40 Agenda Item # 7ii) 2. PURPOSE This report is to provide Council with an update on the Alternative Energy Projects received by the County of Lanark. 3. BACKGROUND Ontario Regulation 359/09 Renewable Energy Approvals under Part V.0.1 of the Environmental Protection Act, section 18 requires that the person who proposes to engage in a renewable energy project that requires approval under the Act, consults with the local municipality and upper-tier municipality in which the project location is situated. The purpose of the consultation is to identify any issues and provide recommendations regarding such items as: infrastructure and servicing, road and road access, traffic management plans, municipal service connections (other than roads), landscaping design, emergency management procedures, easements or restrictive covenants, rehabilitation, permits (including building permits) significant natural features, endangered species, waterbodies, archaeological resources or heritage resources, etc. The regulations also require that the proponent hold at least two public meetings to present the proposal. On February 9, 2010 the government filed a regulation to remove local barriers to designated renewable energy installations (i.e. small-scale). The regulation will ensure that municipal by-laws and other local barriers do not create barriers to ground or wall mounted solar photovoltaic, solar thermal air and solar thermal water systems, and ground source heat pumps. Examples of changes brought forward in this regulation include: - zoning and site planning requirements, height restrictions and setbacks no longer apply for any of the designated technologies; - nuisance by-laws that restrict the installation of renewable energy projects for non-health and non-safety reasons no longer permitted; - Provincial acts and certain local requirements (e.g. property standards by-laws) related to health, safety, heritage and environmental concerns remain in effect. The government did however; ensure that by-laws, instruments and other restrictions relating to natural heritage and heritage features would continue to be in place. Ontario Regulation 15/10 Designations RE: Section 5 of the Act. Exception, prescribed by-laws etc. 3. By-laws, instruments and other restrictions that relate to the following classes of matters are prescribed for the purposes of clause 5 (4) (b) of the Act: 1. The designation and protection, including interim protection, of properties of cultural heritage value or interest, heritage conservation study areas and heritage conservation districts and the designation of properties of archaeological or historic significance pursuant to Parts II, III.1, IV, V and VI of the Ontario Heritage Act. 4. Any activity or matter that is the subject of a regulation made by a conservation authority pursuant to clauses 28 (1) (a), (b) and (c) of the Conservation Authorities Act. O. Reg. 15/10, s. 3. FINANCIAL IMPACT Alternative Energy facilities are assessed under the Assessment Act and therefore subject to property taxation. The rate is yet to be determined. The County of Lanark adopted By-law No Tariff Fees which established a review fee of $1,500 for the Municipal Consultation Form. 8. LOCAL MUNICIPAL IMPACT The local municipality will be required to submit a separate Renewable Energy Approval Consultation Form. 9. CONCLUSIONS This report is for information purposes. 10. 45 Agenda Item # 7iii) 2. PURPOSE The purpose of this report is to update the Community Development Committee on 2012 tourism projects and programs to date. 3. BACKGROUND The Tourism department plans and implements promotional activities to raise the profile of Lanark County as a tourism destination. 4. DISCUSSION Request for Standing Offer In line with the County s Procurement policy, the Tourism department has recently completed a Request for Standing Offer. This resulted in a list of pre-qualified vendors that will be contacted to quote on tourism publications to be produced over the next three years. These vendors will be contacted regarding tourism projects that involve mapping, design, printing and/or sales of advertising Lanark County Map Over the next several months, development of a new Lanark County Road map will be underway. Planned for release in fall 2012, it will feature a large full-colour format, a complete and up-to-date road map of the county, road index, driving tours and yearround maple experiences. Advertising will be sold over the summer in order to offset the cost of printing Festivals & Events Promotion The cover design and content has been compiled for the third edition of the Lanark County Festivals and Events Guide. The guide will be printed in January and distributed in February In addition to standard distribution, a targeted insertion in the Ottawa Citizen is planned to reach the Ottawa market. The Festivals and Events guide acts as a lure piece for visitors and a reference tool for local offices. The online events calendar is prominently featured throughout the guide in order to encourage visitors to learn more about Lanark County. Community events will continue to be posted on the website as they are submitted by organizers throughout