The following ordinance was submitted for introduction by Mrs. Luci Sposito in regular session convened on July 25, PROPOSED ORDINANCE The following Ordinance, having been previously introduced and published, was offered for final adoption by Mrs. Luci Sposito, seconded by Mr. Jerry Jones. ORDINANCE NO AN ORDINANCE AMENDING ORDINANCE 4432 AND AMENDING AND RE- ENACTING DIVISION 4-TRAFFIC, SECTION TRAFFIC CALMING POLICIES AND PROCEDURES OF CHAPTER 40-TRAFFIC OF THE CODE OF ORDINANCES FOR THE LAFOURCHE PARISH COUNCIL AS IT PERTAINS TO THOSE STREETS/ROADS/LANES EXEMPT FROM MEETING THE CRITERIA NECESSARY FOR THE INSTALLATION OF TRAFFIC CALMING DEVICES DUE TO EXTENUATING CIRCUMSTANCES AND INSTALLATION OF TRAFFIC CALMING DEVICES. BE IT ORDAINED, on August 8, 2017 that: by the Lafourche Parish Council convened in Regular Session WHEREAS, for clarity purposes, Division 4-Traffic, Section Traffic Calming Policies and Procedures of Chapter 40 of the Code of Ordinances for the Lafourche Parish Council shall be included in its entirety. SECTION 1. The Code of Ordinances for the Lafourche Parish Council is hereby amended and re-enacted to read as follows: K. INSTALLATION OF TRAFFIC CALMING DEVICES: Upon successful completion of the petition or with Council approval of extenuating circumstances, permanent traffic calming devices are installed pending appropriate funding is available. Residents and/or Homeowner Associations may cost share with Lafourche Parish Government; such participation may expedite the installation of traffic calming devices. All forms of material may be considered for traffic calming devices including but not limited to asphalt, rubber and plastic. When road resurfacing requires traffic calming device removal, replacement shall occur during or within six (6) months of completed work. L. STREETS/ROADS/LANES EXEMPT FROM MEETING CRITERIA FOR INSTALLATION OF TRAFFIC CALMING DEVICES DUE TO EXTENUATING CIRCUMSTANCES: Those streets/roads with extenuating circumstances shall be exempt from meeting the criteria necessary for the installation of Traffic Calming Devices. Extenuating circumstances can be described as those streets/roads/lanes with unusual conditions such as boat launches, dead-end, cul-de-sac, impasse streets with traffic due to a business or establishment being located on the street/road/lane which is not a throughway. A majority vote of the Council shall be required for streets/roads/lanes which are deemed exempt. SECTION 17:23 TRAFFIC CALMING POLICIES & PROCEDURES: The Lafourche Parish Government and the Lafourche Parish Sheriff s Office have developed policies and procedures for Traffic Calming, including criteria in order for Traffic Calming Devices

2 to be installed in a neighborhood. This section discusses policies, procedures, and criteria for Traffic Calming. A. REQUEST: To initiate the process a resident may call the Lafourche Parish Government or the Sheriff s Office to discuss perceived traffic problems in the neighborhood. The resident shall then be sent a Traffic Calming Initiation Packet which describes traffic calming and lists its goals and objectives. The packet also contains an application which requests information about the neighborhood, the perceived traffic problems, and the names of five (5) to ten (10) other residents who will form a traffic calming project steering committee. Exhibit A and D. B. APPLICATION AND PETITION: The homeowner is asked to complete the application and return it to the Lafourche Parish Government or the Lafourche Parish Sheriff s Office. When the application is completed and returned, the Lafourche Parish Government or the Lafourche Parish Sheriff s Office Staff shall establish the boundaries for the project. As part of the application packet, the neighborhood representatives are also given a Petition to Initiate Traffic Calming. This petition shall be distributed by the neighborhood representatives for signature by fifty (50) percent of the homeowners within the boundaries identified. If the petition is successfully completed, staff will work with the representatives on the proceeding steps in the Traffic Calming process. The application and petition are included as Exhibit A and B. C. COLLECTION OF DATA: After deeming the petition to be successful, staff will begin collecting neighborhood traffic data. The collection of data may include but is not limited to road tube counts, speed studies, traffic turning movement counts, crash reports, roadway widths, and regulatory signage. D. ANALYSIS OF DATA: The collected data is analyzed to determine whether the neighborhood meets or exceeds the established evaluation criteria for traffic calming using the following procedures. 1. CUT THROUGH TRAFFIC: Road tube counts are used to determine the amount of vehicles entering and exiting the neighborhood. The number of houses in the study area is determined. The average trip ends, per dwelling unit, per day is multiplied by the amount of homes in the neighborhood to determine the expected amount of traffic entering/exiting the neighborhood per day. This number is compared to the actual amount of vehicles entering/exiting the neighborhood (road tube counts) to determine the amount of projected non study area generated traffic, or cut through traffic. (See Example #1 below). Example #1: Total vehicles entering/exiting neighborhood per day (from road tube counts) = 3,904 Road Tube Count Number of Houses = Trip Ends/Dwelling Unit/day Locations: A: = 10.04; B: = 12.67; C: =10.52 Average Trip Ends/Dwelling Unit/Day = ( ) / 3 = Total houses in neighborhood = 341 Vehicles expected to enter/exit neighborhood per day = x 341 = 3,778 Amount of non-local traffic = = 126 vehicles per day Calculated Non-Local Traffic = ( ) * 100 = 3.3% Criteria to determine if a problem exists: On residential streets the calculated non-local traffic must exceed 15% of the calculated vehicles expected to enter/exit the neighborhood per day in order to meet the criteria for traffic calming measures. 2. SPEED: The speeds from the data collected are compared to the posted speed limit. If the 85th percentile of the vehicles are going seven (7) mph over the speed limit the criteria for traffic calming is met. Additionally if the 95th percentile of the vehicles are going ten (10) mph over the speed limit the criteria could be considered met. 3. CRASHES: If there are four (4) or more reported intersection or spot location crashes within a year on a street in the neighborhood, the criteria for traffic calming is met.

