1 CITY OF AMERICAN CANYON COUNCIL AGENDA STAFF REPORT SUBJECT Meeting Date: August 4, 2009 PUBLIC HEARING: 9 Adopt a Resolution approving the annual Engineer s Report, confirming the assessment diagram and the annual assessment amounts, and authorizing the levy and collection of assessments for Fiscal Year for the American Canyon Landscaping and Lighting Assessment District (LLAD). SUBMITTED BY Michael Throne, P.E., Public Works Director Larry Luporini, Public Works Superintendent BACKGROUND AND ISSUES Tonight s Public Hearing is the last of the required City Council meetings regarding the LLAD. By adopting the attached Resolution, the City Council will approve the Final Engineer s Report and assessment amounts and authorize the levy and collection of assessments for Zones 1, 2 and 3 during FY In January 2001, in accordance with the provisions of the Landscaping and Lighting Act of 1972, the City Council approved the formation of the LLAD to operate and maintain facilities being constructed with the LaVigne subdivision. For LLAD purposes, LaVigne subdivision was designated as Zone 1. For FY , Zone 2, Vintage Ranch Subdivision (previously known as Newell-Scally or Scally Ranch) was annexed into the LLAD, and for FY , the Napa Junction Mixed-Use Project was annexed as Zone 3. The funding sources for the LLAD costs are the parcels within the LLAD. Each zone is financially responsible (by past practice and City Council-approved district formation documents) for the operation, maintenance, repair and replacement of all street lighting and landscaping features inside each zone. The parcels are assessed through an annual process. For FY , that process began on March 17, 2009, when the City Council appointed Winzler & Kelly Consulting Engineers as the Engineer of Work and directed the preparation and filing of the annual Engineer s Report describing the potential changes to the LLAD for FY The annual Engineer s Report was prepared and filed as required, and on July 21, 2009, it was preliminarily approved by the City Council. Note that there are two assessment values established for each zone. The first is the maximum annual assessment and the second is the actual levy to be collected for each zone. The maximum assessment represents a cap established at the inception of the LLAD and is recalculated annually to reflect changes in the Consumer Price Index (CPI). The increase in the CPI for 2008 was + 0.8%. The second number, the actual levy, is the amount proposed to meet the LLAD s operational needs.

2 Public Hearing Page 2 Based on the Final Engineer s Report, the following maximum assessment per zone is recommended: The maximum Zone 1 annual assessment for FY is increased from $ to $ The maximum Zone 2 annual assessment for FY is increased from $ to $ There are two assessments for Zone 3: one for each equivalent single dwelling (ESD) and one for each acre (of commercial property). The maximum annual assessment for FY for each ESD in Zone 3 increases from $ to $ The maximum annual assessment for FY for each acre of commercial property in Zone 3 increases from $1, to $1, The total proposed LLAD budget for FY for all three zones is $613,234. This is an overall increase of $46,584 in the annual budget from FY The final Engineer s Report includes the description and proposed changes for each zone in the LLAD, the proposed costs to operate and maintain the improvements, use of maintenance reserves to offset costs, the method of apportionment (spread) of the assessments, the assessment roll for all parcels, and the assessment diagram (map). No annexations into the LLAD are proposed for FY The proposed FY budget for Zone 1, which is built out, is $160,413. Therefore, the proposed amount to levy and collect for FY is $ per equivalent single-family dwelling unit (ESD) after the maintenance reserves offset is factored in. Zone 2, Vintage Ranch Subdivision Units I, II and III, when fully built out will include operation and maintenance of a large number of parks and trails, as well as an extensive series of detention basins, water quality basins, and creek areas. The proposed FY budget for Zone 2 at its current stage of development is $343,074. Zone 2 is currently not built out. Therefore, the proposed FY assessment to levy and collect is $ per ESD after the maintenance reserve offset is factored in. Zone 3, the Napa Junction Mixed-Use Project when fully built out will include the operation and maintenance of streetscape landscaping, bikeways, water quality basins, parks, fencing, street lighting and traffic signals. The proposed FY budget for Zone 3 at its current stage of development is $109,747. Due to the mixed-use type of development, the Zone 3 method of apportionment (spread) is based on a combination of both ESDs and acreage, or a portion thereof. Zone 3 is currently not built out. Therefore, the proposed FY assessment to levy and collect is both $ per ESD and $ per acre. The procedure to levy and collect annual assessments for the City s LLAD for FY is as follows:

