2 MINUTES OF MAY 16, 2017, LTPOA BOARD MEETING BOARD MEMBERS PRESENT: Adam Pusateri, PresIdent/Roads; Tag Lewis, Beach Maintenance; Rob Boso, Vice President Security, Jim Ohle, Marina; Alissa Nixon, Secretary/Association Programs; Dick Taggart, Conservation; Paul Buncic, Treasurer; Matt Parker, New Construction/Septic; Fred Schuster, Legal BOARD MEMBERS ABSENT: None OTHERS PRESENT: Melvin Meyer, Debbie Meyer, Ryan Nixon, Megan McNear, Tommy McNear CALL TO ORDER: Adam Pusateri called the LTPOA Board meeting to order at 7:24 p.m. ROLL CALL: Adam Pusateri conducted and a roll call vote was taken. MINUTE APPROVAL: The minutes from the April 18 meetings, were approved. A motion was made by Matt Parker, seconded by Alissa Nixon and unanimously carried to approve the minutes. ANNOUNCEMENTS: We will only have the garage sale this year if we get 10 people, right now we only have 3. There isn t going to be a LUAU this year after the Annual Meeting, we are going to go back to the covered dish. EXECUTIVE COMMITTEE: None REPORTS: President: Adam Pusateri: Would like to thank everyone that came out for the Earth Day cleanup day. We had a really good turnout. Secretary: Alissa Nixon: We are on summer hours now everything is going good in the office. Legal: Fred Schuster : 2 nd reading of septic rule change Article 5 Section B: Owners shall submit copies of standing maintenance contracts to LTPOA within 30 days of the date these regulations are adopted by LTPOA and thereafter at the time the annual dues are paid. (Prices for contract work may be obliterated on the contract documents or work reports at the owner s option). This shall be in accordance with the state of Ohio EPA requirements of annual filing to the Columbiana County Board of Health. A motion was made by Rob Boso, seconded by Dick Taggart and unanimously carried to accept the 2 nd reading of the new rule. I have a list of property owners that are behind in their dues, and are making payments regularly. We are going to send a letter stating they are behind and if they are making payments the payments can t exceed 3 months. If the dues aren t paid in 3 months we will take further legal action. I called Fidelity, our collection company and I am waiting for a call back from them. I am going to call property owners that owe money and tell them they either pay their dues or the other options would be to pay the back taxes and sign the property back over to the lake or we will send them for legal action. Treasurer: Paul Buncic: YTD income through the end of is $361,310 YTD Expenses $119,652, YTD Net $241,658. The income is in line with previous years. We will probably collect around $410,000 in total this year. A motion to approve the Treasurers report was made by Alissa Nixon, seconded by Fred Schuster and unanimously carried. Security: Rob Boso: Going to try and have the guys work a little more in the mornings coming up in June. From the Security report we had 15 complaints, 1 Ambulance call, 7 fishing badges, 7 lake assists and 4 dog complaints and 1 report written up. Association Programs: Alissa Nixon : We will be having teen night at the end of July. We aren t doing the LUAU this year after the annual meeting, going to go back to the covered dish. A big thank you to Nancy Parker for doing the lunch for all the helpers at the cleanup day!!! 2 Conservation: Dick Taggart: I would like to thank Tag for the collars on the seepage pipes down at the dam, now we just need to make sure we keep it mowed down there. We are hoping to start checking the lake next week. The Sportsmen s club has offered to paint the garage if the lake would pay for the paint. Adam noted that would be fine, but he would prefer someone that is going to do the painting go and buy the paint to make sure they got the right stuff then we could reimburse them. Beach: Rob Boso: We drug the beach and volley ball court, got the swim buoys in and ordered some new buoys for the beach area. The basketball hoops that Jim had brought we are thinking about selling them for half of what we paid for them. They won t work down at the courts. Tag Lewis made a motion to go ahead and sell them, it was seconded by Alissa Nixon and unanimously carried. Hunter has agreed to drag the beach again this year. The ski slalom should be going in this week. Maintenance: Tag Lewis: I have an estimate on getting the dead trees cut down around the lake. I reached out to 3 companies and got one estimate back from Ken s Tree Service in the amount of $7500. I will try and get more estimates. Our maintenance worker did cut a couple of the dead trees down that were on the list. I talked to him about banking hours he works if he goes over his 15 hours a week and he agreed that would be something he would do so that when he doesn t get 15 hours we can compensate him. The board agreed to that if he was fine with it, we just need to make sure someone is keeping track of his time to bank. He has been doing a lot of ditch cleaning. He would like to bring in his brush hog to get some of the Access areas cleaned up so that mowing could be done properly. Dick noted that he heard a complaint from someone that would like to make sure that if other people are cutting down trees and taking the wood to have them clean everything up including the brush left behind. It was noted that the next time someone asks if it s okay to cut down trees we will make sure that we note everything must be cleaned up. Marina: Jim Ohle : We were open for the weekend, we have 3 returning workers and 1 new employee. We got a new credit card machine. As of the 20 th of May, we will be open every day through the rest of summer. Things are going well, we had almost $900 in sales over the weekend. The weekend specials will start soon. Roads: Adam Pusateri : The road sweeping is done, bill for $2350. Rob Boso made a motion to approve the payment, Matt Parker seconded and it was unanimously carried. Advanced Asphalt finished his job and a final payment of $1379 is still needed. I will drive around and make sure everything is done before we pay him. Gave Lipp area on Iriquois where ground is falling in beside the road. Corner of Iriquois and N. Yuma, told him to dig down and see what was going on and to give us an estimate. Culvert bid out for Access 3, only received one bid back from 6 companies and it was from Lipp. His bid was $ , motion was made by Tag Lewis, seconded by Alissa Nixon and unanimously carried to approve the bid. I m still working on a few other things. New Construction and Septic: Matt Parker: 2 nd letter for septic pumping went out to 1 person. A 1 st letter went out to 3 property owners dues in June and July. We have approved a few docks, going to approve a dock tonight for Adam, the shed that came on before I came on the board has arrived and it s beautiful. Looked at a property that security told me about that they thought septic was leaking into the lake. I will speak to the property owner and go back out and check it out before I do anything. We approved the shed up on Ottawa.