CHARRETTE 1 - STAFF MEETS WITH NEIGHBORHOOD REPRESENTATIVES: The Lafourche Parish Government or the Lafourche Parish Sheriff s Office Staff shall meet with the traffic calming project steering committee to discuss the results of the traffic studies. If the neighborhood meets the criteria for traffic calming, then staff and the neighborhood representatives discuss the traffic problems. The neighborhood representatives develop a few solutions using traffic calming techniques. F. ANALYZE POSSIBLE SOLUTIONS: The Lafourche Parish Government or the Lafourche Parish Sheriff s Office shall review the solutions developed by the neighborhood representatives. At this time staff shall contact the neighborhood representatives in order to discuss the outcome of the review of the proposed solutions. G. CHARRETTE 2 - FIRST NEIGHBORHOOD MEETING: A letter shall be sent to every homeowner within the boundary of the neighborhood study area informing them of a meeting time, date, and location. The purpose of the meeting is to brief homeowners on traffic calming, discuss completed studies, identify traffic calming concepts, and to allow the homeowners to determine possible solutions to their neighborhood traffic problems. The homeowners will, with input from staff, define the objectives of the project, i.e. what decrease in speeds or volumes do they expect the traffic calming project to accomplish. The Lafourche Parish Government and the Lafourche Parish Sheriff s Office feel that it is important for all affected homeowners to participate in developing a plan they can call their own. Neighborhood homeowners are therefore encouraged to furnish their input on the plan. Possible solutions and funding shall also be discussed at the meeting. H. ANALYZE SUGGESTIONS FROM RESIDENTS: The Lafourche Parish Government or the Lafourche Parish Sheriff s Office staff shall analyze possible solutions from homeowners while working with emergency services. These preliminary solutions will be compiled into a single plan. I. PROPOSED PLAN AND PETITION SENT TO THE NEIGHBORHOOD RESIDENTS: A meeting shall be held with the homeowners within the boundaries of the neighborhood. The plan being proposed by the Lafourche Parish Sheriff s Office will be discussed. The Lafourche Parish Sheriff s Office will get approval or disapproval of the proposed plan. If more than sixty-six (66) percent of the homeowners indicate approval of the plan as presented, the plan will be considered approved and will continue on to the next step. If less than sixty-six (66) percent of the homeowners indicate approval of the plan, there will be a follow up meeting with the homeowners to determine if a consensus of opinion can be reached. (Exhibit C is a copy of the petition). J. REPORT TO LAFOURCHE PARISH COUNCIL: Once the petition process is completed and the plan is approved by sixty six (66) percent of the homeowners, a written report detailing the Traffic Calming plan will be submitted to the Lafourche Parish Council for approval. K. A majority vote of the Council shall be required for streets/roads/lanes which are deemed exempt. SECTION 2. If any section, clause, paragraph, provision or portion of these regulations shall be held invalid by any court of competent jurisdiction, such holding shall not affect any other section, clause, paragraph, provision or portion of these regulations. SECTION 3. All Ordinances or parts of Ordinances by the Lafourche Parish Council conflicting with or inconsistent with the provisions of these regulations are hereby repealed. SECTION 4. Any person who violated the provisions of this Ordinance shall upon conviction thereof, be punished by imprisonment in the parish jail for a period of not more than thirty (30) days, or by fine of not more than five hundred ($500.00) dollars or by both such imprisonment and fine, at the discretion of the court. SECTION 5. This ordinance shall be published in the Official Journal of the Lafourche Parish Council in the manner provided by law. SECTION 6.