3 Public Hearing Page 3 On March 17, 2009, the City Council adopted a Resolution appointing the Engineer of Work, directing the preparation and filing of the Engineer s Report, and describing any potential changes to the LLAD. On July 21, 2009, the City Council adopted a Resolution of Intention to levy and collect annual assessments for FY , preliminarily approve the Engineer s Report, and set the date and time for the Public Hearing. At the August 4, 2009, meeting, the City Council will hold the Public Hearing. When the Public Hearing is convened at tonight s meeting, Council will consider adoption of the attached Resolution confirming the assessments as presented in the Engineer s Report or as modified by the City Council at the conclusion of the hearing. The adoption of the Resolution shall constitute authorization to levy and collect annual assessments during FY This procedure is required by the Landscaping & Lighting Act of 1972 of the California Streets and Highways Code. At the July 21, 2009, meeting, two issues were raised by residents in Zone 1: 1. The level of unrestricted reserves in Zone 1 may have been under-represented in the Engineer s Report. 2. Consideration of using funding sources other than Repair and Replacement Reserves to replace stolen streetlight wire. Level of Unrestricted Reserves in Zone 1 Staff has reviewed the fund balance for Zone 1 and confirmed that a $53, remittance from the County was received and credited to the Zone 1 fund balance on June 30, Consequently, staff s recommendation of assessment levels remains unchanged for Zone 1. Funding for Stolen Streetlight Wire During the past year the City experienced theft of copper streetlight wire throughout its limits. One area where wire was stolen was in the Zone 1 service area. The cost of replacing the stolen wire was approximately $5,600. Although the charge was unbudgeted, it does not impact the annual assessments for either Fiscal Year or Fiscal Year because it is a draw against the reserves. Residents have asked the Council to consider using another source of funding for this cost. While in the past Council may have contributed funding to the LLAD when such contributions enhanced overall equity throughout the City, there is more than adequate funding in the Replacement and Repair Reserves, and staff has determined this

4 Public Hearing Page 4 expenditure is appropriate from the Zone 1 LLAD because streetlights are among the facilities operated and maintained by the LLAD. To limit vandalism in the future, all repairs made to the LLAD street light system will include tamper-proof pullboxes. FISCAL IMPACT The action will have no direct fiscal impact on the adopted budget for fiscal year The proposed levy was included in the Assessment District s budget that was adopted by the City Council on July 21, ENVIRONMENTAL DETERMINATION Not applicable. ALTERNATIVES 1. Adopt the Resolution. There is no General Fund impact by this action. All costs associated with these annual proceedings and the annual operation, maintenance and administration of the LLAD are recovered from the annual assessments levied and collected on the parcels within the LLAD. 2. Adopt the Resolution after Directing Modifications to Assessments for Zone 1. Council may direct staff to reduce the assessments through additional contributions for restricted reserve funding. There are no immediate General Fund impacts from this action; however, reduced restricted reserve levels may compromise the ability to fund future repair and replacement needs in Zone Adopt the Resolution and Direct Changes to the Unbudgeted Draw on Zone 1 Repair and Replacement Reserves for Stolen Wire. Council may direct staff to fund the replacement of stolen wire from sources other than the Zone 1 Repair and Replacement Reserve. This will not impact assessments but will result in slightly larger restricted Repair and Replacement Reserve for Zone 1. This may also have General Fund impacts if the alternative source of funding is the General Fund. 4. Reject the Resolution. Since no assessments could be levied and collected during FY , this alternative could require the City to consider contribution of General Funds to cover the cost of operation and maintenance of the LLAD facilities such as parks, bike paths, street landscaping, fencing, walls, water quality basins, parks and traffic signals. 5. Continue the Public Hearing. The City Council may opt to continue the Public Hearing to address any issues that arise during the protest hearing to allow time to resolve any remaining issues and to incorporate the revised information into the Engineer s Report. However, if the Public Hearing is continued, it must be closed and assessments must be confirmed on or before August 15, 2009, the date that the

