3 Maritime Conference & Technology Exposition International Exhibition & Conferences 2010 THE INAUGURAL FUNCTION India has more than 7000 miles of coast line and is a major supplier of human resources for the world maritime industry. However, Indian Shipping Industry has been going through a slow growth phase and grappling with the challenges that restrict the advancement of this sector in the country. Second edition of Shipping, Marine & Port World Expo, by CHEMTECH Foundation opened in a glittering ceremony on 3rd March 2010 at NSE Grounds, Goregaon in Mumbai. The occasion was marked by the presence of stalwarts from the Indian as well as international Shipping Industry from the public and private sector. Mr. K. 4 Inauguration SMP has brought all the stakeholders together to share all the commercial, technical and other aspects, which will benefit all stakeholders including shipowners, shipbuilders and other personnel from the industry. Mohandas, IAS Secretary, Ministry of Shipping, Govt. of India releasing the Shipping, Marine & Ports World Expo 2010 EXHIBITORS DIRECTORY As far as port infrastructure is concerned, there has been some inadequacy in the infrastructure but the actions taken in the recent past have led to creation of substantial additional capacity in the Indian ports. Hopefully in the next few years, it will be possible for Indian Ports to provide comfortable movement of traffic, 25 to 30 percent in excess. Secretary to Govt. of India Shipping is the least polluting form of transport since its level of emissions is much lower than all other modes of transport. India has the best seafarers and the nation can become a global maritime hub if we can remove certain impediments vis-à-vis maritime law and insurance. Since its inception SMP World Expo has been one of the key forums wherein such critical and crucial issues are discussed and deliberated in great detail. Mr. S. The establishment of Confederation of Indian Maritime Associations should be taken up on a priority basis. Industry events like SMP World Expo provide the perfect platform to discuss and review the state of affairs in the Indian shipping industry. Mr. D. T. But, since the past couple of years, the Indian shipping industry has not been growing at the expected rate. This is the right time and SMP World Expo is the right place for the industry and government to introspect and identify the growth inhibitors and drivers. 5 Maritime Conference & Technology Exposition International Conferences 2010 Shipping, Marine & Ports 2010 Theme : Maritime Industry the Vision for Growth Indian economy has shown sustainable growth that is reflected in major expansions in various shipping companies, shipyards and ports. Projects worth USD billion have been identified, for implementation up to under National Maritime Development Program (NMDP) that would cover entire gamut of activities in major ports. Over 100 billion USD investment is envisaged in the next 10 years in this sector. Despite the sustainable growth of the country, industry has come across various challenges during the past two years. SMP 2010 created the ideal platform for Shipping, Maritime Ports and Trade fraternity to present their ideas and exchange their opinions to address the challenges industry was grappling with. Commercial and Legal Aspect of Shipping (L to R) Mr. S. Venkiteswaran, Senior Advocate, Capt S. In the olden days, when ships were taken out, the stronger or the mightier swallowed less mighty. In India, Admirality Jurisdiction was first exercised by virtue of colonial legislature call the Colonial Admirality Jurisdiction Act passed by the British Parliament, which said that the courtesan Bombay, Calcutta and Madras will exercise the same Admirality Jurisdiction as exercised by English courts over the territory of Great Britain. Indian High Courts are superior courts with unlimited jurisdiction. Mr. S. Venkiteswaran, Senior Advocate Wreck, typically connotes to us a vessel line on the ocean floor or typically, a vessel that has been stranded on the rock, shore and seashore. There is a probability that the protection and indemnity insurance be inadequate to meet the wreck removal cost. Perhaps, when we are considering evolving rules rising out of, and provisions rising out of wreck removal conventions, perhaps we can consider effectively insuring recovery. There have always been cases where we thought about managing risks. Due to inadequate shipyard capacities in India, Indian Navy will have to outsource construction of naval ships to other countries. In India new shipyards have been set up such as Pipavav many others have gone for expansions, which is going to set severe competition in the near future. Apart from the issues such as safety, environment etc the shipbuilding industry will have to deal with the challenges of diversification and capacity utilization also during the years to come. Industry must focus on sustainable transport rather than shifting environmental problems to marine environment. This would call for a Mr. U. S. Korean Register of Shipping has recently released a special detecting produce based on Ultrasonic testing against miss leading of defects. Reduced liquidity from international markets will place greater demands on local bank. There is a need to protect reputation of local shipbuilders. PRC trade growth converts to a growing share of container trade displacing other exporters. Intra-Asia trade is opening up new port investment opportunities. Present capacity of the major ports is around 5.75 million tonnes, which is expected to increase up to 1000 million tonnes during the next two years. Some of the states like Orissa, Gujarat, Karnataka, Maharashtra and Andhra Pradesh are picking up fast. Mr. S. S. Hussain Chairman - Indian Ports Association and Jawaharlal Nehru Port Trust Traffic at major ports is expected to grow at a CAGR of 4.9% and non-major ports at a CAGR of 19.5%. Continued expansion by private players at nonmajor ports and new private sector operated ports will result in capacity growth at a CAGR of 12.3% over the next five years. Congestion levels at ports is set to decline with capacity utilization at ports expected to decrease from 83% in to 74% in due to faster growth in capacities compared to traffic. Ports need to be pro actively on the look out for better cargo handling solutions. Our ports and port operators must embrace latest technologies if we are to achieve our full potential. By 2020, use of fuel is expected to increase to 490 million tonnes and emissions to 1.5 billion tonnes. Regulators are considering adoption of a new mandatory instrument to control emissions from shipping. Performance Standards for Protective Coatings provides technical requirements for protective coatings in dedicated seawater ballast tanks of all types of ships of not less than 500 gross tonnage and double side skin space arranged in bulk carries of 150 M in length. This standard is based on specification and requirements, which intend to provide a target useful coating life of 15 years. Piracy has been around the world since a long time but over the last few years the increase in number of incidents has become the biggest bone of contention for the ship operators. The dimension of piracy has change in past three or four years. In 2008, about 875 seafarers went through odd deals and 9 were killed. Total estimated ransom varies from USD 50 million in 2008 to USD 130 million. In 2009, the figure is above USD 85 million. On one hand there is security risk and on the other hand you are also saying give me freedom on economic grounds because Indian sea farer is taxed. The legal framework as it stands today does put forth many options, therefore to plunge into an Indian coast for Indian ships by way of guidelines that the directorate issues is really not the way.we have to take a straight view and amend our laws accordingly. Many issues raised in this forum by shipping, maritime, ports and trade fraternity may take some time to be addressed, however, industrial fraternity will have some questions to take with them to be discussed further in another forum. Cabotage Act must be implemented strictly with the objectives to promote Indian ship owners, create employment opportunities for Indian sea farers and promote indigenous shipbuilding yards. Mr. S. K Shahi, Chairman & Managing Director, SKS Logistic Ltd Cabotage Law puts restrictions on hiring foreign flag vessels, which results in insufficient competition as foreign bidders are discouraged because of First Right Refusal. ONGC suggests that Right of First be linked to Government s price preference policy and be given to Indian Flag vessel owner only if the price quoted by them is within 10 percent of L-1 bidder of foreign Flag vessel. This restriction will ensure healthy competition, prosperity to Indian Flag owner as well as charters Ledger fair is an utopian idea which does not prevail in any industry on any part of the globe. This can exist in truest sense only provided the globe is completely open. When there are trade restrictions for Indian trade on certain shipping lines, it appears illogical to me that Indian trade be open to those particular shipping lines. Mr. S.
