4 History of the Meeting INTRODUCTION Meeting 1.1 The First Meeting of the ICAO Asia/Pacific Unmanned Aircraft Systems Task Force (APUAS/TF/1) was held at the ICAO Regional Office, Bangkok, Thailand from 03 to 05 April Attendance 2.1 The meeting was attended by 60 participants from 13 States, one Special Administrative Region of China and six International Organizations, including Australia, Bangladesh, Cambodia, China, Hong Kong China, India, Indonesia, Japan, Malaysia, New Zealand, Philippines, Singapore, Thailand, USA, CANSO, IATA, ICCAIA, IFALPA, ISO and ICAO. A list of participants is provided at Appendix A to this Report. Officers and Secretariat 3.1 Mr. Liu Hao, Director, Institute of Aviation Law and Standards, Beihang University (BUAA), China was elected as Chair of the APUAS/TF and presided over the meeting for its duration. 3.2 Mr. Shane Sumner, Regional Officer ATM/AIM, ICAO Asia and Pacific Office, was the Secretary for the meeting. He was assisted by Mr. Len Wicks, Regional Officer Air Traffic Management (ATM), ICAO Asia and Pacific Office, and the ATM Secondments from China (Ms. Zhou Ying, Associate ATM/AIM Officer) and Singapore (Mr. Raymond Seah, Associate ATM Officer). Language and Documentation 4.1 The APUAS/TF/1 met as a plenary throughout the meeting. The working language of the meeting was English inclusive of all documentation and this Report. A total of nine working papers (WP), 10 information papers (IP) and 12 presentations were considered by the meeting. The list of working and information papers and presentations is attached at Appendix B to this report. Opening of the Meeting 5.1 On behalf of Mr. Arun Mishra, Regional Director of the ICAO Asia and Pacific Office, Mr. Shane Sumner welcomed all the participants to the meeting. i

5 History of the Meeting Draft Conclusions, Draft Decisions and Decisions of APUAS/TF Definition 6.1 The ATM Sub-Group recorded its actions in the form of Draft Conclusions, Draft Decisions and Decisions within the following definitions: a) Draft Conclusions deal with matters that, according to APANPIRG terms of reference, require the attention of States, or action by the ICAO in accordance with established procedures; b) Draft Decisions deal with the matters of concern only to APANPIRG and its contributory bodies; and c) Decisions of the APUAS/TF relate solely to matters dealing with the internal working arrangements of the APUAS/TF. List of Draft Conclusions and Decisions 7.1 List of APUAS/TF/1 Draft Conclusions Draft Conclusion APUAS/TF/1-1: State UAS Regulations What: That, considering that some Asia/Pacific States are Expected impact: developing or have developed regulations for the safe operation of Political / Global small UAS in their national airspace, and recognizing that sharing Inter-regional regulation and procedure information between States and Economic APUAS/TF will lead to compatible development of State Environmental regulations and regional guidance, States are urged to: a) provide their State regulations and procedures relating to UAS to Ops/Technical APUAS/TF; and b) keep informed of the draft Asia/Pacific Regional Guidance for the Regulation and Safe Operation of Small UAS within National Airspace as it develops in order to facilitate the alignment of their regulations with the regional guidance. Why: To develop the guidance document between APUAS/TF meetings, for Follow-up: review and amendment where necessary at APUAS/TF meetings. 7 Report on Agenda Items REPORT ON AGENDA ITEMS Seminar on Unmanned Aircraft Systems 1.1 A mini-seminar on Unmanned Aircraft Systems (UAS) was conducted to provide some introductory information to the meeting. Presentations were made on: Japan s Safety Rules on Unmanned Aircraft; UAS in New Zealand; Japan s Research and Development Program for Small UAS Traffic Management; and UAS Overview (Industry) ICCAIA Perspectives on UAS Integration; and UAS Regulation in Australia 1.2 Outcomes from the seminar were subsequently considered by the meeting for the development of guidance material. Agenda Item 1: Election of Chair (if required), Adoption of Provisional Agenda 1.1 Mr. Liu Hao, Director, Institute of Aviation Law and Standards, Beihang University (BUAA), China was nominated by Cambodia for the position of Chair of APUAS/TF. The nomination was seconded by New Zealand. There were no other nominations. Mr. Liu Hao was duly elected as Chair of APUAS/TF. Adoption of Agenda (WP/01) 1.2 The provisional agenda (WP01) was adopted by the meeting. APUAS/TF/1 Terms of Reference (IP/02) 1.3 The APUAS/TF Terms of Reference (TOR) were provided so the meeting could note any relevant outcomes arising during the course of the meeting that may warrant an amendment to the TOR. The TOR were further discussed under Agenda Item 6 WP/09. Agenda Item 2: Review Outcomes of Related Meetings and Seminars Outcomes of Related Meetings (WP/02) 2.1 The Secretariat provided information relating to the formation of APUAS/TF from on: Fourth Meeting of the Air Traffic Management (ATM) Sub-Group APANPIRG (ATM/SG/4, Bangkok, Thailand, 4 to 8 July 2016); and The Twenty-Seventh Meeting of the Asia/Pacific Air Navigation Planning and Implementation Regional Group (APANPIRG/27, Bangkok, Thailand, 5 to 8 September 2016). 1