5 Public Hearing Page 5 levy information must be received by the County tax assessor to be included in this fiscal year s tax rolls. 6 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AMERICAN CANYON, STATE OF CALIFORNIA, APPROVING THE ANNUAL ENGINEER S REPORT, CONFIRMING THE ASSESSMENT DIAGRAM AND ANNUAL ASSESSMENT AMOUNTS, AND AUTHORIZING THE LEVYING AND COLLECTING OF ANNUAL ASSESSMENTS FOR FISCAL YEAR FOR THE AMERICAN CANYON LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT (PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972) WHEREAS, in January 2001 the City Council ordered the formation of a Landscaping and Lighting Assessment District (LLAD) in order to levy and collect annual assessments pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, the City Council intends to levy and collect annual assessments within the American Canyon Landscaping and Lighting Assessment District during Fiscal Year , the area of land to be assessed being located in the City of American Canyon, Napa County; and WHEREAS, pursuant to the Act, the City Council on March 17, 2009, adopted a Resolution appointing Winzler & Kelly Consulting Engineers as the Engineer of Work and directed the preparation and filing of the annual Engineer s Report to describe the potential changes to the Assessment District for FY ; and WHEREAS, no annexations to the LLAD are proposed for Fiscal Year ; and WHEREAS, the Engineer of Work prepared and filed the annual Engineer s Report in accordance with the provisions of the Act; and WHEREAS, on July 21, 2009, the City Council adopted a Resolution of Intention to levy and collect annual assessments for FY , preliminarily approved the annual Engineer s Report for FY , and set the time and date of the public protest hearing pursuant to Section of the Streets and Highways Code; and WHEREAS, the annual assessments to be levied for FY are proposed as follows: $ per Equivalent Single-Family Dwelling (ESD) for Zone 1, the LaVigne subdivision (compared to a levy for FY of $254.59), $ per ESD for Zone 2, the Vintage Ranch Subdivision (compared to a levy for FY of $302.34), $ per ESD for Zone 3, the Napa Junction Mixed Use Development (compared to a levy for FY of $211.41) and $ per acre for Zone 3 (compared to $1, for FY ); and

7 WHEREAS, as allowed in the original LLAD formation proceedings to keep pace with inflation, the FY estimated maximum annual assessment at build-out of Zones 1, 2 and 3 will be adjusted upward by the Consumer Price Index (CPI) for 2008 of +0.80% as follows: from $ to $ per ESD for Zone 1; from $ to $ per ESD for Zone 2; from $ to $ per ESD and from $1, to $1, per Acre for Zone 3; and WHEREAS, on August 4, 2009, the City Council held the public protest hearing and gave persons the opportunity to protest the FY Engineer s Report, either in writing or orally, and the City Council has fully heard and considered all matters and things pertaining to the levy and collection of the proposed assessments. NOW THEREFORE, BE IT RESOLVED that in accordance with the requirements of Section of the California Streets and Highways Code, the City Council of the City of American Canyon hereby: 1. Approves the annual FY Engineer s Report as prepared and filed. 2. Confirms the assessment diagram and assessment as set forth in the Annual Engineer s Report or as modified as allowed by the City Council. 3. Authorizes the levy and collection of annual assessments for FY as set forth in said report for Landscaping and Lighting Assessment District Zone 1 - La Vigne Subdivision, Zone 2 - Vintage Ranch Subdivision, and Zone 3 Napa Junction Mixed Use Development. 4. Authorizes adjustments of the FY estimated maximum annual assessment at build-out of Zones 1, 2 and 3 by the annual Consumer Price Index (CPI) of +0.80% for 2008, as allowed in the original formation proceedings. 10 FY Annual Engineer s Report American Canyon Landscaping & Lighting Assessment District (Pursuant to the Landscaping & Lighting Act of 1972) Fiscal Year Annual Assessment Winzler & Kelly, Engineer of Work for the, City of American Canyon (City), County of Napa, State of California, prepares this annual Engineer s Report, as directed by the City Council of the City of American Canyon (City Council), pursuant to Section of the Streets & Highways Code (Landscaping & Lighting Act of 1972) and Articles XIII C and D of the California State Constitution (Proposition 218) for Fiscal Year Background The American Canyon Landscaping & Lighting Assessment District ("Assessment District") was formed in January 2001 to cover the costs associated with the operation and maintenance of landscaping and lighting improvements