1 Minutes of the Regular Meeting of the Town Board of the Town of Lake George held on May 9, 2016 at the Town Center, 20 Old Post Road, Lake George, New York. Supervisor Dickinson called the meeting to order at 6:30 p.m. Jennifer Arnold led the Pledge of Allegiance. A motion was made by Councilperson Stannard and seconded by Councilperson Crocitto to accept the March 14, 2016 minutes. All in favor. A motion was made by Councilperson Muratori and seconded by Councilperson Hurley to accept the April 7, 2016 minutes, the April 11, 2016 meeting and April 27, 2016 meeting. All in favor. RESOLUTION TO HIRE MIDDLE LEAGUE COACH RESOLUTION # , Introduced by Councilperson Hurley and seconded by Councilperson Stannard to appoint Thomas Clark Middle League Coach.

2 WHEREAS the Town of Lake George requires a Middle League Coach to run the Youth Commission Middle League Program; and; WHEREAS the Personnel Commissioner and Recreation Director have interviewed and recommend an applicant for said position; and; NOW, THEREFORE BE IT RESOLVED that the Town agrees to pay Thomas Clark, $500. as an independent contractor, to run the Middle League Program. RESOLUTION TO HIRE SUMMER YOUTH COMMISSION STAFF RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Hurley to hire seasonal Youth Commission Staff. 4 RESOLUTION TO HIRE FULL TIME BUILDINGS AND GROUNDS STAFF RESOLUTION # , Introduced by Councilperson Muratori and seconded by Supervisor Dickinson to hire full time buildings and grounds staff. WHEREAS the Town of Lake George requires various positions in Building and Grounds, specifically to fill vacancy created by the loss of an MEO Maintenance Mechanic; and; WHEREAS the recommendation of the Senior Building Maintenance Mechanic is to hire the following employees as Laborers to fill the void; and; NOW, THEREFORE BE IT RESOLVED that the following applicants be employed Full Time at the following rates, with a probationary period of six months. RESOLUTION TO ACCEPT DONATIONS TO THE TOWN RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Hurley to accept the following donation to the Town: Jaeger & Flynn Associates, Inc. $100 to the YC Scholarship Fund

5 RESOLUTION TO HIRE BACK-UP BUS DRIVER RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to hire part-time, on-call bus driver. WHEREAS the Town of Lake George has the need for a bus driver to fill in when existing bus drivers are unavailable; and; WHEREAS, the Town Board has reviewed the application submitted by Todd Wood; and; NOW, THEREFORE BE IT RESOLVED that Todd Wood be employed as a Bus Driver, with an expected start date of April 1, at an hourly rate of $14., to fill in as needed for both trolley driving and youth commission summer program needs. RESOLUTION TO APPROVE BUDGET TRANSFERS RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to approve the following budget transfers: 1. $7400 to A (misc landfill) from A (losap) $3400 and A (contingency) $4000. for brush grinding. 2. $9000. from SS (contingency) to SS Sewer Salary ($ ) and SS Employee Benefits Social Security ($700). (for change in Joel salary and apportionment to Caldwell Sewer)

6 3. $ to SW (DP water salary) from SW contingency ( ) Due to Joel ODell raise and greater apportionment of time spent in DPWater. 4. $ 50,000 from A Contingency to A (b&g salary) $39,800. and A community beautification salary $3,300. and A Cemetery salary $3,300. and A employee benefits social security $3,600. (this allocates funding for new hires in B&G Kody Kristel and Johnny Cocozza-Hill) 5. $21,500 from B contingency to B Parks Salary $10,000 and B playgrounds salary $10,000 and B social security $1500. (this allocates funding for new hires in B&G, Kody Kristel and Johnny Cocozza-Hill) RESOLUTION TO APPROVE BUDGET AMENDMENTS RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Muratori to approve the following budget amendments: 1. $ TA50, Scholarship Funds (this allows us to carry into 2016 funds remaining at 2015 close) 2. $150,000 increase to revenue code B1113 (Occ Tax) and corresponding increase to B (Occ Tax Joint.) This allows us to receive Joint OT fund and expend the same. 3. $ 2, increase to revenue code A2680 (Insurance Recoveries) and corresponding increase to expense code A (Auto Repairs B & G). This allows us to receive insurance proceeds and expend the same to make repairs. 4. $3.81 increase to revenue code B1113 Occupancy Tax and corresponding increase to B for a refund of unused occupancy tax funds.