8 Report on Agenda Items 2.2 Information was provided on the Aviation System Block Upgrade (ASBU) Block 1 module B1-RPAS, the formation of a Small Unmanned Aircraft Systems Advisory Group (SUAS- AG), and on the forming of an informal body or regulators called the Joint Authorities for Rulemaking on Unmanned Systems (JARUS, which included Australia, China, India, Japan, Malaysia and the Republic of Korea among its membership. 2.3 The meeting was informed that the Asia/Pacific Seamless ATM Plan would include a new element relating to the management of ATM aspects of UAS, and that the element would incorporate B1-RPAS and include guidance material developed by APUAS/TF. Agenda Item 3: Global Update ICAO Remotely Piloted Aircraft Systems Symposium (IP/03) 3.1 State Letter AN 13/66-17/21 dated 1 March 2017 informed States of the Second Remotely Piloted Aircraft Systems Symposium, being held in Montreal, Canada, from 19 to 21 September The State letter was provided in APUAS/TF/1 IP/03 Attachment A, and would soon be made available on the ICAO website at The Chair requested that all participating States share their UAS-related regulations, and any amendment to those regulations, with the ICAO Remotely Piloted Aircraft Systems Panel (RPASP), to benefit the process of development of ICAO Standards and Recommended Practices and the harmonization of State regulations. This was further discussed under Agenda Item 5. ICAO UAS Web Resource and Toolkit (IP/04) 3.3 A web resource of information relating to UAS had been developed, which included inter alia a UAS Toolkit of information on operations, rules, guidelines and special authorizations. The web resource was available on the following ICAO web pages: State Obligation to Protect Civil Aircraft from All Pilotless Aircraft (IP/05) 3.4 State Letter AN13/55-17/38 dated 20 March 2017 referred to the outcome of the Second High-Level Safety Conference (HLSC), held from 2 to 5 February 2015, which recommended that ICAO expedite the development of provisions to be used by States to regulate remotely piloted aircraft system (RPAS) operations within their airspace and to educate users regarding the risks associated with their operations. The State Letter was provided in APUAS/TF/1 IP/05 Attachment A. Update on the FAA s UAS Integration Efforts (IP/06) 3.5 The Meeting was provided with an update on the Federal Aviation Administration s (FAA) activities to integrate Unmanned Aircraft Systems (UAS) into the U.S. national airspace system (NAS). Information was provided on UAS Regulations, and partnering with industry through the Drone Advisory Committee (DAC) and the Unmanned Aircraft Safety Team (UAST). 2