within the La Vigne Subdivision (Zone 1). Landscape and Lighting Districts provide funding for the operation and maintenance of a wide variety of park, streetscape, landscaping and lighting facilities through assessments levied on the property within the Assessment District boundaries. Both Proposition 218 and the Landscape and Lighting Act of 1972 require that the Engineer s Report establish a method of assessment, a maximum assessment, and any escalation factors that will be used to allow the annual assessments to keep pace with inflation. In order to take inflation into account, the 2001 formation proceedings allowed assessments to be escalated in accordance with the All Urban Consumers (San Francisco Area) CPI from the U. S. Department of Labor, Bureau of Labor Statistics. Assessments may be increased annually by the approved inflation factor without the need to provide notices and assessment ballots to property owners within the Assessment District. However, if the City proposes increasing assessments in an amount above the approved inflation factor, it must conduct an assessment balloting process in accordance with Proposition 218. Once an Assessment District is created, it is possible to annex new zones or annex new areas into existing Zones as new subdivisions are developed and new facilities require maintenance. Since 2001, Vintage Ranch (Zone 2) and Napa Junction Mixed Use (Zone 3) have been annexed into the Assessment District. The same CPI escalator was also approved for these Zones at the time they were annexed to the Assessment District. The Landscaping & Lighting Act of 1972 requires that an Engineer's Report must be prepared and adopted by the City Council each year, in order to levy and collect assessments in any following fiscal year. On March 17, 2009 the City Council adopted a resolution appointing Winzler & Kelly as the Engineer of Work and directed the preparation and filing of this annual Engineer's Report July 09

11 The Engineer's Report outlines the facilities to be maintained, the budgets proposed for this maintenance, and the assessments necessary to secure these budgets. This Engineer s Report documents any land use changes in the Zones (i.e. new subdivisions) and any proposed annexations. This Engineer s Report calculates the maximum allowable assessment for each Zone based on CPI escalator of 0.80 % and provides clear confirmation that the proposed assessments do not exceed the approved maximum including adjustments for inflation for each Zone. The table below summarizes the maximum annual assessments allowed in Zones 1, 2 and 3, including the CPI increase, and compares these to the assessments proposed to be levied and collected in Fiscal Year Proposition 218 balloting is not required in any zone. Funding for this budget is proposed to include $ 542,234 from FY assessment revenues levied and collected and $71,000 from available maintenance reserve balances. No General Fund contributions are proposed. A brief discussion of each zone, including the improvements maintained, the property assessed and proposed budgets and assessments, is found below. Zone 1 - La Vigne Improvements Maintained Zone 1 provides for funding for the following improvements, illustrated on the Assessment Diagram found in Part F: 1. The maintenance and operation including repair, replacement, and servicing of street light standards, luminaries, wiring and appurtenances necessary to provide street lighting within Zone The installation, maintenance and operation to include repair, replacement and servicing of street trees, shrubs, planting and irrigation systems together with earth berms, slopes, curbs: root deflectors, decorative paving, masonry walls and concrete or wood appurtenances, all as delineated on the improvements plans for A.P.N prepared by Carlson, Barbee & Gibson, Inc. dated June 1, 1999 or as specified in the City July 09

12 of American Canyon Community Development Department, Engineering Division standard details and specifications. Specifically this work includes the following: Along the entire north side of Parcel A: landscaping and the public walkway adjacent to the creek running through La Vigne subdivision. Parcel B: landscape right-of-way area along east side of Flosden Road including the median area directly adjacent to parcel B; landscape and park area north of Parcel A and south of the north Via Bellagio entry including the entry monument and special amenities. Parcel C: landscape right-of-way area along east side of Flosden Road including the median area directly adjacent to Parcel C; landscaping and detention basin including entry monument and special amenities. Parcel D: landscape right-of-way area along east side of Flosden Road, including the median area directly adjacent to Parcel D; landscaping and sound wall west of Parcel