The website became offline back in March due to a cyber attack. A generic template page was created prior to the main site being created to ensure our clients and potential customers could still contact us. The new site has many features such as:- Advertising all the planned open courses and latest News as well as topical Safety Alerts, past newsletters which can be accessed for procument evidence. A Client Testimonial will be added monthly showing customer satisfaction as well as promoting the broad range of services we offer within the industries we serve. If you would like to contribute to the Testimonial page on our site, please get in touch. Lincsafe have been working in partnership with Jackson Building Centres... Throughout July and August to raise awareness to the dangers of disturbing Asbestos Containing Materials (ACMs). Twelve free taster sessions of one hour were given at 4 of Jacksons Building Centres (Lincoln, Scunthorpe, Sutton-in-Ashfield and Spalding) to highlight the current epidemic of Asbestos related diseases being experienced. Places on these sessions were booked by over 150 personnel. The feedback was extremely positive in confirming a general lack of awareness regarding the inherent dangers and also the lack of legislative training requirements for Non - Licensable material removal. Follow up training has proved to be popular and it is hoped to continue the taster sessions at other Jackson Building Centre Locations in November. 2 HSE PROSECUTIONS Every month we try to highlight issues sourced from different industries, below are this months selection... UPDATE Parcel firm fined d 150, after lorry reverses into worker s head Tuffnells Parcels Express Ltd has been fined 150,000 and ordered to pay 19,000 in court costs after an employee was seriously injured when his skull was crushed by a reversing lorry at the company s depot in West Horndon nr Brentwood, Essex. The Health and Safety Executive (HSE), prosecuting, told Chelmsford Crown Court that in the early hours of 23 March 2010, Simon Mason, 22, from Romford, Essex was working the nightshift as a warehouse porter. An articulated 45ft HGV trailer was being reversed into an open loading bay while Mr Mason waited to unload it. Mr Mason noticed the trailer was not positioned straight in the bay, so thinking it had stopped moving, he put his head around the back of the trailer to shout instructions to the driver. Just as he did so, the trailer came back further, crushing his head against the brick bay wall. Mr Mason received severe head injuries requiring constant care for months and had to undergo several operations. He returned to work in February but is still suffering some long term effects. The damage to the depot wall where Mr Mason was injured} HSE s investigation found Tuffnells had not assessed, controlled, or properly managed the risks arising from vehicle and equipment movements at its West Horndon depot. It had also failed to provide a safe system of work for its employees. After the hearing today at Chelmsford Crown Court, HSE Inspector Glyn Davies said: Working with moving vehicles is a high risk activity which causes significant numbers of major and fatal injuries every year in this country. Tuffnells is well aware of these risks and this horrific incident in which a young man could have lost his life would have been avoided had the company s senior management ensured such risks were properly managed in all of its depots. This firm could have put in place a physical separation between the porters, moving vehicles and the loading bays and a safe way for porters and drivers to communicate with each other. None of these measures were evident and so a worker was seriously hurt for no good reason. Last year, 17 workers were killed and more than 530 suffered major injury after being hit by moving vehicles while at work in Great Britain. Of these, two workers were killed and 130 received major injuries resulting specifically from contact with a reversing vehicle. Tuffnells Parcels Express Ltd, whose Head Office is in Shepcote House, Shepcote Lane, Sheffield, pleaded guilty to breaching Section 2 (1) of the Health and Safety at Work etc Act 1974 and was fined 150,000 with costs of 19, http ttp:// tp ://www w.hs hse.g eg ov. uk/ pre ss/201 s/ 1/coi- e-3 e3211.ht m
3 Meg Burgess Prestatyn -- wall death manslaughter charges Meg Burgess was walking with her mother and brother when a wall collapsed. A company director faces a manslaughter charge after a three-year-old girl died when a wall collapsed on a footpath in Denbighshire. Meg Burgess died in July 2008 after a breeze block wall fell on her as she walked with her mother in Meliden. George Collier is to face a charge of gross negligence manslaughter at Prestatyn Magistrates on 3 October. Mr Collier is a director of Parcol Developments Limited, which designed and built the wall. Crown Prosecution Service lawyer Rosemary Ainslie, who reviewed all the evidence, has also decided that the company should also be charged with an offence under the Health and Safety at Work Act. She also said there was sufficient evidence to prosecute the company for corporate manslaughter, but it would not be in the public interest 1 Worker crushed between two skips while urinating 17 August 2011 A recycling company has been fined 80,000 after a worker suffered life-changing injuries when he was crushed between two skips while urinating in the yard. Ayr Sheriff Court heard that Lowmac Alloys Ltd s site had only one portable toilet, which had no running water. Employees found the toilet to be so filthy that they preferred to use the site s grounds a practice accepted by management. It was for this reason, that Steven Graham, 46, was standing between two skips when the incident happened on 26 August As he stood there a shovel loader, which weighed more than 18 tonnes, hit one of the skips and pushed it towards the other, crushing Mr Graham between them. He was taken to hospital and treated for a broken pelvis and other severe life-changing afflictions. He has been unable to return to work owing to his injuries and still has difficulty walking. The company was issued three Improvement Notices on 1 September 2009, which required it to provide a formal system to separate pedestrians and vehicles, install suitable welfare facilities, and train workers how to safely operate shovel loaders. Lowmac Alloys appeared in court on 15 August and pleaded guilty to breaching s2(1) of the HSWA 1974 and was fined 80,000. No costs are awarded in Scotland. In mitigation, the firm recognised the serious failings at the site and said it has worked to rectify them. It has subsequently procured a larger area of the same site, allowing for more control and management of vehicle and pedestrian traffic. It has also rented some office space, including sanitary facilities, within the yard and it has taken on the services of a new health and safety consultant, who spends more time at the site than their predecessor. The company had no previous convictions