9 Report on Agenda Items 3.6 Information on the DAC, its members and minutes from its meetings were available at In response to a query, USA advised that the safety benefit of registration of all UAS operators, including recreational operators, were the provision of points of contact for use in the event of accidents or incidents, and in helping to identify and educate operators. The registration process included the provision of educational material. 3.8 The meeting discussed the use of the term drone to describe UAS, and was advised that it was more effective in capturing the attention of the public as that was the term in common usage and therefore more readily understood by the public. The Chair re-affirmed the terminology of RPAS which has been approved by the RPASP and the Secretariat, and encouraged the member states to use the terminology accordingly. 3.9 Policy on first person view racing vision for small UAS allows use of FPV, but does not allow FPV to be used as a means of see and avoid. Specifically, the FAA rule does not prohibit the use of FPV devices as long as the device is not used to meet the visual line of sight requirements of 14CFR Part USA was requested to provide updates to future APUAS/TF meetings on UAS regulatory development, and on any relevant outcomes of the DAC and UAST. Update on IATA Activities Related to Unmanned Aircraft Systems (IP/10) 3.11 A summary of IATA activity, input and participation in forums supporting safe integration of UAS into the airspace system was provided to the meeting. Information was provided on the active participation of IATA in activities related to ICAO alignment, JARUS, the Australian Senate Inquiry into RPAS, an Unmanned Traffic Management (UTM) event, the APAC RPAS symposium and workshop, and ongoing engagement in industry groups and task forces. Agenda Item 4: UAS Issues and Asia/Pacific Status Initial Integration of RPAS into Non-Segregated Airspace (WP/05 not presented) 4.1 Pakistan provided a working paper on the national policy for the management of UAS that was under the process of approval, in a bid to regulate UAS integration into the Pakistan ATM system. 4.2 The information provided discussed awareness, airspace management, integration of RPAS operations into ATM and ATM procedures, safety and security, and the need for development of a regulatory framework for the complete spectrum of UAS. The paper also discussed the effect of the national environment on compliance, monitoring, challenges, and the Pakistan Civil Aviation Authority (PKAA) roadmap for RPAS operations. APUAS/TF/1 WP/05 Attachment 1 provided a list of regulation requirements, provided an overview of airspace management in Pakistan, and listed operational aspects that should be considered. 4.3 The working paper was not presented to the meeting as Pakistan was unable to attend. Online Application to Educate and Improve UAS Operations (WP/06) 4.4 Indonesia informed the meeting that regulations for UAS operations had been in place since 2015, and were revised in

10 Report on Agenda Items 4.5 An online permit application process had been established, to provide UAS operators with: general information about manned and unmanned aviation regulation; and A UAS operations application form which included an automatic facility for inserting the operational area into aviation charts; 4.6 The meeting noted that some aspects of online applications, particularly related to automatic map generation, would be dependent on the quality of the aeronautical information. APUAS/TF should where necessary coordinate with other relevant regional bodies. Managing Small RPAS/UAS Operations in Developing Countries A Bangladesh Experience (IP/07) 4.7 Bangladesh presented information on the challenges faced by the aeronautical authorities in the Asia/Pacific region in the management of operation of RPAS/UAS, and their experience in managing the diverse operation. 4.8 Information was provided on categories of UAS operations, ATM and Air Navigation Service (ANS) aspects, and the Bangladesh experience. 4.9 Bangladesh clarified that the expression restricted airspace used in their presentation referred not only to special use airspace but also to civil controlled airspace. Status of UAS Operations in India (IP/08) 4.10 India provided the meeting with a brief overview of the progress of regulating the operation of Unmanned Aircraft Systems (UAS) in Indian airspace. The paper also highlighted a few issues faced by India while attempting to establish regulations for UAS operations. The meeting was informed of India s regulations for certification and operation of UAS, and issues pertaining to integration of small UAS into non-segregated airspace. Micro-Level Perspective on UAS Operations in Mumbai Airspace (IP/09) 4.11 The meeting was provided with information highlighting the possible issues that may arise during integration of RPAS operations in high density airspace like that of Mumbai in India. The paper suggested that evolution of SARPs, regulatory framework and Standard Operating Procedures should supplement one another. It was also suggested that the APUAS TF may undertake case studies in a few select cities in Asia-Pacific Region with respect to operation of RPAS in controlled airspace. Agenda Item 5: Asia/Pacific UAS Regional Guidance Material CANSO Input for the APUAS/TF (WP/03) 5.1 The meeting was presented with highlights of some of the work done by CANSO on the subject of RPAS/UAS, in particular, the CANSO publications relating to RPAS. ANSP Considerations for RPAS Operations was available on the CANSO website at The RPAS Introductory Training for ANSPs, was available to States whose ANSPs were CANSO members. 4