J including entry monument and special amenities. Parcel E: landscape right-of-way area along east side of Flosden Road including the median area directly adjacent to Parcel E and right-of-way area along south side of American Canyon Road to Via Frienze; landscaping and sound wall north and west of La Vigne Unit 1 including entry monuments and special amenities. Parcel F: landscape right-of-way area along south side of American Canyon Road to the wetlands restoration area; sound wall and landscape area north of Parcel F, entry monuments and special amenities. Parcel H: special amenities and landscape within park site. Parcel K: special amenities and landscape within park site. Via Bellagio including the entire length of the landscape right-of-way area from back of curb to face of sidewalk including ancillary medians that intersect Via Bellagio from adjoining parcels and neighborhoods. Entry monuments are not included as they are noted in other parcel descriptions. The assessments collected in the Zone may also fund any and all incidental expenses in connection therewith all as more particularly authorized pursuant to the Landscaping and Lighting Act of Property Assessed Zone 1 is built-out and no new annexations are proposed for Fiscal Year Zone 1 has Equivalent Single Family Dwelling (ESD) units, the same as last year July 09

13 Proposed Budgets All Zone 1 improvements have been completed and accepted. The total proposed Zone 1 budget for Fiscal Year is $160,413. This budget is based on current landscaping contracts, historical cost review, and professional estimates of labor efforts required to maintain the facilities. The proposed funding will be $139,413 from FY assessments and $21,000 from available maintenance reserves. No general fund contributions are proposed. Proposed Assessments For Fiscal Year , the proposed Zone 1 annual assessment to levy and collect is $ per ESD from FY assessments. The new maximum annual assessment for Zone 1 is $ per ESD including the allowed 0.80% CPI increase. Zone 2 - Vintage Ranch Subdivision Improvements Maintained Zone 2 provides funding for the maintenance of landscaping, public walkways, creeks and their related improvements, creek trails, water quality basins and ponds, streetscape, class 1 bikeways, walls and fences, maintenance and electricity of street lighting, a portion of intersection traffic signals, and parks within the Vintage Ranch Subdivision. The Assessment Diagram in Part F illustrates the location of these improvements including: Silver Oak Park Shenandoah Park PG&E Linear Park Environmentally Sensitive Areas located on Lots A, C, D, G and in setback areas and ponds The Creek Trail System Streetscapes within Vintage Ranch The Class 1 Bikeway on Flosden Road Fence and Wall Maintenance Water Quality Basins 1, 2 and 3 Street Lighting 25% of the traffic signals at Flosden and American Canyon Road; Silver Oak and American Canyon Road and Donaldson and Highway 29 The assessments collected in the Zone may also fund any and all incidental expenses in connection therewith all as more particularly authorized pursuant to the Landscaping and Lighting Act of Property Assessed The Fiscal Year assessments are proposed to be levied on ESD units. This is an increase from the 835 ESD units included in the Fiscal Year assessment roll. The increase is the result of a number of single family dwellings being completed July 09

14 Proposed Budgets The total proposed Zone 2 budget for Fiscal Year is $ 347,074. The proposed funding will be $ 303,074 from FY assessments and $40,000 from available maintenance reserves. No general fund contributions are proposed. The proposed budget now includes full year maintenance funding for all facilities except the Environmentally Sensitive Areas, which have not yet been accepted. Proposed Assessments For Fiscal Year , the proposed Zone 2 annual assessment to levy and collect is $ The new maximum assessment is $ including the allowed 0.80 % CPI increase. Zone 3 - Napa Junction Mixed Use Project Improvements Maintained The Napa Junction Mixed Use Project - Zone 3 Improvements include landscaping, streetscape, bikeways, water basins, park areas, fencing, street lighting and traffic signals within the Napa Junction Mixed Use Project. The Assessment Diagram in Part F illustrates the location of these improvements specifically: Streetscaping Class 1 Bikeways Highway 29 Ditch (Water Quality Basin 1) Main Street Park (Water Quality Basin 2) Small Park (Water Quality Basin 3) Street Lighting 25% of the traffic signal at Eucalyptus and Highway 29 The assessments collected in the Zone may also fund any and all incidental expenses in connection therewith all as more particularly authorized pursuant to the Landscaping and Lighting Act of Property Assessed During the annexation proceeding for Zone 3, it was determined the benefits received from certain improvements would be more equitably spread by the acreage, or portion thereof, of each parcel while the benefits received from certain other improvements would be more equitably spread by Equivalent Single Family Dwelling (ESD) units. Therefore, Zone 3 has a two part assessment formula that includes both ESD units and Acres. The Method of Apportionment of Assessment (Part D) includes a complete description of the methodology used to calculate assessments. The Fiscal Year assessments are proposed to be levied on ESD Units and acres. No annexations are proposed for Fiscal Year July 09