the year. Lake 88.1 has agreed to act as our radio partner and feature upcoming events weekly between May and October, Carleton Place and District Tourism Team Now lead by the Town, Carleton Place will be producing a new town map featuring a detailed road map as well as a recreational map. This will be available in January. PURPOSE The purpose of this report is to recommend approval of a three (3) month extension to the lapsing date of draft plan approval for Subdivision Application No. 09-T BACKGROUND The draft plan approval for Glen Isle Shores Subdivision was approved by the MMAH on February 26, The file was subsequently transferred to the County of Lanark with delegation of authority in No action had been undertaken by the applicant/agent following the 2002 date and therefore in February 2009 Council approved a recommendation to change the conditions, which included a lapsing date and a requirement to undertake a number of studies to bring the application up to today s standards. On November 1, 2010, staff met with Sophie Acheson and Brian Casagrande of FoTenn (agents), Matt Craig MVC and Stephen Stirling Town Planner to review the file and determine what was required to be completed to address Provincial Policies and the Town s Community Official Plan Policies for subdivision development. The main concern outlined by both the County/Town and MVC was that the information from the original files (1985) in regard to contours and floodplain was not reflective of what is found in today s mapping. And it was stressed that these issues needed to be addressed before proceeding further. No further action was taken by the agent. The draft plan is scheduled to lapse on March 22, On December 7, 2011, the agent requested up to a three (3) year extension to draft plan approval. It is the County s policy to request the local municipality to review the request and provide a recommendation on whether or not they concur with the request for extension. 4. DISCUSSION Due to the time of receipt of the request, and taking into consideration timing of meetings, vacation/holiday schedules it has been determined that there may be insufficient time for the Town to undertake it s review, report to the County and subsequent reporting to Community Development and County Council, prior to the lapsing date. 2 of 3 Report #PD Request for Extension Subdivision 09-T Glen Isle Shores Page 72 of 86

ANALYSIS AND OPTIONS A three (3) month extension to the lapsing date will enable the Town of Mississippi Mills time to review the plan of subdivision and consider the request for up to a three year extension of lapsing draft approval, under Section 51(32) of the Planning Act, and the subsequent reporting to Community Development Committee and County Council. 6. FINANCIAL IMPLICATIONS There are no financial implications to the County. Should the Town recommend proceeding with the extension to the lapsing of draft approval, and the approval authority (County) approves the extension, the applicant will be required to submit a fee of $ for each year of extension. 7. LOCAL MUNICIPAL IMPACT The proposal is required to be reviewed by the Town of Mississippi Mills. 8. CONCLUSIONS A three-month extension of the lapsing date of the draft approved plan is appropriate. 9. BACKGROUND The proposed Solar Project was reviewed by the two members of the Review Team, Mary Kirkham, Planning Approvals Administrator and Jonathan Allen, Facilities and Fleet Manager. The modifications presented do not affect the requirements to comply with Tree Cutting By-law or the requirements for a Communications and Emergency Plan. The County of Lanark submitted their Technical Report and Recommendations regarding Smiths Falls 2 Solar Park and Smiths Falls 5 Solar Park following the March 30 th, 2011 Council meeting. The Technical Reports were reviewed by Community Development Committee at their meeting on March 9 th, Concerns/comments submitted dealt with: 1/ development of the Communications and Emergency Response Plan; 2/ submission of application for a Civic Address; and 3/ payment of any fees established for processing Municipal Consultation Forms. Neither project was in contravention with the Tree Cutting By-law. 4. DISCUSSION Modifications to the design of the projects are as a result of: 1/ requests from neighbours and the public from the consultation activities; 2/ requests from the Township of Drummond / North Elmsley; and 3/ project refinements resulting from the initiation of the detailed project design. Smiths Falls 2 the modification includes a slightly altered project footprint as a result of a new proposed access road location, revised internal road and inverter location and increased setbacks. These changes were approved by both the MNR and Ministry of Tourism and Culture. The modification also includes a proposal to burn brush, should a re-use option not be feasible. Smiths Falls 5 the modification includes a slightly altered project footprint as a result of increased setbacks from the municipal roadway, revised internal access road and inverter locations and increased setbacks around periphery. These changes were approved by both the MNR and Ministry of Tourism and Culture.