11 Report on Agenda Items 5.2 The CANSO publication ANSP Considerations for RPAS Operations provided information including inter alia RPAS attributes and applications, conduct of routine RPAS operations (ANSP perspective), operations and standards guidance, challenges to be overcome and examples of how some ANSPs had accomplished integration. 5.3 CANSO s RPAS and Emerging Technologies Workgroup (RPAS/ET WG) had produced a training module to provide ANSPs with a high level overview of RPAS operations from the ANSP perspective, with a focus on remotely piloted aircraft operating under the instrument flight rules (IFR) in controlled airspace. 5.4 The CANSO paper also highlighted a survey conducted by CANSO among its APAC Members on their practices and regulations on RPAS/UAS operations and recommended that a similar survey be conducted for all APAC States to serve as a reference for the work of the APUASTF 5.5 The meeting agreed that the APUAS/TF Small Working Group (refer WP/08) would develop a set of survey questions for circulation under State Letter by the ICAO Regional Office, to permit a comparative study of regulation of UAS in the APAC Region. Contribution to International Standards Development for UAS Manufacturing and Operations (WP/04) 5.6 ICCAIA and ISO presented an overview of the international standards development work that the International Organization for Standardization (ISO) had undertaken with the establishment of its UAS Subcommittee (ISO/TC20/SC16). 5.7 Established in 2015, SC16 had four approved work items that it initiated in 2016 with 36- month timelines to publication (2018). While SC16 had participation from some 20 different national standards bodies from North America, Europe, and Asia-Pacific, the volume of work to be done necessitated greater expert participation. 5.8 The SC16 scope was: The ISO UAS Subcommittee develops international standards in the field of unmanned aircraft systems (UAS) including, but not limited to classification, design, manufacture, operation (including maintenance) and safety management of UAS operations. 5.9 Three working groups had been established, WG1 General Specifications, WG2 Product Manufacturing and Maintenance and WG3 Operations and Procedures SC16 was seeking experts with expertise in the areas of: UAS categorization/classification; Autonomy; and Quality and safety programs for components essential to UAS design and manufacture The meeting was invited to nominate subject matter experts from Member States and industry to ISO/TC20/SC16 by sending their CV to the SC16 Secretary, by to cortney.robinson@aia-aerospace.org. Terminology and Concepts Describing Unmanned Aircraft Systems (WP/07) 5.12 The Secretariat presented information inviting discussion of the terminology describing UAS. 5

12 Report on Agenda Items 5.13 Figure 1 illustrated, for discussion by the meeting, a relationship between various categories of UAS for consideration by the meeting. All Unmanned Aircraft Systems 2. RPAS, piloted and tactically managed beyond visual line of sight (beyond VLOS) and often in direct communication with ATC. - Subject of ICAO global guidance (Doc RPAS Manual) and not within the scope of APUAS/TF 3. All other small UAS, generally less than 25kg, operated within or beyond VLOS. - Primary area of interest of APUAS/TF 4. Autonomous Aircraft RPAS during autonomous phases of flight, or small UAS either wholly or partly in autonomous operation during flight and not tactically managed beyond line-of-sight. - Autonomous operation of small UAS is an area of interest of APUAS/TF 5. Model Aircraft, which many States identify as those used for recreational purposes only, and for which globally harmonized standards are not considered necessary. - Not within the scope of APUAS/TF 5.14 The meeting agreed that APUAS/TF should coordinate closely with the RPAS Panel Secretariat to ensure the terminology describing UAS operations and systems used in the regional guidance material was aligned with current and planned terminology, and that other terminologies that were under development by bodies such as ISO and JARUS should be taken into account. 6

