever these services are needed. We have seen an increase in neighborhood/parental and workplace disputes. Many of these are a direct result of the change in people s financial circumstances and so our expectation is that this is likely to continue to increase. Mediation, as a dispute resolution option is known worldwide to be cost effective. It is therefore essential that the service continues to work in the community, empowering people to change how they live and work together in a more harmonious and peaceful way. We therefore request that Dublin City Council continue to support the service through a financial grant of Valerie Gaughran 24

The reason for the closure is to prevent anti-social behaviour. The proposed method of closure is by means of lockable gates. Statutory Requirement The statutory procedure involves giving public notice of the proposal in one or more newspapers circulating in the City and the affixing of that notice at each end of the right of way for a period of not less than 14 days. Any objections or representations made and not withdrawn shall be considered. The extinguishment of a public right of way is a function reserved to the elected members of the City Council. Service Check A service check has highlighted the following requirements: Dublin City Council Main Drainage Division The laneway has a trunk foul sewer running beneath and a manhole in the lane. This is a vital piece of drainage infrastructure serving the area and Dublin City Council will need access to it on a 24 hour basis. Drainage Division do not object to the closure provided that (a) access to the manhole can be maintained for a truck, (b) a key to the gate is provided to Dublin City Council Drainage and (c) that no structures/materials or vehicles are placed over the sewer. Residents have agreed to comply with the above requirements. Recommendation I recommend that this Committee approve of the extinguishment of the public right of way over the area shown on Drawing No. R.M , for consideration later by the City Council. Once the lane is closed, the residents will be responsible for the maintenance and repair of this gully and the pipeline which connects it to the public surface water sewer. Residents have been informed and agree. Eircom Eircom have substantial plant at this location. The Residents have signed an agreement with Eircom to allow access at all times. They have also agreed not to erect or place any concrete surface on the right of way or to build any building or structure whatsoever thereon. UPC Residents agree to allow UPC access to a pole at the rear of 16 Maryfield Drive to carry out routine maintenance. Recommendation I recommend that the Committee approve the extinguishment of the public right of way over the area as shown on Drawing No. R.M for consideration later by the City Council.
