Why, the All American Picnic in the Park, of course! Hey, when Mother Nature gives you lemons (like rain on July 4th), you make lemonade and burgers, funnel cakes, Italian ice and boiled peanuts! What better way to spend a nice fall afternoon and evening than on our own Town Green, visiting with friends and neighbors, eating our hearts out with tasty southern favorites, being entertained by a fabulous DJ, playinng fun picnic games, enjoying live music by Depature (a Journey Tribute Band), and finally, topping it all off with the BEST fireworks show in Northern Georgia! So you think you can bake? We re still looking for Legacy Park s best Apple Pie Bakers to enter the Apple Pie Contest. Kennesaw s Mayor, Mark Mathews and City Council Members will be doing the judging. If you d like to put your best recipe to the test, please Trasey Welton at trasey.welton@legacypark.org? The event is free to residents with your valid LP ID and $5 for guests. Guest tickets may be purchased in advance at the HOA office or at the gate the day of the event. 2 HOA News & Information Property Management Update HOA Items: During 2013, the HOA has collected a total of $4,225 for non-resident sport participation fees compared to $4,505 in During 2013, the HOA has collected a total of $920 in vending machine proceeds compared to $1,150 in Collections: In Northgate, we currently have 33 (of 213) properties turned over for collections with the HOA s law firm, Lazega & Johanson. The breakdown of the cases is as follows: 9 new cases for 2013 with liens filed 15 cases currently in suit and/or collecting judgments 2 cases in current bankruptcy 7 cases where we have judgments against previous owners In Legacy Park, we currently have 78 (of 1745) properties turned over for collections with Lazega & Johanson. The breakdown of the cases is as follows: 17 new cases for 2013 with liens filed 39 cases currently in suit and/or collecting judgments 9 cases in current bankruptcy 13 cases where we have judgments against previous owners Amenity Monitoring: Advanced Protective Services is now on Legacy Park property daily; please remember to bring your Legacy Park ID with you when you are on common property. The guards monitor all the amenity areas, including playgrounds, the lake, etc. The guards turn in daily reports and the HOA has access to monitor their travel in their vehicle. The Kennesaw Police continue to work Friday, Saturday and Sunday evenings off duty, and they monitor Legacy Park s property. Remember that neither the police nor the security company provides any security to privately owned property. We have daily contact with the security guard and pool management companies regarding issues that need to be addressed from asking residents for IDs to emptying the trash. If you see an issue that is not being addressed, please contact the HOA office. Playgrounds: The play set and swing beam at the Lullwater playground located on Kirkwood Drive have been replaced. We hope everyone enjoys this improved playground, it looks great! The drainage issue has been corrected at this site as well. We will be refreshing the mulch at the playgrounds in the next two months; replacing the slide and adding a picnic table to the Lullwater Playground on Kirkwood Run; and painting the swing at the Highcroft Playground. Projects in Progress: Repairing brick and concrete at the Picnic Grove; repairing and painting the Bell Tower; repairing the fence at the Bellingrath entrance; repairing the retaining wall around the Lullwater Pool parking lot; repainting and improving the Champions Field sign; adding a light to the Bandstand area to include the new fire pit and to the Legacy Oak Tree; repairing the parking lot at the main pool turnaround; painting the curbs around Legacy Park Circle; painting the guardrails on Legacy Park Boulevard and Circle; painting the Carillon monument; repairing ceiling in the Lullwater men s bathroom; repairing the fence behind the guardrail next to Bellingrath; repairing siding by the vending machines at the main pool house; repairing the metal roof on the main pool house; repairing or removing fence between Town Fair and the Olmsted Playground; and repairing an elliptical in the gym. Disc Golf: The second set of 9-holes of disc golf have been installed. Once we have walked the project with the vendor, final payment will be made and an updated map will be done. The second 9-holes can be found in the wooded area between the Town Green and the Tennis Courts. 2 HOA News & Information

3 Gramercy & Winterthur Sidewalk Repair: Residents will be notified when work will be in their area and if a tree must be removed that adjoins their property. The HOA will send out updates via as the project progresses and we receive updates from the City. Winterthur Playground: This project started May 7 and will be completed as soon as the new wooden structures are stained. Thank you to everyone for your patience and your input. Jiles Road Beautification: Hutcheson will install new landscape material this fall, as there is no irrigation in that area. Landscape: Maintenance of the grounds continues. The pine straw has been refreshed throughout the common property. We are working with Hutcheson Horticultural on plans for: the culvert between Lullwater and Kentmere, correcting a drainage problem at the basketball court fence and the Lullwater