15 Proposed Budgets The total proposed Zone 3 budget for Fiscal Year is $ 109,747. The proposed funding will be $ 99,747 from FY assessments and $10,000 from available maintenance reserves. No general fund contributions are proposed. Proposed Assessments For FY , the proposed Zone 3 annual assessment to levy and collect for each parcel is $ per acre or portion thereof plus $ per ESD. 16 FY Engineer's Report Format This FY Engineer's Report consists of six parts, as follows: PART A - PART B - PART C - PART D - PART E - PART F - Plans - This portion of the Engineer's Report describes any plans and specifications that may be needed for the installation of the improvements. If plans and specifications exist, they are filed with the City Clerk. Although separately bound, if referenced, the plans and specifications are part of this Engineer's Report. Budget Cost Estimates This portion of the Engineer s Report includes the budget cost estimates associated with the operations and maintenance of the described improvements for Zones 1, 2 and 3. In addition to an overall Budget Summary for each zone, this part includes detailed FY budgets for each zone and a FY Fund Balance Summary. Assessment Roll This portion of the Engineer s Report includes a spreadsheet listing of FY assessments on each benefitting parcel of land in Zones 1, 2 and 3 within the Assessment District. The FY assessment is the amount each parcel will contribute towards the operation and maintenance of the improvements within each zone of the Assessment District. Method of Apportionment of Assessment This portion of the Engineer s Report includes a statement of the method used by Engineer of Work to determine the amount proposed to be assessed against each parcel within each zone of the Assessment District. Property Owner's List This portion of the Engineer s Report includes a list of the names and addresses of the owners of real property within this Assessment District, as shown on the last equalized assessment roll for taxes. The Assessor Parcel Number (A.P.N.) for each parcel keys the list to the Assessment Roll shown in Part C. 17 PART A PLANS AND SPECIFICATIONS The Assessment District will operate and maintain the landscape, lighting and related improvements in Zones 1, 2 and 3 as accepted by the City of American Canyon. Maintenance may include repair, removal, or replacement of any hardscape improvement, damaged irrigation facilities or diseased landscaping, weed and brush clearing, maintenance and electricity for the streetlights and any other allowable maintenance items per Section of the Streets and Highways Code for the life of the Assessment District July 09

27 PART D FY METHOD OF APPORTIONMENT OF ASSESSMENT Initial apportionment information relating to all zones and made a part of this report by reference here, can be found in the City of American Canyon Maintenance District No (A.P.N ) Engineer's Report, Establishment of District and Assessments for Fiscal Year , Part D, City of American Canyon Maintenance District No (A.P.N ) Method of Assessment. The following is a brief description of the manner the annual assessment has been apportioned to each parcel in Zones 1, 2 and 3 within the Assessment District consistent with the approved method. Zone 1 and Zone 2 The method of apportionment (spread) equates all parcels in Zones 1 and 2 to an Equivalent Single Family Dwelling (ESD) unit, or portion thereof. The following ESD units were established for the American Canyon Landscaping and Lighting Assessment District, at its formation, and reflect the relative benefit accruing to parcels of land, in various states of development, from the landscape and lighting facilities: 1. Vacant parcel in undeveloped area 1/10 unit 2. Vacant parcel in developed area 1/2 unit 3. Single dwelling parcel 1 unit ESD units for each zone are determined annually based on the developed pattern. Each zone's operation and maintenance expenses for the upcoming fiscal year is then divided by the total number of ESD units in order to calculate the annual cost per ESD unit for the upcoming fiscal year. The annual assessment for each parcel is calculated by multiplying the annual