4 From Association Programs: I would like to thank everyone that came out and helped for the July 4, holiday. To all the volunteers a very big THANK YOU: Bob & Bobbi Houk for doing BINGO, for Bea DeFazio, Lisa Moore and Barb Harding for doing the Chinese Auction and for Stephanie and Brian Maurer and all the great moms out there who came and helped with the kids games. A big shout out to everyone who donated to the Chinese Auction and everyone who purchased tickets. We collected $ from the auction. 8 LAKE TOMAHAWK SIP AND PAINT FRIDAY, SEPTEMBER 15, :00 pm at The Lake Beach Pavilion Cost of $30.00 CASH per person to be paid at the Lake Office with Sharon prior to event. There is a limit of 45 students so get your spot locked in to guarantee your seat. It is not just for ladies, couples are welcomed. Please bring a beverage for yourself and an appetizer to share. There will be door prizes!!! Update will be on the lake website and also posted on Facebook. Don t delay as the spots will fill quickly! 8

New Membership Applications: -Mark & Debbie Emmerling, Chippewa Trail (Previous Owner: Hardee) motion to approve was made by Rob Boso, seconded by Tag Lewis and unanimously carried. Old Business: A property owner had asked about putting a dock in over at Access 4 Matt noted that with the catch basin where it is he didn t know if it would be possible to put a dock in that area. Jim noted that the property owner asked him if it would be possible to maybe extend the Marina docks. It was noted that this would have to be looked into. New Business: Nancy Parker would like to start doing the welcome committee again. Think this is a good idea, maybe something she ll post on Facebook and get input from everyone. Sportmen s club can paint the garage with us paying for the paint. We would like them to purchase the paint and we will reimburse them. Had some vandalism couple different places around the lake, signs ripped down, and debris was tossed into the lake and we had to go out and retrieve it. PROPERTY OWNER OPEN: -A property owner had a few complaints from items that were noticed around the lake. First house that looks like it isn t being taken care of with tall grass and the house looks like it s going to fall in, it was noted that the grass has been taken care of. Second was a complaint of a Clothes line that was put up. The board noted that there was nothing in the Rules and Regulations about putting up a clothes line in your yard. Third complaint was about a property owner not having the siding completed on the back of their garage. It was noted that it has been this way for a long time and that there is a rule about that and why is nothing being done? And also, all the Trash that they have thrown on the hillside. The board noted that they would talk to the property owner and get it taken care of. Adjournment: The meeting was adjourned at 9:03 pm. MINUTE APPROVAL: The minutes from the May 16 meetings, were approved. A motion was made by Rob Boso, seconded by Dick Taggart and unanimously carried to approve the minutes. ANNOUNCEMENTS: Nancy Parker is going to start up the welcome committee again. She ordered some mugs to hand out, going to put things in the Smoke Signal about it. She is also planning a Sip and Paint for some time in September. EXECUTIVE COMMITTEE: None 11 REPORTS: President: Adam Pusateri: Would like to thank the Sportsmen s club for a great breakfast and holding the kids fishing derby. Bob Fair has the pieces for the valve, we just have to make sure they fit. The vandalism that happened here at the lake was widespread, it didn t just happen here in the community. Secretary: Alissa Nixon: We are on summer hours now, everything is going good. Sharon is ordering more car hangers, we ran out this year. A motion to approve the Treasurers report was made by Rob Boso, seconded by Alissa Nixon and unanimously carried. Security: Rob Boso: The vandalism that happened over Memorial Day didn t just happen here at the lake, cars outside the lake on Carmel Achor were also vandalized. I have Security working a lot of different hours during the week. Looking into getting some security cameras for around the lake. I have a few quotes, one for $ that only puts the cameras at the entrance and one for $ that would put cameras at the entrances, garage, beach, and marina. It was suggested to maybe get a few other quotes before we decide. From the Security report we had 349 hours worked, 104 miles driven, 12 complaints, 2 Ambulance call, 1 alarm, 2 traffic stops, 2 lake assists and 6 dog complaints and 7 report written up. Information from the dog attack last month I went up to the house of the owner that has the dog, the dogs don t seem mean at all, they were up there playing. The dogs are never outside without someone being out there, the day of the incident the kid went outside and didn t close the screen door all the way and the dog got out. As soon as the owner realized it, she went out right away to get the dog. Speed sign was donated by Ed Martin, we ve been pulling it around on different days to the heavy speed areas. We ve had it out a couple times. Association Programs: Alissa Nixon: July 4 th is coming up, Bob Houk is once again handling the fireworks, so a big thank you to him for that. The Houk s will also be handling BINGO and Lisa Moore and Bea DeFazio are once again going to do the Chinese Auction. Planning teenager night sometime in July and the Annual meeting is August 5. Conservation: Dick Taggart: We went out and check the lake last week, it rained really hard the day before we checked so the results may not be what they normally are. I will let everyone know once we get the results back. Beach: Rob Boso: Everything seems to be going good down at the beach so far this season. Hunter is going to drag the beach again for us. The basketball poles we purchased that we can t use cost us around $ so we are going to list them at half that when we sell them.