playground; planting ivy on the hill between Carillon and Bellingrath; addition of landscape material at the Palisades monument; and trail repair by the tennis courts, clubhouse, back trail and trail beside the old basketball court area. Projects completed: The clubhouse has been pressure washed, as well as the tennis pavilion and the windscreens on 7 courts. A treadmill has been repaired. The security system and fire alarm at the clubhouse has been repaired due to storm damage. We have worked at the direction of the City of Kennesaw in cleaning culverts and drainage ditches along Legacy Park Circle and the common property to better control the storm water runoff. WELCOMING OUR New HOA Staff Member The HOA has hired Doug Jones as the Covenant Enforcement Assistant. Doug is responsible for enforcing the covenants by overseeing the properties in Legacy Park that are leased. With the number of rental homes in Legacy Park having doubled since 2008 and continuing to rise, the Board found it necessary to have an additional part-time employee to ensure that all leasing regulations are being followed. Doug will be the point of contact in the HOA office for property owners who lease their property, property managers and tenants for turning in their leases, addressing CCR violations on their property, and paying the annual lease administrative fee. Remember, if you rent your home, you must follow the leasing regulations. Admissions Guidelines Admission to the Town Green begins at 4:30 pm. You may come down earlier to drop off your chairs and blankets but we need the field to be clear for set up until 4:30 pm. COST: This event is FREE to residents. You MUST have your Legacy Park ID for admission. Resident s guests are welcome to attend. Guest tickets are $5.00 for adults and children 2 and up, and can be purchased in advance at the HOA office or at the gate the day of the event. ENTRY: Please ENTER our Spirit of America Celebration via the Palisades Portal. This path can also be reached from the trail leading from the main pool parking lot. Entry to the Town Green will NOT be allowed at Lullwater or the baseball field per the Cobb County Fire Marshall rules and regulations prohibiting access within 300 feet of the fireworks. In addition, no one will be allowed to exit this area after the show. It is very important for everyone to observe this rule for the safety of all. Violating this guideline could result in loss of amenities privileges and entrance into the event WHAT TO BRING: Legacy Park ID, cash (food, drinks and glow bracelets, etc.), sunscreen, bug spray, hats, camera, blankets, chairs, flashlights, sunglasses, ice chests, etc. WHAT NOT TO BRING: No Umbrellas, Tents or Tables are allowed on the field. No dogs or glass allowed. TRASH: Trash Bags will be available at Admissions, please help keep Legacy Park s Town Green clean. IN THE EVENT OF AN EMERGENCY: Please go to our First Aid center located on the left hand side of the main stage or find a Kennesaw Police Officer. SPONSORS: Many of our sponsors will be offering prizes, raffles, and giveaways please stop by and visit them. Without their generous contributions, our Spirit of America Celebration and our other events throughout the year would not be possible. Please take a moment to show your appreciation. PARENTS: Please take a moment to set up a meeting spot for you family we don t want any lost parents this year. Let your children know that if you should get lost to come to the Information Table to let someone know and the MC/DJ can make an announcement. Kennesaw Police Officers will be on duty as well. Don t forget your LP ID! Residents without IDs will be charged admission, no exceptions.

4 All Pools Close SEPTEMBER 3rd EXCEPT the Main Pool Just a reminder that all of the Legacy Park pools, except the Main Pool, will close for the season on September 3rd. The Main Pool will remain open through Sunday, September 29th. The month of September will be Swim at your own Risk during the week, with lifeguards on duty on the weekends. Please remember to follow the rules no one under age 16 is allowed at the pool without adult supervision Budget Planning The Legacy Park HOA is gearing up for the 2014 budget. It s hard to believe it s that time of year again; it does come around so fast! All homeowners, Legacy Park groups, and neighborhoods are welcome and encouraged to submit budget requests to the HOA office. Requests should be made in writing and submitted to the property manager by September 13th. Please include as much information as possible concerning your budget request. Requests will be reviewed by the appropriate committee (if applicable), the Finance Committee, and the Legacy Park Board of Directors during the 2014 budget planning process. There is no guarantee that any or all requests will have funds allocated, but all requests will be considered. The Finance Committee meetings will be posted on the website; Legacy Park members are welcome to attend to see the process of preparing a budget for our community. The budget will be presented for approval at the November 21st Board meeting. Sign up today and stay informed about Legacy Park! 4 HOA News & Information SCHOOL IS BACK IN SESSION With all the local schools back in session, please remember to watch out for children. Bus stops are at intersections to roads and many parents drive