cost per ESD unit by the total number ESD units on the parcel in the upcoming fiscal year. The method of apportionment for Zones 1 and 2 can be expressed mathematically as: Cost per ESD Unit = Fiscal Year Budget for Zone / Total Number of ESD Units in Zone Assessment per Parcel = Cost per ESD Unit x No. of ESD Units on Parcel In Zones 1 and 2, all property is residentially developed. Annual assessments are apportioned as described because the improvements provide relatively equal benefit and are relatively equally accessible to each residential unit. This relative equality of benefits results in an assessment methodology that spreads costs equally at full build out. Although Section of the Streets and Highways Code typically requires that public property not be assessed, Article XIII, Section 4(a) of Proposition 218 requires that public property shall not be exempt from assessment if the property benefits from the facilities being maintained July 09

28 Zones 1 and 2 include publically owned property which is utilized for parks, creeks, open spaces, public rights-of-way and easements. These properties serve to provide landscape, open space and recreational benefits to the adjoining residential property. Because these properties provide special benefits rather than receive special benefits they do not receive an annual assessment. Likewise school sites, which provide for open space and recreational opportunities, enhance the special benefits received by residential property. Therefore because these properties provide benefits rather than receive benefits, they are also not assessed. Finally civic properties including public safety facilities and utility facilities which were constructed as a condition of approval for the residential development serve to support the special benefits received by residential properties. Because these properties support the provision of special benefits rather than receiving special benefits, they are also not assessed. Additionally, Lot 'N' of the original subdivision map is an affordable housing project site and will be dedicated to the City. As directed by the City, this parcel is not to be assessed. Zone 3 Unlike Zones 1 and 2, Zone 3 contains a mix of residential, commercial, industrial and retail land uses. In order to apportion costs proportional to benefit, the method of apportionment (spread) for Zone 3 utilizes both an ESD unit component and an acreage component. The benefits provided by the Class I bike path, three-rail fencing, street lights, traffic signal, and the detention pond along Highway 29 are apportioned by acreage because the size of the property provides a reasonable measure of the number trips (vehicular and bicycle), length of fencing and runoff detained. Therefore the cost of operating and maintaining these facilities is apportioned to benefitting property based on its acreage. The benefits provided by the streetscape, large park and small are apportioned by ESD unit, as is done in the other two zones. These items provide benefit to and are accessible to resident families and employees of local businesses to enjoy during lunch breaks or after work hours. The following benefit units were established for the American Canyon Landscaping and Lighting Assessment Zone 3 (Napa Junction) at the time it was annexed to the Assessment District and these reflect the relative benefit accruing the various parcels of land within the zone: 1. Single dwelling parcel 1 ESD unit 2. Multiple dwelling unit parcels 1 ESD unit per unit 3. Commercial, Retail, or Industrial parcel 1 ESD unit per 1,500 sf of floor space 4. Commercial, Retail, or Industrial type parcel with dwelling unit 1 ESD unit per 1,500 sf of floor space plus 1 ESD unit per dwelling unit 5. All Land Use types Acres or portion thereof ESD units for Zone 3 are determined annually based on the development pattern. 29 park facilities are then divided by the total number of ESD units in order to calculate the annual cost per ESD unit for the upcoming fiscal year. Acreage units within Zone 3 is also determined annually based on development pattern. The operational and maintenance expenses for the upcoming fiscal year for Class I bike path, threerail fencing, street lights, traffic signal, and the detention pond along Highway 29 are then divided by the total acreage unites in order to calculate the annual cost per acreage unit for the upcoming fiscal year. The annual assessment for each parcel is calculated by: 1. Multiplying the number of ESD units on the parcel by the annual cost per ESD unit to arrive at the ESD assessment for the parcel 2. Multiplying the acreage of the parcel by the annual cost per acreage unit to arrive at the acreage assessment; and 3. Adding the ESD assessment to the acreage assessment to arrive at the total assessment for the parcel.