4 Asbestos Bulletin Board Lincsafe have been inundated with requests for Category A Asbestos Awareness training (UKATA) in the last 2 months. Cat A training (4 hours) is a requirement under regulation 10 of the Control of Asbestos Regs 2006 where personnel could come into contact with or disturb asbestos containing materials. As a result, an extra open course each month has been added to the training programme. New Asbestos essentials (A12) Asbestos cement roofing and cladding This information will help employers and the self-employed to comply with the Control of Asbestos Regulations It describes good practice when you need to clean asbestos cement (AC) cladding and roofing, either to improve its appearance or to prepare it for a surface coating. 1 Prosecutions over asbestos exposuree A Norfolk company and a contractor from Manchester have been fined after failing to manage asbestos removal work at a renovation site in Great Yarmouth. The council issued a Prohibition Notice to stop work and asbestos was later found to be present. The Health and Safety Executive (HSE) and local authority launched a joint investigation which resulted in prosecution. HSE inspectors told Norwich Magistrates Court that Mr Zahid failed to order an asbestos survey, as required by law, before starting renovation work, was not trained in asbestos removal and did not possess the required licence. Mohammed Zahid, 33, from Wilbraham Road in Manchester, was fined a total of 1,000 after being found guilty of breaching regulations 4, 5, 8(2) and 10 of the Control of Asbestos Regulations 2006 and ordered to pay costs of 500. Azam Bros Ltd admitted breaching Regulation 4 of the Control of Asbestos Regulations 2006 and was fined 2,500 and ordered to pay costs of 2, Two companies and contractor fined for releasing asbestos at Birmingham office Two Worcestershire companies and a contractor from Hall Green have been prosecuted for releasing asbestos fibres during an office refurbishment project in Birmingham city centre. Inspectors from the Health and Safety Executive (HSE) uncovered a series of failings during the refurbishment of Colmore Row, work that included upgrading a lift containing asbestos insulating board. When lift engineers arrived, they found pieces of asbestos insulating board spread around the lift shaft area and refused to carry on working. HSE inspectors stopped all workers from going into the building until it had been decontaminated. Air tests taken on several floors of the premises revealed significantly high levels of asbestos fibres, which were also found in several vacuum cleaners. Asbestos insulating board was found stored in Roland Morewood s van, which itself was heavily contaminated with raised levels of asbestos fibres in the air. By law it should have been disposed of by a licensed contractor. Marchment Consulting Ltd, of Kidderminster Road, Droitwich, pleaded guilty to breaching Regulations 11(1)(a) and 16 of the Control of Asbestos Regulations 2006 and was fined 7,000 and ordered to pay 1,500 costs. Roland Morewood, of Mapleton Road, Hall Green, Birmingham, pleaded guilty to breaching Regulations 8(1) and 16 of the Control of Asbestos Regulations 2006 and fined 1,000 and ordered to pay 823 costs Croydon roofing company fined for asbestos and scaffolding failures A well established Croydon roofing company has been fined for unlicensed asbestos removal - at a property where employees also worked on unsafe scaffolding. The Health and Safety Executive (HSE) prosecuted Brunwin Professional Roofing Services Ltd after uncovering serious safety failings during a routine inspection at a detached house in Croydon on 28 April During the site visit, a HSE inspector discovered that the scaffolding was poorly positioned, creating a gap large enough for the two workers on site to fall through. The company also removed and broke up soffit (fascia) boards made from asbestos containing materials without the mandatory licence and notifications to HSE. Brunwin Professional Roofing Services Ltd pleaded guilty to breaching safety regulations at City of London Magistrates Court today (15 July 2011). The company - which is registered at Suite L8, Airport House, Purley Way in Croydon - was fined 4,000 for breaching Regulation 8(1) of the Control of Asbestos Regulations 2006 and 2,000 for breaching Regulation 6(3) of the Work at Height 2005 Regulations. Full costs of 2,406 were also awarded against the company, which has been trading for 23 years htm
5 It could happen to you? RIDDOR Accident reporting proceedures are changing In May, the HSE announced changes to the ways that employers will be required to report incidents and to the ways in which they will be able to access health and safety information. From 12th September, HSE will move to a predominatly web-based system of incident reporting. These changes, which will enable the HSE to become more efficient in the way it works, reflect the ever increasing popularity of the internet; more than half of incidents are already notified to the HSE online, compared with fewer than one in four back in Employers will still be able to notify fatal and major incidents by phone, but will be required to notifiy HSE of all other incidents, reportable under RIDDOR, via the new online forms which will be intuitive and interactive to make the process quick and easy. Employers will still have the option to report fatal and major incidents online if they prefer. Under the new arrangments, employers will no longer be able to to notify HSE of incidents by post or fax. In a move to further improve efficiency, HSE s infoline, which currently provides health and safety information via call centre services will end on 30th September Instead, businesses and members of the public will be directed to the HSE s website. The website, which has recently been awarded for its accessibility, is the source of information for Infoline staff and is currently undergoing a revamp to make it even easier to navigate. It features information on the most frequent health and safety enquiries and contains lots of helpful new tools, such as Health and safety made simple. HSE will continue to provide information and guidance to employers and workers in a range of ways, for instance through direct work with organisations and trade associations, face to face workshops, safety training days and via books and bulletins on a range of subjects which you can sign up through the website.