and park there. These areas can be very dangerous if you don t pay attention. By slowing down and using caution, you can help prevent an accident. Let s all do our part in keeping our children safe. Parents, please remember to pick up the trash from the bus stop. Thanks! PARKING ALONG LEGACY PARK CIRCLE The fall sports are starting up again in Legacy Park and the circle will be crowded on Saturday mornings and throughout the fall tennis season. Please follow the guidelines below when parking along the circle within Legacy Park. Failure to do so could result in ticketing and/or towing by the City of Kennesaw. Only park on the INSIDE of the circle Only park WITH the flow of traffic Do not park in any area where the curb is painted white (intersections and loading and unloading zones.).it is illegal to park within 30 feet of an intersection! There are signs posted in these areas as well! Do not park in front of the fire hydrants DO NOT park on both sides of the street! Additionally, if there are cars parked along the circle, please SLOW DOWN! It can be difficult to see a child coming out from between parked cars until it is too late. Slowing down and paying attention could save a life. The HOA has asked the City for assistance with the parking issues, after all, safety is a top priority. Thank you in advance for your cooperation! OFFICIAL LEGACY PARK COMMUNICATION In this day and time of mass communication opportunities, please remember that the following are the official avenues for communicating Legacy Park information: correspondence on LP HOA letterhead; the Legacy Park Town Herald newsletter, Legacy Park website, and Legacy Park distribution from the property manager. 5 JULY BOARD MEETING Unofficial Notes At the July meeting, in attendance were five Board members, three office staff and seven residents. The Board took the following actions: Unanimously approved the previous Board Meeting Minutes and the June Adjustment Report. Reviewed reports provided by the Boy Scouts, Education Committee, Swim Team, Tennis Committee, Tennis Pros and Youth Soccer. Please note that all committee meeting minutes that are provided can be found with the approved Board meeting minutes monthly. Approved the color of stain for the new wooden structures at the Winterthur Playground to match the stain on the other wooden structure with at 4-1 vote (Lisa Ashmeade, Allen Massey, Nimesh Patel, and Tim Smith voting yes and Bob Mulligan voting no). Unanimously approved the 2012 Audit Report submitted by Jack Houseal. Unanimously approved the Basketball Clinic and Training program for the fall of Unanimously approved the fall tennis nonresident ratios at 21%. Unanimously approved the increase in the youth soccer fee. Unanimously approved a resolution for the appointment of a committee for selection of recipients of the Lifetime Achievement Award. Reviewed and decided 5 covenant appeals. The complete set of minutes for a Board meeting is typically approved at the Board meeting the following month. Once the minutes are approved, they may be viewed in a secured section (for Legacy Park homeowners only) of the Legacy Park website or in the Legacy Park HOA office. 7 STORY TIME is back! KBfit Bootcamp, Personal Training, and Small Group Training! The new 8-week bootcamp session began Monday, August 5th. You can attend classes any time during the session no need to wait until the next session to get started. Night classes have been added back to the schedule. If the class schedule does not match your schedule, contact KBfit for personal training and/or small group training. Fees have also changed to eliminate wasted classes and money. 9 THERE IS STILL TIME TO REGISTER FOR ACE OUT CANCER FUNDRAISER & TENNIS MIXER IN MEMORY OF OUR FRIEND AND NEIGHBOR KELLY DONAHUE It is super easy.just visit to register/donate online for this great event. Non-tennis players and tennis players alike can attend Ace Out Cancer on Saturday, September 28th, from 6 pm to 11 pm for a fun night of fundraising and tennis. Ace Out Cancer will be held at the Legacy Park Community Clubhouse and Tennis Pavilion. The event will include a live band, a silent auction, an adult tennis mixer (must be 21 years of age or older), a tennis exhibition, a spectacular fireworks show, raffles for numerous tennis racquets and food provided by several local restaurants including Henry s Louisiana Grill, Fuscos Via Roma, Johnny s Pizza and D liteful Bitez. Various beverages will also be provided. Each participant will receive a goody bag that includes an Ace Out Cancer commemorative cup, a tennis towel, ear buds, water bottle, various coupons and discounts. The entry fee for this great cause is a $30 donation per player, a $50 donation per couple or a $20 donation per non-player. Tennis players must register in advance and participation is limited to 60 players. All levels of tennis are welcome. Ace Out Cancer 2012 raised over $10,000 to support Kelly Donahue and her family and to raise awareness about lung cancer. Kelly lost her courageous fight against lung cancer on June 3, Ace Out Cancer 2013 is being held in memory of Kelly. 100% of the proceeds will go to Kelly s children and to support Lung Cancer Awareness. 