7 RESOLUTION TO ACCESS FUND BALANCE RESOLUTION # , Introduced by Councilperson Stannard and seconded by Councilperson Hurley to allow access to fund balance. 1. Allocate $ of SW Fund Balance to SW (DP salary) and SW DP social security $250. Due to Joel ODell raise and greater apportionment of time spent in DP Water. 2. Allocate $1000 of SS Fund Balance to SS sewer salary. Due to Joel O'Dell raise and greater apportionment of time spent in Sewer Department. RESOLUTION TO CONTRACT WITH ADP PAYROLL RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to approve contract with ADP Payroll. WHEREAS the Town of Lake George currently uses a payroll service to process payroll and maintain and submit ACA compliance data; and; WHEREAS ADP has approached the town with an offer to provide the same services as well as a human resources module at a cost lower than our existing vendor; and;

8 NOW, THEREFORE BE IT RESOLVED the Town shall enter into an agreement with ADP to provide payroll, ACA compliance and human resource services for the Town of Lake George. RESOLUTION TO ACCEPT BIOMETRIC TIME CLOCKS FROM ADP RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to contract with ADP for biometric time clocks. WHEREAS the Town of Lake George currently uses a variety of time keeping systems including paper punch cards, paper handwritten time sheets and manual reporting and allocation of wages; and; WHEREAS ADP has approached the town with an offer to provide five biometric time clocks with fingerprint scan for the following locations: Town Center, Highway, Transfer, Ushers and Diamond Point Beach, at an approximate additional cost of $6200 annually; and; WHEREAS biometric clocks and the associated time module would have the following benefits: 1. increased accuracy for time worked, 2. automated data entry (the time would automatically be entered into software system instead of manual entry and paper records increasing accuracy and reducing employee time spent) and 3. a departmental approval process to approve hours and leave time; and; NOW, THEREFORE BE IT RESOLVED the Town shall enter into an agreement with ADP to provide biometric clocks to enhance the ADP payroll processing.

9 RESOLUTION - OCCUPANCY TAX FUNDING - PROSPECT CENTER 25TH BEACH VOLLEYBALL TOURNAMENT RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to allocate $5, to the Prospect Center 25th Beach Volleyball Tournament from Occupancy Tax Funding. RESOLUTION - OCCUPANCY TAX FUNDING - LAKE GEORGE ARTS PROJECT SUMMER CONCERT SERIES RESOLUTION # , Introduced by Councilperson Muratori and seconded by Councilperson Hurley to allocate $4, to the Lake George Arts Project Summer Concert Series from Occupancy Tax Funding. OLD BUSINESS ANDY LIUCCI - MORIS LANE Andy Liucci addressed the board regarding Morris Lane. He stated that Dan Barusch came up and did a great job cleaning up and fixing the area where it runs into the lake along Morris Lane and Nancy Stannard came out and met with him. He asked where we stood with the signs discussed in February. Nancy Stannard stated this is definitely a safety issue as this a very narrow Town road.