14 MINUTES FROM PAGE 11 Cont Maintenance: Tag Lewis: Roger has been cutting down some trees and did some brush hogging. He is doing a really good job around the lake. Marina: Jim Ohle : We ve been open about 4 weeks now and things are going pretty good. We have had a few electrical repairs done. Sales are doing really good so far this year. Made a few calls about checking on gas prices and I think we are going to stick with Kelly Oil. Their prices are right in line with others I called. We did have some minnows to sell and they sold pretty good one weekend and not so good the next. Roads: Adam Pusateri : I ve been trying to work on a couple projects to get out for bid, but I keep running into a bunch of snags. There is a ditch that needs fixed that I thought belonged to one property owner but actually it belongs to 2. I ve been in contact with the one property owner and he is good with paying for the pipe, the other property owner I haven t been able to get a hold of, I will try again and if I have no luck getting in touch with him we will remove the pipe and he can take care of it himself because we have to get it fixed because it s failing. Some of the projects I was looking into we are going to have to put to the side for now. We received two bills from LIPP that need approved. The first one is for the culvert in Access 5 and it s for $3424. A motion was made by Matt Parker, seconded by Alissa Nixon and unanimously carried to approve payment. The next bill was for the hole in the road over by Iroquois and N. Yuma in the amount of $2, A motion was made by Rob Boso, seconded by Alissa Nixon and unanimously carried to approved payment. New Construction and Septic: Matt Parker: Put in Smoke signal that if you are going to be doing any type of construction that you need to submit the plans for it even if it doesn t require a permit you still need to submit the plans to the board. Property owner questioned on who was to make sure that if someone saw a building or something going up who is supposed to make sure the owner has a permit? It was noted that if you see something and aren t sure to just go ahead and contact security and they can check it out. Old Business: I remember talking about this, but don t remember if we decided anything on it. Should we go ahead and put the meeting minutes on the website once they are approved so that people don t have to wait so long to read the minutes. It was decided to go ahead and do this. New Business: PROPERTY OWNER OPEN: -Property owner from lot 683, 684. About a year ago I brought up about the tree heights around the road and it doesn t look like anything has been done with a lot of the trees. It doesn t look like the berms are being taken care of like they re supposed to be either. Shoshone Trail and Tomahawk has grass in the culvert and it s choking the culvert, Pancake was dumping the grass in there and it s still being dumped. I was told a letter was sent to him maybe another letter needs sent. Trailers sitting along the road, is there someplace that people can park these Trailers so they aren t along the road, this is causing the berms to not be able to be mowed. Year ago, that the road down here was patched, when is it going to get fixed? Adam noted that Lipp is going to fix it as soon as we get him a job out here when there is more asphalt needing put in. Adam noted that he talked to Tag and he is going to get the maintenance guy out there to work on it. -Property owner of lot 37 noted they are having an issue with a culvert that runs under the road and draining into their property. The property owners showed pictures of the damage the water was doing to their property. Adam noted he would be out to look at it and get it fixed as soon As possible. -Property of lot 710 noted that he thought the shrubs out by the entrance needed to be trimmed back. It was said that he had noticed a few cars going out couldn t see to the right because of the shrubs and almost got hit. This is going to be considered. His other issue is the house next To him with the leaking septic. He wanted to know where things were at with this issue. Matt noted that he received a letter from Columbiana Health Department stating that they approved the new septic and it s now with the State waiting for their approval. Matt noted that if we don t receive some resolution soon then the board can consider fining the property owners. The board also has the option of shutting the water off to the home if we see they aren t working to get the issue fixed. Adjournment: The meeting was adjourned at 8:43 pm. 14