10 School & Community News WARRIOR WAY 5K Saturday, September 21st Be a part of the tradition of excellence! Join us for the 6th Annual North Cobb High School Warrior Way 5K run/walk on Saturday, September 21st. Enjoy Cauble Park at Acworth Beach after running the Warrior Way with your friends and family, and elebrate a community that plays together. The Warrior Way begins at 7:30 am at Cauble Park, Acworth Beach, and runs through shaded, historic Acworth neighborhoods, ending back at the beach. The 1K Fun Run starts at 8:30 am in Cauble Park. 12 Clubs & Committees Legacy LEGACY PARK SHARKS The Legacy Park Swim Team ended a great swimming season. Tommy Cellini did a great job as head coach assisted by Thomas Locke, Eric Ramos, Kelly Riedesel and Stephen Taylor as junior coaches. Our swimmers participated in five meets competing against swimmers from other Cobb County Teams. We took 23 swimmers to the Patti Wilder County Qualifying meet where six of our swimmers continued to the Georgia State meet in Gainesville, Georgia placing in the top ten individually. We are so proud of our swimmers this year as they worked tirelessly to improve their strokes, technique and swimming speed. Lunch, often lasting for hours, is considered by native Italians to be a standing tradition for gathering and socializing with friends and family. Members gave their unanimous thumbs on August 14th while dining on pastas, salads, and sweet desserts. Chianti wine bottles on red checkered tablecloths transformed the Clubhouse into a quaint bistro, while in the background Italian operas and Neapolitan songs serenaded members. Congratulations to all the members for being so knowledgeable about Italy's culture, history and landmarks in the fun trivia game! On August 2nd a few members went to a luau dinner and dance sponsored by OLLI, the Osher Lifelong Learning Institute. OLLI offeres classes for seniors through the Kennesaw State University College of Continuing and Professional Education. Pop the champagne and blow out the candles! We are turning 5! On September 20th the club will be marking an important milestone in the history of the club. 13 MAYOR S CORNER SEPTEMBER 2013 Hello, Neighbors! It s budget time for our city government, and the City Council has voted to leave Kennesaw s millage rate for 2013/2014 unchanged so homeowners and businesses will see stability. So again this year, we ve challenged City Manager Steve Kennedy and his staff to offer up a plan that maintains our current service levels even though our tax collections are still declining. The good news is that the rate of decline has slowed considerably and we re optimistic that this will be the last year of the downward trend. Thanks to the superlative efforts of our community development team, business growth in our city continues to improve, which will have a very positive impact on our local economy in terms of job creation and revenue generation. Several noteworthy development projects downtown are in various stages of completion. They include the recently opened Burgerfi Restaurant on Main Street, the Lazy Guys Distillery on Moon Station Road, and the Adore Bridal Boutique at Moon Station and Main. We re also excited to see the openings of the new facility housing the Metro Bank at Cobb Parkway and Kennesaw Due West and the Main Street Pharmacy at North Main and Jiles. Several other industrial and commercial projects are also in progress. It s great to see this level of activity and we re looking forward to watching the development unfold. This month features several great events on our streets and in our parks. Saturday, September 7 begins with the Great Locomotive Chase 5K race at 7:30 am with proceeds benefitting the Southern Museum. It s the 4th race in the Kennesaw Grand Prix series which takes place downtown and through Swift-Cantrell Park. Once you ve gotten your exercise, you ll have the opportunity to sample all kinds of tasty offerings at the Taste of Kennesaw, guilt-free! On September 21, take your dog to Swift-Cantrell Park from 9 am noon for the third annual Paws in the Park Kennesaw sponsored by Dreamland Pet Memorial Center and hosted by Keep Kennesaw Beautiful. 15 FIRST AID/CPR CLASS LEGACY PARK RESIDENTS Do you know exactly what to do in case of a medical emergency (administering First /Aid CPR)? If yes, have you taken a refresher course in the past two years? If you answered no to either question than you will want to register for this potentially life-saving course. A First Aid/CPR class will be held on Saturday, October 19 from 9am-12 pm at Primrose School of Kennesaw North. The class covers proper care for infants, children and adults who may need emergency assistance. The cost of this 3-hour class is $25.00 and is due within five days of enrollment. The third annual Legacy Park MUST Summer Lunch Initiative in the Legacy Park Clubhouse got it done! On May 9th, ALL of the 2,000 children in Cobb County registered with MUST were provided a lunch by Legacy Park. The MUST flier states, Few things are as important as feeding a hungry child. You and your neighbors worked together to do something VERY IMPORTANT! Here are the grand totals: 20 teams 200+ participants 2199 sandwiches 2001 lunch bags Every bag and every sandwich counts! MUST set a goal of serving 2,000 meals in Cobb County each day over the summer. When you look at the numbers, our accomplishment is no coincidence. Once again, Legacy Park s generosity and teamwork made it possible. Thank you so much to all who participated.