10 There is no way for emergency vehicles to get down this road with people parking on it. Nancy suggested that we put signs on both sides of the road down to the Liucci driveway. Big Hollow Road Discussion Mike Lanfear sent a letter to the Town stating he has been to DEC, Warren County Soil and Water due to water. The road was regraded and they will go back and look at this again. Mike s letter will be kept on file and the Town will continue to look into this situation. Supervisor Dickinson stated Craig Brown of Lookout Mountain Subdivision is inquiring about hooking into the Diamond Point Water system and he is working with his engineer and attorney and will be back in front of the board. Supervisor Dickinson stated that the parking area on Westbrook Road is nearing their final approvals. Supervisor Dickinson stated he has had a request from Pam Morin requesting acknowledgement of Father Joques discovery of Lake George and would like the Town Board to dedicate a date for this historic event and set this date aside every year. COMMITTEE REPORTS Councilperson Stannard - Library visits. 1,059 total circulation which is a 9% increase over April The collage workshop was on April 27th with Lori Carpenter. 18 children and adults attended. They will sponsor a table with the Warrensburg Library at the Warren County Youth Fair in August. They are working on providing a weekly storytime for the Youth Commission PEP Program. Courts cases were heard for a total of $18,917. Village Parking was $ Councilperson Muratori - Buildings and Grounds - The Courthouse floors are done. Everything is moved back in. The filing room is not yet finished. Working with a citizen Jackie

11 Robinson who does a lot of genealogical work and has been studying the Caldwell Cemetery. She has discovered a lot of people who have been buried there and there are plans to do some work there and hopefully put up some signage and make improvements so people can walk in and get history and feel like the cemetery is being cared for. Met with representatives from Bio Green Fertilizing Company and the Town has decided to experience with this new soil conditioner. Dave Wick and the Lake George Park Commission have requested to use the Town dock and the crew will be installing it. In the process of getting the clock repaired at the Courthouse. Planning & Zoning - Septic initiative, $26,000 has been advanced from DEC. The Fund for Lake George finished the agreement with the Town for the administration of Septic Grant and executing the septic grant. Have been working on the code Chapter 115 revisions: redlined changes from old A180 to new 134, and various edits. There have been 2 Public Hearings on this. The Route 9 Gateway Plan construction progress is at 10%-12%. There have been various inquiries about the construction including changing the location for the spoils. The final draft of the Comprehensive Plan is on line and the plan has been referred to the Warren County Planning Department. Councilperson Hurley - Diamond Point Water - On May 19th, someone used 50,000 gallons of water which damaged the Roth Valve. They treated 832,000 gallons. All testing came back good. Caldwell Sewer - Spent the month of April checking stations which included priming pumps and cleaning walls of the wet wells. Had Jim Martino and crew replace exhaust fan for the lower pump station. VFD failure at the lower pump station on the pump smart control. Handled 16 Dig Safe tickets. Met with Green Mountain Pipeline and laid out the slip-lining at Snug Harbor. In the process of receiving clearance from DEC. Flow rates were down this month. Supervisor Dickinson mentioned that Amanda Metzger has gone to work for the Lake George Regional Chamber of Commerce, replacing Christine Curley. Amanda did a great job for the Post Star while she was employed by them and did a great job for the Town.

12 PRIVILEGE OF THE FLOOR John Salvador addressed the board. He stated that Big Hollow Road and Morris Lane are both Town Roads. According to Section 181 of the State Highway Law which states that if a Town road by use that has been maintained for 10 years by the Highway Superintendent to be opened by 3 rods. John stated that his attorney received a letter from Attorney Stafford regarding the Salvador v. Town of Lake George, Richard Hyman, et al. It stated there are new markings have been made on Shaw Road Extension, but are unaware of who is responsible. He stated his attorney responded to Attorney Stafford and stated that Mr. Salvador has retained a surveyor to complete a survey of his 185 acres of forested land bordering Shaw Road Extension, and it is Mr. Salvador s belief that any of this work has not been involved in any marking of Shaw Road Extension as of this date. He stated the Court Administration has assigned Judge Afferdou to the lawsuit brought against Mr. Salvador by the Town for damages to Shaw Road Extension. There was a conference held and a scheduling order has been prepared. By May 13th, the Town are to submit an amended complaint. He is obligated by June 3rd to follow with a verified answer. By June 22nd, service will be affected with any discovery demands. A motion was made by Councilperson and seconded by Councilperson Hurley to adjourn at 8:20 p.m. All in favor.