13 Report on Agenda Items 5.15 The meeting noted that some small UAS capability had developed to conduct operations beyond VLOS, and that regulatory guidance for these operations should also be considered by the Task Force It was also noted that there was some overlap of model aircraft and small UAS operations, and that APUAS/TF should consider some general principles relating to model aircraft in the development of guidance material. Development of Regional guidance for UAS ATM Integration (WP/08) 5.17 The Secretariat provided information relating to the development of regional guidance for the safe operation of small UAS within non-segregated airspace from an ATM perspective, in accordance with the APUAS/TF TOR The following schedule of meetings and work programme for APUAS/TF to complete its assigned task was agreed by the meeting: APUAS/TF/1 - Conceptualizing Discuss, develop and agree to the schedule of meetings and work plan of APUAS/TF; Agree to the initial draft version of the guidance document; Discuss a process for the examination of global and State regulations for UAS, for consideration in the regional guidance document; Develop draft principles for the regulation and safe operation of small UAS in nonsegregated airspace; and Consider forming a group of appropriate experts for the development, review and circulation of the draft guidance document between meetings; APUAS/TF/2 November 2017 Review First Draft Review, analyze, modify and agree to the first draft of the regional guidance document, taking into account regional and global developments; APUAS/TF/3 April or May 2018 Review Second Draft Review, analyze, modify and agree to the second draft of the regional guidance document, taking into account regional and global developments; Draft proposed amendments to the Seamless ATM Plan, to incorporate in that document background information and a linkage to the subsidiary UAS guidance document, and to propose high-level regional performance expectations relating to UAS. APUAS/TF/4 November 2018 Completion Completion of the final draft of the Asia/Pacific Regional Guidance for the Regulation and Safe Operation of Small UAS; Finalize the proposed amendment to the Seamless ATM Plan, taking into account any changes arising from the regional UAS guidance document. APUAS/TF/5 April or May 2019 Only if necessary. 7

14 Report on Agenda Items 5.19 It was noted that this was an aggressive schedule, but it would permit a final draft of regional guidance material and the related amendment to the Asia/Pacific Seamless ATM Plan to be presented to ATM/SG at its meeting in The meeting was provided with a skeletal draft of the regional UAS guidance document (APUAS/TF/1 WP/08 Attachment A) in the same structure and format as the Asia/Pacific Seamless ATM Plan and other related ATM guidance documents The meeting developed an initial list of draft Principles for the Regulation and Safe Operation of Small UAS (Appendix C to this report). To ensure the harmonization of State regulations and regional guidance material, the meeting agreed to the following Draft Conclusion: Draft Conclusion APUAS/TF/1-2: State UAS Regulations What: That, considering that some Asia/Pacific States are developing or have developed regulations for the safe operation of small UAS in their national airspace, and recognizing that sharing regulation and procedure information between States and APUAS/TF will lead to compatible development of State regulations and regional guidance, States are urged to: Expected impact: Political / Global Inter-regional Economic 8

Agenda Item 6: APUAS/TF Task List APUAS/TF Terms of Reference and Task List (WP/09) 6.1 The TOR as updated by the meeting are provided at Appendix D to the report. 6.2 The meeting agreed to the updated task list provided at Appendix E to the report Agenda Item 7: Any Other Business 7.1 No discussion. Definitions and terminology to be harmonized with global standards and guidance 2. Applicability of UAS regulations to members of the public, organizations, institutions or any other agencies operating or intending to operate small UAS. 3. Avoid national standards and rely on regional and globally adopted consensus standards to the extent practical in areas including safety, manufacturing and operational quality, and cyber security for both aircraft and UTM. 22. Regulations should be performance-based and technology-neutral. 23. Work toward a balance between airspace access and safety/security concerns through a risk-based approach. 24. Actively address cyber security concerns and promote a comprehensive ICAO framework that includes UAS with manned aviation 25. The principle of operator responsibility for their operation shall be maintained. 26. Member States and international organizations have raised concerns with regards the operational safety to manned aviation from conflicts with small unmanned aircraft. To address these concerns, the objective of the regional guidance for member States in the regulation of domestic suas is to identify the best practices amongst States for enabling and authorizing the safe operation of suas. 27. The regional guidance should be based on the notion of a pilot operating the aircraft from within the aircraft itself and more often than not with passengers on board. Removing the pilot from the aircraft raises important technical and operational issues, the extent of which is being actively studied by the aviation community 28.
